You don&#8217;t bother getting <a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/renters-insurance.html\"><u><span data-term-id=\"55828892\">renters<\/span>\u2019 insurance<\/u><\/a>, thinking you won&#8217;t use the unit long enough to justify it. You give them a credit card and let them deduct the fee automatically each month.<\/p>\n<p>Things are going well until you get an email from the facility saying that your unit may have been affected by a <span data-term-id=\"55828901\">water leak<\/span>. It turns out your unit and several others were flooded when a pipe inside your unit froze and burst. All of your property was ruined by the water damage. If you call a lawyer to learn about your legal options, the first thing they\u2019ll ask you is to see your <span data-term-id=\"55828883\">rental agreement<\/span>.<\/p>\n<h2>Storage <span data-term-id=\"55828883\">Rental Agreements<\/span><\/h2>\n<p>Your <span data-term-id=\"55828883\">rental agreement<\/span> will differ depending on the <span data-term-id=\"55828880\">storage facility<\/span>. Your <span data-term-id=\"55828899\">state&#8217;s law<\/span> governs its interpretation. It will contain some, most, or all the provisions discussed below.<\/p>\n<p>There&#8217;s one thing common to all <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rental-lease-agreements.html\"><u><span data-term-id=\"55828883\">rental agreements<\/span><\/u><\/a>: A lawyer wrote them for the <span data-term-id=\"55828880\">storage facility<\/span>. This means that the agreement probably contains many terms that benefit the facility. Let\u2019s take a look at some of the possibilities:<\/p>\n<h3>Liens on Your Stored Property<\/h3>\n<p>The first is a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/lien.html\" target=\"_blank\" rel=\"noopener\"><u>lien<\/u><\/a> on your property. Most states have statutes called something like the Self-Service <span data-term-id=\"55828880\">Storage Facility<\/span> Act. Under these statutes, <span data-term-id=\"55828910\">self-<\/span><span data-term-id=\"55828884\">storage<\/span><span data-term-id=\"55828910\"> companies<\/span> have a lien (a property interest) on the property you store in the unit. If you fail to pay your rent, the <span data-term-id=\"55828880\">storage facility<\/span> may have the right to hold and sell your property at a public auction.<\/p>\n<p>Your <span data-term-id=\"55828883\">rental agreement<\/span> confirms this right granted by <span data-term-id=\"55828899\">state law<\/span> and spells out what the <span data-term-id=\"55828913\">facility owner<\/span> can do if you fail to pay rent and it decides to exercise its right to sell your property. Lawyers call this process a <span data-term-id=\"55828905\">lien sale<\/span> or a <a href=\"https:\/\/www.findlaw.com\/realestate\/foreclosure.html\"><u>foreclosure<\/u><\/a>. A <span data-term-id=\"55828913\">facility owner<\/span> can keep the proceeds to cover unpaid rent, late fees, storage fees, and the costs of the sale.<\/p>\n<p>If you\u2019re up to date on your monthly rent, you haven&#8217;t broken (<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/breach-of-contract-and-lawsuits.html\"><u>breached<\/u><\/a>) the terms of the agreement.<\/p>\n<h3>Disclaimer of Warranties: Quality of Your Unit<\/h3>\n<p>Your agreement may also contain a <a href=\"https:\/\/www.findlaw.com\/company\/disclaimer.html\"><u>disclaimer of warranties<\/u><\/a>. Most <span data-term-id=\"55828883\">rental agreements<\/span> contain a provision stating that you take the\u00a0<span data-term-id=\"55828881\">storage unit<\/span>\u00a0on an as-is basis and that they make no warranties of any kind regarding the unit. What you see is what you get.<\/p>\n<p>Most <span data-term-id=\"55828883\">rental agreements<\/span> require you to maintain the unit. If you fail to do so, you can be responsible for the costs of restoring it to its original condition.<\/p>\n<h3>Release of Liability: Legal Protection for the Storage Company<\/h3>\n<p>Most self-service storage <span data-term-id=\"55828883\">rental agreements<\/span> contain a <a href=\"https:\/\/www.findlaw.com\/injury\/car-accidents\/what-is-a-release-of-all-claims-form.html\"><u>release<\/u><\/a>. A release means you give up your right to sue if the conditions of the release are met.<\/p>\n<p>Again, the <span data-term-id=\"55828880\">storage facility<\/span>&#8216;s lawyers draft the <span data-term-id=\"55828883\">rental agreements<\/span>, so the release is broad. In most instances, you give up the right to sue for any <span data-term-id=\"55828894\">property damage<\/span> or <span data-term-id=\"55828888\">personal injury<\/span> relating to your use and occupancy of the <span data-term-id=\"55828881\">storage unit<\/span>.<\/p>\n<p>Your lawyer tells you that in your <span data-term-id=\"55828883\">rental agreement<\/span>, the disclaimer specifically states that the facility is not liable for any <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/top-5-legal-faq-property-damage-claims\/\"><u>damage to your property<\/u><\/a>, period. This doesn\u2019t seem fair. The pipes wouldn&#8217;t have frozen unless the facility had known they could freeze and had failed to do what they should to prevent it, right?<\/p>\n<p>Your lawyer tells you to hold that thought for a moment. At this point, they are telling you about the obstacles you face if you decide to sue.<\/p>\n<h3>Indemnification: You Can Be Sued, Too<\/h3>\n<p>Next is <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/the-contract-you-thought-you-made-the-express-negligence.html\" target=\"_blank\" rel=\"noopener\"><u>indemnification<\/u><\/a>. Most <span data-term-id=\"55828883\">rental agreements<\/span> contain a provision that says that if the <span data-term-id=\"55828880\">storage facility<\/span> gets sued for any reason associated with your use and occupancy of the unit, you agree to pay for their legal costs, any judgments against them, and (often) their attorney&#8217;s fees. This is an indemnification provision.<\/p>\n<p>You weren&#8217;t storing anyone else&#8217;s property in your unit and there were no injuries involved, so you don&#8217;t see how this provision applies in your situation. Your <a href=\"https:\/\/lawyers.findlaw.com\/consumer-protection\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"55828914\">consumer protection<\/span> lawyer<\/u><\/a> says that this is true unless the\u00a0<span data-term-id=\"55828880\">storage facility<\/span>\u00a0takes the position that, as part of your responsibility to care for the unit, you should have ensured the thermostat was set\u00a0high enough to prevent the pipe from freezing. They could argue that you have to indemnify (pay) them if the <span data-term-id=\"55828892\">renters<\/span> of the other flooded units, who would be creditors, sue them.<\/p>\n<h3>Limitation on Recovery<\/h3>\n<p>Most <span data-term-id=\"55828883\">rental agreements<\/span> contain a limitation on any <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/injury-damages.html\"><u>potential recovery<\/u><\/a>. For example, a <span data-term-id=\"55828883\">rental agreement<\/span> could say that in the event of any dispute with the <span data-term-id=\"55828880\">storage facility<\/span>, the amount you can recover in any lawsuit is capped.<\/p>\n<p>Your lawyer says your <span data-term-id=\"55828883\">rental agreement<\/span> limits your recovery to $5,000. This would likely put you in <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/small-claims-court.html\"><u><span data-term-id=\"55828889\">small claims court<\/span><\/u><\/a>, though the jurisdictional limit varies by state. Unfortunately, your family heirlooms, let alone the antiques, were worth a lot more than that.<\/p>\n<h3>Insurance Requirements To Store Property<\/h3>\n<p>Your lawyer asks you if you had any insurance on the unit. Most <span data-term-id=\"55828883\">rental agreements<\/span> specify that the <span data-term-id=\"55828880\">storage facility<\/span> does not maintain insurance on your unit, and that you must pay for it if you want coverage. Some agreements force you to get <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/renter-s-insurance.html\"><u><span data-term-id=\"55828892\">renters<\/span>\u2019 insurance<\/u><\/a> on the unit.<\/p>\n<p>They want to know whether you have <span data-term-id=\"55828892\">renters<\/span>\u2019 insurance, since your agreement states that the\u00a0<span data-term-id=\"55828880\">storage facility<\/span>\u00a0doesn&#8217;t. This means that having insurance on the unit is your responsibility. If you have insurance, you\u2019d be required to notify your <span data-term-id=\"55828886\">insurance company<\/span> of your <a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/insurance-claims.html\"><u>potential claim<\/u><\/a> immediately. Unfortunately, you didn&#8217;t get insurance. You didn&#8217;t think you would need the unit long enough to justify it.<\/p>\n<h3>Arbitration<\/h3>\n<p>Although your agreement doesn&#8217;t contain an arbitration provision, your lawyer says many rental contracts do. <a href=\"https:\/\/www.findlaw.com\/adr\/arbitration.html\"><u>Arbitration<\/u><\/a> is a <span data-term-id=\"55828916\">legal process<\/span> for resolving disputes out of court. You and the other side submit evidence and arguments to a neutral third party, who decides your dispute. Many believe arbitration is less expensive and more efficient than going to court.<\/p>\n<p>Arbitration has pros and cons. You lose the right to have a jury of your peers decide your dispute. If it goes against you, appealing the <a href=\"https:\/\/www.findlaw.com\/adr\/arbitration\/the-arbitration-process.html\"><u>arbitrator&#8217;s decision<\/u><\/a> is often not permitted. In our example, you don&#8217;t have to deal with this challenge because your <span data-term-id=\"55828883\">rental agreement<\/span> doesn&#8217;t contain an arbitration provision.<\/p>\n<h2><strong>Potential Legal Claims Against Storage Services<\/strong><\/h2>\n<p>If this were an actual situation, you might be feeling a little queasy at this point. There&#8217;s nothing you can do to get your property back, and now your lawyer is telling you that you can&#8217;t even hold the <span data-term-id=\"55828880\">storage facility<\/span> responsible for your losses.<\/p>\n<p>Your lawyer tells you that you shouldn&#8217;t give up all hope. You may have little luck with a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-for-breach-of-contract-.html\"><u><span data-term-id=\"55828898\">breach of contract<\/span> suit<\/u><\/a>. If not, there are at least two other legal claims you can still bring against the facility.<\/p>\n<h3>Conversion (They Stole Your Stuff)<\/h3>\n<p>Conversion happens when <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/conversion.html\">someone wrongfully exercises control over your possessions<\/a>, depriving you of their use. They &#8220;convert&#8221; your <span data-term-id=\"55828900\">personal property<\/span> to their own use.<\/p>\n<p>Conversion is what&#8217;s called an <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-are-intentional-torts.html\"><u>intentional tort<\/u><\/a>. You rejoice when your lawyer tells you that responsibility can\u2019t be disclaimed in a contract for intentional torts. This means that despite the language in the <span data-term-id=\"55828883\">rental agreement<\/span>, you could still sue the facility for the conversion of your damaged antiques, documents, and heirlooms.<\/p>\n<p>You would still face an uphill battle because of other language in the <span data-term-id=\"55828883\">rental agreement<\/span>, but a conversion claim could help you overcome the disclaimer hurdle. Proving a <span data-term-id=\"55828880\">storage facility<\/span> intentionally converted your property can be difficult, as conversion requires showing deliberate or knowing conduct.<\/p>\n<h3>Gross Negligence<\/h3>\n<p>The second claim you may be able to bring is for <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/negligence.html\"><u>gross negligence<\/u><\/a>. Negligence is the failure to use reasonable care under the circumstances, while gross negligence involves a more severe degree of carelessness or reckless disregard<\/p>\n<p>Gross negligence differs depending on the state in which you live, but consider it as a willful or conscious indifference to the risks associated with conduct that causes harm. It usually requires more than simple carelessness to prove that the facility acted with reckless disregard for safety.<\/p>\n<p>As with conversion, you can&#8217;t disclaim responsibility for gross negligence under a contract. You still have to deal with the other limitations of the <span data-term-id=\"55828883\">rental agreement<\/span>, but gross negligence could also get you past the disclaimers.<\/p>\n<h2>What To Do if Your Property Is Damaged While in a <span data-term-id=\"55828881\">Storage Unit<\/span><\/h2>\n<p>It can be frustrating to arrive at your <span data-term-id=\"55828881\">storage unit<\/span> only to find your property damaged or destroyed. Regardless of\u00a0<span style=\"margin: 0px; padding: 0px;\">the\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/types-of-property-for-tax-purposes.html\"><u>type of property<\/u><\/a> you have in storage, it has some value, whether<\/span>\u00a0financial or sentimental.<\/p>\n<p>It&#8217;s important that you understand what to do immediately after discovering the damage. You can take the proactive steps below to protect your interests.<\/p>\n<h3>Assess and Document the Damage<\/h3>\n<p>It&#8217;s not enough to notice the damage. It&#8217;s imperative that you <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/worksheet-damage-estimate.html\">assess any visible damage<\/a> right away. You can do this by taking photos or videos of the unit and its contents. You should also document the conditions of the unit and describe the specific damage to your property.<\/p>\n<h3>Notify the Storage Facility<\/h3>\n<p>Most <span data-term-id=\"55828884\">storage companies<\/span> have strict policies about <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/when-to-hire-a-lawyer-to-sue-for-property-damage\/\"><u>reporting <span data-term-id=\"55828894\">property damage<\/span><\/u><\/a>. Rather than run the risk of not complying with these policies, notify the <span data-term-id=\"55828902\">facility manager<\/span> immediately after you discover the damage to your unit and its contents. You&#8217;ll want to provide the company with written notice to avoid any dispute about what you told them or when you submitted your documentation. Make sure you include detailed information about the damage, as well as any information about what caused it. For example, if you notice water damage, notify the\u00a0<span data-term-id=\"55828880\">storage facility<\/span>\u00a0of the alleged\u00a0source. The same is true if you discover damage caused by fire or another unnatural source.<\/p>\n<h3>Ask the Storage Facility Manager for an Incident Report<\/h3>\n<p>Each <span data-term-id=\"55828884\">storage company<\/span> has its own unique policy about <span data-term-id=\"55828894\">property damage<\/span>, including a detailed incident report. It&#8217;s not sufficient to provide the company with a written description of the damage. You must submit a completed copy of the facility&#8217;s incident report if you want to recover <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/injury-damages.html\"><u>compensation<\/u><\/a> for your <span data-term-id=\"55828908\">damaged items<\/span>.<\/p>\n<h3>Retain Documentation for Your Records<\/h3>\n<p>If the <span data-term-id=\"55828884\">storage company<\/span> does not agree to compensate you for your <span data-term-id=\"55828894\">property damage<\/span>, you may need to take further action. This is why it&#8217;s critical that you retain a copy of the documentation you submit to the <span data-term-id=\"55828880\">storage facility<\/span>&#8216;s managers. Include a list of the <span data-term-id=\"55828908\">damaged items<\/span>, their value, and the source of the damage (if known). You&#8217;ll need to provide this information to the <a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/insurance-basics.html\"><u><span data-term-id=\"55828886\">insurance company<\/span><\/u><\/a> if you file a claim.<\/p>\n<h3>Contact the Insurance Company<\/h3>\n<p>Once you&#8217;ve given the <span data-term-id=\"55828880\">storage facility<\/span> a chance to resolve the issue, file an <span data-term-id=\"55828906\">insurance claim<\/span>. Include a detailed description of the damage along with a copy of the information you provided to the <span data-term-id=\"55828880\">storage facility<\/span>. Depending on your <span data-term-id=\"55828897\">insurance coverage<\/span>, you may need to <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit.html\"><u>pursue legal action<\/u><\/a> against the <span data-term-id=\"55828880\">storage facility<\/span>.<\/p>\n<p>A lawsuit may be your best option if the <span data-term-id=\"55828886\">insurance company<\/span> denies your claim or the <span data-term-id=\"55828911\">insurance policy<\/span> doesn&#8217;t cover your total loss.<\/p>\n<h2>When Does It Make Sense To Sue a <span data-term-id=\"55828880\">Storage Facility<\/span>?<\/h2>\n<p>You can sue somebody for any reason, but that doesn&#8217;t mean you have a legitimate case. Once you decide to seek <a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55828915\">legal representation<\/span><\/a>, schedule your free <span data-term-id=\"55828912\">initial consultation<\/span>. During this meeting, your attorney will answer any <span data-term-id=\"55828893\">legal questions<\/span> you have. They will also advise you as to whether you have a valid <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/worksheet-damage-estimate.html\"><u>claim for damages<\/u><\/a>.<\/p>\n<p>The reason you sue another party is so that you can recover compensation (damages) for your losses. Just because you can sue a <span data-term-id=\"55828880\">storage facility<\/span> doesn&#8217;t mean you should. You&#8217;ll want to ensure that your <span data-term-id=\"55828896\">legal issue<\/span> warrants legal action.
