You need to read these carefully. You will see that the terms contain sweeping disclaimers and limitations on liability. They may contain limits on the time in which you can pursue legal relief. If you do pursue legal relief, you&#8217;re generally limited to pursuing arbitration or bringing your case to small claims court.<\/p>\n<p>Learn how to sue Expedia, Booking.com, Tripadvisor, or another travel company. Consider speaking with an experienced\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/contracts\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contracts attorney<\/a>\u00a0if you decide to do this.\u00a0<\/p>\n<h2>Online Travel Booking Companies<\/h2>\n<p>Online travel booking has changed the way that people travel. There are a lot of <a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/should-you-use-a-travel-agent.html\">online travel agencies<\/a> (OTAs), travel fare aggregators, and travel metasearch engines (we call these collectively \u201conline booking sites&#8221; or simply \u201csites&#8221;).\u00a0<\/p>\n<p>There are three big players in the industry that we will focus on here. If you have a dispute with other sites, such as Klook or Airbnb, speak with a lawyer for more information.<\/p>\n<h3>Booking Holdings<\/h3>\n<p>Booking Holdings Inc. is the world&#8217;s leading provider of online travel services. It is an American company based in Norwalk, Connecticut. It has generated billions in annual revenue,\u00a0largely from the following sites:<\/p>\n<ul>\n<li>Booking.com<\/li>\n<li>Priceline<\/li>\n<li>Agoda<\/li>\n<li>KAYAK<\/li>\n<li>OpenTable<\/li>\n<li>Rentalcars.com<\/li>\n<\/ul>\n<h3>Expedia Group<\/h3>\n<p>Expedia Group, Inc. is an American online travel company based in Seattle. Expedia also earns billions in annual revenue, largely from the following sites:<\/p>\n<ul>\n<li>Expedia.com<\/li>\n<li>Vrbo<\/li>\n<li>Hotels.com<\/li>\n<li>Hotwire.com<\/li>\n<li>Orbitz<\/li>\n<li>Travelocity<\/li>\n<li>Trivago<\/li>\n<\/ul>\n<h3>Trip.com Group<\/h3>\n<p>Trip.com Group is a Chinese online travel company that provides services in many countries. Founded in 1999, it is one of the largest travel services providers in the world. Trip.com Group operates Trip.com, which is based in Singapore.<\/p>\n<h2>Problems With Online Booking<\/h2>\n<p>Some of the common <a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights.html\">travel disputes<\/a> customers have with online agencies include:<\/p>\n<ul>\n<li>Lost reservations<\/li>\n<li>Last-minute cancellations<\/li>\n<li>Failure to <a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/return-policies-and-refunds.html\">issue a refund<\/a> under the company&#8217;s policies<\/li>\n<li>Unfair pricing methods, hidden fees, and <a href=\"https:\/\/www.findlaw.com\/state\/consumer-laws\/details-on-state-deceptive-trade-practices.html\">deceptive trade practices<\/a><\/li>\n<li>Failure to provide promised points or benefits of rewards programs<\/li>\n<li>Refusal to let you cancel or modify your booking within the allowed time<\/li>\n<\/ul>\n<h3>Example Case: Lost Reservations<\/h3>\n<p>It&#8217;s a cold Minnesota winter, and you decide to head to San Diego for Comic-Con. You book your travel through Expedia. You get a great deal on airline tickets with Delta, a premium hotel on the beach, and a rental car. You plug in your credit card information and get confirmation that the transaction went through.<\/p>\n<p>The day of your flight is when you discover the problem. When you land in San Diego, it takes forever to get your luggage. You finally get to the rental car kiosk, but they can&#8217;t find your reservation, even with your confirmation number. They don&#8217;t have any other cars available. None of the other car rentals at the airport do either. Frustrated, you decide to take a cab to the hotel.<\/p>\n<p>When you get to the hotel, they can&#8217;t find your reservation either. And with the convention in town, they don&#8217;t have any other rooms available. The closest hotel room you can find costs twice as much as the one you reserved. It&#8217;s also part of a hotel chain more than an hour away. You spend more time and money on rideshares to shuttle back and forth. Due to traffic, you also wind up missing a panel you were dying to see.<\/p>\n<p>Your trip ends up costing you a lot more than it should. And you&#8217;re mad. So, you decide to look into your options.<\/p>\n<h2>The OTA&#8217;s Terms and Conditions<\/h2>\n<p>When you created an account on the site, you entered into a contract with the OTA. That contract is governed by the terms and conditions of the site, which you typically can find through a link at the bottom of the page. Although the terms for each OTA vary, Booking.com, Expedia, and Trip.com have similar terms and conditions. Make sure you read them carefully.<\/p>\n<p>As you&#8217;ll see, the terms and conditions are pretty one-sided and strictly limit your right to any recourse. We will use\u00a0<a href=\"https:\/\/www.expedia.com\/lp\/lg-legal\" target=\"_blank\" rel=\"noopener\">Expedia&#8217;s terms<\/a>\u00a0as an example.<\/p>\n<h3>Disclaimers<\/h3>\n<p>The first major hurdle you face is the site&#8217;s disclaimers. A\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/disclaimer.html\" target=\"_blank\" rel=\"noopener\">disclaimer<\/a>\u00a0is a limitation or denial of rights under a warranty. A\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/warranty.html\" target=\"_blank\" rel=\"noopener\">warranty<\/a>\u00a0is a guaranty in a contract that the services provided will meet certain standards of quality and reliability. Many contracts include warranties. Both warranties and disclaimers are generally enforced by courts.<\/p>\n<p>In your case, the terms of the OTA specifically disclaim any warranties of any kind. The site makes no promises about the quality or reliability of their services. This means that if you tried to sue, you would be hard-pressed to persuade a judge that you can recover anything.<\/p>\n<h3>Damage Limits<\/h3>\n<p>The second hurdle you face is the OTA&#8217;s limitations on damages.\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/damages.html\" target=\"_blank\" rel=\"noopener\">Damages<\/a>\u00a0are money that you can recover in a lawsuit, generally to compensate you for the losses you sustained. That amount typically includes\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/damage.html#:~:text=incidental%20damages%0A%3A,any%20other%20category\" target=\"_blank\" rel=\"noopener\">incidental damages<\/a>\u00a0(typically out-of-pocket costs) and\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/damage.html#:~:text=consequential%20damages%0A%3A%20special%20damages%20in%20this%20entry\" target=\"_blank\" rel=\"noopener\">consequential damages<\/a>\u00a0(losses that naturally result from a breach of contract).<\/p>\n<p>The OTA&#8217;s terms and conditions limit your recoverable damages in two ways. First, they expressly disclaim recovery for incidental damages and consequential damages of any kind. So, that means you would not be able to recover out-of-pocket costs or foreseeable losses.<\/p>\n<p>Second, some OTA&#8217;s terms limit the damages you can recover to a specific figure. For example, Expedia&#8217;s terms and conditions limit your recovery to the greater of the Expedia service fees you paid or $100. You may be able to persuade a judge that these damage limitations aren&#8217;t enforceable \u2014 and in some states, they aren&#8217;t \u2014 but the burden would be on you.<\/p>\n<h3>Time Limits<\/h3>\n<p>A third hurdle you may face, depending on the OTA, is time limits. For example, Priceline says you have only\u00a0<a href=\"https:\/\/www.priceline.com\/static-pages\/terms_en.html?referrerid=FOOTER\" target=\"_blank\" rel=\"noopener\">two years<\/a>\u00a0to bring a claim. That may not be a problem for you, but most states give substantially more time to bring a claim based on the terms of a contract.<\/p>\n<h2>How Do I Sue Expedia (or Another Travel Site)?<\/h2>\n<p>Let&#8217;s say that you still want to sue Expedia despite the hurdles. The terms and conditions restrict your rights in this regard, too.\u00a0You likely won&#8217;t get the classic courtroom battle you might have imagined.<\/p>\n<p>Yet, there are still paths to seek compensation for the ways Expedia wronged you. You&#8217;re really limited to two options.\u00a0Option one is to pursue arbitration.\u00a0Option two is to file a case in the small claims court where you live.\u00a0<\/p>\n<h3>Arbitration<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/adr\/arbitration.html\">Arbitration<\/a>\u00a0is a legal process in which the parties hire an impartial third party (the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/arbitrator.html\" target=\"_blank\" rel=\"noopener\">arbitrator<\/a>), typically a lawyer or a former judge, to decide their dispute. Each side typically exchanges relevant documents and then submits their arguments to the arbitrator in writing for why they should win the dispute. Then, the arbitrator hears any witness testimony and reviews any evidence the parties submit in support of their respective claims. Arbitration can be \u2014 but isn&#8217;t always \u2014 a more streamlined, less expensive way to resolve a legal dispute.<\/p>\n<p>But when you agree to arbitrate your claims against an OTC, you give up several important legal rights:<\/p>\n<ul>\n<li>The right to having a jury of your peers decide the facts in your case and determine the amount of the damages you are entitled to recover<\/li>\n<li>The right to appeal the arbitrator&#8217;s decision<\/li>\n<li>The right to group your claims with those of other similarly situated people (this is called a class-action or a class-arbitration waiver)<\/li>\n<\/ul>\n<p>Some OTAs may allow you to opt out of arbitration if you follow certain specified procedures. So, make sure you read the terms and conditions carefully.<\/p>\n<h3>Small Claims Court<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/small-claims-court.html\">Small claims courts<\/a>\u00a0are courts that, as their name suggests, handle disputes that fall below a particular amount set by state law. The amount varies from state to state, but it ranges from $2,500 to $25,000. If your damages are less than the statutory limit, small claims court may be an option for you.<\/p>\n<p>Filing a claim in small claims court is easy. You fill out the paperwork (typically a summons, a complaint, and a civil cover sheet), pay the filing fee, serve it on the OTA, and get a hearing date. The terms and conditions tell you where you need to send the paperwork. Then, on the day of the hearing, you show up, wait until your case is called, and present your case to the judge. Make sure you bring all of your documents and any witnesses you want to testify with you. When you&#8217;re done, the judge either issues a ruling right then or takes the matter under advisement, in which case you&#8217;ll be notified later of the court&#8217;s ruling. Easy.<\/p>\n<p>You don&#8217;t necessarily have to have a lawyer in small claims court. In some states, you are not allowed to have a lawyer represent you while in court. That may reduce your legal fees, but there are the following downsides:<\/p>\n<ul>\n<li>The process can take longer<\/li>\n<li>You may need to spend a lot of your own time gathering your evidence and preparing your case<\/li>\n<li>You may make mistakes<\/li>\n<li>You may not be able to recover as much as you might have if you had a lawyer<\/li>\n<\/ul>\n<h2>Note About Trip.com<\/h2>\n<p>As we&#8217;ve indicated, make sure you read and understand the terms and conditions of the specific OTA you want to book your travel with.<\/p>\n<p>If you book through Trip.com,\u00a0<a href=\"https:\/\/pages.trip.com\/service-guideline\/terms-en-us.html\" target=\"_blank\" rel=\"noopener\">be aware that you agree<\/a>\u00a0that Singapore law, not the law of your state, will determine the outcome of your dispute. You also agree that in the off-chance you do need to sue, any dispute between you and Trip.com may be brought in Singapore&#8217;s courts. This is fine if you happen to live in Singapore, but not so much if you live in New York or Florida.<\/p>\n<h2>A Lawyer May Be Able To Help<\/h2>\n<p>If you find yourself in a <a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/how-to-resolve-disputes-while-traveling.html\">dispute with a travel booking site<\/a>, your best bet is to start by contacting customer service. A representative or travel agent may be able to help. Be polite. Explain what happened. Chances are that they will be willing to work with you if you are familiar with their refund policies. Who knows? Maybe you will be able to get your money back or a voucher good for future travel.<\/p>\n<p>But if you have no such luck, consider consulting with an experienced\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/contracts\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">contracts lawyer.<\/a>\u00a0Forming an attorney-client relationship will give you the chance to ask questions, better understand your rights, and get solid legal advice that can help you determine whether arbitration or a small-claims court case may be worth it.<\/p><\/div>\n\n\n<div
