Depending on where it occurred and what the facts are, you can sue for harassment. There are different types of civil harassment claims, including workplace harassment and emotional distress torts. Instead of a lawsuit, you can also seek to stop harassment using court orders or police reports.<\/p>\n\n    <\/div>\n\n\n\n<div><p>The four different harassment situations are discussed below:<\/p>\n<ul>\n<li>If you are harassed in the workplace and are a member of a protected class, you may be able to sue for workplace discrimination under federal and state law.<\/li>\n<li>If you are intentionally harassed and suffer extreme emotional distress, you may be able to bring a claim for intentional infliction of emotional distress under state law.<\/li>\n<li>If you just want the harassment to stop, you may be able to petition a state court for a harassment restraining order or an order for protection.<\/li>\n<li>There may also be grounds for you to press state criminal charges.<\/li>\n<\/ul>\n<p>While workplace harassment is a common type, other <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/what-really-constitutes-harassment-and-what-can-i-do.html\">types of harassment<\/a> can be grounds for legal action. You could face harassment from creditors, ex-spouses, neighbors, or anyone else. Talk to an <a href=\"https:\/\/lawyers.findlaw.com\/litigation-appeals\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">attorney near you<\/a> about what you can do to stop the harassment and recover damages.<\/p>\n<h2>Types of Workplace Harassment<\/h2>\n<p>Harassment in the workplace can be a form of\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/employment-discrimination.html\">employment discrimination<\/a>. Employment discrimination violates Title VII of the Civil Rights Act of 1964 and other federal and state discrimination laws.<\/p>\n<p>According to the U.S. Equal Employment Opportunity Commission (EEOC), harassment is\u00a0<a href=\"https:\/\/www.eeoc.gov\/youth\/harassment-1\" target=\"_blank\" rel=\"noopener\">unwelcome conduct<\/a>\u00a0based upon:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Sex,\u00a0including pregnancy, gender, sexual orientation, and gender identity<\/li>\n<li>Religion<\/li>\n<li>National origin<\/li>\n<li>Age,\u00a0beginning at 40<\/li>\n<li>Disability<\/li>\n<li>Genetic information<\/li>\n<\/ul>\n<p>The law also protects\u00a0from your employer retaliating against you for complaining about harassment.<\/p>\n<h3>Quid Pro Quo Harassment<\/h3>\n<p>Workplace harassment takes two forms. The first is what&#8217;s called a \u201c<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/what-is-quid-pro-quo-harassment.html\">quid pro quo<\/a>,&#8221; which is Latin for \u201csomething for something.&#8221; That&#8217;s when putting up with a superior&#8217;s harassing behavior becomes a condition of employment or continued employment. Employers are automatically liable for quid pro quo harassment that results in negative employment action.<\/p>\n<p>The most common form of quid pro quo harassment is sexual harassment. For a simple example, suppose your boss suggests that you might get a promotion if you sleep with them. You refuse. They\u00a0promote someone else. If they\u00a0didn&#8217;t promote you\u00a0because<i>\u00a0<\/i>you refused to sleep with them, you have been unlawfully discriminated against.<\/p>\n<p>Note that there is a difference between sexual harassment and sexual assault. Here there was no physical contact. Sexual assault is sexual contact without the victim&#8217;s consent, which is\u00a0a crime.<\/p>\n<h3>Hostile Work Environment<\/h3>\n<p>The second kind is called a\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/employers-what-is-a-hostile-work-environment\/\">hostile work environment<\/a>. To show a hostile work environment, you must demonstrate workplace harassment so severe and pervasive that a reasonable person would consider the work environment hostile, intimidating, or abusive.<\/p>\n<p>If you make this showing, your employer is automatically liable unless they can show:<\/p>\n<ul>\n<li>They reasonably tried to promptly correct the harassing behavior<\/li>\n<li>You unreasonably failed to take advantage of any preventative or corrective opportunities provided by them,\u00a0such as filing a complaint with human resources<\/li>\n<\/ul>\n<p>Often, a hostile work environment forces an employee to quit. It is still possible to <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/can-i-sue-for-harassment-if-i-quit-.html\">sue a former employer<\/a>.\u00a0<\/p>\n<h2>Suing for Workplace Harassment<\/h2>\n<p>You can&#8217;t just go to court and sue. There is a process you have to follow first.<\/p>\n<h3>Filing a Charge<\/h3>\n<p>You first have to file what&#8217;s called a charge of discrimination with either\u00a0the EEOC\u00a0or a state agency with enforcement authority. A charge is a signed statement that asserts that your boss engaged in employment discrimination and asks that the EEOC help.<\/p>\n<p>There are time limits. For most forms of employment discrimination, you have 180 days from the date of the harassment in which to file a charge. That deadline is extended to 300 days if state law also prohibits the discriminatory conduct.<\/p>\n<p>Age discrimination is a little different. The 180-day deadline is extended to 300 days only if state law also prohibits the conduct and there exists a state agency that has enforcement authority. You need to have both.<\/p>\n<h3>EEOC Investigation and Right to Sue<\/h3>\n<p>Once the EEOC receives a charge,\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/eeoc-s-charge-processing-procedures.html\">it will investigate<\/a>. If it believes there is not enough evidence of discrimination, it will notify you in writing of your right to sue. You then have 90 days in which to bring a lawsuit.<\/p>\n<p>If the EEOC believes there is sufficient evidence of discrimination, it will try to get you and your employer to resolve your dispute through a voluntary process called conciliation. If the parties agree to settle, you don&#8217;t need to go to court.<\/p>\n<p>If you&#8217;re unable to work it out, the EEOC will decide whether it wants to sue your employer in federal court. If not, it will close your case. You then would have 90 days in which to bring your own lawsuit. Your ability to sue does not depend on what the EEOC concludes, it&#8217;s just that the timing of your suit may vary.<\/p>\n<h2>Potential Relief for Workplace Harassment<\/h2>\n<p>If you do sue, you may be able to recover:<\/p>\n<ul>\n<li>Compensatory damages such as\u00a0back pay, lost benefits, lost bonuses or raises, etc.<\/li>\n<li><a href=\"https:\/\/dictionary.findlaw.com\/definition\/equitable-relief.html\" target=\"_blank\" rel=\"noopener\">Equitable relief<\/a>\u00a0including\u00a0your job back, a pay raise, and so on<\/li>\n<li>Punitive damages, which are\u00a0designed to punish the wrongdoer for particularly outrageous behavior<\/li>\n<li>Attorneys&#8217; fees<\/li>\n<\/ul>\n<p>Employment discrimination cases, especially sexual harassment cases, can be complicated. Some may take your discrimination lawsuit on what&#8217;s called a contingency fee basis, which means\u00a0the law firm gets paid out of any recovery you get.<\/p>\n<h2>Civil Harassment: Intentional Infliction of Emotional Distress<\/h2>\n<p>State law lets you sue for extreme harassment that results in severe emotional distress.<\/p>\n<p>To prove what is called\u00a0<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/intentional-infliction-of-emotional-distress.html\">intentional infliction of emotional distress<\/a>, you must show:<\/p>\n<ul>\n<li>Your harasser acted intentionally or recklessly<\/li>\n<li>The harassment was extreme and outrageous<\/li>\n<li>The harassment caused you emotional distress<\/li>\n<li>The distress you suffered was severe (in some states, you have to show you suffered not\u00a0just emotional\u00a0harm but physical harm as well,\u00a0such as\u00a0nightmares, nausea, or\u00a0sleeplessness)<\/li>\n<\/ul>\n<p>Courts can award\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\">compensatory damages<\/a>. This can include all sorts of categories\u00a0including\u00a0emotional distress, but also lost wages for the time you were unable to work,\u00a0and doctor bills. If your harasser&#8217;s conduct is particularly bad, you may be able to recover\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/when-can-you-sue-for-punitive-damages\/\">punitive damages<\/a>.<\/p>\n<p>Seek legal advice from a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/personal-injury-plaintiff\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">personal injury attorney<\/a>\u00a0if you want to learn more about a harassment lawsuit and whether going to court makes sense for you.<\/p>\n<h2>Harassment Restraining Orders and Orders of\u00a0Protection<\/h2>\n<p>You may be getting flooded with phone calls, text messages, or experiencing other harassing behavior from a stranger or someone you know. If so, you may be able to petition a state court for an order prohibiting the conduct.<\/p>\n<p>That order is called different things in different places, but it is most commonly referred to as a\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\">restraining order<\/a>. In some states, if you used to live with your harasser or shared a sexual relationship with them, you may be able to petition for an\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\">order of protection<\/a>. Such orders are unfortunately necessary to protect against domestic violence.<\/p>\n<p>Most courts provide forms and guidance about how to prepare these petitions, so you may be able to file one without the help of a lawyer. Some courts and private organizations provide a free advocate who will help you fill out the proper forms and appear beside you in court, but\u00a0they cannot represent you.<\/p>\n<p>If your situation is complicated or if your harasser opposes your petition, you may want to speak to a\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/family-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">capable family law attorney<\/a>. If you cannot afford one, you may be able to obtain a volunteer attorney through a local community service organization.<\/p>\n<h2>Criminal Harassment<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/harassment.html\">Criminal harassment<\/a>\u00a0is most often\u00a0defined by state law. States have different harassment definitions and laws, but virtually all criminalize intentional and repeated efforts to annoy, frighten, or intimidate you.<\/p>\n<p>Minor annoyances aren&#8217;t criminal. A prosecutor generally needs to show a credible threat to your safety in order to establish the crime of harassment.<\/p>\n<p>Depending on the nature, frequency, and severity of the harassment, the crime could be a misdemeanor or even a felony. In many places, charges are enhanced if the harassment is due to someone&#8217;s sex, race, religion, gender, sexual orientation, national origin, or gender identity.<\/p>\n<p>If you believe you are being harassed and want to press charges, call the police right away.<\/p>\n<h2>Discuss Your Legal Options To Stop Harassment\u00a0<\/h2>\n<p>As you can see, you have many options when it comes to harassment.
