It can also help you build a paper trail to document your case.<\/p>\n<p>Some of the possible reasons for denial include:<\/p>\n<ul>\n<li>Ineligibility, as described above<\/li>\n<li>Incomplete documentation of the <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/reasons-that-qualify-for-fmla-leave.html\">qualifying event or medical condition<\/a>, such as lack of <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/fmla-certification-of-need-for-leave.html\"><span data-term-id=\"59114810\">medical certification<\/span><\/a><\/li>\n<li>Procedural errors, such as the failure to provide advance <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/fmla-notice-requirements-employee.html\">notice for an expected leave<\/a><\/li>\n<li>Insufficient amount of available FMLA leave left during the one-year period<\/li>\n<\/ul>\n<p>An employer may provide an illegitimate reason for denial. This protection exists even if your FMLA request was denied.<\/p>\n<p>There is an exception if you&#8217;re <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/return-to-work-under-the-fmla-fitness-for-duty-certification.html\">unfit to return to work<\/a>. For example, if a planned surgery leads to a disability that makes it impossible to work despite <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/the-employer-s-duty-to-accommodate.html\">accommodations<\/a>, you may not be able to return to work. You rush to your boss to request time off from work. Your employer tells you that times are tough and the company can&#8217;t afford to lose you even for a day.<\/p>\n<p>&#8220;I&#8217;m really sorry, but I&#8217;ll just have to hire someone else if you can&#8217;t be here,&#8221; your boss threatens. &#8220;I can&#8217;t make any promises that we can give you a job when you&#8217;re back.&#8221;<\/p>\n<p>You would recognize that the threat of firing you would be retaliatory. You also see that their reason for the denial is likely illegitimate. So, you&#8217;re wondering what to do about this illegal response.<\/p>\n<h2><a id=\"enforcement\"><\/a>Review Your Enforcement Options<\/h2>\n<p>Suing an employer isn&#8217;t necessarily the only path forward. You can decide whether to complain to a government agency or <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/what-to-expect-a-lawsuit-chronology.html\">file a <span data-term-id=\"59114811\">private lawsuit<\/span><\/a> through the court system.<\/p>\n<p>To enforce your <span data-term-id=\"59114788\">FMLA rights<\/span>, you can take the following steps:<\/p>\n<ul>\n<li><strong>Address documentation issues:<\/strong> You may request a <span data-term-id=\"59114810\">medical certification<\/span> or resubmit fully completed forms to prove that you qualify for FMLA. Sometimes this step is enough to resolve the problem with an employer informally. You should act promptly, because FMLA claims generally must be brought within two years of the last alleged violation, or within three years for a willful violation..<\/li>\n<li><strong>File a lawsuit: <\/strong>An FMLA lawsuit must be filed within two years after the last employer action that you believe was in violation of the FMLA. The time is extended to three years if the employer&#8217;s violation was willful.<\/li>\n<\/ul>\n<p>You may file a <span data-term-id=\"59114801\">DOL<\/span> complaint and a <span data-term-id=\"59114811\">private lawsuit<\/span> at the same time. But it&#8217;s important to know how these options interact. If the <span data-term-id=\"59114801\">DOL<\/span> decides to pursue litigation on your behalf following its investigation, you would lose your right to sue privately for those claims. If you already filed a lawsuit, the <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/contact\/complaints\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59114801\">DOL<\/span>&#8216;s investigation<\/a> wouldn&#8217;t recover double damages for the same claim.<\/p>\n<p>Some states also have their own family leave laws with separate enforcement mechanisms. File a Complaint<\/h3>\n<p>The main differences between a lawsuit and a complaint concern your level of involvement and the potential remedies. You can evaluate which process is better based on your goals.<\/p>\n<p>In an agency complaint, the <span data-term-id=\"59114801\">DOL<\/span> takes charge of the investigation for you. You would still need to provide information to support the investigation, but the process would require less involvement on your end. This process can be easier for workers who are already dealing with illnesses or family needs. Filing a complaint with the <span data-term-id=\"59114801\">DOL<\/span> is free.<\/p>\n<p>In a <span data-term-id=\"59114811\">private lawsuit<\/span>, you would take on the burden of arguing your claim in civil court as a plaintiff. You&#8217;d need to file the <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/starting-the-case-initial-court-papers.html\">initial court papers<\/a> and attend court hearings. <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-court-cases.html\"><span data-term-id=\"59114811\">Private lawsuits<\/span><\/a> typically take longer than agency complaints. They also incur upfront costs like filing fees and <span data-term-id=\"59114794\">attorney fees<\/span>. In exchange, you can keep more control over your case.
