Because of this, landlords are legally obligated to disclose the presence of asbestos. Failure to do so can result in lawsuits for breach of the lease contract, breach of the implied warranty of habitability, and negligence.&nbsp;<\/p>\n\n    <\/div>\n\n\n\n<p>While the presence of asbestos might not be enough on its own, you can sue your landlord if they knowingly or negligently failed to disclose its existence and you suffered from asbestos exposure.<\/p>\n<p>Asbestos exposure can lead to serious \u2014 even terminal \u2014 health conditions. If you have developed health problems or are concerned about health risks relating to <span data-term-id=\"59126717\">asbestos-containing materials<\/span> in your rental unit, legal help is available. An <a href=\"https:\/\/lawyers.findlaw.com\/asbestos-mesothelioma\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">asbestos lawyer<\/a>\u00a0near you\u00a0can explain your rights and evaluate your landlord\u2019s actions (or inactions) to determine whether you have a valid claim.<\/p>\n<h2>Is Asbestos Illegal in Rental Properties?<\/h2>\n<p>In new constructions, asbestos has been nearly banned thanks to a <span data-term-id=\"59126744\">federal law<\/span>, the <a href=\"https:\/\/www.epa.gov\/laws-regulations\/summary-clean-air-act\" target=\"_blank\" rel=\"noopener\">Clean Air Act of 1970<\/a> (CAA), which is implemented by the Environmental Protection Agency (EPA). Moreover, asbestos regulations are strict about proper methods for <span data-term-id=\"59126728\">asbestos removal<\/span>.<\/p>\n<p>States have enacted strong landlord-tenant laws which:<\/p>\n<ul>\n<li>Set landlord liability for illegal asbestos exposure<\/li>\n<li>Place a legal obligation on landlords to remove or safely maintain asbestos<\/li>\n<\/ul>\n<p>It is not unusual for an older rental property to still contain <span data-term-id=\"59126725\">asbestos fibers<\/span>. In fact, many homes built between the 1930s and 1970s used asbestos for roofing, <span data-term-id=\"59126727\">floor tiles<\/span>, <span data-term-id=\"59126742\">pipe insulation<\/span>, <span data-term-id=\"59126739\">drywall<\/span>, and patching. It wasn\u2019t until 1977 that amendments to the CAA banned these uses. Fifty years later, some properties still have these materials.<\/p>\n<h3>Can Landlords Leave Asbestos Untreated?<\/h3>\n<p>Yes, landlords may leave <span data-term-id=\"59126750\">asbestos in your rental<\/span> property if it is fully contained within the building. If asbestos is left undisturbed, it might not necessarily be a health risk.<\/p>\n<p>But it becomes a problem when walls start to chip away or floor or ceiling tiles start to fall off. In that case, the <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/asbestos-faq.html\"><span data-term-id=\"59126725\">asbestos fibers<\/span> can be exposed<\/a>. The landlord may then have a legal duty to address the problem.<\/p>\n<p>Improper renovations can also disturb underlying asbestos that may have otherwise been harmless. Even a small amount of dust uncovered by a building\u2019s deterioration or maintenance can cause asbestos to spread into the air and into your lungs.<\/p>\n<p>Being around asbestos or inhaling its fibers can cause many health issues, including:<\/p>\n<ul>\n<li><span data-term-id=\"59126720\">Asbestosis<\/span> (scarring of lung tissue)<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/diagnosis-and-treatment-of-mesothelioma.html\"><span data-term-id=\"59126718\">Mesothelioma<\/span><\/a> (an aggressive type of <span data-term-id=\"59126724\">lung cancer<\/span>)<\/li>\n<\/ul>\n<h3>A Landlord\u2019s Duties<\/h3>\n<p>Landlords must comply with state laws and local <span data-term-id=\"59126743\">housing codes<\/span>. Just about every state will require that any residential housing unit that is offered for rent be in habitable condition.<\/p>\n<p>A property owner <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenant-safety-and-landlord-liability.html\">who manages older buildings<\/a> should expect that asbestos may have been used in their construction materials. They may need to conduct regular inspections by asbestos professionals to prevent potential harm to tenants.<\/p>\n<p>If the asbestos is <span data-term-id=\"59126722\">encapsulated<\/span> within the building, it may be riskier to disturb that material. But if asbestos becomes exposed, the landlord must address the risk to tenants. The landlord or <span data-term-id=\"59126723\">property management<\/span> company may need to hire <span data-term-id=\"59126734\">licensed professionals<\/span> to remove asbestos once it presents a health hazard.<\/p>\n<h2>Types of Asbestos Claims<\/h2>\n<p>If you suspect that you may have been exposed to asbestos as a result of your landlord\u2019s bad behavior, you may sue for:<\/p>\n<ul>\n<li><a href=\"#lease\">Breach of the lease contract<\/a><\/li>\n<li><a href=\"#warranty\">Breach of the implied warranty of habitability<\/a><\/li>\n<li><a href=\"#negligence\"><span data-term-id=\"59126745\">Negligence<\/span><\/a><\/li>\n<\/ul>\n<p>The sections below describe the basic details of each type of claim. You can get <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/asbestos-and-mesothelioma.html\">legal advice for asbestos claims<\/a> to better understand how to resolve disputes with your landlord.<\/p>\n<p>Your state or municipality may also have local laws that are specifically designed to protect renters, so you may want to file complaints with your local <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/hud-information-by-state.html\">Housing Department<\/a> and <a href=\"https:\/\/www.usa.gov\/state-health\" target=\"_blank\" rel=\"noopener\">Public Health Agency<\/a> alongside filing your lawsuit.<\/p>\n<h2><a id=\"lease\"><\/a>Suing for Breach of the <span data-term-id=\"59126719\">Rental Agreement<\/span><\/h2>\n<p>A <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenant-lease-agreement-faqs.html\"><span data-term-id=\"59126726\">lease agreement<\/span><\/a> for residential real estate will usually contain language about the cleanliness, safety, and good condition of the premises.<\/p>\n<h3>Promise of Safe Conditions<\/h3>\n<p>Most of the time, the contract will make it sound like it\u2019s the tenant\u2019s responsibility to keep the rental premises that way. But if the tenant is required to keep the unit in good condition, then the landlord is promising that the rental unit is already being given to the tenant in good condition.<\/p>\n<p>The contract probably says you have to pay the landlord rent every month. So that payment would be dependent on the landlord\u2019s ability to <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/landlords-duties-regarding-repairs-maintenance-and-to-provide.html\">keep the premises habitable<\/a>. The exception is if the property is uninhabitable as a result of a tenant\u2019s own fault.<\/p>\n<p>State law will usually prohibit a landlord from delivering possession of rental premises to a tenant in an unsafe condition. Even if the <span data-term-id=\"59126719\">rental agreement<\/span> has disclaimers saying that the unit is being rented to you \u201cas is,\u201d the landlord must still meet the <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenant-safety-and-landlord-liability.html\">minimum health and safety regulations<\/a> that make a rental dwelling livable.<\/p>\n<h3>How To Prove the Landlord Breached the Contract<\/h3>\n<p>In general, these are the legal elements you must show to prove that a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-for-breach-of-contract.html\">breach of contract<\/a> has occurred:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/will-your-contract-be-enforced-under-the-law.html\">A valid lease contract<\/a> existed.<\/li>\n<li>You\u2019ve <a href=\"https:\/\/dictionary.findlaw.com\/definition\/performance.html\" target=\"_blank\" rel=\"noopener\">performed<\/a> your obligations under the contract, which generally means you\u2019ve been paying your rent on time and you haven\u2019t caused destruction or damage to the premises.<\/li>\n<li>The landlord has <a href=\"https:\/\/dictionary.findlaw.com\/definition\/breach.html\" target=\"_blank\" rel=\"noopener\">breached<\/a> the contract by failing to perform their duty to provide the safe and livable premises that they promised to you under the <span data-term-id=\"59126726\">lease agreement<\/span>.<\/li>\n<li>You suffered <a href=\"https:\/\/dictionary.findlaw.com\/definition\/damages.html\" target=\"_blank\" rel=\"noopener\">damages<\/a>, including losses to you in the form of rent and payment to medical professionals for <span data-term-id=\"59126736\">asbestos-related diseases<\/span>.<\/li>\n<\/ul>\n<h3>Can I Withhold Rent Because of Asbestos?<\/h3>\n<p>A lease contract might have an \u201cabatement\u201d clause which means that the tenant can deduct (abate) rent for any portion of the rental unit that becomes unlivable. So if your kitchen ceiling starts to leak and <span data-term-id=\"59126725\">asbestos fibers<\/span> are exposed from corrosion, the landlord may be in <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/landlord-tenant-disputes-faqs.html\">breach of the <span data-term-id=\"59126726\">lease agreement<\/span><\/a> if they continue to insist on the entire rent.<\/p>\n<p>Any time you\u2019re considering <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/how-does-a-tenant-use-repair-and-deduct.html\">withholding rent or fixing the property<\/a> yourself, use caution. Nonpayment of rent can be <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rules-for-landlords-and-property-managers-when-evicting-a-tenant.html\">grounds for <span data-term-id=\"59126716\">eviction<\/span><\/a> if you fail to follow proper legal procedures.<\/p>\n<h2>Suing for Breach of the Implied Warranty of Habitability<\/h2>\n<p>It doesn\u2019t matter if the <span data-term-id=\"59126719\">rental agreement<\/span> has disclaimers regarding dangerous conditions. The <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-is-the-implied-warranty-of-habitability.html\">implied warranty of habitability<\/a>, which is recognized by nearly all 50 states, is a legal requirement that a <span data-term-id=\"59126733\">rental housing<\/span> unit should be suitable for its intended purpose of being livable.<\/p>\n<p>While state laws vary, in general, you have to show three things:<\/p>\n<ul>\n<li>A bad condition that makes the rental unit uninhabitable<\/li>\n<li>The landlord\u2019s actual (or reasonably required) knowledge of the dangerous condition<\/li>\n<li>Damages<\/li>\n<\/ul>\n<p>For example, let\u2019s say your landlord knows that the rental unit was built in the 1960s and <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/asbestos.html\">contains asbestos<\/a> <span data-term-id=\"59126721\">building materials<\/span>. The kitchen has old linoleum and plastic <span data-term-id=\"59126727\">floor tiles<\/span> that are coming apart, so you share your concerns with your landlord.<\/p>\n<p>It\u2019s reasonable for old linoleum tiles to contain asbestos. It\u2019s also reasonable that your landlord should know about this fact given their knowledge of the building\u2019s history.<\/p>\n<p>Therefore, any illness you face would count as damages. They would be recoverable under a claim for the implied warranty of habitability. Providing habitable premises is part of the <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/ten-landlord-legal-mistakes-to-avoid.html\"><span data-term-id=\"59126730\">landlord\u2019s responsibilities<\/span> to you<\/a>.<\/p>\n<h2>Suing for <span data-term-id=\"59126745\">Negligence<\/span><\/h2>\n<p>If a landlord has been careless, you may also be able to <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/elements-of-a-negligence-case.html\">sue them for <span data-term-id=\"59126745\">negligence<\/span><\/a>. Examples of carelessness include:<\/p>\n<ul>\n<li>Your landlord should have reasonably known that an old building had asbestos but denied its existence when you asked about it before moving in.<\/li>\n<li>Your landlord knew about the asbestos but forgot to warn you about its presence.<\/li>\n<li>Your landlord did renovations to remove the asbestos but didn\u2019t take proper steps to remove the toxic materials properly and exposed you to dangerous <span data-term-id=\"59126725\">asbestos fibers<\/span> in the process.<\/li>\n<\/ul>\n<p>Your <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/negligence.html\"><span data-term-id=\"59126745\">negligence<\/span> lawsuit<\/a> will state:<\/p>\n<ul>\n<li>The landlord had a duty to take <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/standards-of-care-and-the-reasonable-person.html\">reasonable measures<\/a> to prevent harm to you (as their tenant).<\/li>\n<li>They breached that duty by failing to warn you or to abate asbestos inside the rental unit.<\/li>\n<li>You were injured as a result of asbestos exposure.<\/li>\n<li>You suffered damages, such as wasted rent, <span data-term-id=\"59126737\">personal injuries<\/span>, and <span data-term-id=\"59126738\">medical expenses<\/span>.<\/li>\n<\/ul>\n<h2>Remedies for Asbestos Exposure Claims<\/h2>\n<p>If you win your lawsuit against a landlord, the court may award you any one or more of the following remedies:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/what-are-compensatory-damages.html\"><strong>Compensatory damages<\/strong><\/a><strong>:<\/strong> This includes rent illegally collected by the landlord while the rental premises were uninhabitable, your <span data-term-id=\"59126738\">medical expenses<\/span> for illness and <span data-term-id=\"59126737\">personal injuries<\/span> related to asbestos exposure, and any other lost money and pain\/suffering that you can reasonably attribute to the landlord\u2019s wrongdoing.<\/li>\n<li><strong>Statutory damages:<\/strong> These are flat damages that some states might award for every violation committed by a landlord. For example, local building safety codes or healthy codes that are violated can subject your landlord to statutory damages per each violation.<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/when-can-you-sue-for-punitive-damages\"><strong>Punitive damages<\/strong><\/a><strong>:<\/strong> These are intended to punish a landlord that acts with malice or fraud and to deter other landlords from engaging in similar egregious misconduct.
