For example, you cannot <span data-term-id=\"58930938\">sue X<\/span> for content someone else posts that offends you or hurts your reputation.<\/p>\n<p>But you may be able to sue the platform if it posts videos, photos, or documents that belong to you. You may also be able to sue if you were an X employee who was fired in violation of a <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/sample-employment-termination-contract.html\">severance agreement<\/a> or for a discriminatory reason.<\/p>\n<p>Suing a powerful company like X is no easy feat. Even if you do sue, <span data-term-id=\"58930930\">X&#8217;s terms of service<\/span> and liability limitations make winning and recovering damages very difficult. The right attorney to hire depends on the type of lawsuit you wish to bring.<\/p>\n<h2>Legal Concerns When Twitter Became X<\/h2>\n<p>X, formerly Twitter, is an online <span data-term-id=\"58930922\">social media<\/span><span data-term-id=\"58930922\"> platform<\/span> founded in 2006. Twitter had grown into one of the most popular social networking websites on the internet. Billionaire <span data-term-id=\"58930921\">Elon Musk<\/span> bought the platform in October 2022 for about <a href=\"https:\/\/www.reuters.com\/markets\/us\/how-will-elon-musk-pay-twitter-2022-10-07\/\" target=\"_blank\" rel=\"noopener\">$44 billion<\/a> and <span data-term-id=\"58930937\">rebranded<\/span> Twitter to X in 2023.<\/p>\n<p>Shortly after he took over the company, Musk took a series of actions, including:<\/p>\n<ul>\n<li>Began cost-cutting by <a href=\"https:\/\/www.reuters.com\/markets\/deals\/elon-musk-completes-44-bln-acquisition-twitter-2022-10-28\/\" target=\"_blank\" rel=\"noopener\">laying off thousands of employees<\/a><\/li>\n<li>Implemented less-restrictive content moderation policies, which some believe increase the risk of misinformation and disinformation on the platform<\/li>\n<li>Reinstated numerous controversial accounts, including that of former President Donald Trump<\/li>\n<li>Integrated an AI assistant called Grok, which another Musk-owned company had built<\/li>\n<\/ul>\n<p>This <span data-term-id=\"58930922\">social media<\/span><span data-term-id=\"58930922\"> platform<\/span> has faced many changes in its policies, features, and ownership. As <span data-term-id=\"58930950\">Twitter accounts<\/span> morphed into <span data-term-id=\"58930932\">X accounts<\/span> and <span data-term-id=\"58930925\">tweets<\/span> became X posts, new legal issues have arisen.<\/p>\n<h2>Why Might You Want to <span data-term-id=\"58930938\">Sue X<\/span>?<\/h2>\n<p>There are several reasons you may want to pursue <span data-term-id=\"58930923\">legal action<\/span> against X:<\/p>\n<ul>\n<li>You&#8217;ve been harmed due to the content of someone&#8217;s post.<\/li>\n<li>You&#8217;ve been on the receiving end of false statements that hurt your reputation.<\/li>\n<li>You&#8217;re an artist, author, or creator whose work is being shared on X <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/fair-use-law.html\">without your permission<\/a>.<\/li>\n<li>You may be a former employee of X who <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/wrongful-termination.html\">lost your job<\/a> in the mass layoffs after Musk took over.<\/li>\n<li>You\u2019ve suffered a loss or harm due to the content output or data collection of Grok.<\/li>\n<\/ul>\n<p>If you were thinking about suing X, your chances of winning depend on the nature of your complaint. A <a href=\"https:\/\/lawyers.findlaw.com\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58930948\">local attorney<\/span><\/a> can assess your situation and advise on next steps.<\/p>\n<h3>Content of a Post: <span data-term-id=\"58930924\">Free Speech<\/span> vs. <span data-term-id=\"58930920\">Defamation<\/span><\/h3>\n<p>You may be upset with the content of someone&#8217;s post. But there is a legal difference between protected speech under the <span data-term-id=\"58930941\">First Amendment<\/span> and posts that justify <span data-term-id=\"58930943\">defamation<\/span><span data-term-id=\"58930943\"> claims<\/span>.<\/p>\n<p>X users can be rude and mean. Ignoring an offensive post and blocking the user may prevent further conflict. An alternative is to report the post and see if X will take it down.<\/p>\n<p>But sometimes someone posts something false that <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-law-the-basics.html\">hurts your reputation<\/a>. Say, for example, you&#8217;re a restaurant owner and someone falsely posts that they saw rats in your kitchen. If you can identify them, you might be able to sue them for <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\"><span data-term-id=\"58930920\">defamation<\/span><\/a>.<\/p>\n<p>But you wouldn&#8217;t be able to <span data-term-id=\"58930938\">sue X<\/span> directly. <a href=\"https:\/\/codes.findlaw.com\/us\/title-47-telecommunications\/47-usc-sect-230.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58930945\">Section 230<\/span> of the Communications Decency Act<\/a> says that interactive computer services, including <span data-term-id=\"58930922\">social media<\/span><span data-term-id=\"58930922\"> platforms<\/span> such as X, are not the \u201cpublishers&#8221; or \u201cspeakers&#8221; of content posted by third parties. <span data-term-id=\"58930945\">Section 230<\/span> essentially grants X <a href=\"https:\/\/dictionary.findlaw.com\/definition\/immunity.html\" target=\"_blank\" rel=\"noopener\">immunity<\/a> from most civil claims, including <span data-term-id=\"58930920\">defamation<\/span>, based on third-party content.<\/p>\n<p>You also wouldn&#8217;t be able to sue if X refused to remove an offensive or even a <span data-term-id=\"58930934\">defamatory statement<\/span>. <a href=\"https:\/\/codes.findlaw.com\/us\/title-47-telecommunications\/47-usc-sect-230.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58930945\">Section 230<\/span><\/a> immunizes X from lawsuits based upon its decision to remove or leave up objectionable content posted by a third party. As long as X acts in \u201cgood faith,&#8221; they are free to remove any \u201cobscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable&#8221; content. Or, it can choose to leave it up.<\/p>\n<p>X is a private company, so it gets to determine whether something violates its terms of use. Even if it clearly does, X can still choose to leave it up.<\/p>\n<h3><span data-term-id=\"58930939\">Intellectual Property<\/span> Infringement on X<\/h3>\n<p>X cannot violate your <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property.html\"><span data-term-id=\"58930939\">intellectual property<\/span> rights<\/a>. <span data-term-id=\"58930939\">Intellectual property<\/span> laws, specifically <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/what-is-copyright.html\">copyright laws<\/a>, protect creative works, including books, poems, photographs, videos, and paintings.<\/p>\n<p>IP laws grant the creator of an original work the exclusive right to:<\/p>\n<ul>\n<li>Reproduce the work<\/li>\n<li>Make &#8220;derivative works&#8221; (other works based on the original work)<\/li>\n<li>Distribute copies of the work<\/li>\n<li>Perform the work publicly<\/li>\n<li>Display the work publicly<\/li>\n<\/ul>\n<p>The owner of the copyright decides the terms on which their work is used or reproduced. If someone reproduces a work without permission, the copyright owner can sue them for <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/avoiding-infringement-problems.html\"><span data-term-id=\"58930936\">copyright infringement<\/span><\/a>.<\/p>\n<p><span data-term-id=\"58930945\">Section 230<\/span> contains an exception for <span data-term-id=\"58930939\">intellectual property<\/span>. For example, if someone on X posts a photograph you took and sold to a gallery without your permission, you could theoretically <span data-term-id=\"58930938\">sue X<\/span>. You could also sue the user who posted it for violating your copyright. You would still want to ask them to pull the post first.<\/p>\n<p>IP violations involving Grok or X users\u2019 AI-generated content can be more complicated. <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-an-artificial-intelligence-company-for-ai-copyright-vi.html\">AI copyright violations<\/a> belong to an evolving area of law. In such cases, seek <span data-term-id=\"58930952\">legal help<\/span> to better understand your options.<\/p>\n<h2><span data-term-id=\"58930930\">X\u2019s Terms of Service<\/span> May Limit Your Claim<\/h2>\n<p>If you are an X user and want to sue someone, you need to be aware of certain contractual limitations. When you signed up for X, you had to create an <span data-term-id=\"58930932\">X account<\/span>. By clicking \u201cI accept,&#8221; you agreed to <span data-term-id=\"58930930\">X&#8217;s\u00a0<\/span><a href=\"https:\/\/x.com\/en\/tos\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58930930\">terms of service<\/span><\/a>. This created a binding contract between you and X. That contract skews so far in X&#8217;s favor that it makes a lawsuit almost pointless.<\/p>\n<p>But all is not necessarily lost. X cannot use its terms of service as a way of getting around state and federal laws. X probably couldn&#8217;t get away with banning accounts based solely on that person&#8217;s <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination.html\">race or religion<\/a>, for example. And if you do not have an <span data-term-id=\"58930932\">X account<\/span>, you are not bound by its terms of service.<\/p>\n<p>However, the terms of service would apply if X blocked your account for any reason not prohibited by state or federal law, and you wanted\u00a0to sue to get it back. In that situation, your legal options would be limited.<\/p>\n<h3>Limitations of Liability and <span data-term-id=\"58930926\">Disclaimers<\/span><\/h3>\n<p><span data-term-id=\"58930930\">X&#8217;s terms of service<\/span> contains limitations of liability and <span data-term-id=\"58930926\">disclaimers<\/span>. These limit X&#8217;s liability and your potential recovery in a lawsuit. In this section, you agree:<\/p>\n<ul>\n<li>X disclaims responsibility for all of the content on its site<\/li>\n<li>X cannot be held liable for content posted by third parties (even if it&#8217;s defamatory or illegal)<\/li>\n<li>Even if you did <span data-term-id=\"58930938\">sue X<\/span> and won, the most <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/after-a-judgment-collecting-money.html\">you could collect<\/a> is $100 or the amount you paid X in the six months before your claim arose (whichever is greater).<\/li>\n<\/ul>\n<p>So if you were to <span data-term-id=\"58930938\">sue X<\/span>, you&#8217;d have to get around the limitation on its liability for third-party content. And even if you manage to persuade a court that you shouldn&#8217;t be bound by that limitation, you would still be restricted to a recovery that&#8217;s substantially less than the filing fee you&#8217;d pay to start your lawsuit.<\/p>\n<h3>Where You Can <span data-term-id=\"58930938\">Sue X<\/span>: Forum Selection Clause<\/h3>\n<p>The terms of service also make it <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/how-to-sue.html\">hard to <span data-term-id=\"58930938\">sue<\/span><\/a><span data-term-id=\"58930938\"> X<\/span>. Companies often <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/choosing-a-venue-in-state-court.html\">set a specific venue<\/a> in their terms, which is the court that will hear any claims against the business.<\/p>\n<p>According to section 6, if you do want to <span data-term-id=\"58930938\">sue X<\/span>, the only <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/state-court-cases-how-to-determine-where-your-suit-will-be-heard.html\">place you can do it<\/a> is in state or <span data-term-id=\"58930942\">federal court<\/span> in Tarrant County, Texas. This rule isn&#8217;t practical for someone living in, say, <span data-term-id=\"58930927\">New York<\/span> or Washington. Unless you live near Tarrant County in Texas, suing X would <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/ten-things-to-think-about-lawsuits.html\">cost you much more<\/a> than you could probably recover.<\/p>\n<h2>Employment Law Claims Against <span data-term-id=\"58930949\">X Corp<\/span>.<\/h2>\n<p>Maybe you&#8217;re in the unusual position of having worked for X. You lost your job when <span data-term-id=\"58930921\">Elon Musk<\/span> acquired the platform and fired most of the workforce. If you are one of those people, you may be able to file a lawsuit in two particular situations.<\/p>\n<h3>Illegal Discrimination<\/h3>\n<p>The first is illegal discrimination and <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/wrongful-termination.html\">wrongful termination<\/a>. Employment is generally <a href=\"https:\/\/www.findlaw.com\/state\/texas-law\/texas-employment-laws.html\">\u201cat will&#8221; in Texas<\/a>. That means you can fire an employee whenever you want, for a good reason or for no reason at all.<\/p>\n<p>But you can&#8217;t fire them for an illegal reason. Federal law and state law create <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/employees-rights-101.html\">protected classes of people<\/a> based on certain characteristics, such as race, sex, gender, religion, national origin, sexual orientation, and gender identity.<\/p>\n<p>If an employer were to fire you based on your membership in one of these protected classes, you would be able to sue. A skilled <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">civil rights attorney<\/a>\u00a0can help you with your claim.<\/p>\n<h3>Breach of Contract<\/h3>\n<p>The second situation is for <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-for-breach-of-contract-.html\">breach of contract<\/a>. Not every employee is an at-will employee. Many employees, especially those higher up on the organizational chart, have employment contracts. If you have an employment contract, then your employer can only fire you if they can satisfy the terms of their contract.<\/p>\n<p>X faced a slew of lawsuits brought by former employees for violating the terms of their employment contracts. For example, some claim that X failed to reimburse their business expenses. Others contend that X fired them without just cause. Some claims relate to the wrongful denial of benefits under X\u2019s <a href=\"https:\/\/www.findlaw.com\/employment\/losing-a-job\/severance-pay-and-benefits-considerations.html\">severance plan<\/a>.<\/p>\n<p>Regardless of the contractual basis, most of these lawsuits will not be decided in court. Instead, they will be decided through an out-of-court process called <a href=\"https:\/\/www.findlaw.com\/adr\/arbitration.html\"><span data-term-id=\"58930944\">arbitration<\/span><\/a>.<\/p>\n<p>One particular case should be noted. Shannon Liss-Riordan, a lawyer, <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/musks-x-corp-resists-twitter-layoff-battles-as-risks-spread\" target=\"_blank\" rel=\"noopener\">has brought a class action<\/a> against X on behalf of more than 2,000 former employees. A <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/class-action-cases.html\">class action<\/a> is a legal case that allows people with similar claims to group their cases together and have them resolved in a single lawsuit. As of early 2026, the case has still been under settlement negotiations.<\/p>\n<h2>Thinking About Suing X? Consult an Attorney<\/h2>\n<p>In most cases, trying to <span data-term-id=\"58930938\">sue X<\/span> (or any <span data-term-id=\"58930922\">social media<\/span><span data-term-id=\"58930922\"> platform<\/span>) for content posted by a third party is not worth your time or trouble.<\/p>\n<p>But there are some situations where you may be able to sue. If you have a dispute with X over something it did (such as violating your copyright or firing you without cause), you may have a valid legal claim.
