The defendant also has a chance to refute the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s case. A <span data-term-id=\"59271659\">judge<\/span> or jury examines the evidence and issues a <span data-term-id=\"59271660\">verdict<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p>Sometimes, you can\u2019t solve a problem with another person without help. The court system can provide that support \u2014 and it has the authority to decide an enforceable outcome.<\/p>\n<p>Generally, <span data-term-id=\"59271662\">civil cases<\/span> focus on disputes between people, businesses, or other types of organizations. <span data-term-id=\"59271681\">Civil litigation<\/span> seeks a remedy in court. This article will discuss how a typical <span data-term-id=\"59271662\">civil case<\/span> progresses through the trial process.<\/p>\n<p><span data-term-id=\"59271662\">Civil cases<\/span> span a wide range of issues in daily life. They may concern <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-for-breach-of-contract.html\"><span data-term-id=\"59271686\">contract disputes<\/span><\/a>, <span data-term-id=\"59271671\">personal injuries<\/span>, divorces, and more. Your case will likely involve many unique considerations depending on what type of issue you face. Many parties also resolve <span data-term-id=\"59271662\">civil cases<\/span> via <a href=\"https:\/\/www.findlaw.com\/adr.html\">alternative dispute resolution<\/a>,\u00a0such as arbitration or <span data-term-id=\"59271698\">mediation<\/span>. But in some cases, trial becomes the best option to seek a fair result.<\/p>\n<p>The <a href=\"https:\/\/dictionary.findlaw.com\/definition\/verdict.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59271660\">verdict<\/span> <\/a>of a <span data-term-id=\"59271663\">civil trial<\/span> is intended to set a final outcome. In some cases, <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/appealing-a-court-decision-or-judgment.html\">civil appeals<\/a> or later <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/custody-modification.html\">modifications<\/a>, such as for child custody, may change the parties\u2019 circumstances. But aside from those situations, a trial produces a clear and legally enforceable result.<\/p>\n<h2>Steps of <span data-term-id=\"59271663\">Civil Trial<\/span><\/h2>\n<p>Before a <span data-term-id=\"59271662\">civil case<\/span> begins the court process, a <span data-term-id=\"59271661\">plaintiff<\/span> must <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/starting-the-case-initial-court-papers.html\">file a complaint<\/a>, and the defendant can reply. Both parties <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/fact-finding-and-discovery.html\">gather facts and evidence<\/a> about the dispute. These initial steps and documents build a foundation for how the rest of the case will proceed.<\/p>\n<p>A complete <span data-term-id=\"59271663\">civil trial<\/span> consists of seven phases:<\/p>\n<ul>\n<li><a href=\"#jury\">Choosing a jury<\/a><\/li>\n<li><a href=\"#opening\"><span data-term-id=\"59271665\">Opening statements<\/span><\/a><\/li>\n<li><a href=\"#witnesses\"><span data-term-id=\"59271678\">Witness testimony<\/span> and <span data-term-id=\"59271666\">cross-examination<\/span><\/a><\/li>\n<li><a href=\"#evidence\">Presentation of physical evidence<\/a><\/li>\n<li><a href=\"#closing\"><span data-term-id=\"59271668\">Closing arguments<\/span><\/a><\/li>\n<li><a href=\"#instruction\"><span data-term-id=\"59271679\">Jury instruction<\/span><\/a><\/li>\n<li><a href=\"#verdict\"><span data-term-id=\"59271672\">Jury deliberation<\/span> and <span data-term-id=\"59271660\">verdict<\/span><\/a><\/li>\n<\/ul>\n<p>After both sides have presented their arguments, the <span data-term-id=\"59271659\">judge<\/span> or jury decides if the defendant is liable and to what extent.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/civil-court-basics.html\">Civil court cases<\/a> vary. Depending on the type of case, a <span data-term-id=\"59271663\">civil trial<\/span> may not focus only on the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s allegations and the defendant\u2019s liability. For example, a <span data-term-id=\"59271659\">judge<\/span> decides <a href=\"https:\/\/www.findlaw.com\/family\/divorce\/family-court-and-final-judgment.html\">divorce outcomes<\/a> after hearing from both spouses. The judgment may favor one spouse on one issue (<a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/custody-considerations-step-by-step.html\">child custody<\/a>) and the other spouse on another (<a href=\"https:\/\/www.findlaw.com\/family\/divorce\/spousal-support-alimony-basics.html\">alimony<\/a>).<\/p>\n<h2><a id=\"jury\"><\/a>Choosing a Jury for <span data-term-id=\"59271663\">Civil Trial<\/span><\/h2>\n<p>Some cases, such as family law cases, don\u2019t have <span data-term-id=\"59271667\">jury trials<\/span>. A <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/judge-versus-jury-trials.html\"><span data-term-id=\"59271659\">judge<\/span> will decide<\/a> those cases instead. <span data-term-id=\"59271659\">Judges<\/span> often also rule when a party seeks a <span data-term-id=\"59271702\">specific performance<\/span>, such as the fulfillment of a promise.<\/p>\n<p>In other cases, one of the first steps is <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-potential-jurors-selected.html\"><span data-term-id=\"59271695\">jury selection<\/span><\/a>. During\u00a0<span data-term-id=\"59271695\">jury selection<\/span>, or <a href=\"https:\/\/dictionary.findlaw.com\/definition\/voir-dire.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59271690\">voir dire<\/span><\/a>, the <span data-term-id=\"59271659\">judge<\/span> and attorneys will question a pool of potential jurors about the case and general matters. The <span data-term-id=\"59271659\">judge<\/span> can excuse potential jurors at this stage.<\/p>\n<p>The <span data-term-id=\"59271661\">plaintiff<\/span> and the defendant may exclude some jurors through challenges. A party has a limited number of <a href=\"https:\/\/dictionary.findlaw.com\/definition\/challenge.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59271692\">peremptory challenges<\/span><\/a>, excluding jurors for any reason and a limited number of challenges for cause. Challenges for cause exclude jurors who can\u2019t be objective in the case.<\/p>\n<p>Once all parties agree on the jurors, the clerk swears them in. The <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-jury-duty-like.html\">jurors must swear<\/a> they will try the case based only on the evidence presented and follow the court\u2019s instructions.<\/p>\n<h2><span data-term-id=\"59271665\"><a id=\"opening\"><\/a>Opening Statements<\/span><\/h2>\n<p>After the clerk swears in the jury, the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s and defendant\u2019s attorneys make their <span data-term-id=\"59271665\">opening statements<\/span>. The <span data-term-id=\"59271661\">plaintiff<\/span> gives their <span data-term-id=\"59271665\">opening statement<\/span> first. The defendant can wait until the <span data-term-id=\"59271661\">plaintiff<\/span> finishes their main case to make their statement.<\/p>\n<p>In an <span data-term-id=\"59271665\">opening statement<\/span>, the attorneys present the facts of the case and the reasons the jury should find for their client. During <span data-term-id=\"59271665\">opening statements<\/span>, the attorneys tell the jury what evidence they will present, the witnesses who will testify, and how all the evidence ties together.<\/p>\n<p>Attorneys can\u2019t \u201cargue\u201d during <span data-term-id=\"59271665\">opening statements<\/span>. That is, they cannot make any inferences suggesting that the other side is at fault or defending their client. Attorneys can\u2019t produce evidence later in the trial unless they bring it up first in their <span data-term-id=\"59271665\">opening statements<\/span>.<\/p>\n<p>When a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-cases-the-basics.html\"><span data-term-id=\"59271688\">civil lawsuit<\/span><\/a> has multiple parties, such as three <span data-term-id=\"59271661\">plaintiffs<\/span> or one defendant later joins another defendant, each party may have their own <span data-term-id=\"59271665\">opening statement<\/span>, or one attorney may give a single statement for all of them.<\/p>\n<h2><span data-term-id=\"59271678\"><a id=\"witnesses\"><\/a>Witness Testimony<\/span> and <span data-term-id=\"59271666\">Cross-Examination<\/span><\/h2>\n<p>Following the <span data-term-id=\"59271665\">opening statements<\/span>, the <span data-term-id=\"59271661\">plaintiff<\/span> presents their case, called the \u201ccase-in-chief.\u201d The <span data-term-id=\"59271661\">plaintiff<\/span> must show the jury that the defendant is <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/liability-and-insurance\/liability-definition.html\">liable <\/a>for the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s damages.<\/p>\n<p>The <span data-term-id=\"59271661\">plaintiff<\/span> may call witnesses and experts to testify. The <span data-term-id=\"59271661\">plaintiff<\/span> may also introduce physical evidence, such as photographs, documents, and medical reports. Expert testimony and documentary evidence are crucial in proving the defendant\u2019s legal liability in complicated <span data-term-id=\"59271688\">civil lawsuits<\/span> such as <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination.html\"><span data-term-id=\"59271685\">employment discrimination<\/span><\/a> and <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/what-is-product-liability.html\">product liability claims<\/a>.<\/p>\n<p><span data-term-id=\"59271678\">Witness testimony<\/span> follows a standard format:<\/p>\n<ul>\n<li>The clerk swears in the witness.<\/li>\n<li>The party who called the witness <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/do-s-and-don-ts-being-a-witness.html\">questions the witness<\/a> through <span data-term-id=\"59271677\">direct examination<\/span>. <span data-term-id=\"59271677\">Direct examination<\/span> asks questions about what the witness knows about the case.<\/li>\n<li>After <span data-term-id=\"59271677\">direct examination<\/span>, the opposing party has \u201c<span data-term-id=\"59271666\">cross-examination<\/span>.\u201d The attorney casts doubt on the witness\u2019s credibility, pokes holes in their story, and attempts to invalidate their testimony.<\/li>\n<li>If necessary, the first attorney can question the witness again through \u201c<span data-term-id=\"59271703\">re-<\/span><span data-term-id=\"59271677\">direct examination<\/span>.\u201d This helps rehabilitate the witness and undo any damage done by <span data-term-id=\"59271666\">cross-examination<\/span>.<\/li>\n<\/ul>\n<p>The defense has a turn to call its own witnesses and direct, cross, and re-direct with the defense witnesses.<\/p>\n<h2><span data-term-id=\"59271699\"><a id=\"evidence\"><\/a>Trial Procedures<\/span> for Physical Evidence<\/h2>\n<p>Physical and documentary evidence in a <span data-term-id=\"59271663\">civil trial<\/span> can include:<\/p>\n<ul>\n<li>Photographs<\/li>\n<li>Videos<\/li>\n<li>Reports<\/li>\n<li>Medical imagery or records<\/li>\n<li>Appraisals or assessments<\/li>\n<li>Financial records<\/li>\n<li>Communications, such as emails or text messages<\/li>\n<\/ul>\n<p>The <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/evidence-law.html\"><span data-term-id=\"59271683\">rules of evidence<\/span><\/a> differ slightly in each state, but all states lay out how attorneys must present this to the jury. In most states, a documentary custodian must explain how they record and store information. The person who took photos and videos must be present to authenticate the images.<\/p>\n<p>The defense may present its own physical evidence. It can also try to invalidate the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s evidence by challenging the authenticity or \u201cchain of evidence.\u201d After the defense case, the <span data-term-id=\"59271661\">plaintiff<\/span> may have a \u201c<span data-term-id=\"59271691\">rebuttal<\/span>.\u201d This is an opportunity to counter the defense evidence.<\/p>\n<p>When the parties have presented their cases, they \u201crest,\u201d meaning there is no more evidence to show. Once the parties have rested, they can\u2019t present new evidence or call new witnesses.<\/p>\n<h2><span data-term-id=\"59271668\"><a id=\"closing\"><\/a>Closing Arguments<\/span><\/h2>\n<p><span data-term-id=\"59271668\">Closing arguments<\/span> are the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s and defendant\u2019s chance to summarize the case. The <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s attorney will recap the case and remind the jury of the key evidence. The defense will focus on any holes in the <span data-term-id=\"59271661\">plaintiff<\/span>\u2019s case or how the <span data-term-id=\"59271661\">plaintiff<\/span> contributed to the accident.<\/p>\n<h2><span data-term-id=\"59271679\"><a id=\"instruction\"><\/a>Jury Instruction<\/span><\/h2>\n<p>The final step is <span data-term-id=\"59271679\">jury instruction<\/span>. The <span data-term-id=\"59271659\">judge<\/span> tells the jury the <span data-term-id=\"59271683\">rules of evidence<\/span> and the <span data-term-id=\"59271676\">burden of proof<\/span> in a <span data-term-id=\"59271662\">civil case<\/span>.<\/p>\n<p>In a <span data-term-id=\"59271662\">civil case<\/span>, the <span data-term-id=\"59271661\">plaintiff<\/span> has the <span data-term-id=\"59271676\">burden of proof<\/span>. The <span data-term-id=\"59271661\">plaintiff<\/span> must show with a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/standards-of-proof-in-civil-cases-preponderance-of-evidence-and-clear-and-convincing-evidence.html\"><span data-term-id=\"59271670\">preponderance of the evidence<\/span><\/a> that the defendant is liable for their harm. A preponderance of evidence means that \u201cit is more likely than not,\u201d or about 51%. This standard in <span data-term-id=\"59271662\">civil cases<\/span> differs from <span data-term-id=\"59271669\">criminal trials<\/span>, which require proof <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-the-burden-of-proof-in-a-criminal-case.html\"><span data-term-id=\"59271664\">beyond a reasonable doubt<\/span><\/a> that the defendant committed the alleged crime.<\/p>\n<p><span data-term-id=\"59271659\">Judges<\/span> write <span data-term-id=\"59271679\">jury instructions<\/span> with input from both <span data-term-id=\"59271661\">plaintiff<\/span> and defense and standard <span data-term-id=\"59271679\">jury instructions<\/span> from the <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/state-bar-associations.html\">state bar<\/a>. Standard instructions contain basic rules the jury must know, such as definitions of legal terms and damages.<\/p>\n<p>The case then goes to the jury.<\/p>\n<h2><span data-term-id=\"59271672\"><a id=\"verdict\"><\/a>Jury Deliberation<\/span> and <span data-term-id=\"59271660\">Verdict<\/span><\/h2>\n<p><span data-term-id=\"59271679\">Jury instructions<\/span>\u00a0include a warning to base their deliberations only on the facts in the case. Jurors must consider what the witnesses said, the photos and videos they saw, and the documents shown.<\/p>\n<p>The jury must usually determine:<\/p>\n<ul>\n<li>The degree of <a href=\"https:\/\/dictionary.findlaw.com\/definition\/fault.html\" target=\"_blank\" rel=\"noopener\">fault<\/a><\/li>\n<li>Whether the facts in the case meet the <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries.html\">tort or claim<\/a> specified<\/li>\n<li>Whether the amount of financial compensation requested is appropriate<\/li>\n<\/ul>\n<p>About 30 states allow a <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/must-all-jury-verdicts-be-unanimous.html\">majority <span data-term-id=\"59271660\">verdict<\/span><\/a> in a <span data-term-id=\"59271662\">civil case<\/span>. Unlike a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-the-role-of-a-jury-in-a-criminal-case.html\"><span data-term-id=\"59271669\">criminal trial<\/span><\/a>, which must be unanimous, a <span data-term-id=\"59271663\">civil trial<\/span> can have a 9-3 or 10-2 <span data-term-id=\"59271660\">verdict<\/span>. The <span data-term-id=\"59271659\">judge<\/span> declares a <span data-term-id=\"59271682\">mistrial<\/span> if a jury can\u2019t reach a <span data-term-id=\"59271660\">verdict<\/span>. If the <span data-term-id=\"59271661\">plaintiff<\/span> wants a new trial, they must refile the entire case.<\/p>\n<h2>Post-<span data-term-id=\"59271660\">Verdict<\/span> and Appeal<\/h2>\n<p>A jury <span data-term-id=\"59271660\">verdict<\/span> is not the only way a trial can end. Various <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-motion.html\">motions <\/a>could interrupt the typical process, sometimes even <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/resolution-before-trial-court-motions.html\">before the trial begins<\/a>.<\/p>\n<p>After the <span data-term-id=\"59271661\">plaintiff<\/span> presents their case, the defense may move for a \u201cdirected <span data-term-id=\"59271660\">verdict<\/span>\u201d or judgment as a matter of law (JMOL). This motion states that the <span data-term-id=\"59271661\">plaintiff<\/span> has not proved their case, and the <span data-term-id=\"59271659\">judge<\/span> should rule in favor of the defendant. A directed <span data-term-id=\"59271660\">verdict<\/span> is difficult to get.<\/p>\n<p>Once the jury has reached a <span data-term-id=\"59271660\">verdict<\/span>, either attorney can request a \u201cjudgment notwithstanding the <span data-term-id=\"59271660\">verdict<\/span>\u201d (JNOV). A <span data-term-id=\"59271659\">judge<\/span> may issue a JNOV if the <span data-term-id=\"59271659\">judge<\/span> believes that the jury should not have reached the <span data-term-id=\"59271660\">verdict<\/span> or if one attorney requests it.<\/p>\n<p>If the <span data-term-id=\"59271659\">judge<\/span> affirms the jury\u2019s <span data-term-id=\"59271660\">verdict<\/span>, the losing party can still appeal. A <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/litigation-and-appeals.html\">civil appeal<\/a> does not retry the case. Instead, an <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\">appellate court<\/a> reviews the <span data-term-id=\"59271674\">pleadings<\/span>, evidence, and trial transcript.
