You&nbsp;can&#8217;t gift someone money and one day decide you want it back. You also can&#8217;t loan someone money but never tell them you expect to be paid back.<\/p>\r\n<p>In the legal sense, owing money must include:<\/p>\r\n<ul>\r\n<li>Clear expectations this is a loan<\/li>\r\n<li>Both sides understand there is a legal duty to pay the money back<\/li>\r\n<li>A date when the payment, payment plan, or payment installment is payable<\/li>\r\n<li>The payment date has arrived or passed<\/li>\r\n<li>Some physical or digital record of the money owed or given<\/li>\r\n<\/ul>\r\n<p>It&#8217;s&nbsp;a good idea to&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/law_and_life\/2013\/12\/legal-how-to-collecting-money-owed-to-you.html\">create a contract<\/a>&nbsp;for money loaned, money owed, or any personal property you lend. Depending on your circumstances and the type of case, you may be able to have legal aid provided without having to pay an attorney fee.<\/p>\r\n<h2>Step 1: Filing Your Complaint and Paying Filing Fees<\/h2>\r\n<p>First, check the thresholds for the amount of money you are requesting and the correct court to file in. If the amount is too small or too large, you won&#8217;t be able to file in small claims court.<\/p>\r\n<p><a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/how-do-i-file-a-small-claims-court-lawsuit.html\">File a complaint<\/a>&nbsp;with your county clerk&#8217;s office and pay attention to the forms and documentation the case requires. You will need to pay some court clerk costs,&nbsp;typically under $100,&nbsp;to&nbsp;<a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/how-do-i-file-a-small-claims-court-lawsuit.html\">file the paperwork<\/a>.<\/p>\r\n<h2>Step 2: Serving the Lawsuit and Court Dates<\/h2>\r\n<p>The fee you pay may go toward a court official&nbsp;<a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/starting-a-lawsuit-initial-court-papers.html\">serving<\/a>&nbsp;the case. You may have options to collect the money when their case is decided. The bankruptcy judge may also rule that they must pay you back.<\/p>\r\n<h2>Step 3: Attend Court Hearing<\/h2>\r\n<p>Be on time for your court date. You can expect the&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/business-operations\/your-guide-to-the-small-claims-process.html\" target=\"_blank\" rel=\"noopener\">court hearing<\/a>&nbsp;to be quick, often&nbsp;around 15 minutes in total. If you are nervous about what goes on during a hearing, you can sit in on small claims court cases in advance.<\/p>\r\n<p>You will need to show&nbsp;documents that&nbsp;provide evidence that the other person owes you money&nbsp;and has ignored or refused to pay you. Answer all questions and be polite.<\/p>\r\n<h2>Step 4: Final Ruling and Collecting Debt<\/h2>\r\n<p>If the other person doesn&#8217;t show up to court, there will be a&nbsp;default judgment&nbsp;in your favor. The judge can rule that the person must pay.
