We&#8217;ll also review key\u00a0<a href=\"https:\/\/supreme.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a>\u00a0cases that have helped clarify its limits.<\/p>\n<h2>What Is the Presidential Pardon Power?<\/h2>\n<p>The pardon\u00a0is\u00a0a special power granted to the sitting U.S. president by the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">U.S. Constitution<\/a>. The pardon clause in its Executive Powers section. Article II, Section 2 of the U.S. Constitution, states:<\/p>\n<p><em data-redactor-tag=\"em\" data-verified=\"redactor\">&#8220;[The President] shall have Power to Grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.&#8221;<\/em><\/p>\n<p>As a practical matter, this means the president has the power to forgive people of\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/crimes-against-the-government.html\">federal crimes<\/a>. This forgiveness is a form of clemency that removes the legal consequences of the criminal offense(s). These can include statutory disabilities, which are legal restrictions\/disqualifications automatically imposed by law as a result of a criminal conviction.<\/p>\n<p>A presidential pardon can end someone&#8217;s punishment, stop or\u00a0prevent their criminal prosecution, and restore their\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-are-civil-rights.html\">civil rights<\/a>.<\/p>\n<h2>What\u00a0Doesn&#8217;t\u00a0a Presidential Pardon Do?<\/h2>\n<p>Presidential pardons can&#8217;t\u00a0impact state criminal matters. Each state has its own clemency system for state crimes.<\/p>\n<p>As the constitutional language suggests, a presidential pardon also cannot stop or reverse an impeachment. The Constitution gives the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article1\/annotation06.html\" target=\"_blank\" rel=\"noopener\">power to impeach<\/a>\u00a0and remove federal officials to Congress. While the president&#8217;s pardon power is broad, it may not interfere with Congress&#8217; impeachment powers.<\/p>\n<p>Likewise, Congress may not interfere with the president&#8217;s pardon power. The Supreme Court established this in 1871.<\/p>\n<h2><em data-redactor-tag=\"em\" data-verified=\"redactor\">United States vs. Klein\u00a0<\/em>(1871)<\/h2>\n<p><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/80\/128.html\" target=\"_blank\" rel=\"noopener\"><i>United States v. Klein<\/i><\/a>\u00a0centered on a group of pardoned people seeking to reclaim property. Without the pardons, their property would have been subject to forfeiture. Congress had\u00a0passed a law blocking those receiving pardons\u00a0from reclaiming their\u00a0property.<\/p>\n<p>The Supreme Court determined this infringed on the president&#8217;s pardon power because it limited the legal effect of the pardons. As such, it was an unconstitutional violation of the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article1\/annotation01.html\" target=\"_blank\" rel=\"noopener\">separation of powers<\/a>.<\/p>\n<p>The High Court struck down the law. It explained that Congress may not interfere with or limit the president&#8217;s pardon power, which exclusively belongs to the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article2.html\" target=\"_blank\" rel=\"noopener\">executive branch<\/a>.<\/p>\n<h2>Why Do Presidents Have This Pardon Power?<\/h2>\n<p>Rooted in English royal law, the Framers included the pardon power in the Constitution to ensure justice and flexibility in the legal system.\u00a0<a href=\"https:\/\/supreme.findlaw.com\/documents\/fathers\/newyork.html#hamilton\" target=\"_blank\" rel=\"noopener\">Alexander Hamilton<\/a>, for one, vigorously defended the president&#8217;s need to be able to pardon people freely and quickly. He and the other Framers felt the power was essential to:<\/p>\n<ul>\n<li>Show mercy<\/li>\n<li>Fix unfair punishments<\/li>\n<li>Help keep the country united during times of trouble<\/li>\n<\/ul>\n<p>The Framers\u00a0trusted the president, as an elected official, to use this important power responsibly for the nation&#8217;s well-being.<\/p>\n<h2>Can the President Only Pardon Convictions?<\/h2>\n<p>While most pardons are granted after a guilty finding, a conviction isn&#8217;t required. The president can preemptively pardon people before they&#8217;re convicted of, or even charged with, a crime.<\/p>\n<p>There are limitations. The\u00a0offense must have already occurred, which\u00a0means someone cannot be pardoned for future acts. They can be pardoned for\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/view-all-criminal-charges.html\">future charges<\/a>, convictions, and other legal consequences related to past acts.<\/p>\n<p>The Supreme Court affirmed this in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/71\/333.html\" target=\"_blank\" rel=\"noopener\"><em data-redactor-tag=\"em\" data-verified=\"redactor\">Ex Parte Garland<\/em><\/a>\u00a0(1866).<\/p>\n<h2><em data-redactor-tag=\"em\" data-verified=\"redactor\">Ex Parte Garland\u00a0<\/em>(1866)<\/h2>\n<p>President Andrew Johnson pardoned lawyer Augustus Hill Garland for his service to the Confederacy during the Civil War. Garland hadn&#8217;t yet been charged with a crime, but\u00a0Congress had\u00a0passed a law banning former Confederates from practicing law in\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/us-federal-court-system.html\">federal court<\/a>.<\/p>\n<p>The Court said the law unconstitutionally punished Garland for actions for which he had already been pardoned. It explained that a presidential pardon puts someone \u201cbeyond the reach of punishment&#8221; for the offenses pardoned.<\/p>\n<p>The Court also confirmed that the president can pardon someone before they&#8217;re charged, tried, or convicted.<\/p>\n<h2>Does a Pardon Have To Specify Specific Crimes?<\/h2>\n<p>While most pardons\u00a0specify the offenses pardoned, they don&#8217;t have to. There are only two limitations on the president&#8217;s pardon power. It cannot apply to:<\/p>\n<ul>\n<li>State crimes<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/who-can-be-impeached.html\">Impeachment cases<\/a><\/li>\n<\/ul>\n<p>Other than that, a pardon just needs to address federal offenses already committed to be valid. It doesn&#8217;t take legal effect until or unless\u00a0it&#8217;s accepted.<\/p>\n<h2>Someone Can Refuse To Be Pardoned?<\/h2>\n<p>The Supreme Court determined in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/236\/79.html\" target=\"_blank\" rel=\"noopener\"><i>Burdick v. United States<\/i><\/a>\u00a0(1915) that a person can refuse a pardon and that acceptance is required for a pardon to be legally effective.<\/p>\n<p>The\u00a0<em data-redactor-tag=\"em\" data-verified=\"redactor\">Burdick\u00a0<\/em>case centered on a newspaper editor who wouldn&#8217;t testify in a case. He wanted to assert his\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment5\/annotation04.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment right to not incriminate himself<\/a>.\u00a0President Woodrow Wilson offered him a pardon. To accept a pardon, the recipient must admit guilt for what they&#8217;re being pardoned for.\u00a0Burdick didn&#8217;t want to admit guilt, and the Court ruled\u00a0had the right to reject the pardon and keep his Fifth Amendment protection.<\/p>\n<p>The Court explained that accepting a pardon means admitting guilt. Someone can choose not to accept it if they want to keep their right to stay silent or otherwise not admit guilt.\u00a0The\u00a0<em data-redactor-tag=\"em\" data-verified=\"redactor\">Burdick\u00a0<\/em>decision established the acceptance requirement for presidential pardons.<\/p>\n<h2>Are Presidential Commutations and Pardons the Same?<\/h2>\n<p>While both are types of presidential clemency, they are different.\u00a0A commutation\u00a0reduces or\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/sentencing-law-faq.html\">ends the sentence<\/a>\u00a0for someone already convicted of a crime.\u00a0Unlike pardons,\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/courtside\/explaining-the-recent-sentence-commutations-of-37-death-row-inmates\/\">presidential commutations<\/a>\u00a0don&#8217;t:<\/p>\n<ul>\n<li>Forgive the crime<\/li>\n<li>Require acceptance<\/li>\n<\/ul>\n<p>The Constitution&#8217;s pardon clause gives the president the power to grant both, as well as reprieves, for federal offenses.<\/p>\n<h2>What Are Reprieves?<\/h2>\n<p>A reprieve is another form of clemency.<\/p>\n<p>A presidential reprieve is a temporary delay in carrying out a federal sentence. It doesn&#8217;t cancel the punishment or change the conviction. Instead, it pauses the sentence to allow the person more time to appeal or\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-evidence.html\">present new evidence<\/a>. Presidents often\u00a0grant reprieves in death penalty cases to give the courts or lawyers more time.<\/p>\n<p>Like commutations, reprieves don&#8217;t require acceptance to take effect. The Supreme Court clarified this in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/274\/480.html\" target=\"_blank\" rel=\"noopener\"><i>Biddle v. Perovich<\/i><\/a>\u00a0(1927), where the Court ruled that the president can reduce or delay a sentence without the recipient&#8217;s agreement.<\/p>\n<h2>What Is a Conditional Pardon?<\/h2>\n<p>A conditional pardon by the president forgives someone&#8217;s federal crime if they satisfy additional requirements. In simple terms, it&#8217;s a pardon with strings attached.<\/p>\n<p>In\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/419\/256.html\" target=\"_blank\" rel=\"noopener\"><em data-redactor-tag=\"em\" data-verified=\"redactor\">Schick v. Reed<\/em><\/a>\u00a0(1974), the Supreme Court confirmed that presidents can attach any reasonable conditions to pardons, even if those conditions wouldn&#8217;t normally be allowed under regular sentencing laws.<\/p>\n<p>The ruling affirmed that the presidential pardon power is very broad and flexible, allowing creative solutions that balance mercy with other concerns.<\/p>\n<h2>Does a\u00a0Pardon Remove an Offense From Someone&#8217;s Criminal Record?<\/h2>\n<p>A pardon doesn&#8217;t erase a conviction from a person&#8217;s criminal record. It removes the related legal consequences such as prison time, but the conviction remains.<\/p>\n<p>Convictions\u00a0will still appear on a\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-shows-up-in-a-gun-background-check\/\">background check<\/a>, but it will show that a pardon was granted. Someone who&#8217;s pardoned is required to\u00a0disclose the conviction on applications that ask about criminal history.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/expungement\/expungement-eligibility.html\">An expungement<\/a>\u00a0can remove a criminal conviction from the public record. This is an entirely separate legal process and does not fall under a presidential pardon. A\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">criminal defense attorney<\/a>\u00a0licensed in your state can help you understand your\u00a0eligibility for expungement.<\/p>\n<h2>How Does Someone Request Presidential Clemency?<\/h2>\n<p>The standard process is for\u00a0requesting a presidential pardon, commutation, or reprieve is fairly uniform.\u00a0Someone seeking one or more of these forms of clemency submits a petition to the\u00a0<a href=\"https:\/\/www.justice.gov\/pardon\" target=\"_blank\" rel=\"noopener\">Office of the Pardon Attorney<\/a>\u00a0in the U.S. Department of Justice (DOJ). The U.S. Attorney General oversees this office and the process.<\/p>\n<p>After reviewing a petition, the office makes a non-binding recommendation to the president.\u00a0A president has broad discretion and may grant clemency to someone, whether they&#8217;ve followed this process or not.<\/p>\n<h2>Are There Any Legal Safeguards To Prevent Abuse of This Power?<\/h2>\n<p>Not really. This is a broad and largely unchecked power.<\/p>\n<p>The Constitution gives the president pardon power with almost no restrictions. While Congress and the judiciary generally serve as important checks on executive branch actions, pardons are different.\u00a0Courts cannot overturn pardons, and Congress cannot stop them.<\/p>\n<p>The only potentially effective safeguards are political, not legal. For example, Congress could\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/presidential-impeachment-the-legal-standard-and-procedure.html\">impeach a president <\/a>for seriously abusing pardons. Likewise, voters can choose not to re-elect them.<\/p>\n<h2>Can a President Pardon Themselves?<\/h2>\n<p>The answer to this question remains unresolved, and legal experts are divided on the issue.\u00a0Some point to the fact that no constitutional provision prohibits it. According to a 1974\u00a0<a href=\"https:\/\/www.justice.gov\/file\/147746\/dl?inline\" target=\"_blank\" rel=\"noopener\">opinion from the DOJ&#8217;s Office of Legal Counsel<\/a>, self-pardons contradict the principle that \u201cno one may be a judge in his own case.&#8221;<\/p>\n<p>As of 2025, no\u00a0president has tried to pardon themselves.\u00a0The Supreme Court hasn&#8217;t ruled on the potential legality.<\/p>\n<h2>Examples of Controversial Pardons<\/h2>\n<p>There&#8217;s been no shortage of controversy surrounding the pardons presidents have pursued. These include:<\/p>\n<ul>\n<li><strong data-redactor-tag=\"strong\">Richard Nixon (1974)<\/strong>: President Gerald Ford&#8217;s pardon of Richard Nixon for any and all federal crimes he may have committed during his presidency sparked national outrage and accusations of a political deal<\/li>\n<li><strong data-redactor-tag=\"strong\">Vietnam draft evaders (1977)<\/strong>: President Jimmy Carter&#8217;s blanket pardon of hundreds of thousands who avoided the draft during the Vietnam War pleased peace advocates, but angered\u00a0veterans\u00a0and those who served<\/li>\n<li><strong data-redactor-tag=\"strong\">Marc Rich (2001)<\/strong>: President Bill Clinton&#8217;s pardon of the fugitive financier drew criticism due to Rich&#8217;s ties to Clinton allies and donations to Hilary Clinton&#8217;s Senate campaign<\/li>\n<li><strong data-redactor-tag=\"strong\">Joe Arpaio (2017)<\/strong>: President Donald\u00a0Trump&#8217;s pardon of the Arizona sheriff convicted of\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/criminal-contempt-of-court.html\">contempt of court<\/a>\u00a0and accused of torturing prisoners\u00a0was seen as undermining judicial authority<\/li>\n<li><strong data-redactor-tag=\"strong\">Dinesh D&#8217;Souza (2018)<\/strong>: President Trump&#8217;s pardon of the conservative commentator convicted in New York of\u00a0<a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work\/u-s-campaign-finance-laws.html\">campaign finance<\/a>\u00a0violations drew criticism for political favoritism<\/li>\n<li><strong data-redactor-tag=\"strong\">Michael Flynn (2020)<\/strong>: President Trump&#8217;s pardon of his former National Security Advisor for lying to special counsel about Russian contacts raised concerns about obstruction of an FBI investigation<\/li>\n<li><strong data-redactor-tag=\"strong\">Paul Manafort (2020)<\/strong>: Trump&#8217;s pardon of his former campaign chairman, convicted of\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud-financial-crimes.html\">financial crimes<\/a>, was condemned by some for allegedly shielding himself from investigation<\/li>\n<\/ul>\n<p>None of these pardons were granted through the standard petition process. Rather, they resulted from direct presidential action. More structure exists\u00a0in the states&#8217; processes for clemency.<\/p>\n<h2>Legal Relief and Guidance<\/h2>\n<p>Each state has its own pardon system for state crimes. Some states grant pardons regularly, while others do so more infrequently.
