While the end product can often be even better than what you envisioned, construction projects are notorious for their delays, unexpected obstacles, and even defects in the final product. From poor workmanship to building code violations, construction projects can be rife with problems. If you&#8217;ve run into issues with your new construction project, it&#8217;s important to become familiar with the&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/construction-defects\/construction-defects-basics.html\">construction defect laws<\/a>&nbsp;that apply to your particular situation.<\/p>\r\n<h2><b>Time Limits in Construction Defect Law<\/b><\/h2>\r\n<p>State laws govern the process of resolving disputes between property owners and the professionals responsible for the work, including:<\/p>\r\n<ul>\r\n<li>Architects<\/li>\r\n<li>Design professionals<\/li>\r\n<li>General contractors<\/li>\r\n<li>Subcontractors<\/li>\r\n<\/ul>\r\n<p>Plaintiffs\u2019 claims against these individuals can be based on many&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/construction-defects\/legal-liability-for-construction-defects.html\">different types of liability theories<\/a>. These include <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/what-is-strict-liability-how-does-it-affect-injury-lawsuits\/\">strict liability<\/a>,<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/breach-of-contract-and-lawsuits.html\"> breach of contract<\/a>, <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries.html\">tort claims<\/a>, and <a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/consumer-warranty-basics.html\">breach of warranty<\/a>. The type of construction defect case you bring will often determine the amount of time you have to file a lawsuit. This is a deadline known as the <a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/time-limits-to-bring-a-case-the-statute-of-limitations.html\">statute of limitations<\/a>. A typical statute of limitations says that you have a certain number of years to file a lawsuit after you discover, or should have discovered, the defect.<\/p>\r\n<p>There are further limits on how long construction professionals can be held liable for defects. States also have outer limits that prevent you from filing a lawsuit after a certain number of years, even if you haven&#8217;t discovered the defect yet. This is called the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/statute-of-repose.html\" target=\"_blank\" rel=\"noopener\">statute of repose<\/a>. For example, the statute of limitations might give you four years to file a claim after you discover the defect. But if your state&#8217;s statute of repose is seven years from the time the construction is completed, and you don&#8217;t discover the defect until the fifth year, you only have two years to file your claim.<\/p>\r\n<h2><b>Construction Law and the &#8216;Right to Cure&#8217;<\/b><\/h2>\r\n<p>In addition to the often-confusing time limits that apply in construction defect law, some states also have &#8216;right to cure&#8217; statutes. These laws say that before filing a lawsuit (pre-litigation), a project owner must first notify the construction professional of the&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/construction-defects\/types-of-construction-defects.html\">alleged defects<\/a>. This will allow them the opportunity to repair the defect or pay you for the reasonable cost of repair. This process varies from state to state. One of the key differences is the amount of time you have to wait after notifying the professional (notice of claim) before you can&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/construction-defects\/construction-defect-claims-overview.html\">proceed with construction defect litigation<\/a>.<\/p>\r\n<p>The table below lists the key statutes of limitations, statutes of repose, and right-to-cure laws for each of the states.
