This article shares four steps landlords can take to confirm whether they can legally break a tenant&#8217;s lease for cause.<\/p>\n<hr \/>\n<p>An eviction gone wrong can expose you to financial risk and legal liability. It can also harm your business&#8217; reputation. You can&#8217;t evict them for just any reason. Although landlord-tenant law varies by state, there are generally three reasons for which a landlord may terminate a lease:<\/p>\n<ul>\n<li>The tenant doesn&#8217;t pay monthly rent and has no good reason for withholding it (such as a <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-is-the-implied-warranty-of-habitability.html\">warranty of habitability<\/a>\u00a0claim).<\/li>\n<li>The tenant violates a\u00a0material provision in the rental agreement, such as <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-is-the-difference-between-subleasing-and-reletting.html\">subleasing the rental property<\/a> to a new tenant without getting your permission.<\/li>\n<li>The tenant violates some duty imposed by tenancy laws. In general, the tenant must not destroy the apartment. They must refrain from performing any illegal activities. They must not interfere with other tenants&#8217; quiet enjoyment of the premises.<\/li>\n<\/ul>\n<p>The rental agreement may specifically outline scenarios for terminating the lease. A termination clause may address misuse of the property. The term of the lease also ends after a period of time, culminating in a natural termination date.<\/p>\n<p>When a set amount of time (fixed term) in an original lease is complete, <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-is-the-difference-between-a-month-by-month-lease-and-a-fixed.html\">the rental may convert to a month-to-month lease<\/a>.<\/p>\n<h2>2. Rule Out Illegal Excuses to Evict<\/h2>\n<p>If you have personal problems with your tenants, you may need to put them aside. If you&#8217;re annoyed because your renter is disrespectful or messy, you can&#8217;t use that as an excuse to evict them. You also may not send eviction notices to tenants who make too many <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/is-my-landlord-responsible-for-repairs.html\">repair requests<\/a>.<\/p>\n<p>For as long as the term of the lease is in effect, you can&#8217;t break it if your tenant has done nothing wrong. For example, if you intend to move back into the property or remodel it, you must wait until the lease term ends. You can&#8217;t break a one-year lease six months into the term just because you own the property.<\/p>\n<p>On the other hand,\u00a0<span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">you may be able to <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/terminating-a-lease-or-rental-agreement-faqs.html\" target=\"_blank\" rel=\"noopener\">terminate a month-to-month lease<\/a>\u00a0with proper advance\u00a0<\/span>notice and good cause.<\/p>\n<p>In general, the eviction process or early terminations will not apply when:<\/p>\n<ul>\n<li>A renter exercises their\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenant-rights.html\">tenants&#8217; rights under the law.<\/a><\/li>\n<li>A tenant exercises their rights\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/rental-lease-agreements.html\">under the lease agreement.<\/a><\/li>\n<li>The tenant needs special exceptions afforded to seniors, disabled individuals, and those engaged in military service.<\/li>\n<\/ul>\n<p>Some states may also prohibit eviction when a landlord has unclean hands. Sometimes, all it takes is a mature personal conversation with your tenant.<\/p>\n<h3>Issuing Your Tenant a Warning<\/h3>\n<p>Most state laws require property owners <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/what-does-the-landlord-need-to-do-to-evict-the-tenant.html\">to notify tenants<\/a> that they might get evicted if their behavior doesn&#8217;t change. These written notices are called &#8220;Cure or Quit&#8221; or &#8220;Pay Rent or Quit.&#8221; They give the tenant a chance to fix the problem. If the tenant doesn&#8217;t cure within a certain time frame, the landlord can begin eviction proceedings.<\/p>\n<p>The other type of notice a landlord can give is called a &#8220;Vacate or Quit&#8221; notice. This notice simply warns the tenant that the landlord will <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/how-long-does-the-eviction-process-take.html\">begin eviction proceedings<\/a> if the tenant doesn&#8217;t move out on their own.<\/p>\n<p>Some states have requirements regarding the format or delivery method of these notices. For example, some states might require the notice to be affixed to the tenant&#8217;s door. Others may require that the notice be sent by certified mail.<\/p>\n<p>Check your state&#8217;s laws to ensure you&#8217;re giving proper notice. Some states offer templates for 30-day notices to allow a landlord to terminate a month-to-month tenancy. Notice periods and ways to serve a notice of termination vary, so make sure you have the right paperwork. This depends on whether you were allowed to make deductions for damage or unpaid rent related to the rental property.
