In 1992, Congress passed the\u00a0<a href=\"https:\/\/www.epa.gov\/lead\/residential-lead-based-paint-hazard-reduction-act-1992-title-x\" target=\"_blank\" rel=\"noopener\">Residential Lead-Based Hazard Reduction Act<\/a>\u00a0(&#8220;Act&#8221;), or Title X. This Act aimed to protect everyone from exposure to lead in paint, dust, and soil through disclosure in real estate transactions.<\/p>\n<p>The Act applies to buildings constructed before 1978. The EPA and HUD manage and enforce the Act.<\/p>\n<p>Under this Act, landlords and property management must do the following:<\/p>\n<ul>\n<li>Disclose any known information about the existence of lead-based paint or lead-based paint hazards, including the location of such paint or hazards<\/li>\n<li>Give the tenant a copy of an\u00a0<a href=\"https:\/\/www.epa.gov\/sites\/default\/files\/2020-04\/documents\/lead-in-your-home-portrait-bw-2020-508.pdf\" target=\"_blank\" rel=\"noopener\">EPA-approved pamphlet<\/a>\u00a0on how to assess and manage lead-based paint hazards<\/li>\n<li>Confirmation that the property manager complied with notification requirements. The property manager can give you access to records or include language in the lease or rental agreement.<\/li>\n<\/ul>\n<h2><a id=\"Fulfill\"><\/a>How Do Landlords Fulfill Disclosure Requirements?<\/h2>\n<p>Landlords can fulfill disclosure requirements in several ways. One is through the lease agreement. Landlords can include disclosure language for a prospective tenant to confirm in the lease agreement. In some states, like <a href=\"http:\/\/www.mainelegislature.org\/legis\/statutes\/14\/title14sec6030-D.html\" target=\"_blank\" rel=\"noopener\">Maine<\/a>, landlords use a disclosure form prepared by a local agency to make disclosure.<\/p>\n<hr \/>\n<p>Landlords who<span data-subtree=\"aimfl,mfl\" data-copy-service-computed-style=\"font-family: &quot;Google Sans&quot;, Roboto, Arial, sans-serif, &quot;Noto Color Emoji&quot;; font-size: 16px; font-weight: 400; margin: 0px; text-decoration: none solid rgb(10, 10, 10); border-bottom: 0px none rgb(10, 10, 10);\"> fail to provide proper lead-based paint disclosures for required residential properties can face serious civil and financial penalties. <a href=\"https:\/\/lawyers.findlaw.com\/landlord-tenant\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">Find local legal help<\/a>.<\/span><\/p>\n<hr \/>\n<h2><a id=\"Rental\"><\/a>Does the Act Cover All Types of Rental Properties?<\/h2>\n<p>The Act does not cover all types of rental properties. Several types of rental properties are not covered by the Act. These include:<\/p>\n<ul>\n<li>Lofts, efficiencies, studio apartments, and other residential leased properties that contain zero bedrooms<\/li>\n<li>Housing constructed after 1978<\/li>\n<li>Single rooms rented in a larger residential building<\/li>\n<li>Short-term rentals of 100 days or less<\/li>\n<li>Any housing certified as lead-free by a certified lead inspector<\/li>\n<li>Any housing designed for elderly persons (at least one tenant is 62 years of age or older)<\/li>\n<li>Housing for people with disabilities<\/li>\n<\/ul>\n<h2><a id=\"Renovations\"><\/a>Do Disclosure Requirements Apply to Renovations?<\/h2>\n<p>Yes, they do. To protect tenants of any rental property, a landlord must provide notice whenever they renovate. This is true for an occupied rental unit or common area in a rental property building constructed before 1978.<\/p>\n<p>Under EPA regulations, the landlord must provide at least 60 days&#8217; notice to affected tenants. This includes tenants occupying the rental property and all tenants affected by common area renovations. This rule applies to renovation projects that are likely to <a href=\"https:\/\/www.findlaw.com\/injury\/product-liability\/lead-faq.html\">disturb painted surfaces<\/a>.<\/p>\n<p>If the landlord wants to renovate an occupied rental unit, they must provide the tenant with a copy of the EPA pamphlet mentioned above. If the landlord is <a href=\"https:\/\/www.findlaw.com\/realestate\/construction-defects\/construction-law-overview.html\">renovating the common area of a rental property<\/a>, the contractor must distribute a notice to every rental unit that describes the following:<\/p>\n<ul>\n<li>The work they are undertaking<\/li>\n<li>The location of the work<\/li>\n<li>The dates that the work is to begin and end<\/li>\n<\/ul>\n<h2><a id=\"Other\"><\/a>Other Types of Disclosures<\/h2>\n<p>Lead-based paint is not the only hazard landlords must disclose.
