This includes the following:<\/p>\r\n<ul>\r\n<li>Directing downspouts towards your property line<\/li>\r\n<li>Installing a drainage system that sends water to your property<\/li>\r\n<li>Grading their yard to push water towards your yard<\/li>\r\n<\/ul>\r\n<p>The important factor to look at here is whether your neighbor made unreasonable or unnatural changes in their property that increased the water flow into yours.<\/p>\r\n<p>With this, it is important to know the difference between natural and artificial water flow.<\/p>\r\n<ul>\r\n<li>Natural water flow is often caused by the property&#8217;s topography, climate, and natural conditions of the land.<\/li>\r\n<li>Artificial water flow, on the other hand, is a man-made alteration, such as grading or installing drainage systems or gutters.<\/li>\r\n<\/ul>\r\n<p>Property owners are usually not liable for the naturally flowing water onto neighbors&#8217; properties. Man-made alterations are also often acceptable. However, if it causes unreasonable or excessive water flow onto your land, you may have a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/cause-of-action.html\" title=\"cause of action\" target=\"_blank\" rel=\"noopener\">cause of action<\/a> for damages.<\/p>\r\n<h2>Who Is Responsible for Water Runoff?<\/h2>\r\n<p>The answer depends on your local state law. States take three main approaches to handling this legal issue.<\/p>\r\n<h3>Reasonable Use Rule<\/h3>\r\n<p>Most states follow the&nbsp;<a href=\"https:\/\/www.findlaw.com\/injury\/accident-injury-law\/standards-of-care-and-the-reasonable-person.html\">reasonableness approach<\/a>. In order to succeed in a lawsuit against a neighbor, you&#8217;d need proof that:<\/p>\r\n<ul>\r\n<li>Your neighbor altered their land or property<\/li>\r\n<li>The alteration was unreasonable, changing the natural flow of water onto your property<\/li>\r\n<\/ul>\r\n<p>Manmade alterations create stronger legal obligations under the &quot;reasonable use&quot; doctrine. The courts may also consider other factors such as:<\/p>\r\n<ul>\r\n<li>The necessity of the alteration<\/li>\r\n<li>The extent of the harm or property damage caused<\/li>\r\n<li>Whether there are less harmful alternatives available<\/li>\r\n<li>Whether the neighbor installed the artificial water flow negligently<\/li>\r\n<\/ul>\r\n<p>The North Carolina Supreme Court&#8217;s decision in <a href=\"https:\/\/archives.law.nccu.edu\/cgi\/viewcontent.cgi?article=1356&amp;context=ncclr\" target=\"_blank\" rel=\"noopener\"><i>Pendergrast v. Aiken<\/i><\/a> provides a good example of how courts approach water drainage issues.<\/p>\r\n<p>The court allowed property owners to make reasonable use of their land even if it would alter the surface water and cause some damage to others. However, this does not give them unlimited rights in draining water onto their neighboring properties.<\/p>\r\n<p>A cause of action may arise if:<\/p>\r\n<ul>\r\n<li>The water flow caused substantial damage, and<\/li>\r\n<li>The diversion of the water is either reckless, intentional, negligent, or a result of abnormally dangerous activity.<\/li>\r\n<\/ul>\r\n<h3>Common Enemy Rule<\/h3>\r\n<p>Derived from English common law, this rule expects landowners to protect their property from surface and runoff water. Rainwater and other natural sources of water were considered a common enemy to all landowners. So, landowners can take whatever steps they wish, such as building dikes or water drainage ditches. If surface water runs from&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors.html\">your neighbor&#8217;s land<\/a> onto your land, you are expected to protect your land from this water.<\/p>\r\n<p>Many states still follow the common enemy rule. However, most have modified it to make it less strict. Under the modified rules, you may be able to hold your neighbor liable for damage to your property if the neighbor is negligent in making modifications to their property.<\/p>\r\n<h3>Civil Law Rule<\/h3>\r\n<p>The civil law rule, also known as the &quot;natural flow rule,&quot; imposes liability on any landowner who changes their land in a way that diverts the natural flow of surface water across the land.<\/p>\r\n<p>Most states modify civil law rules and allow alterations to property, so long as the modifications are reasonable. Under the modified civil law rule, the landowner, seeing the increased harm, should also take reasonable measures to protect their land from damage due to the increased surface water.<\/p>\r\n<h2>What Damages Must Be Paid?<\/h2>\r\n<p>If you prove that your neighbor is responsible for the water damage that you suffered, you may be able to collect damages for:<\/p>\r\n<ul>\r\n<li>The cost of repairs or replacement of water-damaged property<\/li>\r\n<li>The cost of staying at a hotel while your home is uninhabitable because of water damage<\/li>\r\n<li>Any medical bills directly related to the water damage, either for physical injury or mental distress<\/li>\r\n<li>Punitive damages (if you can show that your neighbor acted maliciously)<\/li>\r\n<\/ul>\r\n<p>You can engage a&nbsp;<a href=\"https:\/\/lawyers.findlaw.com\/real-estate-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">real estate lawyer<\/a> to appear before a judge and request a court order that directs your neighbor to fix the problem. Judges are more likely to issue such an order if the fix or repair is minor. Otherwise, they&#8217;ll order that the defendant compensate you for the repairs.<\/p>\r\n<h2>Insurance Coverage for Water Damage<\/h2>\r\n<p>There are two types of insurance that may cover you if your home or property has been damaged by water:&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/insuring-your-home.html\">homeowner&#8217;s insurance<\/a> and&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/insurance\/flood-insurance.html\">flood insurance<\/a>.<\/p>\r\n<p>If you experienced water damage from a source within your home, your homeowner&#8217;s insurance should be able to cover it. In addition, you may be able to collect damages from your neighbor&#8217;s insurance company.<\/p>\r\n<p>If the water damage is from an outside source of rising water,&nbsp;<a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/insuring-your-home.html\">homeowner&#8217;s insurance<\/a> may not be adequate. It is important that you have adequate insurance coverage in these situations. You should consider <a href=\"https:\/\/www.fema.gov\/flood-insurance\" target=\"_blank\" rel=\"noopener\">flood insurance<\/a> if located within a flood zone. The majority of mortgage lenders require flood insurance as a condition of your mortgage. If you let coverage lapse or cancel any insurance premiums, you may be in default on your mortgage terms.<\/p>\r\n<h2>What Should You Do if a Neighbor Is Causing One of These Issues?<\/h2>\r\n<p>If your neighbor is causing water damage-related issues, there are a few steps that you can take.<\/p>\r\n<h3>Document Everything<\/h3>\r\n<p>Take photos and videos of the water damage. It is also helpful to keep detailed notes with dates and times of discovery. Record the water source if identifiable and create an inventory of the items damaged by the water. You can also keep records of all correspondence you made with your neighbor related to this issue.<\/p>\r\n<h3>Talk to Your Neighbor<\/h3>\r\n<p>Talk to your neighbor calmly and explain the problem. Ask them to fix the issue. It is best to put this request in writing and then give them a reasonable time to respond.<\/p>\r\n<p>For residential areas with a homeowner&#8217;s association or condominium association, you can also send them a written notification. This is particularly true if, for instance, the condominium units share a plumbing system.<\/p>\r\n<h3>Check Your Insurance<\/h3>\r\n<p>Contact your homeowner&#8217;s insurance and ask about the coverage for water damage.<\/p>\r\n<p>Your insurer is likely to deny a claim for any issue outside of what your specific policy covers. But if it denies a claim for covered damage, you may need a lawyer to help.<\/p>\r\n<h3>Seek Legal Help<\/h3>\r\n<p>If negotiation does not work, <a href=\"https:\/\/www.findlaw.com\/realestate\/legal-help-resources.html\">consider working with a real estate attorney.<\/a> They can help review your state&#8217;s water laws and help you understand your rights. They can also write a formal demand letter, asking your neighbor to take the necessary action.<\/p>\r\n<p>A real estate attorney can also assist you in calculating damages.
