As apartment dwellers know, shared walls mean less privacy. Houses must have enough distance between the side walls to avoid contact.<\/p>\n<p>Setback lines also help control residential density in <a href=\"https:\/\/www.findlaw.com\/realestate\/land-use-laws\/types-of-zoning.html\" title=\"zoning districts\">zoning districts<\/a>. The size of the lot typically dictates the size of the setback. In some subdivisions, the size of the setback may prevent homeowners from building accessory units in their yards.<\/p>\n<p>Residential properties have setbacks on all four sides. Front and rear setbacks are larger than the side setbacks, although there are exceptions for corner lots and \u201cthrough lots\u201d (adjoining lots facing opposite directions).<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home.html\">Homeowners<\/a> can find the setback lines for their property at the city or county planning department.<\/p>\n<h3>Accessory Structures<\/h3>\n<p>Accessory structures are additional structures or installations a homeowner builds on the property after completing the main structure. Setback restrictions limit where (and sometimes if) you can have those accessories. Setbacks also affect \u201cprojections,\u201d or whether an accessory structure can protrude from the house into the yard.<\/p>\n<p>Some <a href=\"https:\/\/www.fema.gov\/glossary\/accessory-structure\" title=\"accessory structures\" target=\"_blank\" rel=\"noopener\">accessory structures<\/a> include:<\/p>\n<ul>\n<li>Built-in barbecue pits (not free-standing grills)<\/li>\n<li>Carports and add-on garages<\/li>\n<li>External air conditioning units and generators<\/li>\n<li>Decks, patios, and balconies<\/li>\n<\/ul>\n<p>In most cases, you cannot place other structures in the front yard, regardless of setback. Accessories may only go in the side and rear yards up to the property line.<\/p>\n<p>Your local planning commission may have other restrictions about ground cover and drainage. Homeowners should consult their planning board or a <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/interviewing-contractors.html\">contractor<\/a> to determine if they need any building permits before installing substantial accessory structures.<\/p>\n<h3>Accessory Dwelling Units<\/h3>\n<p>An <a href=\"https:\/\/www.planning.org\/knowledgebase\/accessorydwellings\" title=\"accessory dwelling unit\" target=\"_blank\" rel=\"noopener\">accessory dwelling unit<\/a> (ADU) is a self-contained residential building inside the property boundaries of an existing residence. ADUs provide additional living space at a lower cost than additions or remodeling the existing home.<\/p>\n<p>In some states, like <a href=\"https:\/\/www.hcd.ca.gov\/policy-and-research\/accessory-dwelling-units\" title=\"California\" target=\"_blank\" rel=\"noopener\">California<\/a>, ADU construction has increased as housing costs have skyrocketed. One of these is the right of <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/property-rights-my-neighbor-is-a-nuisance.html\">quiet enjoyment<\/a>. In simple terms, this means you have a right to use your home without interference from neighbors. If the neighbors do something that disturbs you, you may have grounds for legal action.<\/p>\n<p>A <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/private-nuisance.html\">private nuisance<\/a> is anything that substantially affects your ability to use your property. Common private nuisances include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/what-to-do-about-a-neighbor-s-noise-faqs.html\" title=\"Loud noises\">Loud noises<\/a>, music, or vibrations<\/li>\n<li>Smoke or noxious odors<\/li>\n<li>Blocked driveways or shared access points<\/li>\n<li>Excessive light or security camera intrusion<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/neighbor-animal-disputes.html\" title=\"Intrusive animals\">Intrusive animals<\/a><\/li>\n<\/ul>\n<p>To prove a case of nuisance, the harm must be greater than simple annoyance. If the neighbor\u2019s kids put a basketball hoop in their driveway and shoot hoops every Saturday afternoon, you do not have a nuisance lawsuit. A private nuisance must substantially and unreasonably interfere with your enjoyment of your own property.<\/p>\n<p>For instance, the neighbor kids playing basketball in their driveway does not interfere with your use of your own property. But if you and your neighbor share a driveway, then the basketball hoop may <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/blocked-driveway-what-the-law-says-about-neighborhood-parking.html\">block your access to the road<\/a>.<\/p>\n<h3><b>Resolving Private Nuisances<\/b><\/h3>\n<p>You can <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/property-rights-my-neighbor-is-a-nuisance.html\" title=\"sue a neighbor for private nuisance\">sue a neighbor for private nuisance<\/a>, but it should be your last course of action. You can resolve most neighbor disputes through mediation or by referring to city building codes or zoning ordinances.<\/p>\n<p>City codes limit some types of structures on private property. Municipal codes govern <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/fencing-laws-and-your-neighbors-faqs.html\" title=\"fence height and materials\">fence height and materials<\/a>, how tall additions may be, and rights-of-way for utilities. If your neighbor&#8217;s new structure or accessory affects building codes or zoning laws, you can request code enforcement.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/home-owners-associations.html\">HOA covenants, conditions, and restrictions<\/a> (CC&amp;Rs) may provide another means of resolution. HOAs can regulate the appearance and maintenance of homes within their boundaries. HOA disputes often involve noise, yard sales, property line encroachment by trees or accessory buildings, and animal issues.<\/p>\n<h2>Should I Get Help From an Attorney?<\/h2>\n<p>Legal advice from a local attorney can be crucial in some situations.
