If children do not grow up in a two-parent household,&nbsp;<a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-basics.html\">child support<\/a>&nbsp;ensures their needs are met.<\/p>\r\n<p>Alabama courts use the <a href=\"https:\/\/judicial.alabama.gov\/docs\/library\/rules\/ja32.pdf\" target=\"_blank\" rel=\"noopener\">child-support guidelines<\/a>, Rule 32, to determine each parent&#8217;s child support obligation. The amount of child support varies in each situation.<\/p>\r\n<p>Determining child support payments requires financial disclosure and complicated <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/how-to-calculate-child-support.html\">child support calculations<\/a>. In this article, we&#8217;ll examine Alabama&#8217;s child-support guidelines, discuss the factors and laws involved, and walk you through what to expect during the process.<\/p>\r\n<h2><b>Alabama Child Support Guidelines: The Basics<\/b><\/h2>\r\n<p>For child support, Alabama views all parental relationships as together or not together. If parents are married or in a domestic relationship, the state assumes they take care of the children&#8217;s needs. If the parents aren&#8217;t raising the children in a shared household, they must pay <a href=\"https:\/\/www.findlaw.com\/family\/child-support.html\">child support<\/a>. It doesn&#8217;t matter if the parents divorced were in a serious relationship, or had a one-night stand.<\/p>\r\n<p><a href=\"https:\/\/www.ssa.gov\/OP_Home\/ssact\/title04\/0451.htm\" title=\"Title IV-D of 1975&#039;s Social Security Act\" target=\"_blank\" rel=\"noopener\">Title IV-D of 1975&#8217;s Social Security Act<\/a> requires that all states have a system for collecting, distributing, and enforcing child support payments. In Alabama, child support payment by check or money order goes to:<\/p>\r\n<p>Alabama Child Support Payment Center (Central Payment Center)<br>\r\nP.O. Box 244015<br>\r\nMontgomery, AL 36124-4015<\/p>\r\n<p>Parents can make payments online through a <a href=\"https:\/\/myalabama.gov\/home\/index\" target=\"_blank\" rel=\"noopener\">MyAlabama account<\/a> or via <a href=\"https:\/\/www.moneygram.com\/mgo\/us\/en\/\" target=\"_blank\" rel=\"noopener\">Moneygram<\/a> or <a href=\"https:\/\/www.expertpay.com\/\" target=\"_blank\" rel=\"noopener\">ExpertPay<\/a>. This option is available for the parent making the payment and employers.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/childsupport.alacourt.gov\/default.aspx\" target=\"_blank\" rel=\"noopener\">Alabama Central Disbursement Division (ACDD)<\/a>&nbsp;disburses money to custodial parents. The <a href=\"https:\/\/dhr.alabama.gov\/child-support-enforcement-division\/\" title=\"Child Support Enforcement Program (CSE or IV-D)\" target=\"_blank\" rel=\"noopener\">Child Support Enforcement Program (CSE or IV-D)<\/a> enforces accounts that fall into arrears (behind on payments). The CSE is part of the Alabama Department of Human Resources.<\/p>\r\n<p>The default collection method is income withholding, which lowers the possibility of a parent falling into arrears. Once the Alabama courts issue a child support order, employers must deduct the child support payment amount from the obligor&#8217;s (paying parent&#8217;s) paycheck. The employer then submits the payment to the Child Support Central Payment Center.<\/p>\r\n<h2><b>The Calculation of Child Support Process<\/b><\/h2>\r\n<p>The <a href=\"https:\/\/judicial.alabama.gov\/docs\/library\/rules\/ja32.pdf\" target=\"_blank\" rel=\"noopener\">Alabama child support guidelines<\/a> are key in determining child support payments. Alabama courts must apply them while considering the best interests of the child. If they deviate from the guidelines, the judge must give a written explanation. The guidelines are in place to ensure child support determinations are as uniform as possible.<\/p>\r\n<p>Alabama child support guidelines use an <a href=\"https:\/\/www.ncsl.org\/human-services\/child-support-guideline-models\" target=\"_blank\" rel=\"noopener\">income shares<\/a> model to calculate child support payments. This system aims to have children get the same financial support they would have in a two-parent household. This shows in the court order issued for child support. The court calculates it via the following steps:<\/p>\r\n<h3>1. Determine Gross Income and the Custody Arrangement<\/h3>\r\n<p>To begin a child support order, each parent must determine their monthly gross income. The state of Alabama has child support guideline worksheets for this. But it&#8217;s important to understand which one applies to your <a href=\"https:\/\/codes.findlaw.com\/al\/title-30-marital-and-domestic-relations\/al-code-sect-30-3-151\/\" target=\"_blank\" rel=\"noopener\">child custody situation<\/a>:<\/p>\r\n<ul>\r\n<li><b>Sole physical custody<\/b> \u2014 The custodial parent has sole physical custody, and the noncustodial parent has visitation rights<\/li>\r\n<li><b>Joint physical custody<\/b> \u2014 Each parent assumes physical custody of the child; the amount of time with each parent does not have to be equal<\/li>\r\n<li><b>Shared custody<\/b> \u2014 When each parent has physical custody 50% of the time or close to 50% of the time (used only for determination of amount of support)<\/li>\r\n<\/ul>\r\n<p>For sole or joint physical custody, parents use <a href=\"https:\/\/eforms.alacourt.gov\/media\/c5vl4eht\/revised-child-support-worksheet-5-22.pdf\" target=\"_blank\" rel=\"noopener\">Child Support Worksheet Form CS-42<\/a> to determine their gross income. The state amended Rule 32(C) <a href=\"https:\/\/judicial.alabama.gov\/docs\/rules\/OrderonRule32AlabamaRulesofJudicialAdministration.pdf\" target=\"_blank\" rel=\"noopener\">in 2023<\/a> for parents who have shared custody. This means they each have custody about half of the time. The shared custody designation only applies to child support determination. These parents use <a href=\"https:\/\/eforms.alacourt.gov\/media\/kxqfpoz4\/cs-42-s-6-23.pdf\" target=\"_blank\" rel=\"noopener\">Child Support Worksheet Form CS-42-S<\/a>.<\/p>\r\n<p>Determining <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-determining-parents-income.html\">gross income requires listing all sources of income<\/a> (including any Social Security benefits) and giving an <a href=\"https:\/\/dhr.alabama.gov\/wp-content\/uploads\/2020\/02\/Affidavit-of-Income.pdf\" target=\"_blank\" rel=\"noopener\">income statement\/affidavit<\/a>. After deductions, such as alimony, the remaining amount is a parent&#8217;s adjusted gross income for the month.<\/p>\r\n<h3>2. Adding Gross Incomes<\/h3>\r\n<p>This is as straightforward as it sounds. The parents add their gross incomes to create a <a href=\"https:\/\/dhr.alabama.gov\/child-support-enforcement-division\/child-support-order-establishment\/#:~:text=The%20guidelines%20are%20based%20on%20the%20monthly%20gross%20income%20of%20both%20parents\" title=\"combined monthly adjusted gross income\" target=\"_blank\" rel=\"noopener\">combined monthly adjusted gross income<\/a>. This combined income shows the amount of income available in a two-parent household. The combined gross income of both parents gets used in the next step.<\/p>\r\n<h3>3. Determining the Basic Child Support Obligation<\/h3>\r\n<p>Apply the new total to the <a href=\"https:\/\/www.alacourt.gov\/docs\/ChildSupportObligations.512022.pdf\" target=\"_blank\" rel=\"noopener\">Alabama Schedule of Basic Child Support Obligation<\/a> by cross-referencing the amount with the number of children eligible. This gives you the basic child support obligation.<\/p>\r\n<p>Let&#8217;s use an example. Parents with a combined adjusted gross income of $10,000 have three children eligible for child support. See if you can determine what they should pay via the Obligation Chart. If you came up with $1,984, you&#8217;re correct.<\/p>\r\n<h3>4. Determining Each Parent&#8217;s Basic Child Support Obligation<\/h3>\r\n<p>The next step is to <a href=\"https:\/\/judicial.alabama.gov\/docs\/library\/rules\/ja32.pdf\" title=\"multiply the basic child support obligation by the percentage\" target=\"_blank\" rel=\"noopener\">multiply the basic child support obligation by the percentage<\/a> one of the parents contributed to the combined adjusted gross income. That sounds confusing, but it doesn&#8217;t have to be.<\/p>\r\n<p>Let&#8217;s use our previous example. Let&#8217;s say Jackie&#8217;s share of the $10,000 is $7,000. That $7,000 is 70% of the combined adjusted gross income. Jackie must pay 70% of the basic obligation.<\/p>\r\n<p>As the other parent, Adrian owes 30%. The basic obligation amount due each month is $1,984, so Jackie would pay $1,388.80 monthly (70% of $1,984). Adrian&#8217;s obligation is $595 per month (30% of $1,984).<\/p>\r\n<p>But this is not the final amount, as there are <a href=\"https:\/\/dhr.alabama.gov\/child-support-enforcement-division\/child-support-order-establishment\/#:~:text=There%20are%20other%20things%20taken%20into%20consideration%20such%20as%20day%20care%20expenses%2C%20health%20insurance%20costs%20and%20additional%20children%20for%20whom%20support%20is%20court%20ordered%20or%20provided\" title=\"other costs are taken into consideration\" target=\"_blank\" rel=\"noopener\">other costs to consider<\/a> in the last step.<\/p>\r\n<h3>5. Getting the Final Child Support Obligation Amount<\/h3>\r\n<p>After calculating each parent&#8217;s basic child support obligation, certain costs get added. Work-related childcare and health insurance costs get determined by applying the same percentages used in step four. Parents using shared custody will also <a href=\"https:\/\/eforms.alacourt.gov\/media\/kxqfpoz4\/cs-42-s-6-23.pdf\" target=\"_blank\" rel=\"noopener\">have a shared physical custody<\/a> obligation. This is Line 5 on the CS-42-S worksheet.<\/p>\r\n<p>The guidelines&#8217; support amount can push a parent&#8217;s income below the <a href=\"https:\/\/www.alacourt.gov\/docs\/AL_MemoJune2021_fromCPRto_post.pdf\" title=\"self-support reserve (poverty level)\" target=\"_blank\" rel=\"noopener\">self-support reserve (poverty level)<\/a>. The courts can lower a parent&#8217;s payment to a minimum of $75 monthly. Parents struggling to meet their obligations should speak with the CSE caseworker or an <a href=\"https:\/\/lawyers.findlaw.com\/child-support\/alabama?fli=dcta\" title=\"Alabama family law attorne\" target=\"_blank\" rel=\"noopener\">Alabama family law attorney<\/a>.<\/p>\r\n<h2><b>Alabama Child Support Guidelines: Chart<\/b><\/h2>\r\n<p>Understanding how the Alabama child support guidelines work can help you in many ways. You&#8217;ll know what to expect during a child support hearing.
