These rules don\u2019t always match up, so it\u2019s important to know which applies to your situation.<\/p>\n<p>The Alabama Constitution establishes a <a href=\"https:\/\/alison.legislature.state.al.us\/constitution\" target=\"_blank\" rel=\"noopener\">baseline exemption for homesteads<\/a> of up to 80 acres or for city or town lots valued at up to $2,000. The statutory code is more generous. Under the <a href=\"https:\/\/alison.legislature.state.al.us\/code-of-alabama?section=6-10-2\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52741572\">Code of Alabama<\/span><\/a>, the exemption covers homesteads of up to 160 acres and valued at $15,000.<\/p>\n<p>Alabama does not use the federal bankruptcy exemption system. If you file for bankruptcy in Alabama, you must use <a href=\"https:\/\/alison.legislature.state.al.us\/code-of-alabama?section=6-10-11\" target=\"_blank\" rel=\"noopener\">Alabama\u2019s state exemptions<\/a> instead of the federal ones.<\/p>\n<p>For <span data-term-id=\"52741563\">property tax<\/span> relief, Alabama offers several levels of exemption. Let\u2019s take a closer look at both.<\/p>\n<h3>Creditor Protection<\/h3>\n<p>Alabama\u2019s creditor exemption <a href=\"https:\/\/alison.legislature.state.al.us\/code-of-alabama?section=6-10-2\" target=\"_blank\" rel=\"noopener\">protects up to $15,000<\/a> in home equity and 160 acres of land from being taken to pay most debts. Married couples who own the home together can each claim the exemption, doubling the protected amount to $30,000 in a joint bankruptcy case.<\/p>\n<p>Alabama updates its bankruptcy <span data-term-id=\"52741562\">homestead exemption<\/span> every three years to account for inflation. As of April 1, 2024, the <a href=\"https:\/\/www.alsb.uscourts.gov\/alabama-exemption-amounts\" target=\"_blank\" rel=\"noopener\">exemption is $18,800 per person<\/a>, or $37,600 for married couples filing jointly.<\/p>\n<p>Federal law adds another timing rule. Any interest in your home that you acquired during the 1,215 days (around 40 months) before filing for bankruptcy <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">is capped at $214,000<\/a>. This figure applies regardless of what <span data-term-id=\"52741599\">Alabama law<\/span> provides and applies to cases filed on or after April 1, 2025.<\/p>\n<p>The <span data-term-id=\"52741562\">homestead exemption<\/span> safeguards your equity, not the entire <span data-term-id=\"52741596\">appraised value<\/span> of your home. Equity is the value of your home minus the amount you still owe. For instance, if your home is valued at $200,000 and you owe $185,000, your equity is $15,000. This amount falls within Alabama\u2019s standard exemption, preventing a bankruptcy trustee from compelling a sale to settle unsecured debts.<\/p>\n<p>Alabama also passed a law that expands the exemption for certain <span data-term-id=\"52741570\">homeowners<\/span>. Under <a href=\"https:\/\/alison.legislature.state.al.us\/files\/pdf\/SearchableInstruments\/2026RS\/HB96-enr.pdf\" target=\"_blank\" rel=\"noopener\">HB96<\/a>, which took effect on June 1, 2026, the creditor protection exemption increases to $56,400 for <span data-term-id=\"52741570\">homeowners<\/span> who are 62 <span data-term-id=\"52741580\">years of age<\/span> or older or who qualify as individuals with a disability under state law. You must live in the home as your main residence on the first day of the <span data-term-id=\"52741568\">tax year<\/span> to qualify.<\/p>\n<p><span data-term-id=\"52741573\">Real property<\/span> that qualifies includes:<\/p>\n<ul>\n<li>Single-family homes on owned land<\/li>\n<li>Manufactured homes, provided you also own the land on which the home sits, and the manufactured home is assessed together with the property<\/li>\n<li>Properties held as a fee simple estate or a lesser estate, including interests held in common or in severalty<\/li>\n<\/ul>\n<p>You can claim only one <span data-term-id=\"52741562\">homestead exemption<\/span> in Alabama, no matter how many properties you own. The exemption does not transfer to a new owner, so anyone who buys your property must apply for their own exemption. Rental properties, vacation homes, and investment properties are not eligible for the <span data-term-id=\"52741562\">homestead exemption<\/span>.<\/p>\n<h2>How To Claim a <span data-term-id=\"52741562\">Homestead Exemption<\/span> in Alabama<\/h2>\n<p><span data-term-id=\"52741583\">Alabama\u2019s <\/span><span data-term-id=\"52741562\">homestead exemption<\/span> does not apply automatically. You must take specific steps to claim these protections.<\/p>\n<h3>For Creditor and Bankruptcy Protection<\/h3>\n<p>To <a href=\"https:\/\/alison.legislature.state.al.us\/code-of-alabama?section=6-10-20\" target=\"_blank\" rel=\"noopener\">protect your home<\/a> from levy and sale, you must file a written declaration with the probate judge in the county where your property is located. The declaration must be signed, sworn, and describe the property you want to claim as exempt. Filing before a creditor takes action gives you the strongest protection. Temporarily moving out or renting the property does not cancel your homestead claim, as long as the declaration remains on file with the probate court.<\/p>\n<h3>For <span data-term-id=\"52741563\">Property Tax<\/span> Relief<\/h3>\n<p>To claim a <span data-term-id=\"52741563\">property tax<\/span> <span data-term-id=\"52741562\">homestead exemption<\/span>, you must apply through your <a href=\"https:\/\/www.revenue.alabama.gov\/property-tax\/county-offices-appraisal-assessment-records\/\" target=\"_blank\" rel=\"noopener\">local <span data-term-id=\"52741567\">county tax<\/span> assessor<\/a> or <span data-term-id=\"52741575\">revenue commissioner<\/span>&#8216;s office. Procedures vary by location, so contact your local <span data-term-id=\"52741591\">county office<\/span> for specific instructions. In general, <span data-term-id=\"52741591\">county offices<\/span> will require you to bring:<\/p>\n<ul>\n<li>A copy of your recorded deed or title<\/li>\n<li>Proof of primary residency, such as a <span data-term-id=\"52741594\">driver&#8217;s license<\/span>, utility bills, or voter registration card<\/li>\n<li>For H-2 and H-3 exemptions, recent state or <span data-term-id=\"52741581\">federal <\/span><a href=\"https:\/\/codes.findlaw.com\/al\/title-40-revenue-and-taxation\/al-code-sect-40-9-19\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52741581\">income tax returns<\/span><\/a>, or official documentation of disability status<\/li>\n<\/ul>\n<p>Once you receive the <a href=\"https:\/\/www.revenue.alabama.gov\/property-tax\/homestead-exemptions\/\" target=\"_blank\" rel=\"noopener\">standard H-1 exemption<\/a>, you don\u2019t need to renew it each year. Other exemptions based on age, income, or disability must be renewed annually. <span data-term-id=\"52741563\">Property taxes<\/span> in Alabama are due on October 1 and become delinquent after December 31.<\/p>\n<h1>Exceptions and Limitations<\/h1>\n<p>Some situations can still lead to a forced sale of your home, even if you have a <span data-term-id=\"52741562\">homestead exemption<\/span>. The exemption does not protect you if:<\/p>\n<ul>\n<li>A lien existed on the property before you established the homestead<\/li>\n<li>You pledged the property as security for a mortgage<\/li>\n<li>You owe past-due taxes to the <span data-term-id=\"52741576\">state of Alabama<\/span>, its counties, or <span data-term-id=\"52741584\">municipalities<\/span><\/li>\n<li>You owe money to mechanics, contractors, or builders for work performed on the property<\/li>\n<\/ul>\n<p>Alabama\u2019s homestead protections apply only under state law. Federal law can override them. For example, a federal income tax lien can take priority over <span data-term-id=\"52741583\">Alabama\u2019s <\/span><span data-term-id=\"52741562\">homestead exemption<\/span>. The IRS rarely forecloses on homes for tax debts, but it may get involved if you sell or mortgage the property before the lien expires.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">Federal law<\/a> has an anti-abuse rule for bankruptcy. If you convert non-exempt assets into home equity within a decade before filing for bankruptcy, and you did so to hinder, delay, or defraud creditors, a court may reduce your protected equity. For example, if you cash out investments and use the money to pay down your mortgage before filing, a trustee may challenge that move. The court looks at your intent. Regular mortgage payments over time are treated differently from last-minute transfers meant to hide assets.<\/p>\n<p>To use Alabama&#8217;s state exemptions in bankruptcy, you must have lived in Alabama for <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/\" target=\"_blank\" rel=\"noopener\">at least 730 days<\/a> (two years) before filing. If you don\u2019t meet that residency requirement, you must use the exemptions of the state where you lived for most of the 180 days before that two-year period.<\/p>\n<h2>Get Legal Help With Alabama
