They may hack into your email account or other repositories of your information to find something they can exploit. Unfortunately, there are many ways of securing your identity, social security number, and banking information. This could be through&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/phishing-scams.html\">phishing<\/a>, but it could also occur from forces outside of your control, such as a security breach in a company that has your name and credit card information.<\/p>\r\n<p>Regardless of how they get it, identity thieves use your information to purchase items, empty your bank accounts, or impersonate you in some other way. In many cases, the offender chooses the victim randomly, and there is no personal relationship between them and the perpetrator. In others, a person tries to build up a relationship before attempting to acquire information they can exploit.<\/p>\r\n<h2>Alabama\u2019s Identity Theft Laws at a Glance<\/h2>\r\n<p>The following table describes Alabama\u2019s&nbsp;<a href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/details-on-state-identity-theft-laws.html\">identity theft laws<\/a>.<\/p>\r\n<table>\r\n<tbody><tr><td><p>Code Sections<\/p>\r\n<\/td>\r\n<td><p>Alabama Code Title 13A: Criminal Code, Chapter 8: Offenses Involving Theft, Article 10:&nbsp;<a href=\"https:\/\/alison.legislature.state.al.us\/code-of-alabama\" target=\"_blank\" rel=\"noopener\">The Consumer Identity Protection Act<\/a><\/p>\r\n<\/td>\r\n<\/tr><tr><td><p>What is Prohibited?<\/p>\r\n<\/td>\r\n<td><p>Alabama law prohibits the following:<\/p>\r\n<ul>\r\n<li><p>Identity Theft \u2013 Obtaining any of the following without authorization of the victim and with the intent to&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud.html\">defraud<\/a>&nbsp;anyone:<\/p>\r\n<ul>\r\n<li><p>Identifying information to access financial resources, get identification documents, or obtain other benefits, such as credit cards<\/p>\r\n<\/li>\r\n<li><p>Purchasing goods or services using the victim&#8217;s information<\/p>\r\n<\/li>\r\n<li><p>Identification documents in the victim\u2019s name<\/p>\r\n<\/li>\r\n<li><p>A job through the use of the victim\u2019s identification<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/li>\r\n<li><p>Trafficking in Stolen Identities \u2013 Manufacturing, buying, or selling identification documents or other information without the permission of the victim for the purpose of committing identity theft.<\/p>\r\n<ul>\r\n<li><p><i>Possessing five or more identification documents of one victim or identifying information of five or more people without their permission creates the presumption that the defendant has committed \u201cTrafficking in Stolen Identities.\u201d<\/i><\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/li>\r\n<li><p>Obstructing Justice Using a False Identity \u2013 Using another person\u2019s identification documents or information to avoid arrest, prosecution, or otherwise impede a criminal investigation.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p>Penalty<\/p>\r\n<\/td>\r\n<td><p>Alabama\u2019s criminal penalties depend on the felony classification. Class A felonies are the most severe and carry the heaviest punishments. Class C felonies are the most minor and carry lesser penalties.<\/p>\r\n<p>The following penalties apply to a defendant guilty of identity theft:<\/p>\r\n<ul>\r\n<li><p>Identity Theft is a Class B felony. A conviction of this crime carries a sentence of two to 20 years in prison and a fine of up to $30,000.<\/p>\r\n<\/li>\r\n<li><p>Trafficking in stolen identities is also a Class B felony.<\/p>\r\n<\/li>\r\n<li><p>Obstructing Justice Using a False Identity is a Class C felony, punishable by one to ten years in prison and fines of up to $15,000.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<p>Offenders must also make&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/restitution.html\">restitution<\/a>&nbsp;or pay victims for their financial losses. This includes the costs of correcting the victim\u2019s credit reports or money the victim paid to get rid of debts or liens that resulted from the theft.<\/p>\r\n<\/td>\r\n<\/tr><tr><td><p>Defenses<\/p>\r\n<\/td>\r\n<td><p>The identity theft criminal statute doesn\u2019t apply to minors who were attempting to benefit from privileges denied to minors. Specifically, a minor who uses another person\u2019s driver\u2019s license to get into a bar or buy alcohol is not guilty of identity theft. That is a separate offense that carries fewer penalties.<\/p>\r\n<p>Other&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/theft-defenses.html\">defenses<\/a>&nbsp;include actual innocence or lack of intent.
