While tenants have some legal protection, Alabama law tends to favor landlords and property management companies. This is especially true regarding nonpayment of rent and late fees.<\/p>\r\n<p>In this article, we will explain Alabama\u2019s landlord-tenant law and discuss how Alabama law affects tenant\u2019s rights. If you\u2019re experiencing issues with your landlord and feel it\u2019s time to take them to <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/small-claims-court.html\">small claims court<\/a>, you should familiarize yourself with these laws. The same is true if you\u2019re a property owner or landlord dealing with a problem tenant.<\/p>\r\n<h2><b>Alabama Tenants&#8217; Rights Overview<\/b><\/h2>\r\n<p>Alabama statutes detail landlord and tenant responsibilities and rights. This includes provisions on collecting and returning <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/security-deposits.html\">security deposits<\/a>, rent, and eviction. While Alabama offers tenants a modicum of protection from unfair treatment by a landlord, Alabama doesn&#8217;t recognize certain tenants&#8217; rights that many other states do.<\/p>\r\n<p>For example, some states allow a tenant to <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/how-does-a-tenant-use-repair-and-deduct.html\">&quot;repair and deduct,&quot;<\/a> meaning they can pay for necessary repairs and deduct the cost from their rent. Of course, they can only do this if the landlord refuses to make reasonable repairs.<\/p>\r\n<p>In Alabama, if tenants withhold rent after paying for repairs, their landlord can take this as a violation of the lease and give them an eviction notice.<\/p>\r\n<h2><b>Alabama and the Fair Housing Act<\/b><\/h2>\r\n<p>Alabama lawmakers have adopted the federal Fair Housing Act (FHA), which prohibits landlords from discriminating against tenants based on race, religion, gender, or other classifications.<\/p>\r\n<p>While some states implement unique laws <a href=\"https:\/\/www.findlaw.com\/lgbtq-law\/housing-discrimination-protections-for-lgbtq-renters.html\">protecting LGBTQ individuals from housing discrimination<\/a>, Alabama chooses to incorporate the federal statute instead.<\/p>\r\n<h2><b>Can a Landlord Enter Without Permission in Alabama?<\/b><\/h2>\r\n<p>Generally, yes.&nbsp;As long as the landlord has a reasonable rationale for wanting to enter the unit and gives the tenant reasonable notice, the tenant does not have the right to withhold consent or deny entry (Alabama Code&nbsp;\u00a7 35-9A-303).&nbsp;<\/p>\r\n<p><span style=\"background-color: transparent;\">One frustration for many Alabama renters is that the law doesn\u2019t require landlords to give a specific amount of notice before entering the tenant\u2019s unit. Under Alabama law, all a landlord must do is give their tenant \u201creasonable\u201d notice that they intend to enter the property.<\/span><\/p>\r\n<p>In many situations, landlords have the right to enter and inspect a rental unit without the tenant\u2019s consent. Some of these include:<\/p>\r\n<ul>\r\n<li>Emergencies<\/li>\r\n<li>Court order<\/li>\r\n<li>A landlord reasonably believes their tenant has abandoned or surrendered the rental property<\/li>\r\n<li>The landlord gave the tenant what they deemed to be reasonable notice of entry<\/li>\r\n<li>The landlord wishes to show the unit to a prospective renter or buyer<\/li>\r\n<\/ul>\r\n<p>Generally, the Alabama courts deem two days\u2019 notice as fair and equitable.&nbsp;<\/p>\r\n<h2><b>Alabama Landlord-Tenant Laws at a Glance<\/b><\/h2>\r\n<p>If you\u2019re currently dealing with a dispute with your landlord (or tenant), you should familiarize yourself with Alabama\u2019s landlord-tenant law. The chart below provides details of Alabama&#8217;s tenants&#8217; rights laws.<\/p>\r\n<table>\r\n<tbody><tr><td><p><b>Statutes<\/b><\/p>\r\n<\/td>\r\n<td><div>&nbsp;<\/div>\r\n<ul>\r\n<li>Alabama <a href=\"https:\/\/calhoun.alacourt.gov\/media\/1038\/sample-uniform-residential-landlord-and-tenant-act.pdf\" target=\"_blank\" rel=\"noopener\">Uniform Residential Landlord and Tenant Act<\/a><\/li>\r\n<li>Federal <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/federal-fair-housing-act.html\" target=\"_blank\" rel=\"noopener\">Fair Housing Act<\/a><\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Security Deposits<\/b><\/p>\r\n<\/td>\r\n<td><div>&nbsp;<\/div>\r\n<ul>\r\n<li>Landlords cannot charge more than one month&#8217;s rent as a security deposit (not including pet deposits).<\/li>\r\n<li>Landlords have 60 days to give a tenant\u2019 their security deposit, along with an itemized list of deductions.<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Rent<\/b><\/p>\r\n<\/td>\r\n<td><div>&nbsp;<\/div>\r\n<ul>\r\n<li>Alabama law does not specify how much notice a landlord must provide before raising rent. However, the law does require the landlord to act in good faith when raising a tenant\u2019s rent. In a month-to-month lease, 30 days is reasonable and fair notice.<\/li>\r\n<li>Individual lease agreements may address rent increases. Either the tenant or the landlord can negotiate the terms of the notice and include this term in the rental agreement.<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Living Conditions<\/b><\/p>\r\n<\/td>\r\n<td><p>Alabama law requires landlords to comply with applicable building and housing codes that may affect health and safety.&nbsp;Landlords must also make necessary repairs to maintain habitability. This includes maintaining the following:<\/p>\r\n<ul>\r\n<li>Electrical<\/li>\r\n<li>Plumbing<\/li>\r\n<li>Sanitation<\/li>\r\n<li>Heating<\/li>\r\n<li>Air-conditioning<\/li>\r\n<li>Other facilities and appliances<\/li>\r\n<\/ul>\r\n<p>Alabama tenants do NOT have the right to &quot;repair and deduct&quot; rental payments for repairs.&nbsp;The landlord must provide proper notice to enter a rental property, and a tenant may not unreasonably withhold consent.&nbsp;<span style=\"background-color: transparent;\">Landlords may enter a rental unit without a tenant\u2019s consent in an emergency or under a court order.<\/span><\/p>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Discrimination<\/b><\/p>\r\n<\/td>\r\n<td><p>&nbsp;<\/p>\r\n<p>The Fair Housing Act prohibits landlords from discriminating against a tenant based on race, national origin, religion, gender, disability, or familial status.<\/p>\r\n<p>&nbsp;<\/p>\r\n<\/td>\r\n<\/tr><tr><td><p><b>Ending or Renewing a Tenancy<\/b><\/p>\r\n<\/td>\r\n<td><ul>\r\n<li>Landlords and tenants can terminate a lease with appropriate notice equal to the length of the lease term.
