Mental injuries are covered in specific circumstances, but not if the <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-010.html\" target=\"_blank\" rel=\"noopener\">mental injury<\/a> results from a disciplinary action, work evaluation, job transfer, layoff, demotion, termination, or similar action taken in good faith by the employer.<\/p>\r\n<p>Alaska provides compensation for medical treatment, lost wages from time away from work, compensation for permanent impairment resulting from a work injury, training for a new position, and death benefits including burial expenses.<\/p>\r\n<h2>Time Limits<\/h2>\r\n<p>You must report your injury in writing to your employer within <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-100.html\" target=\"_blank\" rel=\"noopener\">30 days<\/a> of your injury. If your workers&#8217; compensation insurer denies you benefits, you have <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-105.html\" target=\"_blank\" rel=\"noopener\">two years<\/a> to file a claim against the insurer. Unless you are unable to work at full capacity for more than <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-150.html\" target=\"_blank\" rel=\"noopener\">28 days<\/a>, you will not receive compensation for time away from work for the first three days you are disabled. Fortunately for injured employees, there is no time limit on how long you can receive wage compensation.<\/p>\r\n<h2>Benefit Caps<\/h2>\r\n<p>Compensation is determined by first establishing your <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-220.html\" target=\"_blank\" rel=\"noopener\">gross weekly earnings<\/a>. Alaska has several ways of <a href=\"http:\/\/labor.state.ak.us\/wc\/benefitcalculator.htm\" target=\"_blank\" rel=\"noopener\">computing<\/a> this, depending on how your earnings are calculated at the time of your injury. Most importantly, however, is that the <a href=\"https:\/\/codes.findlaw.com\/ak\/title-23-labor-and-workers-compensation\/ak-st-sect-23-30-175.html\" target=\"_blank\" rel=\"noopener\">maximum compensation<\/a> rate is 120 percent of the <a href=\"http:\/\/labor.alaska.gov\/wc\/rate.htm\" target=\"_blank\" rel=\"noopener\">Alaska Average Weekly Wage<\/a> (AAWW).<\/p>\r\n<h2>Dispute Resolution<\/h2>\r\n<p>If your claim is <a href=\"https:\/\/www.findlaw.com\/legalblogs\/injured\/2014\/09\/denied-workers-comp-5-first-steps-to-appeal.html\">denied<\/a>, you must request a hearing before the Workers&#8217; Compensation Board by filing an <a href=\"http:\/\/labor.alaska.gov\/wc\/forms\/wc6107.pdf\" target=\"_blank\" rel=\"noopener\">Affidavit of Readiness for Hearing<\/a>. At the hearing, you or your attorney will present evidence which supports your position.
