This is particularly true if an individual uses these tools and devices for purposes related to committing drug offenses. The following are some examples as outlined in the law:<\/p>\r\n<ul>\r\n<li>Isomerization devices<\/li>\r\n<li>Testing equipment<\/li>\r\n<li>Scales and balances<\/li>\r\n<li>Diluents and adulterants<\/li>\r\n<li>Blenders, bowls, containers, spoons, and mixing devices<\/li>\r\n<li>Capsules, balloons, develops and other containers<\/li>\r\n<li>Hypodermic syringes, needles, and objects used for injecting illegal drugs into the body<\/li>\r\n<\/ul>\r\n<p>It also covers other objects used for inhaling, ingesting, or introducing drugs into the body. These include:<\/p>\r\n<ul>\r\n<li>Acrylic, ceramic, glass, metal, plastic, or stone pipes<\/li>\r\n<li>Water pipes<\/li>\r\n<li>Chamber pipes<\/li>\r\n<li>Carburetor pipes<\/li>\r\n<li>Electric pipes<\/li>\r\n<li>Air driven pipes<\/li>\r\n<li>Carburetion tubes and devices<\/li>\r\n<li>Smoking and carburetion masks<\/li>\r\n<li>Roach clips<\/li>\r\n<li>Cocaine spoons and vials<\/li>\r\n<li>Chillums<\/li>\r\n<li>Bongs<\/li>\r\n<li>Ice pipes or chillers<\/li>\r\n<\/ul>\r\n<p>Arizona state law classifies these items as drug paraphernalia due to the potential of facilitating the production, use, or handling of drugs in a manner that violates Arizona laws. The <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3415\/\" target=\"_blank\" rel=\"noopener\">list of possible items<\/a> is lengthy.<\/p>\r\n<h2><b>What Are the Illegal Actions Under Arizona&#8217;s Drug Paraphernalia Laws?<\/b><\/h2>\r\n<p>Under <a><a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3415\/\" target=\"_blank\" rel=\"noopener\">Section 13-3415<\/a><\/a> of Arizona drug paraphernalia laws, illegal actions include the following:<\/p>\r\n<ul>\r\n<li><b>Use of drug paraphernalia:<\/b> It is unlawful for individuals to use or have in possession of drug paraphernalia with the intent to use it to introduce it into the human body illegally<\/li>\r\n<li><b>Delivery, possession, and manufacturing of drug paraphernalia:<\/b> It is unlawful to deliver, possess with intent to deliver, or manufacture with intent to deliver drug paraphernalia<\/li>\r\n<li><b>Advertisement of drug paraphernalia:<\/b> It is unlawful for individuals to advertise drug paraphernalia if the ad intends to promote the sale of materials or objects meant as drug paraphernalia<\/li>\r\n<\/ul>\r\n<p>Law enforcement officials may consider any instrument or item used in close connection with illegal drugs as drug paraphernalia. Mere possession of such an item is enough for a drug paraphernalia charge.<\/p>\r\n<p>In determining whether a spoon is just a spoon or legitimate drug paraphernalia, a <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3415\/\" target=\"_blank\" rel=\"noopener\">court considers all relevant factors<\/a>, including:<\/p>\r\n<ul>\r\n<li>Statements by an owner or anyone controlling the object concerning its use<\/li>\r\n<li>Prior convictions, if any, of an owner or anyone in control of the object under any state or federal law relating to any drug<\/li>\r\n<li>The proximity of the object, in time and space, to other prohibited items<\/li>\r\n<li>The proximity of the object to drugs<\/li>\r\n<li>The existence of any drug residue on the object<\/li>\r\n<li>Direct or circumstantial evidence of the intent of an owner, or anyone in control of the object, to deliver it to persons whom he knows, or should reasonably know, intend to use the object to facilitate a violation of this chapter<\/li>\r\n<li>Expert testimony concerning its use<\/li>\r\n<\/ul>\r\n<h2><b>What Is the Penalty for Possession of Drug Paraphernalia?<\/b><\/h2>\r\n<p>Possession of drug paraphernalia is a class 6 felony. It comes with a penalty of imprisonment that ranges from 6 months to 1.5 years. This applies to first-time offenders without any prior criminal convictions. If the offender has a prior criminal history or there&#8217;s an aggravating circumstance, the sentence could go higher and reach the statutory maximum.<\/p>\r\n<p>First-time and low-level drug offenders can benefit from \u201cout-of-custody\u201d sentencing options. Many Arizona counties have drug diversion programs providing a drug monitoring program that lasts three to six months.<\/p>\r\n<p>After the passage of Proposition 200 (<a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-901-01\/\" target=\"_blank\" rel=\"noopener\">A.R.S. \u00a713-901.01<\/a>), a defendant with a first or second nonviolent possession or paraphernalia conviction is eligible for probation instead of jail time.
