Here\u2019s what you need to know about drug possession laws in Arizona.<\/p>\r\n<h2><b>Overview of Arizona Drug Possession Laws<\/b><\/h2>\r\n<p>Below, you will find key provisions of Arizona\u2019s drug possession laws.<\/p>\r\n<p><b>Arizona Statutes<\/b><\/p>\r\n<ul>\r\n<li><p><a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3401\/\" target=\"_blank\" rel=\"noopener\">Arizona Revised Statutes<\/a> Title 13, Chapter 34, Sections 3401 &#8211; 3421 et. seq.<\/p>\r\n<\/li>\r\n<\/ul>\r\n<h2><b>Classification of Drugs in Arizona<\/b><\/h2>\r\n<p>State law divides illegal drugs, referred to as <a href=\"https:\/\/codes.findlaw.com\/az\/title-32-professions-and-occupations\/az-rev-st-sect-32-1901\/\" target=\"_blank\" rel=\"noopener\">controlled dangerous substances (CDS)<\/a>, into six types of drugs. They are as follows:<\/p>\r\n<ol>\r\n<li>Marijuana<\/li>\r\n<li>Peyote<\/li>\r\n<li>Prescription drugs<\/li>\r\n<li>Dangerous drugs<\/li>\r\n<li>Narcotic drugs<\/li>\r\n<li>Substances that emit toxic vapors<\/li>\r\n<\/ol>\r\n<p>There are threshold levels for CDS that, if met, create a presumption of sales. This exposes you to a mandatory prison term even without further evidence of sales and regardless of a lack of prior criminal history. The law&nbsp;defines <a href=\"https:\/\/azleg.gov\/ars\/13\/03401.htm#:~:text=36.%20%22Threshold%20amount,at%20least%20%241%2C000.\" target=\"_blank\" rel=\"noopener\">threshold amount<\/a>&nbsp;as a weight, market value, or other form of measurement of an unlawful substance as follows:<\/p>\r\n<ul>\r\n<li>1 gram of heroin<\/li>\r\n<li>9 grams of cocaine<\/li>\r\n<li>4 grams or 50 milliliters of PCP<\/li>\r\n<li>9 grams of methamphetamine, including methamphetamine in liquid suspension<\/li>\r\n<li>9 grams of amphetamine, including amphetamine in liquid suspension<\/li>\r\n<li>2 pounds of marijuana<\/li>\r\n<\/ul>\r\n<p>Arrest for drug possession in Arizona is no joke. The crime of possession of a narcotic drug&nbsp;requires the state prosecutor to prove&nbsp;beyond a reasonable doubt the following two statements:<\/p>\r\n<p><b>1. The defendant knowingly possessed a narcotic drug<\/b><\/p>\r\n<p>Being present where law enforcement found drugs is not enough for a conviction of possession. There must be evidence linking you to the drugs. The prosecutor must show that you exercised control over the drugs. A \u2018<a href=\"https:\/\/caselaw.findlaw.com\/court\/az-supreme-court\/1297520.html\" target=\"_blank\" rel=\"noopener\">usable quantity\u2019 is not an element of the possession<\/a>&nbsp;offense nor necessary to sustain a conviction for possession.<\/p>\r\n<p><b>2. The substance was, in fact, a narcotic drug<\/b><\/p>\r\n<p>The prosecutor also must show that the recovered substance contains a recognized dangerous drug. Forensic scientists have to test the drugs. That same scientist must later testify that the substance is a dangerous drug.<\/p>\r\n<h2><b>Drug Possession Penalties<\/b><\/h2>\r\n<p>A conviction for any drug offense can impact your life. In addition to fines and jail time, you can also&nbsp;<a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3418.html\" target=\"_blank\" rel=\"noopener\">lose access to public benefits<\/a>. This includes the state&#8217;s money or services for scholarships, tuition waivers, welfare benefits, public housing, or other subsidies.<\/p>\r\n<p>After Arizona passed <a href=\"https:\/\/ballotpedia.org\/Arizona_Proposition_200,_Controlled_Substances_Initiative_(1996)\" target=\"_blank\" rel=\"noopener\">Proposition 200<\/a>, in 1996, judges could no longer send first- or second-time nonviolent drug offenders to prison. href=\"https:\/\/www.azleg.gov\/ars\/13\/03407.htm#:~:text=F.%20A%20person,sentence%20is%20commuted.\" target=\"_blank\" rel=\"noopener\">ARS 13-3407(F)<\/a> states that a person convicted of offenses involving methamphetamine is not eligible for probation, suspension of sentence, pardon, or release from confinement until they&#8217;ve served the sentence provided by the court.<\/p>\r\n<h2><b>Defenses for Drug Possession Charges<\/b><\/h2>\r\n<p>There are a variety of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-possession-defenses.html\">defenses an attorney can raise<\/a>&nbsp;for drug possession charges. Some defenses challenge the facts, testimony, or evidence in the case. Others target procedural errors, such as search and seizure violations. There are also affirmative defenses that negate criminal liability, such as the right to use the drug. The following are some of the more common defenses to drug possession:<\/p>\r\n<ul>\r\n<li><b>Lack of knowledge &#8211;<\/b> The state must prove there was known possession of the narcotic drugs and that you were aware of both the presence of the drug and its illegal nature<\/li>\r\n<li><b>Illegal search &#8211;<\/b> The&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\">Fourth Amendment<\/a>&nbsp;to the U.S. Constitution protects you against unlawful searches and seizures. If law enforcement officers search your home without a valid warrant or the search does not fall under a valid exception to the warrant requirement, the court may exclude any evidence they obtain from the illegal or unlawful search.<\/li>\r\n<li><b>Medical marijuana &#8211; <\/b>For a state law charge, this is an affirmative defense for those arrested on possession charges of less than 2.5 ounces if they can show the drug came from a licensed medical marijuana dispensary and that the defendant is a qualifying patient.<\/li>\r\n<li><b>Religious use &#8211;<\/b> This affirmative defense applies to <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3402.html\" target=\"_blank\" rel=\"noopener\">peyote possession<\/a>. A person can use this defense if they use the drug for religious purposes or as part of a religious exercise, and it does not pose a threat to the community.<\/li>\r\n<\/ul>\r\n<h2><b>Recent Legislation in Arizona Concerning Controlled Substances<\/b><\/h2>\r\n<p>In 2020, <a href=\"https:\/\/www.azleg.gov\/ars\/36\/02862.htm\" target=\"_blank\" rel=\"noopener\">Arizona passed a law<\/a> allowing for the <a href=\"https:\/\/www.findlaw.com\/criminal\/expungement\/expungement-basics.html\">expungement of certain marijuana-related offenses<\/a>. The law took effect on July 12, 2021. It allows individuals to file a petition in court for expungement. This applied if they were arrested, adjudicated, charged, convicted, or sentenced to certain marijuana offenses that happened before the law\u2019s effectivity date.<\/p>\r\n<p>Included among the offenses that qualify for expungement are as follows:<\/p>\r\n<ul>\r\n<li>Transportation or possession of marijuana for up to 2.5 ounces<\/li>\r\n<li>Cultivation of up to six marijuana plants for personal use<\/li>\r\n<li>Possession of related drug paraphernalia<\/li>\r\n<\/ul>\r\n<p>This recent legislation reflects the vital shift in Arizona\u2019s approach when it comes to marijuana-related offenses.
