It isn&#8217;t easy to keep track of the&nbsp;<a href=\"https:\/\/www.findlaw.com\/cannabis-law\/cannabis-laws-and-regulations\/medical-marijuana-laws-by-state.html\">various states&#8217; new laws<\/a>. Arizona is one such state where rules are changing rapidly. This article provides an overview of the legalization of:<\/p>\r\n<ul>\r\n<li>Adult-use marijuana<\/li>\r\n<li>Qualifying marijuana products<\/li>\r\n<li>Protections for medical use<\/li>\r\n<li>The allowable amount of marijuana possession<\/li>\r\n<\/ul>\r\n<p>Read on to learn about the marijuana laws in Arizona.<\/p>\r\n<h2>Is Marijuana Legal in Arizona?<\/h2>\r\n<p>Yes. Arizona legalized recreational marijuana use in 2020. Retail sales of recreational marijuana in licensed dispensaries began in 2021.<\/p>\r\n<p>Under the&nbsp;<a href=\"https:\/\/www.azcourts.gov\/prop207\/Timeline\" target=\"_blank\" rel=\"noopener\">Smart and Safe Arizona Act<\/a>&nbsp;(Prop 207), adults&nbsp;21 or over&nbsp;can legally possess up to 28 grams of marijuana (one ounce) and cultivate up to six marijuana plants in their homes. They can&nbsp;transfer&nbsp;without charge&nbsp;up to one ounce of marijuana to another person who is 21 years or older. They can also possess drug paraphernalia without facing a criminal charge.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.azdhs.gov\/licensing\/medical-marijuana\/index.php\" target=\"_blank\" rel=\"noopener\">Arizona Department of Health Services<\/a>&nbsp;(ADHS) regulates the issuance of dispensary licenses and medical marijuana cards and provides guidelines such as cultivation restrictions.<\/p>\r\n<h2>Arizona Medical Marijuana Act<\/h2>\r\n<p>In 2010, Arizona voters passed the&nbsp;<a href=\"https:\/\/arizonastatecannabis.org\/laws\" target=\"_blank\" rel=\"noopener\">Arizona Medical Marijuana Act<\/a>&nbsp;by a narrow margin of just over 50%. The citizen initiative (Proposition 203) called on the ADHS to create a&nbsp;<a href=\"https:\/\/www.azdhs.gov\/licensing\/medical-marijuana\/index.php#faqs-general:~:text=The%20Arizona%20Medical%20Marijuana%20Act%20(Act)%20does%20not%3A\" target=\"_blank\" rel=\"noopener\">medical marijuana program<\/a>.<\/p>\r\n<p>The Medical Marijuana Act authorizes the possession and personal use of up to 2.5 ounces of marijuana by qualifying patients diagnosed with&nbsp;<a href=\"https:\/\/www.azleg.gov\/viewdocument\/?docName=https:\/\/www.azleg.gov\/ars\/36\/02801.htm#:~:text=Debilitating%20medical%20condition%22%20means%20one%20or%20more%20of%20the%20following%3A\" target=\"_blank\" rel=\"noopener\">debilitating medical conditions<\/a>. Some of these conditions include:<\/p>\r\n<ul>\r\n<li>Cancer<\/li>\r\n<li>Glaucoma<\/li>\r\n<li>HIV\/AIDS<\/li>\r\n<li>Crohn&#8217;s disease<\/li>\r\n<li>Hepatitis C<\/li>\r\n<\/ul>\r\n<p>Recommending physicians must provide written certification and can prescribe medical marijuana for treatment of the following symptoms:<\/p>\r\n<ul>\r\n<li>Chronic pain<\/li>\r\n<li>Severe nausea<\/li>\r\n<li>Cachexia or wasting syndrome<\/li>\r\n<li>Seizures, including epilepsy<\/li>\r\n<li>Severe muscle spasms, including multiple sclerosis<\/li>\r\n<\/ul>\r\n<p>Recreational marijuana is available as well, but more limited in the amount you can possess.<\/p>\r\n<h2>Qualifying Marijuana Products<\/h2>\r\n<p>Qualifying patients,&nbsp;including minors,&nbsp;can use marijuana with restrictions. In Arizona, dispensaries must obtain authorization prior to selling&nbsp;<a href=\"https:\/\/www.azdhs.gov\/licensing\/medical-marijuana\/index.php#faqs-dispensary:~:text=Dispensaries%20must%20obtain,prepares%20the%20products.\" target=\"_blank\" rel=\"noopener\">marijuana-infused edible food products<\/a>. The following forms of marijuana derived from its plant flower&nbsp;<a href=\"https:\/\/www.azleg.gov\/viewdocument\/?docName=https:\/\/www.azleg.gov\/ars\/36\/02801.htm#:~:text=17.%20%22Usable%20marijuana,or%20preparation%20thereof.\" target=\"_blank\" rel=\"noopener\">are allowable<\/a>:<\/p>\r\n<ul>\r\n<li>Extracts<\/li>\r\n<li>Concentrates<\/li>\r\n<li>Capsules<\/li>\r\n<\/ul>\r\n<p>State marijuana laws&nbsp;are in constant flux, so make sure to confirm anything you&#8217;re uncertain about.<\/p>\r\n<h2>State Penalties for Non-Medical Marijuana Use<\/h2>\r\n<p>Although Arizona legalized the recreational use of marijuana for adults over 21 through Proposition 207, it&#8217;s important to note that you cannot smoke marijuana on public transport or in a public place.
