A <span data-term-id=\"40826250\">right-to-<\/span><span data-term-id=\"40826252\">work<\/span><span data-term-id=\"40826252\"> state<\/span> does not mean workers are guaranteed a job. Instead, workers are not required to join a union to keep their jobs, and employers may not make <span data-term-id=\"40826260\">union membership<\/span> a <span data-term-id=\"40826265\">condition of employment<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<div><p>Unlike many states, <span data-term-id=\"40826249\">Arizona<\/span> has made the <span data-term-id=\"40826250\">right to work<\/span> part of its state constitution. In addition to <span data-term-id=\"40826256\">state law<\/span>, Article XXV of the <span data-term-id=\"40826249\">Arizona<\/span> Constitution prohibits companies from denying employment based on membership or non-membership in a union or <span data-term-id=\"40826259\">labor organization<\/span>.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/employment.html\"><span data-term-id=\"40826255\">Employment laws<\/span><\/a> define <span data-term-id=\"40826269\">employee rights<\/span> in matters such as <span data-term-id=\"40826280\">wage rates<\/span>, <span data-term-id=\"40826283\">working conditions<\/span>, and the length of the <span data-term-id=\"40826289\">workweek<\/span>. When <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/unions.html\">labor unions<\/a> first organized in the early 20th century, companies tried to prevent workers from joining. Later, as <span data-term-id=\"40826303\">labor relations<\/span> improved and unions gained more power, union shops sought to control membership and job access by negotiating contracts that required companies to force new hires to join the union.<\/p>\n<p>To prevent people from losing work if they preferred not to join a union, <span data-term-id=\"40826249\">Arizona<\/span> and other states enacted <a href=\"https:\/\/www.findlaw.com\/state\/employment-laws\/right-to-work.html\"><span data-term-id=\"40826251\">right-to-work<\/span><span data-term-id=\"40826251\"> laws<\/span><\/a>. These laws prohibit employers from requiring <span data-term-id=\"40826260\">union membership<\/span> as a <span data-term-id=\"40826265\">condition of employment<\/span>. They also prevent employers from treating union and non-union members differently. Under the National <span data-term-id=\"40826303\">Labor Relations<\/span> Act (NLRA), all employees must have the same wages and benefits under a union contract or <span data-term-id=\"40826284\">collective bargaining<\/span><span data-term-id=\"40826284\"> agreement<\/span>, whether or not they <span data-term-id=\"40826278\">pay union dues<\/span>.<\/p>\n<p>In states that lack these laws, employers may have contracts requiring <span data-term-id=\"40826260\">union membership<\/span> or payment of membership fees as a <span data-term-id=\"40826265\">condition of employment<\/span>. As of 2026, the states are split almost evenly on <span data-term-id=\"40826251\">right-to-work<\/span><span data-term-id=\"40826251\"> laws<\/span>.<\/p>\n<h2><strong><span data-term-id=\"40826270\">Arizona<\/span><span data-term-id=\"40826270\">\u2019s <\/span><span data-term-id=\"40826251\">Right<\/span><span data-term-id=\"40826251\"> to Work<\/span><span data-term-id=\"40826251\"> Laws<\/span><\/strong><\/h2>\n<p>The <span data-term-id=\"40826249\">Arizona<\/span> Revised Statutes (<span data-term-id=\"40826302\">ARS<\/span>) codify <a href=\"https:\/\/www.azleg.gov\/viewDocument\/?docName=http:\/\/www.azleg.gov\/const\/25\/0.htm\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"40826249\">Arizona<\/span>\u00a0Constitution<\/a>\u00a0and <a href=\"https:\/\/codes.findlaw.com\/az\/title-23-labor\/az-rev-st-sect-23-1302\/\" target=\"_blank\" rel=\"noopener\">state that workers must have the option to refuse to join a union<\/a>. The law applies to private workers, <span data-term-id=\"40826299\">public employees<\/span>, and any unionized government workers.<\/p>\n<h3><strong>Right to Unionize<\/strong><\/h3>\n<p>Under the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/what-is-the-nlrb.html\">National <span data-term-id=\"40826303\">Labor Relations<\/span> Act <\/a>(NLRA), all <span data-term-id=\"40826275\">Americans<\/span> have the right to form unions and <span data-term-id=\"40826254\">collective bargaining<\/span> units to negotiate wages and benefits with their employer. <span data-term-id=\"40826270\">Arizona<\/span><span data-term-id=\"40826270\">\u2019s <\/span><span data-term-id=\"40826251\">right<\/span><span data-term-id=\"40826251\">-to-work<\/span><span data-term-id=\"40826251\"> laws<\/span>\u00a0guarantee that a worker does not have to engage in these efforts or join any subsequent union. Gig workers can unionize in some states, but most <span data-term-id=\"40826297\">independent contractors<\/span> are not covered by the NLRA.<\/p>\n<h3><strong><span data-term-id=\"40826263\">At-Will Employment<\/span><\/strong><\/h3>\n<p>\u201c<span data-term-id=\"40826250\">Right to work<\/span>\u201d is often confused with \u201c<span data-term-id=\"40826263\">at-will employment<\/span>.\u201d Although they sound similar, the two legal concepts are not related. <span data-term-id=\"40826250\">Right to work<\/span> involves <span data-term-id=\"40826260\">union membership<\/span>. <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/at-will-employee-faq-s.html\"><span data-term-id=\"40826263\">At-will employment<\/span><\/a> concerns the <span data-term-id=\"40826281\">employment relationship<\/span>.<\/p>\n<p><span data-term-id=\"40826249\">Arizona<\/span> is an at-will state. Under this system, either the employer or the employee may end the <span data-term-id=\"40826281\">employment relationship<\/span> at any time. This can be for any reason and with or without notice, unless a contract states otherwise. <span data-term-id=\"40826249\">Arizona<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/az\/title-23-labor\/az-rev-st-sect-23-1501\/\" target=\"_blank\" rel=\"noopener\">Employment Protection Act<\/a> (AEPA) provides statutory <span data-term-id=\"40826272\">exemptions<\/span> to the at-will relationship if:<\/p>\n<ul>\n<li>A <span data-term-id=\"40826288\">written contract<\/span> or bargaining agreement says the employment is not at-will<\/li>\n<li>The employee is terminated in violation of <span data-term-id=\"40826261\">Arizona<\/span><span data-term-id=\"40826261\"> law<\/span><\/li>\n<li>The employee is terminated in violation of <span data-term-id=\"40826257\">federal law<\/span><\/li>\n<\/ul>\n<p>Both <span data-term-id=\"40826249\">Arizona<\/span> and <span data-term-id=\"40826257\">federal law<\/span> prohibit terminating or discriminating against an employee based on:<\/p>\n<ul>\n<li>Race, religion, gender, or <span data-term-id=\"40826258\">national origin<\/span><\/li>\n<li>Lawful use of <span data-term-id=\"40826296\">medical leave<\/span> or <span data-term-id=\"40826286\">workers\u2019 compensation<\/span><\/li>\n<li>Requesting time off for <span data-term-id=\"40826290\">jury duty<\/span> or other legal rights<\/li>\n<\/ul>\n<p>A job firing for any of these reasons is subject to fines and open to civil lawsuits.<\/p>\n<h2><strong>Violations and Penalties<\/strong><\/h2>\n<p><span data-term-id=\"40826262\">Arizona<\/span><span data-term-id=\"40826262\"> workers<\/span> have a civil right of action against employers who violate <span data-term-id=\"40826264\">labor laws<\/span>. If you believe you were terminated or lost a job because of <span data-term-id=\"40826260\">union membership<\/span>, you should speak to an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/arizona\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40826255\">employment law<\/span> attorney<\/a> for <span data-term-id=\"40826274\">legal advice<\/span>.<\/p>\n<p>You should report all <span data-term-id=\"40826264\">labor law<\/span> violations to the <a href=\"https:\/\/www.azica.gov\/labor-department\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40826300\">Industrial Commission of <\/span><span data-term-id=\"40826249\">Arizona<\/span><\/a>, the department that oversees matters regarding labor violations. Civil rights violations should be filed with the <a href=\"https:\/\/www.azag.gov\/civil-rights\" target=\"_blank\" rel=\"noopener\">Civil Rights Division of the Attorney General\u2019s Office<\/a> or <a href=\"https:\/\/www.eeoc.gov\/\" target=\"_blank\" rel=\"noopener\">the EEOC<\/a>. An attorney can explain what you need to file a complaint with the department.<\/p>\n<p>For a violation of the <span data-term-id=\"40826251\">right-to-work<\/span><span data-term-id=\"40826251\"> laws<\/span>, employees may receive:<\/p>\n<ul>\n<li>Civil recovery for damages such as lost wages and benefits<\/li>\n<li>Injunctive relief if they were the victims of any injury or harassing behavior<\/li>\n<li>Civil fines and restitution of up to $150 per day until the final judgment<\/li>\n<\/ul>\n<p>Violations of the <span data-term-id=\"40826251\">right-to-work<\/span><span data-term-id=\"40826251\"> law<\/span> are very fact-specific.
