In Arizona, the criminal laws refer to rape as <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/sexual-assault-overview.html\">sexual assault<\/a> and defines this sex crime as intentionally or knowingly engaging in sexual intercourse or oral sexual contact without a person&#8217;s consent.<\/p>\r\n<p>If the sexual act does not involve intercourse or oral sex, the law classifies it as &quot;sexual abuse.&quot;<\/p>\r\n<p>Here, we&#8217;ll explain Arizona&#8217;s sexual assault laws, including the penalties and possible defenses to sexual assault charges. Most sexual assault convictions carry prison time, fines, and mandatory sex offender registration.<\/p>\r\n<p>If you&#8217;re facing charges for either of these sexual offenses, you should contact an experienced criminal defense lawyer.<\/p>\r\n<h2><b>What is Sexual Assault Under Arizona Law?<\/b><\/h2>\r\n<p>Sexual assault in Arizona can include any of the following acts:<\/p>\r\n<ul>\r\n<li>Sexual intercourse without consent (sexual intercourse requires penetration of the vulva, penis, or anus using a body part or foreign object)<\/li>\r\n<li>Oral sexual contact (oral contact with the vulva, penis, or anus) without consent<\/li>\r\n<li>Verbal threats, fear, or intimidation may also qualify as sexual assault<\/li>\r\n<\/ul>\r\n<h2><b>The Age of the Victim Will Impact Your Criminal Charges<\/b><\/h2>\r\n<p>Under <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-705\/\" target=\"_blank\" rel=\"noopener\">A.R.S. 13-705<\/a>, when the victim of a sexual assault is under 15 years of age, it qualifies as a &quot;Dangerous Crime Against Children (DCAC).&quot;<\/p>\r\n<p>The statute includes various offenses under the umbrella of a DCAC. These include:<\/p>\r\n<ul>\r\n<li>Molestation of a child<\/li>\r\n<li>Sexual abuse of a child<\/li>\r\n<li>Sexual exploitation of a child<\/li>\r\n<li>Sexual conduct with a minor<\/li>\r\n<\/ul>\r\n<p>If the sexual assault victim is under 15 years old, the penalties are more severe than they would be if the victim were over 15. If you have a prior felony conviction, the penalty increases to 21 years in prison.
