This is partly because the internet and <span data-term-id=\"40410114\">social media<\/span> have made it easier for stalkers to communicate with and threaten their victims.<\/p>\n<p><span data-term-id=\"40410098\">Arizona<\/span>, like every other state, has specific <a href=\"https:\/\/www.findlaw.com\/state\/criminal-laws\/details-on-state-stalking-laws.html\"><span data-term-id=\"40410105\">stalking laws<\/span><\/a>. They work together with federal laws that prohibit <span data-term-id=\"40410134\">stalking behavior<\/span>. Not only does it offer a general definition of this crime, but it also provides specific examples of the types of stalking recognized by <span data-term-id=\"40410104\">Arizona<\/span><span data-term-id=\"40410104\"> law<\/span>.<\/p>\n<p>In <span data-term-id=\"40410098\">Arizona<\/span>, a person is guilty of <a href=\"https:\/\/ovc.ojp.gov\/topics\/stalking\" target=\"_blank\" rel=\"noopener\">stalking<\/a> if they knowingly engage in a <span data-term-id=\"40410099\">course of conduct<\/span> directed toward a <span data-term-id=\"40410107\">specific person<\/span> that causes the other person to experience significant <span data-term-id=\"40410102\">emotional distress<\/span> or fear for their <span data-term-id=\"40410133\">personal safety<\/span>. It also applies to the <span data-term-id=\"40410152\">victim&#8217;s family members<\/span> and others considered part of the <span data-term-id=\"40410148\">victim&#8217;s household<\/span>.<\/p>\n<p>It\u2019s important to understand who <span data-term-id=\"40410104\">Arizona<\/span><span data-term-id=\"40410104\"> law<\/span> considers as &#8220;family&#8221; under the law. A person <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-2923\/\" target=\"_blank\" rel=\"noopener\">commits a stalking offense<\/a> when their behavior causes the other person to suffer <span data-term-id=\"40410102\">emotional distress<\/span>, reasonably fear that their property will be damaged or destroyed, or that any of the following will suffer a physical injury:<\/p>\n<ul>\n<li>The victim themselves<\/li>\n<li>The victim&#8217;s <span data-term-id=\"40410109\">immediate family members<\/span><\/li>\n<li>The victim&#8217;s <span data-term-id=\"40410132\">domestic animal<\/span> (or livestock)<\/li>\n<li>A person the victim has (or used to have) a romantic and <span data-term-id=\"40410146\">sexual relationship<\/span> with<\/li>\n<li>Anybody who regularly resides with the victim or has lived with them within six months of the defendant&#8217;s <span data-term-id=\"40410134\">stalking behavior<\/span><\/li>\n<\/ul>\n<p>Anyone suspected of the above faces <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-601\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40410100\">Class 5<\/span> felony charges<\/a>. If the defendant causes the victim to fear their own death or the death of any of the people identified as family or household members, they instead face <span data-term-id=\"40410101\">Class 3<\/span> felony charges.<\/p>\n<h3>Types of Stalking Under <span data-term-id=\"40410104\">Arizona<\/span><span data-term-id=\"40410104\"> Law<\/span><\/h3>\n<p><span data-term-id=\"40410098\">Arizona<\/span>&#8216;s <span data-term-id=\"40410105\">stalking laws<\/span> outline specific behaviors that qualify as stalking and offer a clear definition of what constitutes a &#8220;<span data-term-id=\"40410099\">course of conduct<\/span>.&#8221; The state must prove its case beyond a\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/who-has-the-burden-of-proof-3-things-you-should-know\/\">reasonable doubt<\/a>\u00a0that a\u00a0<span data-term-id=\"40410121\">criminal defense lawyer<\/span>\u00a0may attempt to create.<\/p>\n<p>A <span data-term-id=\"40410099\">course of conduct<\/span> that constitutes stalking in <span data-term-id=\"40410098\">Arizona<\/span> means engaging, either directly or through another person, <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-2923\/\" target=\"_blank\" rel=\"noopener\">in any of the following behaviors<\/a>:<\/p>\n<ul>\n<li>Maintaining a visual or physical proximity to the victim<\/li>\n<li>Sending repeated communications to the victim by any method (email, <span data-term-id=\"40410110\">text messages<\/span>, <span data-term-id=\"40410114\">social media<\/span> messages, or any other <span data-term-id=\"40410115\">electronic communication<\/span>, etc.)<\/li>\n<li>Making threats or <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/what-really-constitutes-harassment-and-what-can-i-do.html\"><u>harassing the victim<\/u><\/a><\/li>\n<li><a href=\"https:\/\/archive.findlaw.com\/blog\/top-5-stalking-laws-and-legal-questions\/\" target=\"_blank\" rel=\"noopener\"><u>Monitoring the victim<\/u><\/a> using GPS or other electronic devices<\/li>\n<li><span data-term-id=\"40410103\">Surveilling<\/span> the victim in any manner<\/li>\n<\/ul>\n<p>To qualify as a <span data-term-id=\"40410099\">course of conduct<\/span>, the defendant must engage in the above behaviors more than once and over a <span data-term-id=\"40410145\">period of time<\/span>. For example, if an individual sent a single <span data-term-id=\"40410110\">text message<\/span> to their ex-spouse, it would not constitute stalking. However, if that same individual sent dozens of <span data-term-id=\"40410110\">text messages<\/span> each week to their ex for months on end, it would qualify as a <span data-term-id=\"40410099\">course of conduct<\/span> for stalking purposes.<\/p>\n<h3><span data-term-id=\"40410122\">Reasonable Fear<\/span> or <span data-term-id=\"40410102\">Emotional Distress<\/span><\/h3>\n<p>It&#8217;s not enough that a person engages in a <span data-term-id=\"40410099\">course of conduct<\/span> with an <span data-term-id=\"40410125\">alleged victim<\/span>. To be found guilty of stalking in <span data-term-id=\"40410098\">Arizona<\/span>, a defendant&#8217;s actions must also create a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-proof-do-you-need-to-get-a-restraining-order\/\"><span data-term-id=\"40410122\">reasonable fear<\/span><\/a> in the victim. This can be a <span data-term-id=\"40410120\">fear of death<\/span>, physical injury, damage to property, or any other type of danger.<\/p>\n<p>A person can also be guilty of stalking if their behavior causes <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/5-ways-to-prove-emotional-distress\/\"><span data-term-id=\"40410102\">emotional distress<\/span><\/a> in the victim. For instance, if a person makes a series of <span data-term-id=\"40410123\">phone calls<\/span> threatening to kill an individual&#8217;s pet, that will most certainly cause <span data-term-id=\"40410102\">emotional distress<\/span>.<\/p>\n<p>A person does not have to seek medical or psychological help to prove they suffered <span data-term-id=\"40410102\">emotional distress<\/span>. Requiring assistance, therapy, or counseling isn\u2019t required to secure a stalking conviction, but it helps in <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/how-to-prove-emotional-distress\/\">proving <span data-term-id=\"40410102\">emotional distress<\/span><\/a>.<\/p>\n<h3><span data-term-id=\"40410119\">Cyberstalking<\/span><\/h3>\n<p>Federal laws <a href=\"https:\/\/uscode.house.gov\/view.xhtml?edition=prelim&amp;num=0&amp;req=granuleid:USC-prelim-title18-section2261A\" target=\"_blank\" rel=\"noopener\">criminalize <span data-term-id=\"40410119\">cyberstalking<\/span><\/a>, making it illegal to use <span data-term-id=\"40410115\">electronic communications<\/span> to engage in a pattern of behavior meant to cause fear or <span data-term-id=\"40410102\">emotional distress<\/span> in another person. It\u2019s also addressed on the state level.<\/p>\n<p>Under <a href=\"https:\/\/www.findlaw.com\/state\/arizona-law\/arizona-criminal-laws.html\"><span data-term-id=\"40410104\">Arizona<\/span><span data-term-id=\"40410104\"> law<\/span><\/a>, a person who uses the internet to stalk another individual is guilty of either a <span data-term-id=\"40410100\">Class 5<\/span> or <span data-term-id=\"40410101\">Class 3<\/span> felony. The specific charge depends on the nature of the offense and whether the defendant threatened the victim with physical harm or death.<\/p>\n<p>The penalties for <span data-term-id=\"40410119\">cyberstalking<\/span> are the same as those for regular stalking. Both <span data-term-id=\"40410101\">Class 3<\/span> and <span data-term-id=\"40410100\">Class 5<\/span> felonies impose lengthy <span data-term-id=\"40410128\">prison time<\/span> and substantial fines.<\/p>\n<h2>Penalties for Stalking in <span data-term-id=\"40410098\">Arizona<\/span><\/h2>\n<p>In a stalking case, the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-criminal-charges-brought-against-someone.html\">prosecutor may file charges<\/a> as a\u00a0<span data-term-id=\"40410101\">Class 3<\/span>\u00a0or\u00a0<span data-term-id=\"40410100\">Class 5<\/span> felony. It depends on the facts of the case and the seriousness of the defendant&#8217;s behavior. A person who threatens their <span data-term-id=\"40410125\">alleged victim<\/span> with death will face more serious charges than someone who makes other types of threats. Those who make death threats <a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-702\/\" target=\"_blank\" rel=\"noopener\">will be charged with a <span data-term-id=\"40410101\">Class 3<\/span> felony offense<\/a>, which carries between two-and-a-half and seven years in state prison, along with fines of up to $150,000.<\/p>\n<p>A person accused of any other <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/5-ways-you-can-get-charged-with-stalking\/\">type of stalking<\/a> often faces <span data-term-id=\"40410100\">Class 5<\/span> felony charges. The penalties for this level of offense include fines of up to $150,000 and a <span data-term-id=\"40410147\">prison term<\/span> of between nine months and two years.<\/p>\n<p>These penalty ranges are presumptive and provide guidelines for sentencing. Judges have discretion to impose sentences outside these ranges based on the specific circumstances of the case. The judge can increase or decrease a defendant&#8217;s sentence based on <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/factors-considered-in-determining-sentences.html\">mitigating and aggravating factors<\/a>. For example, if a defendant used a deadly weapon while stalking an <span data-term-id=\"40410125\">alleged victim<\/span>, the judge may increase their maximum prison sentence to 8.75 years.<\/p>\n<p>It works the other way as well. A defendant who didn\u2019t use death threats and had no previous <span data-term-id=\"40410138\">criminal record<\/span> may find their sentence to six months instead of the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/types-of-sentences.html\">presumptive sentence<\/a> minimum of one-and-a-half years for a <span data-term-id=\"40410100\">Class 5<\/span> felony. Mitigating factors are usually only applied to a <span data-term-id=\"40410135\">first-time<\/span> offender. If a defendant in a stalking case has prior convictions, they&#8217;ll likely receive the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-sentencing.html\">maximum sentence<\/a>.<\/p>\n<h2>Possible Defenses to <span data-term-id=\"40410106\">Stalking Charges<\/span><\/h2>\n<p>As with any other crime, you have the right to raise <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-an-affirmative-defense.html\">affirmative defenses<\/a> to the <span data-term-id=\"40410130\">criminal charges<\/span> you face. Given the seriousness associated with <span data-term-id=\"40410106\">stalking charges<\/span>, it\u2019s a good time to consider getting professional <span data-term-id=\"40410142\">legal advice<\/span>. Facing a <span data-term-id=\"40410116\">misdemeanor<\/span> charge like shoplifting or petty theft is one thing, but felonies are much more serious. When you&#8217;re facing <span data-term-id=\"40410130\">criminal charges<\/span> that may result in a lengthy <span data-term-id=\"40410147\">prison term<\/span>, having a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/arizona\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">seasoned <span data-term-id=\"40410121\">criminal defense lawyer<\/span><\/a> by your side is a necessity.<\/p>\n<p>After reviewing your case, your attorney will decide on a specific <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-legal-help\/criminal-defense-strategies.html\">defense strategy<\/a>. The state of <span data-term-id=\"40410098\">Arizona<\/span> recognizes the following defenses to stalking:<\/p>\n<ul>\n<li><strong>Consent:<\/strong> If the victim consented to the communications, it does not qualify as stalking<\/li>\n<li><strong>Lack of intent:<\/strong> If you can prove that you didn&#8217;t intend to cause fear or <span data-term-id=\"40410102\">emotional distress<\/span>, the prosecutor should <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/what-is-a-lesser-included-offense.html\"><u>dismiss or reduce the charges<\/u><\/a><\/li>\n<li><strong><span data-term-id=\"40410140\">Constitutionally protected activity<\/span>:<\/strong> Your attorney may pursue a defense of free speech rights if feasible<\/li>\n<li><strong>No <span data-term-id=\"40410122\">reasonable fear<\/span>:<\/strong> A lawyer may be able to prove that your actions did not cause <span data-term-id=\"40410122\">reasonable fear<\/span> in the victim<\/li>\n<li><strong>Lack of <span data-term-id=\"40410102\">emotional distress<\/span>: <\/strong>The prosecutor must demonstrate that your behavior caused the victim to suffer <span data-term-id=\"40410102\">emotional distress<\/span><\/li>\n<li><strong><span data-term-id=\"40410112\">Legitimate purpose<\/span>:<\/strong> You may be able to convince the judge (or jury) that your communications served a <span data-term-id=\"40410112\">legitimate purpose<\/span>, such as shared custody issues<\/li>\n<\/ul>\n<p>In any criminal case, you may be able to argue that <span data-term-id=\"40410127\">law enforcement<\/span> conducted an illegal search and seizure. If you\u2019re arrested without a warrant or <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\">probable cause<\/a>, your attorney may be able to get the judge to deem the state&#8217;s evidence inadmissible.<\/p>\n<h2>What About a Defendant&#8217;s Freedom of Speech?<\/h2>\n<p>When someone is facing <span data-term-id=\"40410130\">criminal charges<\/span> for stalking, it may be tempting to claim that their actions qualify as <span data-term-id=\"40410140\">constitutionally protected activity<\/span>. Be aware that it\u2019s challenging to effectively employ this defense, despite the U.S. Supreme Court holding that certain types of speech and actions are <a href=\"https:\/\/constitution.findlaw.com\/amendment1.html\" target=\"_blank\" rel=\"noopener\">protected by the First Amendment<\/a>.<\/p>\n<p>A person can exercise their right of free speech in their communications with another person, but there are limits, as ruled in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/22-138.html\" target=\"_blank\" rel=\"noopener\"><em>Counterman v. Colorado<\/em><\/a> (2023). In <em>Counterman<\/em>, the court held that to secure a stalking conviction, the prosecutor must prove that the defendant was aware that their words or actions could pose a risk of threatening the victim. Adopting a <a href=\"https://www.findlaw.com/static/f/files\/pdf\/injury\/injury.findlaw.com_accident-injury-law_recklessness.pdf\" target=\"_blank\" rel=\"noopener\">recklessness standard<\/a>, a defendant must demonstrate a conscious disregard for the substantial risk that a <span data-term-id=\"40410118\">reasonable person<\/span> would view their behavior as a threat of violence.<\/p>\n<h2>How Does an <span data-term-id=\"40410124\">Order of Protection<\/span> Impact a Stalking Case?<\/h2>\n<p>If a person violates an existing <span data-term-id=\"40410124\">order of protection<\/span> while engaging in stalking, it can impact their case in two important ways. First, violating the protective order is itself a separate criminal offense. Second, the existence of a violated protective order may serve as an aggravating factor that can enhance the penalties for the underlying <span data-term-id=\"40410106\">stalking charge<\/span>.<\/p>\n<p>When someone is accused of violating an <span data-term-id=\"40410124\">order of protection<\/span>, the specific charges depend on the circumstances. For a <span data-term-id=\"40410135\">first-time<\/span> violation of a protective order, a person may face Class 1 <span data-term-id=\"40410116\">misdemeanor<\/span> charges. If the defendant has prior <span data-term-id=\"40410141\">felony convictions<\/span> or this is their second or subsequent violation of the order, the state may charge them with a <span data-term-id=\"40410100\">Class 5<\/span> felony.<\/p>\n<p>Violating an existing <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-proof-do-you-need-to-get-a-restraining-order\/\"><span data-term-id=\"40410143\">restraining order<\/span><\/a> or <span data-term-id=\"40410124\">order of protection<\/span> is often considered an aggravating factor.
