The decision to rent out your property as a landlord or to lease property as a tenant comes with various legal rights and responsibilities. Each state, including Arizona, has developed laws that set forth the obligations and rights of tenants<\/a>. These laws inform tenants of important issues like payment of rent, security deposits, living conditions and habitability, terminating a lease, discrimination, and retaliation.<\/p>\r\n

  • Security Deposit Limit<\/i>: cannot exceed one and one-half times rent.<\/li>\r\n

When a tenancy can be terminated depends on the circumstances:<\/p>\r\n

    \r\n
  • Landlord or tenant can terminate a week-to-week tenancy by giving 10 days’ written notice and can terminate a monthly tenancy with 30 days’ written notice.<\/li>\r\n
  • In the event of non-payment of rent, landlord must give 5 days’ notice to pay rent before commencing eviction proceedings.<\/li>\r\n
  • If the tenant fails to maintain the unit, landlord can give 5 days’ notice to cure, and thereafter can evict.<\/li>\r\n
  • If tenant violates the rental agreement, landlord can give 10 days’ notice to quit.<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>
Discrimination<\/b><\/td>\r\n

A landlord can’t discriminate against tenants on the basis of race, gender, religion, national origin, familial status, or disability.<\/p>\r\n<\/td>\r\n<\/tr>

Retaliation<\/b><\/p>\r\n<\/td>\r\n

A landlord can’t retaliate against a tenant for exercising legal rights by increasing rent, decreasing services, or threatening to evict a tenant.<\/p>\r\n<\/td>\r\n<\/tr><\/tbody><\/table>\r\n
