The <a href=\"https:\/\/codes.findlaw.com\/az\/title-23-labor\/az-rev-st-sect-23-1501\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52778130\">Arizona<\/span><span data-term-id=\"52778130\"> Employment Protection Act<\/span><\/a> (<span data-term-id=\"52778151\">AEPA<\/span>) prohibits the termination of an employee under very specific grounds. Not all <span data-term-id=\"52778159\">adverse employment action<\/span> falls under the <span data-term-id=\"52778151\">AEPA<\/span>. The employee must report violations of state or <span data-term-id=\"52778123\">federal law<\/span> and have been terminated because of their actions. Harassment or other adverse treatment (such as <span data-term-id=\"52778122\">demotion<\/span>) is not sufficient, although an employee can claim constructive termination if the harassment caused them to quit.<\/p>\n<p><span data-term-id=\"52778128\">Arizona<\/span><span data-term-id=\"52778128\">\u2019s <\/span><span data-term-id=\"52778128\">whistleblower<\/span><span data-term-id=\"52778128\"> law<\/span> extends the\u00a0<span data-term-id=\"52778126\">state law<\/span>\u00a0passed in the 1980s that protects\u00a0<span data-term-id=\"52778155\">public employees<\/span>\u00a0who report workplace safety violations. The <span data-term-id=\"52778130\">Arizona<\/span><span data-term-id=\"52778130\"> Employment Protection Act<\/span> (<span data-term-id=\"52778151\">AEPA<\/span>) extends coverage to all workers in all jobs.<\/p>\n<h3>What Is <span data-term-id=\"52778119\">Whistleblowing<\/span>?<\/h3>\n<p>Some companies can get away with unethical or illegal behavior. The government relies on inspectors and auditors to find evidence of wrongdoing, but those investigations take time. More often, proof of wrongdoing comes from inside. Employees who have proof of violations report the crime to government agencies. The term \u201c<a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers.html\"><span data-term-id=\"52778119\">whistleblowers<\/span><\/a>\u201d originated with old mill workers who would pull a whistle to stop work.<\/p>\n<p><span data-term-id=\"52778119\">Whistleblowers<\/span> were, and still are, subject to harassment and retaliation for their acts. To help ensure that their valuable help continues, the <span data-term-id=\"52778152\">federal government<\/span> and state legislatures enacted <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protection-act-an-overview.html\"><span data-term-id=\"52778121\">whistleblower<\/span><span data-term-id=\"52778121\"> protection<\/span> laws<\/a>. These laws give <span data-term-id=\"52778119\">whistleblowers<\/span> legal recourse against retaliatory termination and harassment.<\/p>\n<h3><span data-term-id=\"52778128\">Arizona<\/span><span data-term-id=\"52778128\">\u2019s <\/span><span data-term-id=\"52778128\">Whistleblower<\/span><span data-term-id=\"52778128\"> Laws<\/span><\/h3>\n<p><span data-term-id=\"52778120\">Arizona<\/span> has two <span data-term-id=\"52778121\">whistleblower<\/span><span data-term-id=\"52778121\"> protection<\/span> statutes. They work together to protect both public and <span data-term-id=\"52778160\">private sector employees<\/span>.<\/p>\n<p>Private employees are protected from <span data-term-id=\"52778138\">wrongful termination<\/span> only under the <span data-term-id=\"52778151\">AEPA<\/span>. This coverage includes being fired for any of the following reasons:<\/p>\n<ul>\n<li>Refusing to commit an act or failing to perform an action that would violate the <span data-term-id=\"52778136\">Arizona<\/span><span data-term-id=\"52778136\"> Constitution<\/span> or any <span data-term-id=\"52778133\">Arizona<\/span><span data-term-id=\"52778133\"> statute<\/span><\/li>\n<li>Disclosing any information where the employee reasonably believes that the employer or another employee has violated the state constitution or <span data-term-id=\"52778126\">state law<\/span>, and has reported such belief to management or any <span data-term-id=\"52778132\">public body<\/span><\/li>\n<li>Claiming <span data-term-id=\"52778141\">workers\u2019 compensation<\/span> protection<\/li>\n<li>Serving on a jury, voting, or exercising a \u201cright-to-work\u201d choice<\/li>\n<\/ul>\n<p>If a statute has a separate reporting and protection clause, employees must use it if they face retaliation for reporting under it.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/az\/title-38-public-officers-and-employees\/az-rev-st-sect-38-532\/\" target=\"_blank\" rel=\"noopener\">Violation reporting by state employees<\/a> is governed by the <span data-term-id=\"52778120\">Arizona<\/span> Revised Statutes (<span data-term-id=\"52778140\">A.R.S<\/span>.). This statute protects civil employees who report <span data-term-id=\"52778127\">mismanagement<\/span> or <span data-term-id=\"52778131\">abuse of authority<\/span> in a government agency. The law prohibits any retaliatory disciplinary action, including:<\/p>\n<ul>\n<li><span data-term-id=\"52778122\">Demotion<\/span>, suspension, or dismissal<\/li>\n<li>Disciplinary or corrective action<\/li>\n<li>Adverse performance evaluations<\/li>\n<li>Transfer or reassignment without merit<\/li>\n<li>Elimination of a position without cause<\/li>\n<\/ul>\n<p>The primary difference between the two laws is that the <span data-term-id=\"52778151\">AEPA<\/span> only protects workers after termination. The <span data-term-id=\"52778126\">state law<\/span> protects state workers who are still employed.<\/p>\n<h2>How To Report Violations<\/h2>\n<p><span data-term-id=\"52778145\">Arizona<\/span><span data-term-id=\"52778145\"> employees<\/span> who want to ensure they have <span data-term-id=\"52778121\">whistleblower<\/span><span data-term-id=\"52778121\"> protections<\/span> before filing a complaint must follow the proper procedure. The best way is to speak to <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">an employment attorney<\/a> about your concerns. <span data-term-id=\"52778123\">Federal laws<\/span> may give you the right to compensation, but you must report under certain federal regulations.<\/p>\n<ul>\n<li>You must make the report in <span data-term-id=\"52778144\">good faith<\/span>. This means you must have either proof or a <span data-term-id=\"52778134\">reasonable belief<\/span> that the violation is occurring or is about to occur.<\/li>\n<li>You must report the violation to someone in a managerial position you reasonably believe has the authority to investigate the offense. The violation must be reported within your company before the state or <span data-term-id=\"52778152\">federal government<\/span> can become involved.<\/li>\n<li>If you cannot reasonably or safely report within your company, you must make the report to a \u201c<span data-term-id=\"52778132\">public body<\/span>.\u201d These include political agencies or government divisions.<\/li>\n<\/ul>\n<p>In some cases, the law provides its own reporting agency. For instance, occupational health and safety concerns should be reported to the <a href=\"https:\/\/www.azica.gov\/forms\/adosh-whistleblower-discrimination-whistleblower-complaint-form\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52778120\">Arizona<\/span> Division of <span data-term-id=\"52778143\">Occupational Safety<\/span> and Health<\/a> (ADOSH). The department also handles retaliation complaints.<\/p>\n<p>State employees must file retaliation complaints with the <span data-term-id=\"52778120\">Arizona<\/span> State Personnel Board within ten business days of any suspected retaliatory action. These complex reporting requirements and deadlines make a strong argument for <span data-term-id=\"52778119\">whistleblowers<\/span> to consult with an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> before making any reports.<\/p>\n<h2>Penalties and Remedies<\/h2>\n<p>Penalties for employers who violate the <span data-term-id=\"52778121\">whistleblower<\/span><span data-term-id=\"52778121\"> protection<\/span> laws depend on whether the employer is private or public. The law provides workers with a civil cause of action against their employer, allowing them to sue for damages. The <span data-term-id=\"52778151\">AEPA<\/span> allows employees to recover:<\/p>\n<ul>\n<li>Back pay, front pay, lost benefits, and other income due to termination<\/li>\n<li>Compensatory damages, such as emotional distress and loss of reputation<\/li>\n<li><span data-term-id=\"52778129\">Attorney fees<\/span> and costs<\/li>\n<li>Punitive damages if the termination or constructive termination was intentional, malicious, or egregiously retaliatory<\/li>\n<\/ul>\n<p>Public service employees may recover:<\/p>\n<ul>\n<li>Full reinstatement<\/li>\n<li>Double back pay<\/li>\n<li>Injunctive relief<\/li>\n<li><span data-term-id=\"52778129\">Attorney fees<\/span> and costs<\/li>\n<\/ul>\n<p>An individual supervisor or employee who committed the prohibited personnel practice may be ordered to pay up to $5,000 into the state general fund.<\/p>\n<h2><span data-term-id=\"52778149\">Qui Tam<\/span> Actions and Federal <span data-term-id=\"52778119\">Whistleblowing<\/span><\/h2>\n<p>The <span data-term-id=\"52778152\">federal government<\/span> considers fraud a matter of great <span data-term-id=\"52778150\">public concern<\/span>. To encourage private individuals to report fraud against the government, it created <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protections-in-qui-tam-actions.html\"><em><span data-term-id=\"52778149\">qui tam<\/span><\/em> actions<\/a>. These allow private citizens to be awarded some of the money recovered when the government acts on their information.<\/p>\n<p>A <em><span data-term-id=\"52778149\">qui tam<\/span><\/em> action requires a claimant to follow many government guidelines regarding what can be reported and how it must be delivered to government agents.
