These laws exist to help families keep their homes, even if they face lawsuits or unpaid debts. The other possibility is that you may file for Chapter 7 or Chapter 13 bankruptcy, where the exemption determines how much home equity you keep instead of giving it up to the bankruptcy estate.<\/p>\n<p>The <span data-term-id=\"52741984\">Arkansas<\/span> <span data-term-id=\"52741968\">homestead exemption<\/span> is addressed directly in the state constitution, rather than in <span data-term-id=\"52741975\">state law<\/span>. <a href=\"https:\/\/codes.findlaw.com\/ar\/arkansas-constitution-of-1874\/ar-const-art-9-sect-3\/\" target=\"_blank\" rel=\"noopener\">Article 9 of the\u00a0<span data-term-id=\"52741967\">Arkansas<\/span>\u00a0Constitution<\/a> provides the core protection. The state legislature later codified and clarified those protections through the <span data-term-id=\"52741968\">Homestead Exemption<\/span> Act.<\/p>\n<p>You don\u2019t need to file a formal declaration to get this protection. It applies automatically if you are married or the <span data-term-id=\"52741976\">head of a family and the property is\u00a0<\/span>your main home. If you file for bankruptcy, you\u2019ll need to claim the exemption using the appropriate paperwork.<\/p>\n<p>The <span data-term-id=\"52741967\">Arkansas<\/span> Constitution includes a $2,500 value cap for homesteads above the minimum protected acreage, which hasn\u2019t changed since being set decades ago. <span data-term-id=\"52741967\">Arkansas<\/span> lawmakers never adjusted it for inflation, leaving the <span data-term-id=\"52741984\">Arkansas<\/span> <span data-term-id=\"52741968\">homestead exemption<\/span> unusually low compared to neighboring states. However, the acreage-based structure of the <span data-term-id=\"52741967\">Arkansas<\/span> homestead law fills that limitation.<\/p>\n<h2><span data-term-id=\"52741968\">Homestead Exemption<\/span> Limits in <span data-term-id=\"52741967\">Arkansas<\/span><\/h2>\n<p><span data-term-id=\"52741967\">Arkansas<\/span> is among the few states that tie <span data-term-id=\"52741997\">homestead protection<\/span> to acreage. The <span data-term-id=\"52741967\">Arkansas<\/span> Constitution protects a homestead up to a maximum acreage, subject to a $2,500 value cap. It also guarantees a minimum acreage that is protected regardless of value. This depends on location:<\/p>\n<ul>\n<li><strong>If your property sits in a city, town, or village<\/strong>: The <a href=\"https:\/\/codes.findlaw.com\/ar\/arkansas-constitution-of-1874\/ar-const-art-9-sect-5\/\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"52741967\">Arkansas<\/span> Constitution<\/u><\/a> protects an urban homestead of up to one acre, as long as it does not exceed $2,500 in value. If the homestead&#8217;s value exceeds $2,500, it is still protected up to one-quarter acre, regardless of value.<\/li>\n<li><strong>If your property sits outside city limits<\/strong>: The exemption protects a rural homestead of up to 160 acres, as long as it does not exceed $2,500 in value. If the homestead&#8217;s value exceeds $2,500, it\u2019s still protected up to 80 acres, regardless of value.<\/li>\n<\/ul>\n<p>Whether you own up to a quarter acre in a town or up to 80 acres in the country, that minimum amount of land stays protected no matter what it\u2019s worth. For acreage above those minimums, protection depends on whether the homestead stays within the constitution&#8217;s $2,500 value cap under the acreage maximums.<\/p>\n<p><span data-term-id=\"52741972\">Arkansas<\/span><span data-term-id=\"52741972\"> law<\/span> also provides a smaller, alternative protection if you do not qualify for the full <span data-term-id=\"52741968\">homestead exemption<\/span>. This applies if you are unmarried and not the <span data-term-id=\"52741988\">head of household<\/span>. Under a\u00a0<a href=\"https:\/\/codes.findlaw.com\/ar\/title-16-practice-procedure-and-courts\/ar-code-sect-16-66-218\/\" target=\"_blank\" rel=\"noopener\"><u>separate exemption for property<\/u><\/a>\u00a0used as a residence in a bankruptcy filing, an unmarried debtor may exempt up to $800 in equity. A married debtor may exempt up to $1,250. This lower-tier exemption covers <span data-term-id=\"52741970\">real property<\/span> or <span data-term-id=\"52741977\">personal property<\/span> used as a residence. It also includes certain cooperative interests and burial plots, and works independently of the acreage-based homestead described above.<\/p>\n<h2>Understanding the Federal 1,215-Day Rule<\/h2>\n<p>If you bought your home <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/#:~:text=(p)(1)%20Except,in%20value%20in%2D%2D\" target=\"_blank\" rel=\"noopener\">within the last 1,215 days<\/a> (about three years and four months), a federal cap may limit how much of <span data-term-id=\"52741967\">Arkansas<\/span>&#8216;s <span data-term-id=\"52741968\">homestead exemption<\/span> you can claim in bankruptcy. The cap applies regardless of how generous <span data-term-id=\"52741967\">Arkansas<\/span>\u2019 <span data-term-id=\"52741994\">homestead exemption<\/span><span data-term-id=\"52741994\"> law<\/span> is. This federal limit adjusts every three years for inflation and is <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/02\/04\/2025-02207\/adjustment-of-certain-dollar-amounts-applicable-to-bankruptcy-cases\" target=\"_blank\" rel=\"noopener\">$214,000 as of April 1, 2025<\/a>.<\/p>\n<h2>Choosing Between the State or Federal Exemptions<\/h2>\n<p>Because <span data-term-id=\"52741967\">Arkansas<\/span>&#8216;s $2,500 cap is so low, many <span data-term-id=\"52741986\">property owners<\/span> with substantial equity opt to use the <span data-term-id=\"52741985\">federal <\/span><span data-term-id=\"52741968\">homestead exemption<\/span> rather than the <span data-term-id=\"52741982\">state exemption<\/span>. You must choose either one or the other, as mixing and matching isn\u2019t permitted. Under the federal exemption schedule effective April 1, 2025, a single filer can shield $31,575 of home equity. Spouses who co-own the home may combine their exemptions for a total of $63,150.<\/p>\n<p>To use <span data-term-id=\"52741967\">Arkansas<\/span>&#8216; state <span data-term-id=\"52741983\">bankruptcy exemptions<\/span> in a filing, you must have been domiciled in <span data-term-id=\"52741967\">Arkansas<\/span> for at least 730 days (two years) before filing. If you have not lived in <span data-term-id=\"52741967\">Arkansas<\/span> that long, you can use the exemptions of whichever state you lived in for the greater part of the 180 days before that two-year period.<\/p>\n<p>Unsure which option protects more of your equity? The exemption is not limited to a detached single-family home. It can extend to other forms of residential property, though the specific facts of ownership matter.<\/p>\n<p>If you have a\u00a0<span data-term-id=\"52741968\">homestead exemption<\/span>\u00a0and pass away, <a href=\"https:\/\/codes.findlaw.com\/ar\/title-16-practice-procedure-and-courts\/ar-code-sect-16-66-210\/\" target=\"_blank\" rel=\"noopener\">the <span data-term-id=\"52741968\">Homestead Exemption<\/span> Act<\/a> allows your minor children to retain the protection. This means the home stays protected from most creditors, helping your family keep their residence during a difficult time.<\/p>\n<p>If your rural homestead is annexed into a city or town, <a href=\"https:\/\/codes.findlaw.com\/ar\/title-16-practice-procedure-and-courts\/ar-code-sect-16-66-210\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52741972\">Arkansas<\/span><span data-term-id=\"52741972\"> law<\/span> <\/a>allows it to retain its rural status and the larger 80- to 160-acre protection. This applies as long as the land still has a rural character and is mainly used for agriculture.<\/p>\n<h2>Claiming a <span data-term-id=\"52741968\">Homestead Exemption<\/span> in <span data-term-id=\"52741967\">Arkansas<\/span><\/h2>\n<p>Since the <span data-term-id=\"52741968\">homestead exemption<\/span> is part of the state constitution, there\u2019s no need to file a separate application to get protection from judgment creditors. The exemption attaches automatically to a qualifying <span data-term-id=\"52741969\">homeowner<\/span>-occupant&#8217;s main residence. If you need to assert the exemption in a lawsuit or in a judgment, be prepared to provide proof of ownership and occupancy. This can include a deed, utility bills, or other documents showing the property is your <span data-term-id=\"52741974\">primary residence<\/span>.<\/p>\n<p>Claiming the exemption in bankruptcy is a more formal process. You must complete the following steps:<\/p>\n<ul>\n<li><strong>List the home on Schedule A\/B: Property<\/strong>:\u00a0This is the bankruptcy form used to disclose all <span data-term-id=\"52741989\">real estate<\/span> you own<\/li>\n<li><strong>Claim the applicable <span data-term-id=\"52741981\">exemption amount<\/span> on Schedule C: The Property You Claim as Exempt<\/strong>:\u00a0Specify either the <span data-term-id=\"52741984\">Arkansas<\/span> <span data-term-id=\"52741968\">homestead exemption<\/span> or the federal exemption<\/li>\n<li><strong>Declare your intentions regarding the property on the Statement of Intention if you are filing under <span data-term-id=\"52741992\">Chapter 7 bankruptcy<\/span><\/strong>: This means stating whether you plan to keep or surrender the home<\/li>\n<li><strong>Attend the 341 meeting of creditors<\/strong>:\u00a0The bankruptcy trustee and any creditors who appear may ask questions about your claimed exemption<\/li>\n<\/ul>\n<p><span data-term-id=\"52741967\">Arkansas<\/span>&#8216;s <span data-term-id=\"52741968\">homestead exemption<\/span> for creditor protection is different from the state&#8217;s <a href=\"https:\/\/www.dfa.arkansas.gov\/office\/arkansas-assessment-coordination-division\/real-property\/property-tax-relief\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52741991\">homestead <\/span><span data-term-id=\"52741971\">property<\/span> <span data-term-id=\"52742000\">tax<\/span><span data-term-id=\"52742000\"> credit<\/span><\/a> under\u00a0Amendment 79. The <span data-term-id=\"52742000\">tax\u00a0credit<\/span>, worth up to $600 starting with 2026 tax bills, lowers your annual <span data-term-id=\"52741971\">property tax<\/span> bill and must be claimed separately with your county <span data-term-id=\"52741987\">assessor<\/span>&#8216;s office. It does not protect your home from creditors and is not the same as the exemption described here.<\/p>\n<h2>Debts That Can Still Affect Your Homestead<\/h2>\n<p>The <span data-term-id=\"52741993\">state of <\/span><span data-term-id=\"52741984\">Arkansas<\/span> <span data-term-id=\"52741994\">homestead exemption<\/span><span data-term-id=\"52741994\"> laws<\/span> are broad but not absolute. Your homestead remains subject to certain categories of debt even when the exemption applies. This includes:<\/p>\n<ul>\n<li><strong>Purchase-money debt<\/strong>:\u00a0Includes a mortgage or other lien used to buy the home itself<\/li>\n<li><strong>Mechanic&#8217;s and laborer&#8217;s liens<\/strong>:\u00a0Covers debts owed for labor or materials used to improve the homestead<\/li>\n<li><strong>Taxes<\/strong>:\u00a0Includes <span data-term-id=\"52741971\">property taxes<\/span> owed on the homestead<\/li>\n<li><strong>Fiduciary debts<\/strong>: Covers money you owe while acting as an executor, administrator, guardian, receiver, or attorney holding funds collected on someone else&#8217;s behalf, or as a trustee of an express trust<\/li>\n<\/ul>\n<p>The federal <a href=\"https:\/\/codes.findlaw.com\/us\/title-11-bankruptcy\/11-usc-sect-522\/#:~:text=(p)(1)%20Except,in%20value%20in%2D%2D\" target=\"_blank\" rel=\"noopener\">1,215-day acquisition rule<\/a> can also affect your <span data-term-id=\"52741968\">homestead exemption<\/span>. If you recently acquired your homestead, you may not get the full benefit of <span data-term-id=\"52741967\">Arkansas<\/span>&#8216;s <span data-term-id=\"52741983\">bankruptcy exemption<\/span>, regardless of where or how large your property is. Courts and bankruptcy trustees can also reverse transfers made to avoid paying creditors.
