In addition to common residential and <span data-term-id=\"42064734\">commercial structures<\/span>, the burglary statute covers:<\/p>\n<ul>\n<li>Tents, campers, and trailers<\/li>\n<li><span data-term-id=\"42064766\">Railroad cars<\/span> and aircraft<\/li>\n<li>Locked or sealed cargo containers<\/li>\n<li>Mines<\/li>\n<\/ul>\n<p>A property is considered \u201cinhabited\u201d if anyone lives there, regardless of whether they\u2019re home at the time of the burglary or not. The property remains a \u201cdwelling\u201d under the law if the residents have relocated due to a natural disaster or other emergency,<\/p>\n<h3><strong><span data-term-id=\"42064708\">First-Degree Burglary<\/span><\/strong><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/penal-code\/pen-sect-460\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42064708\">First-degree burglary<\/span><\/a> involves entering an <span data-term-id=\"42064741\">inhabited dwelling<\/span>. The residents do not need to be present for the crime to be charged as <span data-term-id=\"42064708\">first-degree burglary<\/span>.<\/p>\n<h3><strong><span data-term-id=\"42064707\">Second-Degree Burglary<\/span><\/strong><\/h3>\n<p>All other burglaries are <span data-term-id=\"42064707\">second-degree burglaries<\/span>. The <span data-term-id=\"42064756\">value of the property<\/span> must remain below $950 (<span data-term-id=\"42064716\">petty theft<\/span>). <span data-term-id=\"42064725\">Shoplifting<\/span> is the only <span data-term-id=\"42064748\">type of <\/span><span data-term-id=\"42064736\">burglary<\/span><span data-term-id=\"42064736\"> offense<\/span> where the time of day is one of the <span data-term-id=\"42064742\">elements of the crime<\/span>.<\/p>\n<h3><strong><span data-term-id=\"42064746\">Possession of Burglary Tools<\/span><\/strong><\/h3>\n<p>The legality of <a href=\"https:\/\/codes.findlaw.com\/ca\/penal-code\/pen-sect-466\/\" target=\"_blank\" rel=\"noopener\">burglary tools<\/a>, like drug paraphernalia, depends on the circumstances. Lockpicks, master keys, screwdrivers, or crowbars are reasonable things to have at some places and some times. Center punches (used to break car windows), foil-lined bags (\u201cbooster bags\u201d), and other items are less innocent. If someone enters a store without any money and with no ability to pay, a <span data-term-id=\"42064770\">police officer<\/span> could infer that they intended to shoplift after they take items and exit the store.<\/p>\n<h2><strong>Penalties for Burglary<\/strong><\/h2>\n<p>Sanctions for burglary in California vary and depend on a number of factors. The penalties include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"42064708\">First-degree burglary<\/span> <\/strong>is a felony with possible penalties of two, four, or six years in prison. Defendants may also receive fines of up to $1,000 and have to pay restitution to the victims. <span data-term-id=\"42064708\">First-degree <\/span><span data-term-id=\"42064728\">burglary<\/span><span data-term-id=\"42064728\"> convictions<\/span> count under <span data-term-id=\"42064722\">California\u2019s three-strikes law<\/span>.<\/li>\n<li><strong><span data-term-id=\"42064707\">Second-degree burglary<\/span> <\/strong>is a \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/common-criminal-law-questions.html\"><span data-term-id=\"42064714\">wobbler<\/span><\/a>\u201d offense.
