These laws expand federal civil rights protections by covering more protected classes, such as <span data-term-id=\"52846847\">gender identity<\/span> and <span data-term-id=\"52846825\">medical conditions.<\/span><\/p>\n\n    <\/div>\n\n\n\n<p>Civil rights laws prevent discrimination in a range of daily activities. Employment, housing, education, and the right to marry are all part of your civil rights. The U.S. Constitution guarantees most civil rights, and <span data-term-id=\"52846827\">federal laws<\/span> cover the remainder at the national level.<\/p>\n<p>State civil rights laws typically mirror <span data-term-id=\"52846827\">federal laws<\/span>. <span data-term-id=\"52846817\">State laws<\/span> may expand on <span data-term-id=\"52846827\">federal laws<\/span>, provided they do not infringe on <span data-term-id=\"52846827\">federal laws<\/span> or violate constitutional rights.<\/p>\n<p><span data-term-id=\"52846818\">California civil rights laws<\/span> contain more protected classes and cover a wider range of employers and businesses. California is noteworthy for supporting immigration rights and LGBTQ+ protections.<\/p>\n<h2><span data-term-id=\"52846818\">California Civil Rights Laws<\/span><\/h2>\n<p><span data-term-id=\"52846832\">Californians<\/span> have the same civil rights as <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/civil-rights-laws.html\">all other U.S. citizens<\/a>. <span data-term-id=\"52846818\">California civil rights laws<\/span> are codified in the California State Code and enforced by various branches of the state government.<\/p>\n<h3>The <span data-term-id=\"52846853\">Unruh <\/span><span data-term-id=\"52846815\">Civil Rights Act<\/span><\/h3>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ca\/civil-code\/civ-sect-51.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52846853\">Unruh <\/span><span data-term-id=\"52846815\">Civil Rights Act<\/span> of 1959<\/a> broadly prevents any business from discriminating against anyone on the basis of any protected category, including:<\/p>\n<ul>\n<li>Race or ethnicity<\/li>\n<li>Religion or creed<\/li>\n<li><span data-term-id=\"52846813\">National origin<\/span><\/li>\n<li>Gender, <span data-term-id=\"52846814\">sexual orientation<\/span>, or <span data-term-id=\"52846847\">gender identity<\/span><\/li>\n<li>Age or <span data-term-id=\"52846825\">medical condition<\/span><\/li>\n<li>Disability, including mental health<\/li>\n<\/ul>\n<p>California courts have consistently ruled that the law protects other classes beyond those listed in the Act, and that a \u201cbusiness\u201d may include any entity engaged in commercial activities, such as school sales that raise money from outside sources. The Unruh Act contains provisions for other types of discrimination, such as housing and <span data-term-id=\"52846826\">employment discrimination<\/span>. Other California laws add protections and rights.<\/p>\n<h3>Fair Employment and Housing<\/h3>\n<p>The <span data-term-id=\"52846819\">Fair Employment and Housing Act<\/span> (<span data-term-id=\"52846822\">FEHA<\/span>) (<a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-12940\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52846829\">Government Code<\/span> \u00a7 12940<\/a> <span data-term-id=\"52846843\">et seq<\/span>.) prevents an employer from refusing to hire any qualified individual solely because they belong to a protected category. The <span data-term-id=\"52846822\">FEHA<\/span> provides protection for employees who are not qualified for legitimate reasons, such as medical issues.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-12955\/\" target=\"_blank\" rel=\"noopener\">California\u2019s <span data-term-id=\"52846829\">government code<\/span><\/a> prevents anyone from discriminating in the sale, rental, or leasing of a housing accommodation because of their race, religion, gender, or other protected characteristic. The law prohibits discrimination in any <span data-term-id=\"52846838\">public accommodations<\/span>, such as motels and hotels. It also applies to Airbnb and other short-term rentals. The <span data-term-id=\"52846830\">Department of Fair Employment and Housing<\/span> (<span data-term-id=\"52846831\">DFEH<\/span>), now called the <a href=\"https:\/\/calcivilrights.ca.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52846824\">California <\/span><span data-term-id=\"52846812\">Civil Rights Department<\/span><\/a>, handles all complaints and concerns related to unfair housing and <span data-term-id=\"52846837\">employment practices<\/span>.<\/p>\n<h3>Family Rights<\/h3>\n<p>A cluster of <span data-term-id=\"52846815\">civil rights acts<\/span> protects <span data-term-id=\"52846842\">familial status<\/span> and marital rights. The <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/family-and-medical-leave-laws-by-state.html\"><span data-term-id=\"52846858\">California Family Rights Act<\/span> <\/a>provides employees with up to 12 weeks of unpaid job-protected leave for family and medical reasons. In most cases, this leave runs concurrently with the leave provided by the federal <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/family-and-medical-leave-act.html\">Family and Medical Leave Act (FMLA)<\/a>. It can also run consecutively, giving employees more time. If you have a pregnancy-related disability, you are covered under <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-12945\/\" target=\"_blank\" rel=\"noopener\">Pregnancy Disability Leave<\/a>.<\/p>\n<p>The CFRA also gives employees the right to take leave for:<\/p>\n<ul>\n<li>Child bonding after <span data-term-id=\"52846860\">childbirth<\/span>, adoption, or foster placement<\/li>\n<li>Bereavement<\/li>\n<li>Reproductive loss after miscarriage, stillbirth, or failed adoption<\/li>\n<li>Violence survivors leave for victims of domestic or other types of violence<\/li>\n<\/ul>\n<p>The CFRA applies to any employer with more than five employees.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ca\/civil-code\/civ-sect-51-7\/\" target=\"_blank\" rel=\"noopener\">Ralph <span data-term-id=\"52846815\">Civil Rights Act<\/span><\/a> protects individuals against hate crimes and other forms of targeted violence. This includes intimidation or threats of violence, threatening to report the victim to <span data-term-id=\"52846840\">law enforcement<\/span>, or distribution of materials on the victim\u2019s property with the intent to terrorize.<\/p>\n<h3>Disability Rights<\/h3>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/ca\/civil-code\/civ-sect-54\/\" target=\"_blank\" rel=\"noopener\">Disabled Persons Act<\/a> guarantees equal access to all public places, facilities, buildings, and transportation to individuals with disabilities. The term \u201cdisability\u201d means any physical disability or any mental disability as defined by California law.<\/p>\n<p>The act mirrors the federal <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">Americans with Disabilities Act (ADA)<\/a>. The laws cover access to employment, housing, and education for all individuals, with\u00a0<span data-term-id=\"52846856\">reasonable accommodations<\/span>, provided they are otherwise qualified for the position.<\/p>\n<p><span data-term-id=\"52846854\">Housing discrimination<\/span> under the Disabled Persons Act is handled by the <span data-term-id=\"52846824\">California <\/span><span data-term-id=\"52846812\">Civil Rights Department<\/span> (<span data-term-id=\"52846816\">CRD<\/span>). Employment matters should be referred to the <span data-term-id=\"52846850\">Equal Employment Opportunity Commission<\/span> (<span data-term-id=\"52846855\">EEOC<\/span>) or the <span data-term-id=\"52846824\">California <\/span><span data-term-id=\"52846812\">Civil Rights Department<\/span>.<\/p>\n<h2>Sanctuary Laws<\/h2>\n<p>California\u2019s powerful, though misunderstood, status as a \u201csanctuary state\u201d has earned it accolades and criticism from other government officials. The sanctuary laws encompass two specific areas of civil rights: LGBTQ+ rights and immigrant rights.<\/p>\n<h3>LGBTQ+ Protections<\/h3>\n<p>California was one of the first states to protect the rights of LGBTQ+ individuals to marry, be eligible for <span data-term-id=\"52846839\">health care<\/span>, and access other services. In addition to robust marriage rights and domestic partnership protections, California laws prevent <span data-term-id=\"52846840\">law enforcement<\/span> agencies from sending information about legal gender-affirming care to out-of-<span data-term-id=\"52846834\">state agencies<\/span>. California law:<\/p>\n<ul>\n<li>Gives California courts primary jurisdiction in custody disputes over cases involving transgender youth and prevents out-of-state entities from obtaining information about California <span data-term-id=\"52846839\">health care<\/span> providers who offer legal gender-affirming care to California residents<\/li>\n<li>Requires foster care agencies to provide gender-affirming care for transgender youth in placement<\/li>\n<li>Prohibits discrimination against LGBTQ+ individuals and families in housing, employment, and other <span data-term-id=\"52846838\">public accommodations<\/span><\/li>\n<li>Prohibits the forced outing of LGBTQ+ students to their parents under the SAFETY Act<\/li>\n<\/ul>\n<p>These laws primarily counter laws in other states that criminalize providing gender-affirming care to minors. They provide safe havens for families and minors seeking such care, as well as for medical professionals providing treatment.<\/p>\n<h3>Undocumented Immigrant Rights<\/h3>\n<p>The California Values Act (SB 54), passed in 2018, creates limits on what state and local <span data-term-id=\"52846840\">law enforcement<\/span> can do to assist federal immigration agents in enforcing federal immigration law. \u201cSanctuary laws\u201d do not prevent federal agents from performing their jobs in California, but they do:<\/p>\n<ul>\n<li>Prevent state and local <span data-term-id=\"52846840\">law enforcement<\/span> from detaining individuals for immigration purposes<\/li>\n<li>Prohibit the use of state and local resources for federal enforcement purposes<\/li>\n<li>Prevent state and local officers from investigating, interrogating, or detaining individuals for federal immigration purposes<\/li>\n<li>Limit the transfer of inmates to federal agents, except where individuals have existing criminal convictions<\/li>\n<\/ul>\n<p>The law\u2019s purpose is to ensure trust and cooperation between local police agencies and communities. It\u2019s also designed to prevent a drain on local resources by diversion to federal activities. The law creates safe zones around schools, libraries, and hospitals where state or local authorities limit assistance to federal immigration enforcement officers.<\/p>\n<h2>Enforcement and Oversight<\/h2>\n<p>The <a href=\"https:\/\/calcivilrights.ca.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52846824\">California <\/span><span data-term-id=\"52846812\">Civil Rights Department<\/span> <\/a>(<span data-term-id=\"52846816\">CRD<\/span>) investigates most complaints of discrimination, harassment, and retaliation. The <a href=\"https:\/\/oag.ca.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52846833\">State of California<\/span>\u2019s <span data-term-id=\"52846836\">Attorney General<\/span><\/a>\u2019s Office investigates hate crimes, police misconduct, and criminal <span data-term-id=\"52846841\">civil rights violations<\/span>.
