These regulations ensure student literacy by holding parents legally responsible for attendance in public, private, or <span data-term-id=\"36342773\">home school<\/span> settings.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"36342848\">California<\/span> has a strict <span data-term-id=\"36342766\">education code<\/span> that requires nearly all students to attend school between the ages of six and 18. <span data-term-id=\"36342848\">California<\/span>\u2019s public education laws make parents and guardians responsible for enrolling their children in school and ensuring attendance throughout the <span data-term-id=\"36342767\">school year<\/span>.<\/p>\n<p>The <span data-term-id=\"36342781\">California<\/span> <span data-term-id=\"36342766\">Education Code<\/span> addresses students attending private and parochial schools and parents who wish to <span data-term-id=\"36342773\">homeschool<\/span> their children. <span data-term-id=\"36342797\">Attendance laws<\/span> still require all school-age students to attend some type of <span data-term-id=\"36342835\">full-time education<\/span> until they reach adulthood.<\/p>\n<h2><strong><span data-term-id=\"36342829\">Compulsory <\/span><span data-term-id=\"36342850\">School <\/span><span data-term-id=\"36342797\">Attendance<\/span><span data-term-id=\"36342797\"> Laws<\/span><\/strong><\/h2>\n<p>All states have <a href=\"https:\/\/www.findlaw.com\/education\/education-options\/compulsory-education-laws-background.html\">compulsory education laws<\/a> to ensure all U.S. residents are literate and reasonably educated. Before the 20th Century, only towns and cities large enough to support a <span data-term-id=\"36342770\">public school<\/span> system had graded schools for all students. Today, all children must get some type of basic education.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-48200\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36342781\">California<\/span><span data-term-id=\"36342781\">\u2019s <\/span><span data-term-id=\"36342766\">Education Code<\/span><\/a> requires that:<\/p>\n<ul>\n<li>Children six to 18 <span data-term-id=\"36342811\">years of age<\/span><\/li>\n<li>Attend <span data-term-id=\"36342770\">public school<\/span> or an approved alternative<\/li>\n<li>Full-time as determined by the <span data-term-id=\"36342852\">school district<\/span> or other <span data-term-id=\"36342815\">governing board<\/span><\/li>\n<li>For not less than the minimum <span data-term-id=\"36342774\">school day<\/span>, unless otherwise exempted<\/li>\n<\/ul>\n<p>Parents and <span data-term-id=\"36342819\">legal guardians<\/span> who do not send their children to\u00a0<span data-term-id=\"36342770\">public school<\/span>\u00a0can enroll them in any approved alternative school. These alternatives still fall under some provisions of the <span data-term-id=\"36342848\">California<\/span> Department of Education.<\/p>\n<h3><strong>Alternative School Choices<\/strong><\/h3>\n<p>The <span data-term-id=\"36342848\">California<\/span> Department of Education has approved <a href=\"https:\/\/www.findlaw.com\/education\/education-options\/statutory-exemptions-to-compulsory-education.html\">these alternatives<\/a> for parents who prefer not to send their children to the nearest <span data-term-id=\"36342770\">public school<\/span>. They include:<\/p>\n<ul>\n<li><strong>Charter schools<\/strong>: These are publicly funded schools that have more flexible curricula than traditional schools, are independently run, and may have online or hybrid options<\/li>\n<li><strong>Private and parochial schools<\/strong>: <span data-term-id=\"36342771\">Private schools<\/span> must follow state curriculum requirements, but are not directly overseen by the Department of Education<\/li>\n<li><strong><span data-term-id=\"36342771\">Private school<\/span> <span data-term-id=\"36342846\">affidavits<\/span>\/<span data-term-id=\"36342773\">homeschooling<\/span><\/strong>: Parents can <span data-term-id=\"36342773\">homeschool<\/span> their children by filing a <span data-term-id=\"36342771\">Private School<\/span> <span data-term-id=\"36342846\">Affidavit<\/span> (PSA) with the Department of Education, making their home a \u201c<span data-term-id=\"36342771\">private school<\/span>\u201d that must follow <span data-term-id=\"36342848\">California<\/span> attendance and curriculum requirements<\/li>\n<li><strong>Non-<span data-term-id=\"36342770\">public schools<\/span><\/strong>: Specialized <span data-term-id=\"36342771\">private schools<\/span> may contract with local districts to provide classes for special-needs students<\/li>\n<li><strong>Non-classroom-based programs<\/strong>: Some charter schools may offer <span data-term-id=\"36342807\">independent study<\/span> programs, remote learning, and <span data-term-id=\"36342773\">homeschooling<\/span> classes<\/li>\n<li><strong>Continuation schoo<\/strong>l: <span data-term-id=\"36342793\">Education programs<\/span> for 16- to 18-year-old students who work while completing their diploma<\/li>\n<\/ul>\n<p>Students at these schools still must meet minimum <span data-term-id=\"36342848\">California<\/span> education requirements.<\/p>\n<h3><strong><span data-term-id=\"36342787\">Exemptions<\/span><\/strong><\/h3>\n<p>Some children are exempt by law from attending <span data-term-id=\"36342770\">public school<\/span>. These are permanent conditions unrelated to a single day or period of <span data-term-id=\"36342765\">absence<\/span>. Reasons include:<\/p>\n<ul>\n<li><strong>Permanent physical or mental condition that makes attendance unsafe for the child<\/strong>: A physician may order or recommend such a removal for the child<\/li>\n<li><strong>Emancipation<\/strong>: Emancipated minors who have otherwise completed their schooling may choose to begin work or attend college<\/li>\n<li><strong><span data-term-id=\"36342823\">Work permit<\/span> or continuation school<\/strong>: Students over the age of 16 may obtain a <span data-term-id=\"36342823\">work permit<\/span> and attend continuation school while employed<\/li>\n<li><strong><span data-term-id=\"36342807\">Independent study<\/span> programs<\/strong>: Charter and <span data-term-id=\"36342770\">public schools<\/span> that offer\u00a0<span data-term-id=\"36342807\">independent study<\/span>\u00a0can release individual students for\u00a0<span data-term-id=\"36342807\">independent study<\/span>\u00a0or distance learning<\/li>\n<\/ul>\n<p>Other situations may also exempt a student.<\/p>\n<h2><strong><span data-term-id=\"36342777\">Enrollment<\/span> and Attendance<\/strong><\/h2>\n<p><span data-term-id=\"36342777\">Enrollment<\/span> depends on a student\u2019s home address. <a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-48200-5\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36342848\">California<\/span> <span data-term-id=\"36342783\">state law<\/span><\/a> allows students who live in some cities where their <span data-term-id=\"36342773\">home <\/span><span data-term-id=\"36342852\">school<\/span><span data-term-id=\"36342852\"> district<\/span> is less convenient than a closer district to enroll in the adjacent district.<\/p>\n<p>As schools learned during the 2020 lockdowns, missed days mean that students do not retain what they learned. Regular attendance is essential for students to maintain steady progress throughout their education. Too many half-days and missed classes mean students are not fully educated by their <span data-term-id=\"36342827\">high school<\/span><span data-term-id=\"36342827\"> graduation<\/span>.<\/p>\n<h3><strong>Enforcement and Consequences<\/strong><\/h3>\n<p>Schools are aware that students skip classes. <a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-48260\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36342783\">State law<\/span><\/a> defines <span data-term-id=\"36342768\">truancy<\/span> as a student who is either absent three <span data-term-id=\"36342839\">full days<\/span> in one <span data-term-id=\"36342767\">school year<\/span>, <span data-term-id=\"36342791\">tardy<\/span> or absent more than 30 minutes during the <span data-term-id=\"36342774\">school day<\/span> on three occasions, or any combination of these without a <span data-term-id=\"36342813\">valid excuse<\/span>. The <span data-term-id=\"36342778\">School Attendance<\/span><span data-term-id=\"36342778\"> Review Board<\/span> (<span data-term-id=\"36342775\">SARB<\/span>) handles statistics on <span data-term-id=\"36342772\">truant<\/span> students and parent notification.<\/p>\n<h3><strong>Penalties<\/strong><\/h3>\n<p>Parents are responsible for ensuring their children attend school. After the first <span data-term-id=\"36342768\">truancy<\/span> report, the <span data-term-id=\"36342775\">SARB<\/span> sends a Notice of <span data-term-id=\"36342768\">Truancy<\/span> to the parent or guardian\u2019s residence. If <span data-term-id=\"36342768\">truancy<\/span>\u00a0continues, the\u00a0<span data-term-id=\"36342821\">attendance supervisor<\/span> will submit a formal request to meet with the parent.<\/p>\n<p>If the parent fails to attend or respond to any notices, the <span data-term-id=\"36342775\">SARB<\/span> can refer the parent to the <a href=\"https:\/\/www.cde.ca.gov\/ls\/ai\/sb\/sarbhbkenforcement.asp#legallyrequired\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"36342789\">district attorney<\/span>\u2019s office for criminal charges.<\/a> Failure to attend <span data-term-id=\"36342768\">truancy<\/span> meetings can result in an\u00a0<span data-term-id=\"36342803\">infraction<\/span>\u00a0(ticket) or\u00a0a\u00a0<span data-term-id=\"36342831\">misdemeanor<\/span>. More serious charges depend on the student&#8217;s age and the number of <span data-term-id=\"36342768\">truancy<\/span> violations.<\/p>\n<p>Habitual <span data-term-id=\"36342772\">truants<\/span> may become wards of the court. <span data-term-id=\"36342772\">Truants<\/span> 16 <span data-term-id=\"36342811\">years of age<\/span> and over may face criminal charges, be ordered to perform community service, or pay fines of up to $50.<\/p>\n<h2><strong>Getting Legal Advice on Compulsory Education<\/strong><\/h2>\n<p><span data-term-id=\"36342848\">California<\/span> has strict requirements for <span data-term-id=\"36342770\">public <\/span><span data-term-id=\"36342850\">school<\/span><span data-term-id=\"36342850\"> attendance<\/span>. <span data-term-id=\"36342848\">California<\/span> no longer accepts <a href=\"https:\/\/codes.findlaw.com\/ca\/education-code\/edc-sect-48216\/\" target=\"_blank\" rel=\"noopener\">waivers for student vaccinations,<\/a> including for personal preference or religious <span data-term-id=\"36342787\">exemptions<\/span>. Medical <span data-term-id=\"36342787\">exemptions<\/span> are permitted in specific circumstances. Beginning in 2026, <span data-term-id=\"36342848\">California<\/span> classrooms must follow new laws, including:<\/p>\n<ul>\n<li>Phone-free schools that no longer allow any cell phones, tablets, or other devices into the classroom<\/li>\n<li>Gender-neutral bathrooms<\/li>\n<li>Task forces for creating Native American curricula<\/li>\n<li>Prohibition on book banning<\/li>\n<\/ul>\n<p><span data-term-id=\"36342848\">California<\/span> laws prohibit immigration enforcement on all <span data-term-id=\"36342770\">public school<\/span> campuses. Some cities, including Los Angeles, Long Beach, and San Francisco, have municipal ordinances banning police from assisting federal officers during immigration sweeps.<\/p>\n<p>Parents who have concerns about any of these issues may want to consult an <a href=\"https:\/\/lawyers.findlaw.com\/education-law\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">education law attorney in <span data-term-id=\"36342848\">California<\/span><\/a>.
