These local laws oversee the cultivation and manufacturing of drugs within the state and ensure that the cannabis business operates safely and the products are appropriately regulated.<\/p>\r\n<p>This article offers a detailed overview of California&#8217;s cultivation and manufacturing laws.<\/p>\r\n<h2><b>What&#8217;s the definition of manufacturing and cultivation in California?<\/b><\/h2>\r\n<p><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=BPC&amp;division=10.&amp;title=&amp;part=&amp;chapter=1.&amp;article=\" target=\"_blank\" rel=\"noopener\">California law<\/a> defines \u201cmanufacture\u201d as the act of transforming raw materials into a product for consumers. It encompasses various activities. These activities include compounding, extracting, infusing, packaging, labeling, making, or preparing cannabis products.<\/p>\r\n<p>Cultivation refers to the various agricultural processes involved in producing the cannabis plant, including:<\/p>\r\n<ul>\r\n<li>Growing<\/li>\r\n<li>Planting<\/li>\r\n<li>Harvesting<\/li>\r\n<li>Curling<\/li>\r\n<li>Drying<\/li>\r\n<li>Trimming<\/li>\r\n<li>Grading<\/li>\r\n<\/ul>\r\n<h2><b>Is it legal to use marijuana in California?<\/b><\/h2>\r\n<p>Yes. For over a quarter of a century, it has been <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-marijuana-laws.html\">legal in California<\/a> to have cannabis for medical use. In 1996, the state authorized individuals with a doctor&#8217;s recommendation to plant, grow, cultivate, harvest, and prepare marijuana plants for <a href=\"https:\/\/www.findlaw.com\/healthcare\/patient-rights\/medical-marijuana-laws-by-state.html\">medical use<\/a>. In 2016, the <a href=\"https:\/\/www.courts.ca.gov\/documents\/BTB24-3I-1.pdf\" target=\"_blank\" rel=\"noopener\">Adult Use of Marijuana Act<\/a> (Proposition 64) extended the legality of marijuana for recreational use.<\/p>\r\n<p>Under the <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/DO\/letstalkcannabis\/Pages\/legal.aspx\" target=\"_blank\" rel=\"noopener\">Medicinal and Adult-Use Cannabis Regulation and Safety Act<\/a> (MAUCRSA), marijuana is legal in California. It is legal both for recreational and medical use. The Act allows individuals 21 years of age and above to buy or have the following for recreational use:<\/p>\r\n<ul>\r\n<li>28.5 grams of marijuana plant<\/li>\r\n<li>Eight grams of concentrated cannabis<\/li>\r\n<li>Six cannabis plants in their private residence for cultivation as long as they are in a secure location not visible to the public<\/li>\r\n<\/ul>\r\n<p>Medical marijuana patients and their primary caregivers can have a higher amount of marijuana. MAUCRSA allows them to possess:<\/p>\r\n<ul>\r\n<li>226.8 grams of dried cannabis or concentrated cannabis and up to six mature plants.<\/li>\r\n<li>Twelve immature plants<\/li>\r\n<\/ul>\r\n<p>While legal in California, marijuana remains <a href=\"https:\/\/californiacannabis.org\/laws\" target=\"_blank\" rel=\"noopener\">illegal at the federal level<\/a>, similar to other controlled substances. Law enforcement officials still criminalize certain activities. This includes smoking marijuana in public places or engaging in commercial cannabis activities without a license.<\/p>\r\n<h2><b>Do I need a manufacturing license in California to produce cannabis products?<\/b><\/h2>\r\n<p>Yes. The state requires manufacturing licenses for entities producing products derived from cannabis. California Business and Professional Code Section 19300.5 defines the term &quot;<a href=\"https:\/\/california.public.law\/codes\/ca_bus_and_prof_code_section_19300.5\" target=\"_blank\" rel=\"noopener\">manufactured cannabis<\/a>.&quot; This includes processing raw cannabis into edibles, concentrates, or topical products.<\/p>\r\n<p>With this provision, businesses that create marijuana cookies, candies, ointments, creams, or concentrates need a manufacturing license to operate. The <a href=\"https:\/\/cannabis.ca.gov\/\" target=\"_blank\" rel=\"noopener\">Department of Cannabis Control<\/a> issues the license. Each premises that manufactures raw cannabis should have a separate license.<\/p>\r\n<h2><b>Do licensed cannabis manufacturers need cultivation licenses?<\/b><\/h2>\r\n<p>Cannabis manufacturers do not have to have a <a href=\"https:\/\/californiacannabis.org\/licensing\/manufacturing\" target=\"_blank\" rel=\"noopener\">cultivation state license<\/a>. However, those who have manufacturing licenses can acquire licenses in various categories. The cannabis producer can also acquire a cultivation license.<\/p>\r\n<h2><b>What are the penalties for cultivation and manufacturing without a license?<\/b><\/h2>\r\n<p>In general, growing more than six marijuana plants is considered a misdemeanor in the state of California. It is subject to six months imprisonment or a $500 fine. The misdemeanor could escalate to a felony in any of the following conditions:<\/p>\r\n<ul>\r\n<li>A prior criminal history of severe offenses such as sex crimes against minors, murder, or manslaughter <a href=\"https:\/\/www.findlaw.com\/dui.html\">caused by DUI<\/a><\/li>\r\n<li>Status as a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/the-sex-offender-registry-what-you-need-to-know.html\">registered sex offender<\/a><\/li>\r\n<li>At least two prior misdemeanor convictions for cultivation of cannabis<\/li>\r\n<li>Significant environmental damage<\/li>\r\n<\/ul>\r\n<p>Individuals meeting any of these criteria could face a sentence ranging from 16 months to three years in state prison.
