These laws address how to create a <span data-term-id=\"41246310\">durable power of attorney<\/span>, who can create one, and how to make it valid through notarization or attestation by two qualified witnesses.<\/p>\n\n    <\/div>\n\n\n\n<div><p>Creating an <span data-term-id=\"41246315\">estate plan<\/span> is about more than just providing instructions about distributing your property at your death. A comprehensive <span data-term-id=\"41246315\">estate plan<\/span> also includes instructions about how to manage your finances and your healthcare if you become incapacitated.<\/p>\n<p>A <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/how-to-make-a-power-of-attorney-in-california-faq.html\">power of attorney<\/a> (POA) is a <span data-term-id=\"41246319\">legal document<\/span>. The person creating the POA (the principal) grants another person (the <span data-term-id=\"41246313\">attorney-in-fact<\/span> or agent) legal authority to act on the principal&#8217;s behalf, within the scope defined in the document. There are several different <span data-term-id=\"41246334\">types of power of attorney<\/span>.<\/p>\n<p>For <span data-term-id=\"41246315\">estate planning<\/span> purposes, POAs are a way to manage your <span data-term-id=\"41246359\">financial matters<\/span> (<span data-term-id=\"41246310\">durable power of attorney<\/span> for <span data-term-id=\"41246359\">financial matters<\/span>) or your <span data-term-id=\"41246318\">healthcare decisions<\/span> (<span data-term-id=\"41246344\">power of attorney for healthcare<\/span>) if you become incapacitated. To be effective for this purpose, these POAs must be <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/what-is-a-power-of-attorney\/what-is-durable-power-of-attorney.html\"><span data-term-id=\"41246310\">durable powers of attorney<\/span><\/a>. They should remain effective during the principal\u2019s <span data-term-id=\"41246321\">incapacity<\/span> if they cannot or should not make their <span data-term-id=\"41246380\">own decisions<\/span>. With these <span data-term-id=\"41246319\">legal documents<\/span> in place, you can protect your <span data-term-id=\"41246356\">family members<\/span> and <span data-term-id=\"41246342\">loved ones<\/span> by ensuring your financial and healthcare matters are in trusted hands during your <span data-term-id=\"41246321\">incapacity<\/span>.<\/p>\n<h2>Key Difference Between a POA and a <span data-term-id=\"41246350\">Durable POA<\/span><\/h2>\n<p>It\u2019s important to distinguish between a <span data-term-id=\"41246362\">non-<\/span><span data-term-id=\"41246310\">durable<\/span><span data-term-id=\"41246310\"> power of attorney<\/span> and a <span data-term-id=\"41246310\">durable power of attorney<\/span>. This article focuses on <span data-term-id=\"41246310\">durable powers of attorney<\/span> used for <span data-term-id=\"41246321\">incapacity<\/span> planning as an <span data-term-id=\"41246315\">estate planning<\/span> strategy.<\/p>\n<h3><span data-term-id=\"41246362\">Non-<\/span><span data-term-id=\"41246310\">Durable<\/span><span data-term-id=\"41246310\"> Power of Attorney<\/span><\/h3>\n<p>Unless it is stated to be durable, a POA is\u00a0<span data-term-id=\"41246362\">non-durable<\/span>\u00a0by default under\u00a0<span data-term-id=\"41246323\">California<\/span><span data-term-id=\"41246323\"> law<\/span>. A <span data-term-id=\"41246362\">non-<\/span><span data-term-id=\"41246350\">durable<\/span><span data-term-id=\"41246350\"> POA<\/span> terminates automatically if the principal becomes incapacitated. <span data-term-id=\"41246362\">Non-<\/span><span data-term-id=\"41246350\">durable<\/span><span data-term-id=\"41246350\"> POAs<\/span> serve many <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney\/who-needs-power-of-attorney.html\">valuable purposes<\/a>. In an <span data-term-id=\"41246315\">estate-planning<\/span> context, POAs must be durable to address <span data-term-id=\"41246321\">incapacity<\/span>.<\/p>\n<h3><span data-term-id=\"41246310\">Durable Power of Attorney<\/span><\/h3>\n<p><span data-term-id=\"41246321\">Incapacity<\/span> does not terminate a <span data-term-id=\"41246310\">durable power of attorney<\/span>. The term \u201cdurable\u201d denotes an important difference between a <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span> and a <span data-term-id=\"41246344\">Power of Attorney for Healthcare<\/span>.<\/p>\n<p><strong>POA for Healthcare<\/strong><\/p>\n<p>Calling a <span data-term-id=\"41246303\">California<\/span> healthcare POA &#8220;durable&#8221; is unnecessary. The durability of this <span data-term-id=\"41246382\">type of POA<\/span> is baked into the language that creates it. A <span data-term-id=\"41246303\">California<\/span> healthcare POA is triggered by the principal\u2019s <span data-term-id=\"41246321\">incapacity<\/span>.<\/p>\n<p><strong><span data-term-id=\"41246350\">Durable POA<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span><\/strong><\/p>\n<p>The word \u201cdurable\u201d is essential to distinguish a <a href=\"https:\/\/www.findlaw.com\/estate\/financial-power-of-attorney.html\">POA for <span data-term-id=\"41246359\">Financial Matters<\/span><\/a> that terminates with the principal\u2019s <span data-term-id=\"41246321\">incapacity<\/span> from a <span data-term-id=\"41246350\">durable POA<\/span>, which does not. The <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4124\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246384\">California<\/span><span data-term-id=\"41246384\"> Probate Code<\/span><span data-term-id=\"41246384\"> Section<\/span><\/a> requires a <span data-term-id=\"41246310\">durable power of attorney<\/span> to show the principal\u2019s intent for the authority given to the agent, which does not terminate during any instance of <span data-term-id=\"41246321\">incapacity<\/span> by the principal. The statute provides sample language:<\/p>\n<ul>\n<li>\u201c<span data-term-id=\"41246324\">This power of attorney<\/span> shall not be affected by subsequent <span data-term-id=\"41246321\">incapacity<\/span> of the principal.\u201d<\/li>\n<li>\u201c<span data-term-id=\"41246324\">This power of attorney<\/span> shall become effective upon the <span data-term-id=\"41246321\">incapacity<\/span> of the principal.\u201d<\/li>\n<\/ul>\n<p>Note that the first example is for a <span data-term-id=\"41246310\">durable power of attorney<\/span> that takes effect immediately upon execution and survives the principal&#8217;s later <span data-term-id=\"41246321\">incapacity<\/span>. The second example is for a springing power of attorney that takes effect only upon the principal\u2019s <span data-term-id=\"41246321\">incapacity<\/span>. For <span data-term-id=\"41246321\">incapacity<\/span> planning, including durability language is essential to create a <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span>.<\/p>\n<h2><span data-term-id=\"41246321\">Incapacity<\/span> Planning Under <span data-term-id=\"41246323\">California<\/span><span data-term-id=\"41246323\"> Law<\/span><\/h2>\n<p>The statutes governing the <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span> and the Healthcare Power of Attorney are found in two separate sections of the Probate Code. While there is some overlap, each has its own requirements, forms, and rules.<\/p>\n<h3>Common Requirements<\/h3>\n<p>Some of the key requirements for creating a <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span> and for a <span data-term-id=\"41246344\">Power of Attorney for Healthcare<\/span> are the same:<\/p>\n<ul>\n<li>A principal must be an adult with the capacity to create the document<\/li>\n<li>The document must be in writing<\/li>\n<li>The principal must sign or direct another person to sign the document in the principal\u2019s presence<\/li>\n<li>The document must be dated<\/li>\n<li>Two adult witnesses to the <span data-term-id=\"41246383\">principal\u2019s signing<\/span> or acknowledgment must sign the document, or the <span data-term-id=\"41246383\">principal\u2019s signing<\/span> must be notarized by a <span data-term-id=\"41246317\">notary public<\/span><\/li>\n<\/ul>\n<p>A document lacking any of these provisions will likely be ruled invalid.<\/p>\n<h3>Specific Requirements<\/h3>\n<p>Each <span data-term-id=\"41246382\">type of POA<\/span> has unique conditions that must be met.<\/p>\n<p><strong><span data-term-id=\"41246359\">Financial Matters<\/span><\/strong><\/p>\n<p>A <span data-term-id=\"41246326\">financial power of attorney<\/span> is <span data-term-id=\"41246362\">non-durable<\/span> by default. The POA must include durability language to survive or to spring into effect upon the principal\u2019s <span data-term-id=\"41246321\">incapacity<\/span>. The <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4401\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246374\">Uniform <\/span><span data-term-id=\"41246338\">Statutory<\/span><span data-term-id=\"41246338\"> Form Power of Attorney<\/span><\/a> is a statutory form used to appoint an agent for your <span data-term-id=\"41246359\">financial matters<\/span>.<\/p>\n<p>This <span data-term-id=\"41246382\">type of POA<\/span> does not impose restrictions on who may serve as a witness or agent. The principal\u2019s death terminates a <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span>, removing the <span data-term-id=\"41246340\">agent\u2019s authority<\/span>.<\/p>\n<p><strong><span data-term-id=\"41246318\">Healthcare Decisions<\/span><\/strong><\/p>\n<p>A <span data-term-id=\"41246303\">California<\/span> <span data-term-id=\"41246344\">Power of Attorney for Healthcare<\/span> is durable by nature. It is part of an <span data-term-id=\"41246336\">Advance Healthcare Directive<\/span>. <span data-term-id=\"41246303\">California<\/span>\u2019s <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4701\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246336\">Advance Healthcare Directive<\/span><\/a> is a statutory form used to designate a healthcare agent, communicate healthcare preferences, and more.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4659\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246323\">California<\/span><span data-term-id=\"41246323\"> law<\/span><\/a> restricts who may serve as an agent. Neither the supervising healthcare provider nor an employee may serve as the principal\u2019s agent. The law does provide exceptions for <span data-term-id=\"41246356\">family members<\/span> and co-workers who are employees.<\/p>\n<p>Who can be a witness also faces restrictions. The witnesses cannot include your healthcare agent, healthcare provider, or your residential care facility. Their employees are also excluded. The statute requires that at least one witness not be entitled to inherit your estate as a beneficiary. If you are in a <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4675\/\" target=\"_blank\" rel=\"noopener\">skilled nursing facility<\/a>, one witness must be a patient advocate or ombudsman.<\/p>\n<p>Unless the document provides otherwise, the agent retains <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4683\/\" target=\"_blank\" rel=\"noopener\">limited authority after the principal\u2019s death<\/a>, including:<\/p>\n<ul>\n<li>Making anatomical gifts<\/li>\n<li>Ordering an autopsy<\/li>\n<li>Directing the disposition of the principal\u2019s remains<\/li>\n<li>Authorizing the release of the principal&#8217;s records to fulfill their duties under the <span data-term-id=\"41246318\">Healthcare Decisions<\/span> Law<\/li>\n<\/ul>\n<p>If you are confused or feel overwhelmed, consider speaking to a <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246303\">California<\/span> <span data-term-id=\"41246332\">estate planning<\/span><span data-term-id=\"41246332\"> attorney<\/span><\/a>.<\/p>\n<h2>How To Revoke Your POA<\/h2>\n<p>If the person you appointed as your agent is no longer the right person for the role, you can remove them. You can revoke your <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span> or your <span data-term-id=\"41246344\">Power of Attorney for Health Care<\/span> at any time, as long as you still have legal capacity. In both cases, a written, dated, and signed <span data-term-id=\"41246330\">revocation<\/span>, delivered directly to the agent, is the best option, but not the only one.<\/p>\n<p>To revoke a <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span>, the only requirement is that it be in <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4151\" target=\"_blank\" rel=\"noopener\">accordance with the terms of the POA or by writing<\/a>. You should provide written notice to any banks, <span data-term-id=\"41246358\">financial institutions<\/span>, or other third parties who have been relying on the POA. <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4303\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"41246323\">California<\/span><span data-term-id=\"41246323\"> law<\/span><\/a> protects the agent and third parties who act in good faith on a POA without actual knowledge that it has been revoked. For this reason, written notice to the affected parties is essential for your\u00a0<span data-term-id=\"41246330\">revocation<\/span>\u00a0to be\u00a0fully effective.<\/p>\n<p>Although you can revoke most parts of your <span data-term-id=\"41246336\">Advance Healthcare Directive<\/span> with any act showing your intent, such as ripping up the document, the requirements for revoking your <span data-term-id=\"41246344\">Power of Attorney for Healthcare<\/span> are different. For a healthcare POA, an <span data-term-id=\"41246340\">agent&#8217;s authority<\/span> is only removed by a <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-4695\/\" target=\"_blank\" rel=\"noopener\">signed writing or by personally informing the supervising healthcare provider<\/a>.<\/p>\n<p>For both <span data-term-id=\"41246382\">types of POA<\/span>, it\u2019s a good idea to destroy all copies of the original document after any <span data-term-id=\"41246330\">revocation<\/span>. Like any <span data-term-id=\"41246315\">estate planning<\/span> tool, it\u2019s important to revisit your <span data-term-id=\"41246321\">incapacity<\/span>-planning POAs after any major life event. This includes marriage, divorce, significant illness, a substantial change in family relationships, or your named agent\u2019s death.<\/p>\n<h2>What Happens if You Become Incapacitated Without a <span data-term-id=\"41246350\">Durable POA<\/span> in Place?<\/h2>\n<p>Adding <span data-term-id=\"41246310\">durable powers of attorney<\/span> to your <span data-term-id=\"41246315\">estate plan<\/span> is a proactive and private way to plan for your potential <span data-term-id=\"41246321\">incapacity<\/span>. The alternative may be a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/estate-planning\/what-is-a-conservatorship-5-basic-questions-2\/\"><span data-term-id=\"41246381\">court-appointed conservatorship<\/span><\/a>. There are two types of <span data-term-id=\"41246381\">conservatorships<\/span>:<\/p>\n<ul>\n<li><strong><span data-term-id=\"41246381\">Conservatorship<\/span> of the Person<\/strong>: Makes health care and personal decisions<\/li>\n<li><strong><span data-term-id=\"41246381\">Conservatorship<\/span> of the Estate<\/strong>: Manages finances and property<\/li>\n<\/ul>\n<p>On petition by an interested person, the court may appoint one or both. Aside from losing your say in who has authority over important decisions during your <span data-term-id=\"41246321\">incapacity<\/span>, <span data-term-id=\"41246381\">conservatorship<\/span> is costly, public, and court-supervised. A well-drafted <span data-term-id=\"41246310\">Durable Power of Attorney<\/span> for <span data-term-id=\"41246359\">Financial Matters<\/span> and <span data-term-id=\"41246344\">Power of Attorney for Healthcare<\/span> can help avoid this outcome.<\/p>\n<h2>Consult an Experienced Power of Attorney Lawyer<\/h2>\n<p><span data-term-id=\"41246321\">Incapacity<\/span> can happen at any time. If you want to take charge of the <span data-term-id=\"41246388\">decision-making<\/span> that will happen on your behalf during an <span data-term-id=\"41246321\">incapacity<\/span>, you\u2019ll need to prepare. You may not need a lawyer to create a <a href=\"https:\/\/www.findlaw.com\/estate\/financial-power-of-attorney\/do-i-need-a-lawyer-to-write-a-durable-power-of-attorney.html\"><span data-term-id=\"41246310\">durable power of attorney<\/span><\/a>, but it\u2019s a good idea if you\u2019re uncertain about any aspect of the process.<\/p>\n<p>For many people, <span data-term-id=\"41246303\">California<\/span>\u2019s statutory forms or an <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/power-of-attorney.html\">online DIY form<\/a> will fit the bill.
