When federal and <span data-term-id=\"40889461\">state laws<\/span> overlap, <span data-term-id=\"40889424\">federal law<\/span> controls over any conflicting <span data-term-id=\"40889461\">state law<\/span> under the <a href=\"https:\/\/constitution.findlaw.com\/article6\/annotation02.html\" target=\"_blank\" rel=\"noopener\">Supremacy Clause<\/a>. But as long as they don\u2019t interfere with areas Congress intended to control exclusively, such as unions and collective bargaining, states can pass laws that give workers <em>greater<\/em> <span data-term-id=\"40889418\">protections<\/span> than <span data-term-id=\"40889424\">federal law<\/span>.<\/p>\n<h3><span data-term-id=\"40889490\">Leaves of Absence<\/span><\/h3>\n<p>The cornerstone <span data-term-id=\"40889414\">employment laws<\/span> that address <span data-term-id=\"40889490\">leaves of absence<\/span> in <span data-term-id=\"40889410\">California<\/span> are the\u00a0federal <a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/family-and-medical-leave-overview.html\"><u>Family and <span data-term-id=\"40889549\">Medical Leave Act<\/span><\/u><\/a> (<span data-term-id=\"40889478\">FMLA<\/span>) and the <span data-term-id=\"40889432\">California<\/span><span data-term-id=\"40889432\"> Family Rights Act<\/span> (<span data-term-id=\"40889444\">CFRA<\/span>). The <span data-term-id=\"40889444\">CFRA<\/span> provides broader <span data-term-id=\"40889418\">protections<\/span> for workers than the <span data-term-id=\"40889478\">FMLA<\/span>. Other <span data-term-id=\"40889453\">California<\/span> <span data-term-id=\"40889414\">employment laws<\/span> specifically address pregnancy leave, military leave, <span data-term-id=\"40889467\">bereavement leave<\/span>, paid <span data-term-id=\"40889416\">sick leave<\/span>, and more.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/family-medical-leave\/california-paid-family-leave-law.html\">The <span data-term-id=\"40889410\">California<\/span> Paid <span data-term-id=\"40889555\">Family Leave<\/span> Act<\/a> works with the <span data-term-id=\"40889432\">California<\/span><span data-term-id=\"40889432\"> Family Rights Act<\/span> (<span data-term-id=\"40889444\">CFRA<\/span>) and the Paid <span data-term-id=\"40889416\">Sick Leave<\/span> Act to ensure <span data-term-id=\"40889410\">California<\/span> workers can take care of themselves and their families.<\/p>\n<p>Under the <span data-term-id=\"40889444\">CFRA<\/span>, covered employers must provide <span data-term-id=\"40889463\">eligible employees<\/span> with up to 12 weeks of job-protected leave for specified family and medical reasons, with continued health benefits and the right to be reinstated.<\/p>\n<p>Under the Paid <span data-term-id=\"40889416\">Sick Leave<\/span> Act, employers must provide paid sick time to employees for their own <span data-term-id=\"40889440\">healthcare<\/span>; to seek help related to domestic violence, <span data-term-id=\"40889557\">sexual assault<\/span>, or stalking; or to care for a <span data-term-id=\"40889442\">family member<\/span>\u2019s <span data-term-id=\"40889542\">health condition<\/span>.<\/p>\n<h3>Wage and Hour Laws<\/h3>\n<p>While the federal <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/fair-labor-standards-act.html\">Fair Labor Standards Act (FLSA)<\/a> addresses issues like\u00a0<span data-term-id=\"40889412\">minimum wage<\/span>,\u00a0<span data-term-id=\"40889428\">overtime pay<\/span>, and basic employment recordkeeping,\u00a0<span data-term-id=\"40889410\">California<\/span>-specific requirements are found in the <span data-term-id=\"40889532\">California<\/span><span data-term-id=\"40889532\"> Labor Code<\/span> and the IWC Wage Orders.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-wage-and-hour-laws.html\"><span data-term-id=\"40889410\">California<\/span> wage and hour laws<\/a> are the foundation of the state\u2019s labor and <span data-term-id=\"40889414\">employment law<\/span>. These laws ensure employers treat their employees fairly, setting standards for pay (such as <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\"><span data-term-id=\"40889412\">minimum wage<\/span><\/a>), work hours, and the <span data-term-id=\"40889508\">work environment<\/span>.<\/p>\n<p>Some wage and hour <span data-term-id=\"40889418\">protections<\/span> apply to <em>all<\/em> employees, including exempt workers. These include the <span data-term-id=\"40889418\">protections<\/span> that ensure your employer:<\/p>\n<ul>\n<li>Pays your wages on time<\/li>\n<li>Provides complete and accurate pay stubs<\/li>\n<li>Reimburses your expenses<\/li>\n<li>Does not unlawfully deduct from your paycheck<\/li>\n<li>Does not retaliate against you if you raise an issue.<\/li>\n<\/ul>\n<p>Other wage and hour <span data-term-id=\"40889418\">protections<\/span> only apply to <span data-term-id=\"40889451\">non-exempt employees<\/span>.<\/p>\n<p>As of January 1, 2026, <span data-term-id=\"40889430\">California<\/span><span data-term-id=\"40889430\">\u2019s <\/span><span data-term-id=\"40889412\">minimum wage<\/span> is generally $16.90, but this can vary. Some cities and counties set a higher <span data-term-id=\"40889412\">minimum wage<\/span>. Additionally, employers in certain industries\u2014such as fast food restaurants, hotels, and certain <span data-term-id=\"40889440\">healthcare<\/span> facilities\u2014may be required to pay a higher <span data-term-id=\"40889412\">minimum wage<\/span> rate.<\/p>\n<p><span data-term-id=\"40889410\">California<\/span> employers must provide <span data-term-id=\"40889451\">non-exempt employees<\/span> with timely, uninterrupted <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\" target=\"_blank\" rel=\"noopener\">meal and <span data-term-id=\"40889420\">rest breaks<\/span><\/a>. The 30-minute <span data-term-id=\"40889459\">meal break<\/span> is unpaid. The 10-minute <span data-term-id=\"40889493\">rest periods<\/span> are paid.<\/p>\n<p><span data-term-id=\"40889410\">California<\/span> requires employers to provide the <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/final-paycheck-laws-by-state.html\"><span data-term-id=\"40889547\">final paycheck<\/span><\/a> on the employee\u2019s last day of work if the employee is terminated or if the employee resigns or quits with at least 72 hours\u2019 notice.<\/p>\n<p>The employer must provide the <span data-term-id=\"40889547\">final paycheck<\/span> within 72 hours of the employee\u2019s last day of work if the employee resigns or quits without 72 hours\u2019 notice. By contrast, the federal guidelines require payment on the next regular pay period after the employee leaves.<\/p>\n<h3>Workplace Discrimination and Harassment<\/h3>\n<p><span data-term-id=\"40889424\">Federal laws<\/span> and <span data-term-id=\"40889410\">California<\/span> laws both prohibit <a href=\"https:\/\/www.findlaw.com\/employment\/legal-help-and-resources\/documents-to-show-your-attorney-discrimination-harassment.html\">workplace discrimination<\/a> and all forms of harassment, including <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/sexual-harassment-what-is-it.html\"><span data-term-id=\"40889476\">sexual harassment<\/span><\/a>. Key <span data-term-id=\"40889424\">federal laws<\/span> include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Title VII of the Civil Rights Act<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/the-americans-with-disabilities-act-overview.html\">The Americans with Disabilities Act (ADA)<\/a><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/age-discrimination-act-of-1975.html\">The Age Discrimination in Employment Act (ADEA)<\/a><\/li>\n<\/ul>\n<p>These <span data-term-id=\"40889424\">federal laws<\/span> prohibit discrimination based on protected characteristics and require employers to prevent harassment.<\/p>\n<p>But, again, the <span data-term-id=\"40889410\">California<\/span> laws tend to provide more <span data-term-id=\"40889418\">protection<\/span> for employees. <span data-term-id=\"40889410\">California<\/span>\u2019s <a href=\"https:\/\/www.dor.ca.gov\/Home\/FairEmploymentAct\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40889465\">Fair Employment and Housing Act<\/span> (FEHA)<\/a> covers more protected categories, including:<\/p>\n<ul>\n<li><span data-term-id=\"40889514\">Sexual orientation<\/span><\/li>\n<li><span data-term-id=\"40889474\">Gender identity<\/span>\/expression<\/li>\n<li>Marital status<\/li>\n<li>Medical and genetic conditions<\/li>\n<li>Ancestry<\/li>\n<li>Military\/veteran status<\/li>\n<li>Reproductive health decisions<\/li>\n<\/ul>\n<p>Further, FEHA applies to employers with <span data-term-id=\"40889544\">fewer employees<\/span> and <em>requires<\/em> employers to conduct anti-harassment training.<\/p>\n<h3>Safety and Health at Work<\/h3>\n<p>Worker safety and health are covered in the <a href=\"https:\/\/codes.findlaw.com\/cfr\/title-29-labor\/\" target=\"_blank\" rel=\"noopener\">Code of Federal Regulations, Title 29<\/a> and <a href=\"https:\/\/www.dir.ca.gov\/counters\/t8index.htm\" target=\"_blank\" rel=\"noopener\">Title 8 of the <span data-term-id=\"40889410\">California<\/span> Code of Regulations<\/a>. When it comes to keeping the <span data-term-id=\"40889508\">work environment<\/span> safe, the <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/osha.html\">Occupational Safety and Health Administration (<span data-term-id=\"40889449\">OSHA<\/span>)<\/a> enforces the federal regulations.<\/p>\n<p><span data-term-id=\"40889426\">Cal<\/span>\/<span data-term-id=\"40889449\">OSHA<\/span> enforces state regulations, which generally go beyond the federal regulations. For example, the <span data-term-id=\"40889410\">California<\/span> regulations specifically address heat illness prevention and wildfire smoke <span data-term-id=\"40889418\">protection<\/span>.<\/p>\n<h2>Types of Workers Under <span data-term-id=\"40889410\">California<\/span> Law<\/h2>\n<p>Many employment <span data-term-id=\"40889418\">protections<\/span> apply based on how you are categorized as a worker. For example, if you are an <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/exempt-employees-vs-nonexempt-employees.html\">exempt employee vs. a <span data-term-id=\"40889451\">non-exempt employee<\/span><\/a>, the overtime and break rules do not apply to you. Additionally, if your employer properly classifies you as an <span data-term-id=\"40889422\">independent contractor<\/span>, many <span data-term-id=\"40889414\">employment laws<\/span> will not apply to your situation.<\/p>\n<p><span data-term-id=\"40889410\">California<\/span> uses a strict test to determine if a worker is an employee or an <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/hiring-independent-contractors-overview.html\"><span data-term-id=\"40889422\">independent contractor<\/span><\/a>. The <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-2750-5\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40889532\">California<\/span><span data-term-id=\"40889532\"> Labor Code<\/span><\/a> presumes a worker is an employee and primarily applies a three-prong test (known as the ABC Test) to decide if a worker is an <span data-term-id=\"40889422\">independent contractor<\/span>. Under this test, the <em>hiring entity <\/em>must show that a worker is an <span data-term-id=\"40889422\">independent contractor<\/span> by proving <em>all three <\/em>of these elements:<\/p>\n<ol>\n<li>\n<p><strong>Control over worker: <\/strong>The hiring entity does not control or direct the worker\u2019s performance in the contract <em>and in actual practice<\/em>. For example, the contract does not set work hours, and the worker is truly free to work when he or she chooses. In other words, the worker controls how the work is done.<\/p>\n<\/li>\n<li>\n<p><strong>Outside hiring entity\u2019s usual course of business:<\/strong> The work performed by the worker is outside the hiring entity\u2019s usual course of business. For example, a graphic designer performing work for a plumbing company or a chef making and serving food at a car dealership\u2019s grand opening event. In other words, the worker is doing work outside of the company\u2019s main business.<\/p>\n<\/li>\n<li>\n<p><strong>Worker\u2019s independently established business:<\/strong> The worker customarily works in an independently established trade, occupation, or business similar to the work performed for the hiring entity.
