While all homeowners have an automatic exemption, recording a declared homestead provides better protection for voluntary sale proceeds and future equity.<\/p>\n\n    <\/div>\n\n\n\n<div><p><span data-term-id=\"52742285\">Homestead protection<\/span> laws allow <span data-term-id=\"52742279\">homeowners<\/span> to declare some real property as \u201chomesteads\u201d during bankruptcy and other legal proceedings. This prevents creditors from seizing the property to pay off <span data-term-id=\"52742291\">judgment liens<\/span>. <span data-term-id=\"52742277\">California<\/span> law gives <span data-term-id=\"52742279\">homeowners<\/span> an <span data-term-id=\"52742308\">automatic <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742308\"> exemption<\/span> based on the median home value in the area.<\/p>\n<p><span data-term-id=\"52742318\">Homestead exemption<\/span><span data-term-id=\"52742318\"> laws<\/span> help owners keep their <span data-term-id=\"52742296\">principal residence<\/span> during financial difficulties. There are some restrictions to the <span data-term-id=\"52742277\">California<\/span> <span data-term-id=\"52742307\">homeowner<\/span><span data-term-id=\"52742307\">\u2019s exemption<\/span>. <span data-term-id=\"52742279\">Homeowners<\/span> considering <a href=\"https:\/\/www.findlaw.com\/bankruptcy\/chapter-7\/bankruptcy-exemptions-chapter-7.html\">bankruptcy<\/a> should discuss methods of protecting their assets <a href=\"https:\/\/lawyers.findlaw.com\/bankruptcy-law\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">with a bankruptcy attorney<\/a>.<\/p>\n<h2><strong><span data-term-id=\"52742293\">California<\/span> <span data-term-id=\"52742318\">Homestead Exemption<\/span><span data-term-id=\"52742318\"> Laws<\/span><\/strong><\/h2>\n<p><span data-term-id=\"52742277\">California<\/span> has two types of <span data-term-id=\"52742278\">homestead exemptions<\/span>. The automatic exemption applies to all homes once purchased. The second is a \u201cdeclared\u201d exemption. You must file the declaration with the <span data-term-id=\"52742302\">County Recorder<\/span><span data-term-id=\"52742302\">&#8216;s office<\/span> in your home county.<\/p>\n<h3><strong><span data-term-id=\"52742308\">Automatic <\/span><span data-term-id=\"52742278\">Homestead<\/span><span data-term-id=\"52742308\"> Exemptions<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"52742277\">California<\/span> <span data-term-id=\"52742308\">automatic <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742308\"> exemption<\/span> prevents <span data-term-id=\"52742287\">forced sales<\/span> by creditors. In other words, if you file a bankruptcy and a creditor wants a judge to order you to sell your house to pay your debts, they <a href=\"https:\/\/codes.findlaw.com\/ca\/code-of-civil-procedure\/ccp-sect-704-740\/\" target=\"_blank\" rel=\"noopener\">cannot force you to sell<\/a> just because you have that much equity in the home, according to the <span data-term-id=\"52742313\">California<\/span><span data-term-id=\"52742313\"> Code of Civil Procedure<\/span>.<\/p>\n<p>To qualify for the automatic exemption, a <span data-term-id=\"52742279\">homeowner<\/span> must:<\/p>\n<ul>\n<li><strong>Live in the residence<\/strong>: The exemption only protects the <span data-term-id=\"52742296\">principal residence<\/span>. If you own a multi-unit property and live in one unit, the exemption only protects that unit.<\/li>\n<li><strong>Own the property<\/strong>: The exemption does not protect leaseholders or someone who acquires the property as a \u201cremainderman.\u201d This means someone who receives the property upon the death of a life estate holder.<\/li>\n<\/ul>\n<p>A <a href=\"https:\/\/www.boe.ca.gov\/lawguides\/property\/current\/ptlg\/annt\/505-0000-all.html\" target=\"_blank\" rel=\"noopener\">primary residence<\/a> can be a:<\/p>\n<ul>\n<li><span data-term-id=\"52742320\">Single-family home<\/span><\/li>\n<li>Condo or duplex (if spouses live separately in both units, then both units are primary residences)<\/li>\n<li><span data-term-id=\"52742305\">Mobile home<\/span> and the property where the it sits (if the individual owns the property and rents the <span data-term-id=\"52742305\">mobile home<\/span>, the <span data-term-id=\"52742278\">homestead exemption<\/span> applies to the land, but not the <span data-term-id=\"52742305\">mobile home<\/span>)<\/li>\n<li>Trailers, under the same exclusions as <span data-term-id=\"52742305\">mobile homes<\/span><\/li>\n<li>Boats (\u201cvessels\u201d), if it is the primary dwelling<\/li>\n<\/ul>\n<p>An automatic exemption will not protect <span data-term-id=\"52742279\">homeowners<\/span> against:<\/p>\n<ul>\n<li><span data-term-id=\"52742290\">Foreclosure<\/span> for missed mortgage payments<\/li>\n<li>Lenders holding a <span data-term-id=\"52742315\">deed of trust<\/span><\/li>\n<li><span data-term-id=\"52742289\">Property tax<\/span> liens<\/li>\n<li><span data-term-id=\"52742295\">Mechanic\u2019s liens<\/span> and contractor liens<\/li>\n<li>Money judgments for arrearages in spousal or child support<\/li>\n<\/ul>\n<p>The automatic exemption protects between $377,215 to $753,430 as of 2026. Under <span data-term-id=\"52742314\">state law<\/span>, this amount is adjusted annually based on the <span data-term-id=\"52742316\">countywide median sales price<\/span> of comparable homes.<\/p>\n<h3><strong><span data-term-id=\"52742281\">Declared <\/span><span data-term-id=\"52742278\">Homestead<\/span><span data-term-id=\"52742278\"> Exemption<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"52742281\">declared <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742278\"> exemption<\/span> adds some additional protection for a portion of your <span data-term-id=\"52742284\">home equity<\/span> from a voluntary sale, <span data-term-id=\"52742287\">forced sale<\/span>, or bankruptcy. This exemption requires filing paperwork and it provides protection up to six months after the sale of the home.<\/p>\n<p>To get a <span data-term-id=\"52742281\">declared <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742278\"> exemption<\/span>, you must:<\/p>\n<ul>\n<li>Obtain and complete the <span data-term-id=\"52742281\">Declared <\/span><span data-term-id=\"52742278\">Homestead<\/span><span data-term-id=\"52742278\"> Exemption<\/span> form from the <span data-term-id=\"52742302\">county recorder<\/span><span data-term-id=\"52742302\">\u2019s office<\/span> in your county of residence.<\/li>\n<li>Sign the form (all owners on the property deed must sign)<\/li>\n<li>Have the form notarized<\/li>\n<li>File the form with the <span data-term-id=\"52742302\">County Recorder<\/span><span data-term-id=\"52742302\">\u2019s office<\/span> (contact the office first for <span data-term-id=\"52742294\">recording fees<\/span>)<\/li>\n<\/ul>\n<p>Any companies offering to assist you with completing and filing your <span data-term-id=\"52742278\">homestead exemption<\/span> documents cannot charge more than $25. This does not include <span data-term-id=\"52742303\">notary<\/span> and <span data-term-id=\"52742294\">recording fees<\/span> charged by the county.<\/p>\n<h2><strong>Special Considerations<\/strong><\/h2>\n<p><span data-term-id=\"52742277\">California<\/span> has a <a href=\"https:\/\/www.boe.ca.gov\/proptaxes\/homeexem.htm\" target=\"_blank\" rel=\"noopener\">separate <span data-term-id=\"52742278\">homestead exemption<\/span><\/a> for disabled veterans and surviving spouses of disabled veterans. Veterans and spouses may also file an annual request for Low-Income Exemption, which can run concurrently with the <span data-term-id=\"52742278\">Homestead Exemption<\/span>.<\/p>\n<p>There is no acreage limit on either urban or rural property. Case law provides some historical limits on large rural properties (over 500 acres), but as long as the property is the owner\u2019s <span data-term-id=\"52742296\">principal residence<\/span>, it falls under the <span data-term-id=\"52742278\">homestead exemption<\/span>.<\/p>\n<p>A <span data-term-id=\"52742281\">declared <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742278\"> exemption<\/span> remains in effect until:<\/p>\n<ul>\n<li>The <span data-term-id=\"52742301\">sale of the property<\/span> (<span data-term-id=\"52742278\">homestead exemptions<\/span> are not transferable)<\/li>\n<li>The owner no longer uses it as their primary residence<\/li>\n<li>The property is ineligible for other reasons<\/li>\n<\/ul>\n<p>A <span data-term-id=\"52742281\">declared <\/span><span data-term-id=\"52742278\">homestead<\/span><span data-term-id=\"52742278\"> exemption<\/span> can keep your primary home in your hands.<\/p>\n<h2><strong>Get <span data-term-id=\"52742286\">Legal Advice<\/span> From a <span data-term-id=\"52742277\">California<\/span> Bankruptcy Attorney<\/strong><\/h2>\n<p>To file a <span data-term-id=\"52742297\">Declaration of Homestead<\/span>, visit the <span data-term-id=\"52742302\">County Recorder<\/span><span data-term-id=\"52742302\">\u2019s office<\/span> of the county where the property is located.
