Indecent exposure in California is the intentional display of one’s genitals in public or where others can see, with the intent to achieve sexual gratification<\/span> or to offend. Under Penal Code 314<\/span>, it is a misdemeanor<\/span> for first-time<\/span> offenders, requiring sex offender<\/span> registration<\/span> and up to six months in jail. Repeat offenses or entering an inhabited dwelling<\/span> can result in felony charges<\/span> and lifetime registration.<\/p>\n\n <\/div>\n\n\n\n

Indecent exposure is often treated as a joke or with contempt for the perpetrator. Flashers and others who display their genitals in public are seldom seen as a serious threat. California treats indecent exposure as a serious offense that can lead to felony charges<\/span> and prison time for repeat offenders.<\/p>\n

California\u2019s indecent exposure laws<\/span> can lead to placement on the state sex offender<\/span> registration<\/span> and a possible third-strike penalty. Proving the elements for an indecent exposure conviction<\/span> requires a prosecutor to show that the defendant intentionally exposed themselves for the purpose of <\/span>sexual gratification<\/span>.<\/p>\n

How California Defines Indecent Exposure<\/h2>\n

California Penal Code<\/span> Section<\/span> 314<\/a> defines indecent exposure as someone exposing their \u201cperson\u201d or their private parts<\/span> in a public place<\/span>. Indecent exposure can also mean assisting or \u201ccounseling<\/span>\u201d another person to do so with the intent to create lewd<\/span> thoughts<\/span> in others.<\/p>\n

In practice, context and intent define indecent exposure. \u201cLewd<\/span> conduct<\/span>\u201d means the individual wants some kind of sexual gratification<\/span> or arousal from their acts. When frat boys moon<\/span> their rivals or a drunk patron urinates against a bar wall, it may be shocking and annoying to others, but not necessarily lewd<\/span> conduct<\/span>.<\/p>\n
