This raises an important question. Are <span data-term-id=\"56817801\">California employers<\/span> required to provide <span data-term-id=\"56817804\">paid holidays<\/span> for their employees or <span data-term-id=\"56817812\">extra pay<\/span> for working on a legal holiday?<\/p>\n<p>While California <span data-term-id=\"56817806\">labor laws<\/span> offer some of the strongest employee protections in the nation, the laws about <span data-term-id=\"56817800\">holiday pay<\/span> may surprise you. Your employer\u2019s holiday schedule is generally based on <span data-term-id=\"56817822\">company policy<\/span> and not on <span data-term-id=\"56817844\">legal requirements<\/span>. To further complicate things, <span data-term-id=\"56817802\">California laws<\/span> use the word \u201choliday\u201d in several different ways. The resulting confusion is a common source of workplace disputes.<\/p>\n<p>This article provides a detailed look at California\u2019s laws about <span data-term-id=\"56817800\">holiday pay<\/span> and legal holidays, with a focus on private-sector (non-government) employees. For a broader look at federal rules and approaches taken in other states, see our <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/do-companies-have-to-provide-holiday-pay.html\">companion article on <span data-term-id=\"56817800\">holiday pay<\/span><\/a>.<\/p>\n<h2>State Laws About <span data-term-id=\"56817800\">Holiday Pay<\/span><\/h2>\n<p>The most important thing to know about <a href=\"https:\/\/www.dir.ca.gov\/dlse\/faq_holidays.htm\" target=\"_blank\" rel=\"noopener\">holidays in California<\/a> is that private employers are <strong>not required<\/strong> to provide them. In other words, <span data-term-id=\"56817801\">California employers<\/span> are not legally required to pay <span data-term-id=\"56817821\">premium pay<\/span>, such as <span data-term-id=\"56817808\">time-and-a-half<\/span> or <span data-term-id=\"56817854\">double time<\/span>, for working on holidays. There is also no requirement to provide <span data-term-id=\"56817815\">paid time off<\/span> for holidays.<\/p>\n<p><span data-term-id=\"56817802\">California law<\/span> does not require private employers to provide holiday incentives to their employees. There are certain elements to be aware of, which we explain below.<\/p>\n<h3>An Employer\u2019s Written Promise<\/h3>\n<p>Many employers choose to offer holiday incentives, such as <span data-term-id=\"56817834\">additional pay<\/span> for working on <span data-term-id=\"56817830\">specific holidays<\/span> or providing the <span data-term-id=\"56817803\">day off<\/span>, with or without pay. Again, there is no <span data-term-id=\"56817844\">legal requirement<\/span> for an employer to do this. Unless a promise to pay holiday incentives is in writing, such as in an employment contract,\u00a0<span data-term-id=\"56817828\">employee handbook<\/span>,\u00a0<span data-term-id=\"56817822\">company policy<\/span>, or\u00a0<span data-term-id=\"56817824\">collective bargaining agreement<\/span>, <span data-term-id=\"56817800\">holiday pay<\/span> is not required by law in the private sector.<\/p>\n<p>If an <span data-term-id=\"56817823\">employer\u2019s policy<\/span> provides holiday incentives, the employer must honor that promise. In this case, <span data-term-id=\"56817800\">holiday pay<\/span>\u00a0becomes a wage benefit that the <a href=\"https:\/\/www.dir.ca.gov\/dlse\/\" target=\"_blank\" rel=\"noopener\">California Division of Labor Standards Enforcement (<span data-term-id=\"56817813\">DLSE<\/span>)<\/a> will enforce.<\/p>\n<p>The employer may set its own requirements for <span data-term-id=\"56817800\">holiday pay<\/span>, such as:<\/p>\n<ul>\n<li>The holiday must fall on a normally scheduled <span data-term-id=\"56817820\">workday<\/span> (common for <span data-term-id=\"56817852\">part-time employees<\/span>)<\/li>\n<li>Requiring a specific amount of <span data-term-id=\"56817832\">full-time<\/span> work (waiting time) before the benefit kicks in<\/li>\n<li>Employee must be actively employed on the holiday<\/li>\n<\/ul>\n<p>The key to a valid holiday policy is that it must be clearly stated and consistently applied. If your employer promises <span data-term-id=\"56817800\">holiday pay<\/span> in the <span data-term-id=\"56817828\">employee handbook<\/span>, employment contract, or <span data-term-id=\"56817822\">company policy<\/span>, they must follow their own rules. They can\u2019t randomly change the rules or apply them only to certain employees.<\/p>\n<h3>Important Considerations for Non-<span data-term-id=\"56817825\">Exempt Employees<\/span><\/h3>\n<p>Non-<span data-term-id=\"56817825\">exempt employees<\/span> in California are usually entitled to <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-overtime-laws.html\"><span data-term-id=\"56817818\">overtime pay<\/span><\/a> for working more than eight hours in a day or more than 40 hours in a <span data-term-id=\"56817807\">workweek<\/span>. This doesn\u2019t mean that you\u2019ll automatically receive overtime for working on a holiday. This is a common misunderstanding. An employer is free to offer <span data-term-id=\"56817812\">extra pay<\/span> for holiday work, but the law does not require it.<\/p>\n<p>Employers must always pay non-<span data-term-id=\"56817825\">exempt employees<\/span> <span data-term-id=\"56817818\">overtime pay<\/span> according to the <span data-term-id=\"56817806\">labor laws<\/span>. <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-510\/\" target=\"_blank\" rel=\"noopener\">California Labor Code \u00a7 510<\/a> requires employers to pay employees <span data-term-id=\"56817818\">overtime pay<\/span> for the hours of labor or <a href=\"https:\/\/www.dir.ca.gov\/dlse\/Glossary.asp?Button1=H#hours%20worked\" target=\"_blank\" rel=\"noopener\">hours worked<\/a>. When <span data-term-id=\"56817800\">holiday pay<\/span> is included in the <span data-term-id=\"56817807\">work week<\/span>, an employee may have over 40 hours of pay and still be compensated at their <span data-term-id=\"56817845\">regular <\/span><span data-term-id=\"56817809\">rate of pay<\/span> for the entire week.<\/p>\n<p>For example, if an hourly <span data-term-id=\"56817835\">employee works<\/span> 40 hours in a <span data-term-id=\"56817807\">workweek<\/span>\u00a0and receives eight hours of <span data-term-id=\"56817815\">paid time off<\/span> for a holiday, the employee receives 48 hours of total compensation. However, since only 40 hours were actually worked, no overtime is owed beyond any daily overtime already earned during those 40 worked hours for working more than eight hours in a day. In other words, when calculating overtime in a week with a <span data-term-id=\"56817804\">paid holiday<\/span>, <strong>hours paid<\/strong> are not the same as <strong>hours worked<\/strong>.<\/p>\n<h3>Important Considerations for <span data-term-id=\"56817825\">Exempt Employees<\/span><\/h3>\n<p>If you are an <a href=\"https:\/\/corporate.findlaw.com\/human-resources\/exemp-vs-non-exempt-employees.html\" target=\"_blank\" rel=\"noopener\">exempt (salary) employee<\/a>, a holiday generally does not reduce your pay. As long as you work any part of the week, your employer must pay you your full salary. That said, your employer may require you to use vacation time or <span data-term-id=\"56817815\">paid time off<\/span> (PTO) for a holiday closure. In other words, your employer may not reduce your salary for a holiday, but they may reduce your PTO balance.<\/p>\n<p>If your employer reduces your salary because of a holiday or a partial-day absence tied to a holiday, this can raise misclassification or wage-and-hour issues. You may want to contact a California <a href=\"https:\/\/lawyers.findlaw.com\/wage-hour\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56817806\">labor law<\/span> attorney<\/a>. This can be a costly mistake for your employer.<\/p>\n<h2>California Holidays<\/h2>\n<p>For the most part, California recognizes the same core holidays as the federal government. The state also recognizes elective holidays and additional holidays that are narrowly recognized, if at all.<\/p>\n<p>Remember, private employers are under no legal obligation to provide <span data-term-id=\"56817804\">paid holidays<\/span> to their employees. That said, they may choose to recognize any of these holidays or choose to observe a <span data-term-id=\"56817830\">specific holiday<\/span> of their own, such as the company\u2019s founding date.<\/p>\n<p>Let\u2019s untangle the holidays recognized in California.<\/p>\n<h3>Paid State-Employee Holidays: The Core Group<\/h3>\n<p>A state employee who is required to work on any of these state legal holidays is entitled to their <span data-term-id=\"56817845\">regular <\/span><span data-term-id=\"56817809\">rate of pay<\/span> and eight hours of holiday credit. The law that creates these holidays is <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-19853\/\" target=\"_blank\" rel=\"noopener\">California Government Code \u00a7 19853<\/a>. The <a href=\"https:\/\/www.sos.ca.gov\/state-holidays\" target=\"_blank\" rel=\"noopener\">California Secretary of State<\/a> keeps an up-to-date list of the state employee holidays.<\/p>\n<ul>\n<li><span data-term-id=\"56817811\">New Year\u2019s Day<\/span> &#8211; January 1<\/li>\n<li>Dr. <span data-term-id=\"56817843\">Martin Luther King<\/span>, <span data-term-id=\"56817846\">Jr. Day<\/span> &#8211; 3rd Monday in January<\/li>\n<li><span data-term-id=\"56817842\">President\u2019s Day<\/span> (George Washington\u2019s Birthday)- 3rd Monday in February<\/li>\n<li>Cesar Chavez Day &#8211; March 31<\/li>\n<li><span data-term-id=\"56817810\">Memorial Day<\/span> &#8211; last Monday of May<\/li>\n<li><span data-term-id=\"56817819\">Independence Day<\/span> &#8211; July 4<\/li>\n<li><span data-term-id=\"56817814\">Labor Day<\/span> &#8211; 1st Monday in September<\/li>\n<li><span data-term-id=\"56817839\">Veterans Day<\/span> &#8211; November 11<\/li>\n<li><span data-term-id=\"56817827\">Thanksgiving Day<\/span> &#8211; 4th Thursday in November<\/li>\n<li>The day after <span data-term-id=\"56817827\">Thanksgiving Day<\/span><\/li>\n<li>December 25-<span data-term-id=\"56817826\">Christmas Day<\/span><\/li>\n<\/ul>\n<p>For the most part, California recognizes the same holidays as the federal government, except:<\/p>\n<ul>\n<li>Cesar Chavez Day and the day after <span data-term-id=\"56817827\">Thanksgiving Day<\/span> (not federal-employee <span data-term-id=\"56817804\">paid holidays<\/span>)<\/li>\n<li>Juneteenth National <span data-term-id=\"56817819\">Independence Day<\/span> and <span data-term-id=\"56817848\">Columbus Day<\/span> (not state-employee <span data-term-id=\"56817804\">paid holidays<\/span>)<\/li>\n<\/ul>\n<p>The federal government continues to refer to the February holiday as \u201cWashington\u2019s Birthday\u201d and the October holiday as \u201c<span data-term-id=\"56817848\">Columbus Day<\/span>,\u201d while many state and local governments now refer to the October holiday\u00a0as \u201cIndigenous Peoples\u2019 Day.\u201d The federal law addressing public legal holidays is <a href=\"https:\/\/codes.findlaw.com\/us\/title-5-government-organization-and-employees\/5-usc-sect-6103\/\" target=\"_blank\" rel=\"noopener\">5 U.S.C. \u00a7 6103<\/a>.<\/p>\n<p><span data-term-id=\"56817802\">California law<\/span> also grants state employees a personal holiday credit or \u201cfloating holiday\u201d to use on a day of their choice under <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-19854\/\" target=\"_blank\" rel=\"noopener\">California Government Code \u00a7 19854<\/a>. The law also grants the Governor the authority to appoint additional days for \u201ca public fast, thanksgiving, or holiday.\u201d<\/p>\n<h3>California Elective Holidays<\/h3>\n<p>In addition to the core holidays listed above, California <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-19853\/\" target=\"_blank\" rel=\"noopener\">recognizes elective holidays<\/a>. These cultural and <span data-term-id=\"56817836\">religious observances<\/span> are not automatically state-employee holidays, but state employees can choose to observe one by using their personal holiday credit. They include:<\/p>\n<ul>\n<li>Lunar New Year &#8211; usually the date corresponding with the new moon after the winter solstice<\/li>\n<li>Genocide Remembrance Day &#8211; April 24<\/li>\n<li>Diwali <em>&#8211; <\/em>recognized for the first time on Monday, November 9, 2026<\/li>\n<li>Juneteenth &#8211; June 19<\/li>\n<li>Native American Day &#8211; 4th Friday in September<\/li>\n<\/ul>\n<h3>California Legal Holidays With Limited or Narrow Impact<\/h3>\n<p>A few more state holidays are recognized under a different law, <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-6700\/\" target=\"_blank\" rel=\"noopener\">California Government Code \u00a7 6700<\/a>. The holidays from this law that don\u2019t overlap with California\u2019s core holidays and elective holidays are:<\/p>\n<ul>\n<li>Every Sunday<\/li>\n<li>Lincoln Day &#8211; February 12<\/li>\n<li>Admission Day &#8211; September 9<\/li>\n<li><span data-term-id=\"56817848\">Columbus Day<\/span>\/Indigenous Peoples\u2019 Day &#8211; 2nd Monday in October<\/li>\n<li>Good Friday, from 12 pm to 3 pm (judicial holiday only) &#8211; the Friday before Easter<\/li>\n<\/ul>\n<p>These holidays have limited, narrow, or no impact on state office closures or <span data-term-id=\"56817800\">holiday pay<\/span> for state employees. Instead, they are more about filing deadlines or historical importance.<\/p>\n<h3>Agency Holidays<\/h3>\n<p>Government agencies may have their own lists of observed holidays. For example, California\u2019s Employment Development Department observes a comprehensive list of <a href=\"https:\/\/edd.ca.gov\/en\/payroll_taxes\/holidays\/\" target=\"_blank\" rel=\"noopener\">legal holidays<\/a> that affect when your employer must report or pay employment taxes. While this doesn\u2019t affect you as an employee, it demonstrates how complex and varied the definition of \u201choliday\u201d is in California.<\/p>\n<h3>Local Legal Holidays<\/h3>\n<p>In addition to state legal holidays, some cities and counties have additional legal holidays that affect local offices and local government employees. For example:<\/p>\n<ul>\n<li>The city of <span data-term-id=\"56817833\">Los Angeles<\/span> recognizes Indigenous Peoples&#8217; Day (the second Monday in October) as a <span data-term-id=\"56817804\">paid holiday<\/span> for city employees<\/li>\n<li><span data-term-id=\"56817853\">Orange County<\/span> recognizes President Lincoln\u2019s birthday in February (distinct from the combined <span data-term-id=\"56817842\">President\u2019s Day<\/span> holiday) and Native American Day in September (distinct from Indigenous Peoples\u2019 Day) as <span data-term-id=\"56817804\">paid holidays<\/span> for most county employees<\/li>\n<\/ul>\n<p>Your city, county, or both may recognize additional <span data-term-id=\"56817804\">paid holidays<\/span> for local government employees.<\/p>\n<h2>Get <span data-term-id=\"56817840\">Legal Advice<\/span> for Your Wage and Hour Concerns<\/h2>\n<p>While the lists of California holidays and their inconsistent overlap can be challenging to understand, the state\u2019s stance on <span data-term-id=\"56817804\">paid holidays<\/span> for private-sector employees is not. The state does not require employers to offer <span data-term-id=\"56817800\">holiday pay<\/span>, but if they do, they must consistently apply it.<\/p>\n<p>If <span data-term-id=\"56817837\">holiday time<\/span> has come and gone and you didn\u2019t receive the <span data-term-id=\"56817812\">extra pay<\/span> required by your employment agreement, <span data-term-id=\"56817822\">company policy<\/span>, or <span data-term-id=\"56817824\">collective bargaining agreement<\/span>, you may want to meet with an attorney for <span data-term-id=\"56817840\">legal advice<\/span>. <span data-term-id=\"56817825\">Exempt employees<\/span> who discover their employer either reduced or docked their salary for a holiday closure should consider discussing a potential claim with an attorney.
