Let\u2019s take a look at what they are and how they function.<\/p>\n<h3>Who Is Protected?<\/h3>\n<p>The protections under the <span data-term-id=\"56817697\">California Labor Code<\/span>\u00a0are broad. In general, these <span data-term-id=\"56817690\">whistleblower protections<\/span> cover current employees, former employees, and even job applicants. California\u2019s <span data-term-id=\"56817690\">whistleblower protections<\/span> cover private-sector employees and many public-sector employees, including <span data-term-id=\"56817706\">University of California<\/span> employees.<\/p>\n<p>The law does not protect elected officials or true independent contractors. It\u2019s not uncommon for employers to misclassify workers as <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/being-an-independent-contractor-vs-employee.html\">independent contractors<\/a>. The whistleblower doesn\u2019t have to prove that the employer\u2019s conduct is illegal. Holding a reasonable belief is enough.<\/p>\n<p>The illegal conduct can look like violations or <span data-term-id=\"56817713\">noncompliance<\/span> with laws, rules, or regulations at the federal, state, or local level. Some examples of an employer\u2019s <span data-term-id=\"56817717\">illegal activity<\/span> include:<\/p>\n<ul>\n<li>Violating health or safety codes<\/li>\n<li>Directing employees to do something illegal<\/li>\n<li>Committing wage theft or violating other <span data-term-id=\"56817697\">California labor code<\/span> provisions<\/li>\n<li>Allowing or committing discrimination or harassment<\/li>\n<li>Conducting fraudulent activity<\/li>\n<li>Violating regulations<\/li>\n<li>Failing to follow licensing requirements<\/li>\n<\/ul>\n<p>The whistleblower\u2019s report or opposition must be made in <span data-term-id=\"56817701\">good faith<\/span>. This means if you are honest and do not knowingly make a false report, you are covered by the <span data-term-id=\"56817690\">whistleblower protections<\/span>. They remain in place regardless of whether an investigation clears the employer of any wrongdoing.<\/p>\n<p>A protected report can be internal (within the company) or external (to a <span data-term-id=\"56817709\">government agency<\/span> or authority). For example, if you make a report to your supervisor, the HR department, or a company <span data-term-id=\"56817727\">hotline<\/span>, you are protected. You do not have to report to an outside authority to be protected from retaliation.<\/p>\n<h3><span data-term-id=\"56817725\">Employer Retaliation<\/span><\/h3>\n<p>Firing the whistleblower is one example of <span data-term-id=\"56817725\">employer retaliation<\/span>, but adverse <span data-term-id=\"56817736\">employment action<\/span> can be more subtle than an outright termination. Examples of <span data-term-id=\"56817725\">employer retaliation<\/span> may look like:<\/p>\n<ul>\n<li><span data-term-id=\"56817700\">Demotion<\/span><\/li>\n<li>Threats or harassment<\/li>\n<li>A negative write-up<\/li>\n<li>Being passed over for a promotion<\/li>\n<li>Losing your top-performing clients or accounts<\/li>\n<li>Being excluded from important meetings<\/li>\n<li>Getting scheduled for fewer hours or less desirable shifts<\/li>\n<\/ul>\n<p>Any <span data-term-id=\"56817718\">adverse action<\/span> that might discourage an employee from reporting their <span data-term-id=\"56817717\">illegal activity<\/span> may indicate <span data-term-id=\"56817725\">employer retaliation<\/span>. Timing can be a strong indicator of <span data-term-id=\"56817725\">employer retaliation<\/span>. For example, disciplinary action taken just after a report, or new inconsistencies in performance reviews after a report, can be a strong indicator of retaliation.<\/p>\n<h3>Other <span data-term-id=\"56817719\">Contributing Factors<\/span> to an <span data-term-id=\"56817718\">Adverse Action<\/span><\/h3>\n<p>The employee must only show (usually by a <span data-term-id=\"56817741\">preponderance of the evidence<\/span>) that the retaliation was a \u201c<span data-term-id=\"56817719\">contributing factor<\/span>\u201d to the employer\u2019s <span data-term-id=\"56817718\">adverse action<\/span>. In other words, the employee can meet the burden of proving <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-retaliation-and-the-law.html\">unlawful retaliation<\/a> even if other factors also contributed to the employer\u2019s <span data-term-id=\"56817718\">adverse action<\/span>.<\/p>\n<p>Once an employee shows a <span data-term-id=\"56817704\">protected activity<\/span> and <span data-term-id=\"56817725\">employer retaliation<\/span>, the <span data-term-id=\"56817702\">burden of proof<\/span> shifts to the employer. The employer must prove that it would have taken the same <span data-term-id=\"56817718\">adverse action<\/span> even if the employee had not reported it.<\/p>\n<p>For example, let\u2019s say an employer demotes an employee for being late twice in a week. However, the <span data-term-id=\"56817700\">demotion<\/span> occurs after the employee reports the employer for a violation. The employer must prove that the employee was demoted solely for being late. An employer can have multiple reasons for its <span data-term-id=\"56817718\">adverse action<\/span>, but it is still illegal if whistleblowing is a <span data-term-id=\"56817719\">contributing factor<\/span>. This requirement can encourage an employee to report unlawful activity even if they are not a \u201cmodel\u201d employee.<\/p>\n<h2>Other Key <span data-term-id=\"56817733\">Whistleblower Protection<\/span><span data-term-id=\"56817733\"> Laws<\/span> in California<\/h2>\n<p>In addition to the main whistleblower law, several other California laws include <span data-term-id=\"56817690\">whistleblower protections<\/span>. For example, the <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-8547\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56817691\">California <\/span><span data-term-id=\"56817691\">Whistleblower Protection<\/span><span data-term-id=\"56817691\"> Act<\/span><\/a> protects <span data-term-id=\"56817703\">state employees<\/span>. An employee may have a claim under more than one of these laws, depending on the circumstances. These can include:<\/p>\n<ul>\n<li>Reporting an employer\u2019s unlawful act related to discrimination may be protected under both \u00a7 1102.5 and the <a href=\"https:\/\/www.dor.ca.gov\/Home\/FairEmploymentAct\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56817742\">Fair Employment and Housing Act<\/span> (FEHA)<\/a><\/li>\n<li>Reporting an employer\u2019s <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/how-to-report-wage-and-hour-violations.html\">wage theft<\/a> might be protected under the main law and the <a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-98-6\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56817697\">California Labor Code<\/span><\/a><\/li>\n<\/ul>\n<p>Filing more than one type of claim can be strategic, providing additional legal remedies against your employer and greater leverage. Some of the <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protections.html\">Federal <span data-term-id=\"56817733\">Whistleblower Protection<\/span><span data-term-id=\"56817733\"> Laws<\/span><\/a> include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56817690\">Whistleblower Protection<\/span> Act:<\/strong> Protects <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protection-act-an-overview.html\">federal employees<\/a> reporting government issues<\/li>\n<li><strong><span data-term-id=\"56817739\">Sarbanes-Oxley Act<\/span> (SOX): <\/strong>Protects corporate employees reporting <a href=\"https:\/\/www.whistleblowers.gov\/statutes\/sox_amended\" target=\"_blank\" rel=\"noopener\">financial misconduct<\/a> and gross waste of funds<\/li>\n<li><strong>Occupational Safety and Health Act (OSHA):<\/strong> Provides protection for certain workers reporting <a href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/employee-safety-and-retaliation.html\">workplace health and safety issues<\/a><\/li>\n<\/ul>\n<p>The federal filing deadlines are extremely short. Some give workers as few as 30 days to file, rather than months or years. For this reason, filing a whistleblower claim as soon as possible is essential. While one report can lead to both a federal and a California claim, you must act fast enough to keep every option open.<\/p>\n<h2>State and Federal Rewards for Reporting Fraud<\/h2>\n<p>If your employer is defrauding the state or federal government, you may be able to bring a lawsuit known as a\u00a0\u201c<a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/qui-tam-actions.html#:~:text=Qui%20tam%20actions%20are%20lawsuits,reward%20for%20filing%20the%20suit.\"><u>qui tam action<\/u><\/a>.\u201d Both the federal\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/what-is-the-false-claims-act.html\">False Claims Act<\/a> and the <a href=\"https:\/\/oag.ca.gov\/cfs\/falseclaims\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56817705\">California False Claims Act<\/span><\/a> allow a private citizen (known as the \u201crelator\u201d) to sue their employer for defrauding government programs and protect the relator against <a href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers\/whistleblower-protections-in-qui-tam-actions.html\"><span data-term-id=\"56817695\">whistleblower retaliation<\/span><\/a>. Although not limited to the healthcare sector, many of these cases involve employers in the healthcare industry defrauding government programs such as Medicare or MediCal.<\/p>\n<p>If the government recovers money as a result of the lawsuit, the relator may receive a significant percentage of the funds. The <span data-term-id=\"56817729\">public policy<\/span> behind qui tam laws is to encourage employees to report fraud that the government might not otherwise detect, while protecting them from <span data-term-id=\"56817725\">employer retaliation<\/span>.<\/p>\n<h2>How To <span data-term-id=\"56817737\">Report Violations<\/span><\/h2>\n<p>If you think your employer is breaking the law, here are some actions to consider taking.
