Many states follow the <a href=\"https:\/\/www.uniformlaws.org\/committees\/community-home?CommunityKey=35a4e3e3-de91-4527-aeec-26b1fc41b1c3\" target=\"_blank\" rel=\"noopener\">Uniform <span data-term-id=\"57474051\">Probate<\/span> Code<\/a>, but <span data-term-id=\"57474050\">California<\/span> is not one of them. With a <span data-term-id=\"57474055\">valid will<\/span> in place, your assets will pass to your intended heirs according to your wishes.<\/p>\n<h3>Types of Wills<\/h3>\n<p>How you communicate your final wishes is important. <span data-term-id=\"57474057\">California<\/span><span data-term-id=\"57474057\">\u2019s law<\/span> requires the person making the will (the <em><span data-term-id=\"57474054\">testator<\/span>)<\/em> to have the <em>legal capacity<\/em> to make a will. As mentioned, this means you must be at least 18 <span data-term-id=\"57474068\">years old<\/span> and of <span data-term-id=\"57474056\">sound mind<\/span>. <span data-term-id=\"57474050\">California<\/span> <span data-term-id=\"57474075\">state law<\/span> also requires wills to be written down to be valid. An attested will is a formally prepared will that meets specific <span data-term-id=\"57474067\">legal requirements<\/span>. The state also recognizes <span data-term-id=\"57474086\">handwritten wills<\/span> (<a href=\"https:\/\/dictionary.findlaw.com\/definition\/will.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"57474058\">holographic <\/span><\/em><span data-term-id=\"57474058\">wills<\/span><\/a>), but they must meet specific\u00a0requirements. Unlike a few states, <span data-term-id=\"57474050\">California<\/span> does not recognize oral (<em>nuncupative<\/em>) wills.<\/p>\n<p><strong>Attested Will<\/strong><\/p>\n<p>A formal will is usually a written document prepared by an attorney. The will must be <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-6110\/\" target=\"_blank\" rel=\"noopener\">signed<\/a> by one of the following:<\/p>\n<ul>\n<li>The <span data-term-id=\"57474054\">testator<\/span><\/li>\n<li>Another person in the <span data-term-id=\"57474054\">testator<\/span>\u2019s name, in the <span data-term-id=\"57474054\">testator<\/span>\u2019s presence, and at the <span data-term-id=\"57474054\">testator<\/span>\u2019s direction<\/li>\n<li>A <span data-term-id=\"57474091\">conservator<\/span> acting under a court order<\/li>\n<\/ul>\n<p>The will must also be attested by witnesses. At least two competent people, present at the same time, must witness the will\u2019s signing (or the <span data-term-id=\"57474054\">testator<\/span>\u2019s acknowledgment of the will signing) during the <span data-term-id=\"57474054\">testator<\/span>\u2019s lifetime and understand that it is the <span data-term-id=\"57474088\">testator<\/span><span data-term-id=\"57474088\">\u2019s will<\/span>. The witnesses should be disinterested, meaning they don\u2019t have a financial interest under the will.<\/p>\n<p>If a witness has an interest in the will, the <span data-term-id=\"57474060\">probate<\/span><span data-term-id=\"57474060\"> court<\/span> may presume the <span data-term-id=\"57474094\">interested witness<\/span> had <span data-term-id=\"57474059\">undue influence<\/span> over the <span data-term-id=\"57474054\">testator<\/span>. In this case, the <span data-term-id=\"57474094\">interested witness<\/span> may have to overcome the presumption of <span data-term-id=\"57474059\">undue influence<\/span> to receive more than what they would receive under intestate succession law.<\/p>\n<p>Unlike many <span data-term-id=\"57474080\">legal documents<\/span>, a will does not need to be notarized to be valid. Because of the legal weight of an attested will, the <span data-term-id=\"57474071\">probate<\/span><span data-term-id=\"57474071\"> process<\/span> tends to be smooth.<\/p>\n<p><strong><span data-term-id=\"57474058\">Holographic Will<\/span><\/strong><\/p>\n<p>A <span data-term-id=\"57474086\">handwritten will<\/span> is known as a \u201cholographic\u201d will. <span data-term-id=\"57474050\">California<\/span> recognizes <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-6111\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57474058\">holographic wills<\/span><\/a> if:<\/p>\n<ul>\n<li>The <span data-term-id=\"57474083\">material provisions<\/span> of the will and the signature are in the <span data-term-id=\"57474087\">testator<\/span><span data-term-id=\"57474087\">\u2019s handwriting<\/span><\/li>\n<li>The language shows testamentary intent (this can be shown by extrinsic evidence, meaning evidence that is found outside of the document itself)<\/li>\n<\/ul>\n<p>A formal will that is missing attestation may still be valid as a <span data-term-id=\"57474058\">holographic will<\/span> if these requirements are met. Like a formal will, a <span data-term-id=\"57474086\">handwritten will<\/span> does not need to be attested by a <span data-term-id=\"57474093\">notary<\/span> public. It also does not require witnesses. As a result, a\u00a0<span data-term-id=\"57474086\">handwritten will<\/span>\u00a0may be subject to greater legal scrutiny by the <span data-term-id=\"57474060\">probate<\/span><span data-term-id=\"57474060\"> court<\/span>.<\/p>\n<p><strong><span data-term-id=\"57474078\">Oral Wills<\/span><\/strong><\/p>\n<p>An <span data-term-id=\"57474078\">oral will<\/span> is sometimes known as a nuncupative will. Examples include a so-called \u201cdeathbed declaration.\u201d The state of <span data-term-id=\"57474050\">California<\/span> does not recognize <span data-term-id=\"57474078\">oral wills<\/span>.<\/p>\n<h3>What Does \u201c<span data-term-id=\"57474056\">Sound Mind<\/span>\u201d Mean?<\/h3>\n<p>The <span data-term-id=\"57474065\">California<\/span> <span data-term-id=\"57474065\">Probate<\/span><span data-term-id=\"57474065\"> Code<\/span> requires a <span data-term-id=\"57474054\">testator<\/span> to be <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-6100-5\/\" target=\"_blank\" rel=\"noopener\">mentally competent<\/a> at the time the will is made. The statute defines what is not mentally competent in two ways.<\/p>\n<p>First, an individual who does not have sufficient <span data-term-id=\"57474073\">mental capacity<\/span> won\u2019t be able to understand that they are making a will, understand and remember what property they own, or remember and understand who their close <span data-term-id=\"57474064\">family members<\/span> are and how the will might affect them.<\/p>\n<p>Second, an individual who has a mental health disorder with symptoms including delusions or hallucinations that cause the individual to distribute their property in a way that the individual would not have done otherwise is not legally capable of making a will.<\/p>\n<p>If either of these applies, the will is likely to be declared invalid.<\/p>\n<h2>What Happens if You Die Without a <span data-term-id=\"57474055\">Valid Will<\/span> in Place?<\/h2>\n<p>If you <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/what-happens-if-i-die-without-a-will.html\">die without a will<\/a> in <span data-term-id=\"57474050\">California<\/span>, the <span data-term-id=\"57474060\">probate<\/span><span data-term-id=\"57474060\"> court<\/span> will handle your estate. The <span data-term-id=\"57474071\">probate<\/span><span data-term-id=\"57474071\"> process<\/span> for an intestate estate includes:<\/p>\n<ul>\n<li>Appointing the personal representative (administrator)<\/li>\n<li>Identifying the legal heirs under the intestacy statutes<\/li>\n<li>Paying debts<\/li>\n<li>Distributing any remaining assets in the order set out in the <span data-term-id=\"57474051\">Probate<\/span> Code<\/li>\n<\/ul>\n<p>This means your estate will be handled under your state&#8217;s intestate succession laws rather than according to your wishes. <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-6402\/\" target=\"_blank\" rel=\"noopener\">These laws<\/a> tend to divide your estate equally between your surviving spouse and your relatives or, if you don\u2019t have a surviving spouse, among your relatives. This may include distant relatives. If no heirs are found, your estate \u201c<a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-6404\/\" target=\"_blank\" rel=\"noopener\">escheats<\/a>\u201d (goes) to the state.<\/p>\n<h2>The <span data-term-id=\"57474071\">Probate<\/span><span data-term-id=\"57474071\"> Process<\/span> in <span data-term-id=\"57474050\">California<\/span><\/h2>\n<p>The <span data-term-id=\"57474071\">probate<\/span><span data-term-id=\"57474071\"> process<\/span> for a will is similar to the intestate process. In this case, you\u2019ve chosen your personal representative (executor) who will administer your estate. The executor gathers and manages your assets, notifies the heirs you\u2019ve named, pays the estate\u2019s debts, and distributes the remainder of your estate to your heirs according to your wishes, all under court supervision.<\/p>\n<p>The cost of <span data-term-id=\"57474051\">probate<\/span> in <span data-term-id=\"57474050\">California<\/span> is set by statute. The <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-10800\/\" target=\"_blank\" rel=\"noopener\">personal representative fees<\/a> (the administrator or executor) and <a href=\"https:\/\/codes.findlaw.com\/ca\/probate-code\/prob-sect-10810\" target=\"_blank\" rel=\"noopener\">attorney fees<\/a> are based on the gross value of the estate. <span data-term-id=\"57474051\">Probate<\/span> is that it is a public process. This means that the public can access the will and court filings, although some details may be redacted. Because of its cost and public nature, some people plan their estates to avoid <span data-term-id=\"57474051\">probate<\/span>.<\/p>\n<h2>Potential Ways To Avoid <span data-term-id=\"57474051\">Probate<\/span><\/h2>\n<p>There are ways to pass along some or even all of your assets at your death that avoid the <span data-term-id=\"57474071\">probate<\/span><span data-term-id=\"57474071\"> process<\/span>. Some of the key strategies include a trust-based <span data-term-id=\"57474052\">estate plan<\/span>, ownership and <span data-term-id=\"57474053\">beneficiary<\/span> designations, and statutory small-estate shortcuts.<\/p>\n<h3>Trust-Based <span data-term-id=\"57474052\">Estate Plan<\/span><\/h3>\n<p>Assets held in trust are often exempt from <span data-term-id=\"57474051\">probate<\/span>. A revocable <span data-term-id=\"57474079\">living trust<\/span> is a common <span data-term-id=\"57474052\">estate planning<\/span> tool. In a revocable <span data-term-id=\"57474079\">living trust<\/span>, you transfer your assets to the trust and serve as the trustee until your death. Your successor trustee then takes over the trust administration. A main benefit of a trust-based <span data-term-id=\"57474052\">estate plan<\/span> is that it may avoid <span data-term-id=\"57474051\">probate<\/span> entirely if properly funded. This can be quicker, less expensive, and more private. A revocable <span data-term-id=\"57474079\">living trust<\/span> may cost more to set up and administer than a will, which is also an important consideration.<\/p>\n<h3>Ownership and <span data-term-id=\"57474053\">Beneficiary<\/span> Designations<\/h3>\n<p>If you hold any <span data-term-id=\"57474085\">real estate<\/span> as a joint tenant with right of survivorship or community property with right of survivorship, these assets will pass to the other owner or owners at your death. You can avoid <span data-term-id=\"57474051\">probate<\/span> for some assets by making transfer-on-death (TOD) or payable-on-death (POD) designations for some of your assets.<\/p>\n<p>In addition, retirement accounts and life insurance policies include <span data-term-id=\"57474053\">beneficiary<\/span> designations. At your death, these assets transfer to your named <span data-term-id=\"57474053\">beneficiary<\/span>.<\/p>\n<h3>Statutory Short Cuts<\/h3>\n<p>If an estate\u2019s value is below statutory thresholds, the <span data-term-id=\"57474065\">California<\/span> <span data-term-id=\"57474065\">Probate<\/span><span data-term-id=\"57474065\"> Code<\/span> allows a streamlined transfer process for certain small estates. These shortcuts have detailed requirements, but may avoid the full <span data-term-id=\"57474071\">probate<\/span><span data-term-id=\"57474071\"> process<\/span>.<\/p>\n<h2>Additional Considerations<\/h2>\n<p>An <a href=\"https:\/\/www.findlaw.com\/estate.html\"><span data-term-id=\"57474052\">estate plan<\/span><\/a> is about more than just passing on your assets to your heirs. For example, if you have <span data-term-id=\"57474084\">minor children<\/span>, you can nominate a guardian to take care of them. You can do the same for your pets, if you\u2019d like.<\/p>\n<p>With a <span data-term-id=\"57474081\">healthcare<\/span> <span data-term-id=\"57474076\">power of attorney<\/span> or advance <span data-term-id=\"57474081\">healthcare<\/span> directive in your <span data-term-id=\"57474052\">estate plan<\/span>, your wishes can be carried out if you become incapacitated. In addition, you can appoint a <span data-term-id=\"57474076\">power of attorney<\/span> to make your financial decisions during your incapacity.<\/p>\n<p>Your <span data-term-id=\"57474052\">estate plan<\/span> should be customized to meet your specific needs, which <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/checklist-reasons-estate-planning.html\">may change over time<\/a>. You can update an existing will with new terms by adding <a href=\"https:\/\/www.findlaw.com\/forms\/resources\/estate-planning\/last-will-and-testament\/what-is-a-codicil-to-a-will-simple-writing-tips-to-complete-one.html\"><span data-term-id=\"57474074\">a codicil<\/span><\/a> or creating an entirely <span data-term-id=\"57474072\">new will<\/span>.
