Certainly, few would expect that they might be <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/types-of-sentences.html\" target=\"_blank\">sent to prison<\/a> for years or exposed to huge fines for such a simple act.<\/p>\r\n<p>The fact of the matter is that Colorado criminal trespass laws treat trespassing very seriously, so much so that trespassing in certain circumstances can result in a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/felonies.html\" target=\"_blank\">felony<\/a> conviction. There are two different kinds of trespassing charged as a felony:<\/p>\r\n<ul>\r\n<li>Trespassing that is incident to the commission of a crime is frequently charged as a felony.<\/li>\r\n<li>Trespassing on certain designated agricultural lands is frequently charged as a felony.<\/li>\r\n<\/ul>\r\n<p>Even the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\" target=\"_blank\">misdemeanor<\/a> trespassing convictions carry the possibility of a significant term of imprisonment. The following chart outlines the different Colorado criminal trespass laws, the potential charges, and their penalties:<\/p>\r\n<table width=\"667\" cellspacing=\"0\" cellpadding=\"2\" border=\"1\">\r\n<tbody><tr><td width=\"200\" valign=\"top\"><b>Statutes<\/b><\/td>\r\n<td width=\"465\" valign=\"top\">Colorado Revised Statutes, <a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-4-502.html\" target=\"_blank\" rel=\"noopener\">Title 18, Article 4, Part 5<\/a><\/td>\r\n<\/tr><tr><td width=\"200\" valign=\"top\"><b>First Degree Criminal Trespass<\/b><\/td>\r\n<td width=\"465\" valign=\"top\"><ul>\r\n<li><b>Definition:<\/b> knowingly and unlawfully entering or remaining in the dwelling of another or entering any motor vehicle with the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\" target=\"_blank\">intent<\/a> to commit a crime therein.*<\/li>\r\n<li><b>Charge:<\/b> Class 5 felony<\/li>\r\n<li><b>Penalty:<\/b> 1-4 years imprisonment and\/or a fine of $1,000-$100,000<\/li>\r\n<\/ul>\r\n<p>*<i>Some forms of criminal trespass require intent to commit an additional crime, which makes their definition very similar to the crime of burglary. The difference is often the severity of the intended criminal act.
