If it falls on a Saturday, it is observed on the Friday before.<\/p>\n<p>The statute also recognizes &#8220;any day appointed or recommended by the governor of this state or the president of the United States as a day of fasting or prayer or thanksgiving.&#8221; For example, the governor may declare the day after Thanksgiving as an additional holiday, providing state workers with two consecutive days off.<\/p>\n<h2>Holiday Entitlements for Public Employees<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/do-businesses-have-to-give-federal-holidays-like-presidents-day-off\/\" target=\"_blank\" rel=\"noopener\"><strong><u><span data-term-id=\"59014963\">Federal holidays<\/span><\/u><\/strong><\/a> apply to federal workers, and state holidays apply to state workers. Colorado recognizes 11 legal holidays by statute, some of which overlap with the federally recognized holidays. The subsequent statutes acknowledge additional holidays, some of which a state employee can choose to observe in place of one of the 11 legal holidays.<\/p>\n<p>For example, Colorado also allows state employees to observe Farm Workers Day (formerly known as &#8220;C\u00e9sar Ch\u00e1vez Day&#8221;) on March 31 in place of another legally observed holiday.<\/p>\n<p>State employees get a paid day off, an alternate day off (compensatory time off or &#8220;comp&#8221; time), or premium <span data-term-id=\"59014935\">holiday pay<\/span> if they work a legal holiday.<\/p>\n<h2>Are <span data-term-id=\"59014955\">Private Employers<\/span> Required to Provide <span data-term-id=\"59014935\">Holiday Pay<\/span>?<\/h2>\n<p>No. <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/do-companies-have-to-provide-holiday-pay.html\" target=\"_blank\" rel=\"noopener\"><strong><u><span data-term-id=\"59014955\">Private employers<\/span> owe employees nothing for holidays<\/u><\/strong><\/a>\u2014no time off work, no <span data-term-id=\"59014937\">holiday incentive pay<\/span>, no obligation to close the business. Neither federal law nor Colorado state law requires <span data-term-id=\"59014955\">private employers<\/span> to close their businesses on holidays or to provide their employees with paid time off for holidays or <span data-term-id=\"59014953\">premium pay<\/span> for working on holidays.<\/p>\n<p>In the private sector, holidays are not a legal entitlement\u2014they are a negotiated benefit.<\/p>\n<h3>When <span data-term-id=\"59014955\">Private Employers<\/span> Choose to Offer Holidays<\/h3>\n<p>That said, most <span data-term-id=\"59014955\">private employers<\/span> do provide some holidays as an employment perk. Employer holidays are often listed in the employee handbook, employment contract, or established by custom.<\/p>\n<p>A holiday policy typically designates the <span data-term-id=\"59014962\">paid holidays<\/span>, who qualifies for them (full-time employees, part-time employees, etc.), and whether employees receive extra pay for working on those days.<\/p>\n<p>Once established, these policies are enforceable as wage agreements under the <a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-4-101\/\" target=\"_blank\" rel=\"noopener\"><strong><u>Colorado Wage Act<\/u><\/strong><\/a>. This law establishes strict legal guidelines for employee pay, deductions, final paychecks, and <span data-term-id=\"59014941\">minimum wage<\/span> requirements.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/colorado-law\/colorado-employment-laws.html\" target=\"_blank\" rel=\"noopener\"><strong><u>Colorado employment law<\/u><\/strong><\/a> extends significant protections to private-sector employees. These include paid <span data-term-id=\"59014947\">sick leave<\/span>, <span data-term-id=\"59014941\">minimum wage<\/span>, <span data-term-id=\"59014946\">overtime pay<\/span>, and more. Although a <span data-term-id=\"59014955\">private employer<\/span> may be required to provide holidays under a contract or collective bargaining agreement, holidays remain optional unless specifically agreed upon.<\/p>\n<h2>How Holidays Affect <span data-term-id=\"59014955\">Private Employer<\/span> Obligations<\/h2>\n<p>A <span data-term-id=\"59014955\">private employer<\/span> that chooses to offer holidays to its employees must be aware of how this may affect overtime and vacation pay obligations.<\/p>\n<h3>Holidays and <span data-term-id=\"59014960\">Overtime Premiums<\/span><\/h3>\n<p>Under the Colorado Overtime and Minimum Pay Standards Order or &#8220;<span data-term-id=\"59014948\">COMPS Order<\/span>,&#8221; <span data-term-id=\"59014945\">nonexempt employees<\/span> are entitled to an <span data-term-id=\"59014946\">overtime pay<\/span> rate of <span data-term-id=\"59014952\">time and a half<\/span>. In the <span data-term-id=\"59014939\">overtime calculation<\/span> for <span data-term-id=\"59014945\">nonexempt employees<\/span>, <span data-term-id=\"59014937\">holiday incentive pay<\/span> must be included in the <span data-term-id=\"59014936\">regular rate of pay<\/span>.<\/p>\n<p>Including <span data-term-id=\"59014937\">holiday incentive pay<\/span> in the regular rate can increase the overtime rate owed on all overtime hours that week. This was confirmed by a 2024 <span data-term-id=\"59014943\">Colorado Supreme Court<\/span> decision, <a href=\"https:\/\/caselaw.findlaw.com\/court\/co-supreme-court\/116566902.html\" target=\"_blank\" rel=\"noopener\"><strong><em><u><span data-term-id=\"59014944\">Hamilton v. Amazon.com Services LLC<\/span><\/u><\/em><\/strong><\/a>. The case clarified the state&#8217;s more employee-protective stance than the federal <span data-term-id=\"59014942\">Fair Labor Standards Act<\/span> (<span data-term-id=\"59014940\">FLSA<\/span>).<\/p>\n<p><em>Holiday hours<\/em> worked count toward the hourly thresholds for overtime, over 12 hours in a workday, over 40 hours in a workweek, or over 12 consecutive hours of work. But <em><span data-term-id=\"59014935\">holiday pay<\/span><\/em> for a day off work does not count toward the overtime thresholds. For example, if an employee works 40 hours in a week but is compensated for 48 hours because of a <span data-term-id=\"59014962\">paid holiday<\/span>, the employee is not entitled to overtime. The state&#8217;s overtime thresholds count hours <em>worked<\/em>, not hours compensated.<\/p>\n<h3>Holidays and Vacation Pay Obligations<\/h3>\n<p>Some <span data-term-id=\"59014955\">private employers<\/span> offer &#8220;floating holidays.&#8221; This is typically a set number of days off work that employees can use at their discretion. Colorado law treats floating holidays the same as <a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-4-101\/\" target=\"_blank\" rel=\"noopener\"><strong><u>vacation and PTO<\/u><\/strong><\/a>.<\/p>\n<p>This means that once earned, they are considered wages and cannot be forfeited. Additionally, all earned and unused floating holidays must be paid out in the employee&#8217;s <a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-4-109\/\" target=\"_blank\" rel=\"noopener\"><strong><u>final paycheck<\/u><\/strong><\/a> because they are considered earned wages.<\/p>\n<h2>Are You Owed <span data-term-id=\"59014935\">Holiday Pay<\/span>?<\/h2>\n<p>Even if you&#8217;re not a public-sector employee, your <span data-term-id=\"59014955\">private employer<\/span> may be required to follow the holiday policy they&#8217;ve established.
