Three of the key sources for these state protections are:<\/p>\n<ul>\n<li><strong><span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\"> Wage<\/span> Act: <\/strong>Covers wages and compensation, including <span data-term-id=\"40794590\">paydays<\/span>, <span data-term-id=\"40794617\">final paychecks<\/span>, wage deductions, and employees&#8217; rights to recover <span data-term-id=\"40794594\">unpaid wages<\/span><\/li>\n<li><strong><span data-term-id=\"40794575\">Colorado<\/span><span data-term-id=\"40794575\"> Overtime<\/span> and <span data-term-id=\"40794602\">Minimum Pay Standards<\/span> (<span data-term-id=\"40794603\">COMPS<\/span>) Order: <\/strong>Establishes <span data-term-id=\"40794576\">Colorado<\/span><span data-term-id=\"40794576\">&#8216;s <\/span><span data-term-id=\"40794553\">minimum wage<\/span>, overtime requirements, meal and <span data-term-id=\"40794586\">rest break<\/span> rules, and other wage and hour protections for covered (nonexempt) employees<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-5-101\/\" target=\"_blank\" rel=\"noopener\"><strong><span data-term-id=\"40794574\">Equal Pay for Equal Work Act<\/span> (EPEWA)<\/strong><\/a><strong>:<\/strong> Prohibits wage discrimination based on sex and certain other protected characteristics and requires pay transparency in job postings and promotion opportunities<\/li>\n<\/ul>\n<p>Together, these are designed to offer maximum protection to <span data-term-id=\"40794547\">Colorado<\/span> workers.<\/p>\n<h2>Protected <span data-term-id=\"40794547\">Colorado<\/span> Workers<\/h2>\n<p><span data-term-id=\"40794616\">Independent contractors<\/span> are not covered by most <a href=\"https:\/\/www.findlaw.com\/state\/colorado-law\/colorado-employment-laws.html\"><span data-term-id=\"40794547\">Colorado<\/span> <span data-term-id=\"40794560\">employment laws<\/span><\/a>, including wage-and-hour protections, as they are not considered employees. Otherwise, <span data-term-id=\"40794547\">Colorado<\/span> law presumes every worker is an employee. The burden is on the hiring entity to prove a worker\u2019s <span data-term-id=\"40794616\">independent contractor<\/span> status. <span data-term-id=\"40794547\">Colorado<\/span> law establishes the tests for <span data-term-id=\"40794616\">independent contractor<\/span> status. The applicable test depends on the type of employment claim being made, whether it\u2019s unemployment, workers\u2019 compensation, or wage-and-hour.<\/p>\n<p>Some employment protections under the\u00a0<span data-term-id=\"40794603\">COMPS<\/span>\u00a0Order apply only\u00a0to certain employees, usually referred to as \u201cnonexempt\u201d employees. \u201cExempt\u201d employees aren\u2019t eligible for these protections. Exempt employees have specific duties (executive\/supervisor, administrative, or professional) and a minimum compensation amount that is adjusted annually. Highly compensated employees are also exempt. These exempt employees are sometimes commonly referred to as \u201cwhite-collar\u201d employees.<\/p>\n<p>The <span data-term-id=\"40794603\">COMPS<\/span> Order also <a href=\"https:\/\/cdle.colorado.gov\/sites\/cdle\/files\/2026_comps_order_poster_english_%5Baccessible%5D.pdf\" target=\"_blank\" rel=\"noopener\">exempts other specific employees<\/a>. Some of the <span data-term-id=\"40794603\">COMPS<\/span> <span data-term-id=\"40794585\">exemptions<\/span> beyond white-collar include agricultural workers (partially exempt with different rules), some healthcare workers, certain motor carrier employees, and ski industry workers.<\/p>\n<h2><span data-term-id=\"40794576\">Colorado<\/span> <span data-term-id=\"40794553\">Minimum Wage<\/span><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/state-minimum-wage-laws.html\"><span data-term-id=\"40794576\">Colorado<\/span><span data-term-id=\"40794576\">\u2019s <\/span><span data-term-id=\"40794553\">minimum wage<\/span><\/a> (as of 2026, $15.16 per hour) is much higher than the <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/minimum-wage-and-overtime-basics.html\">federal <span data-term-id=\"40794553\">minimum wage<\/span><\/a> ($7.25 per hour). It is updated every year. <span data-term-id=\"40794576\">Colorado<\/span><span data-term-id=\"40794576\">\u2019s <\/span><span data-term-id=\"40794553\">minimum wage<\/span> for tipped employees is $12.14 per hour, provided their total tips bring them to the full $15.16\u00a0<span data-term-id=\"40794553\">minimum wage<\/span>. Otherwise, the employer must make up the difference. The <span data-term-id=\"40794581\">minimum wage<\/span><span data-term-id=\"40794581\"> rate<\/span> applies regardless of how you\u2019re paid (hourly, salaried, on commission, or at a piece rate).<\/p>\n<h3>Local <span data-term-id=\"40794602\">Minimum Pay Standards<\/span><\/h3>\n<p><span data-term-id=\"40794576\">Colorado<\/span> <span data-term-id=\"40794588\">minimum <\/span><span data-term-id=\"40794562\">wage<\/span><span data-term-id=\"40794588\"> law<\/span> allows local governments to set higher <span data-term-id=\"40794581\">minimum wage<\/span><span data-term-id=\"40794581\"> rates<\/span>. As a result, some cities and counties, including <span data-term-id=\"40794565\">Denver<\/span>, Edgewater, and Boulder, impose a <a href=\"https:\/\/cdle.colorado.gov\/dlss\" target=\"_blank\" rel=\"noopener\">higher <span data-term-id=\"40794553\">minimum wage<\/span><\/a> than the state.<\/p>\n<h3>Youth Pay Rate<\/h3>\n<p>An employer may sometimes pay an <a href=\"https:\/\/www.findlaw.com\/family\/emancipation-of-minors\/emancipation-of-minors-basics.html\">unemancipated <span data-term-id=\"40794591\">minor<\/span><\/a> at a rate 15% below the applicable <span data-term-id=\"40794553\">minimum wage<\/span>. Some local <span data-term-id=\"40794588\">minimum <\/span><span data-term-id=\"40794562\">wage<\/span><span data-term-id=\"40794588\"> laws<\/span> prohibit this practice.<\/p>\n<h2>Overtime in <span data-term-id=\"40794547\">Colorado<\/span><\/h2>\n<p><span data-term-id=\"40794606\">Nonexempt employees<\/span> in <span data-term-id=\"40794547\">Colorado<\/span> are entitled to receive extra pay for <a href=\"https:\/\/www.findlaw.com\/state\/colorado-law\/colorado-overtime-laws.html\">overtime work<\/a>. Overtime is calculated at 1.5 times the <span data-term-id=\"40794604\">regular pay<\/span> rate for work hours over:<\/p>\n<ul>\n<li>40 hours per <span data-term-id=\"40794568\">workweek<\/span><\/li>\n<li>12 hours per <span data-term-id=\"40794558\">workday<\/span><\/li>\n<li>12 <span data-term-id=\"40794579\">consecutive <\/span><span data-term-id=\"40794564\">hours<\/span><span data-term-id=\"40794564\"> of work<\/span> regardless of start and end times<\/li>\n<\/ul>\n<p>Employers may not substitute compensatory time off for <span data-term-id=\"40794570\">overtime pay<\/span>, and may not average hours across days or weeks to avoid overtime.<\/p>\n<h2><span data-term-id=\"40794582\">Meal Breaks<\/span> and <span data-term-id=\"40794580\">Rest Periods<\/span><\/h2>\n<p><span data-term-id=\"40794547\">Colorado<\/span> <span data-term-id=\"40794560\">employment law<\/span> requires <a href=\"https:\/\/www.findlaw.com\/employment\/wages-and-benefits\/meal-break-and-rest-break-laws.html\">meal and <span data-term-id=\"40794586\">rest breaks<\/span><\/a>. <span data-term-id=\"40794606\">Nonexempt employees<\/span> are entitled to a 10-minute paid <span data-term-id=\"40794586\">rest break<\/span> for every four hours worked and an uninterrupted and duty-free 30-minute unpaid <span data-term-id=\"40794582\">meal break<\/span> for shifts over five hours. If the work environment doesn\u2019t allow uninterrupted <span data-term-id=\"40794599\">meal periods<\/span>, the employer must allow you to eat while you are performing duties on paid time.<\/p>\n<p>The <a href=\"https:\/\/cdle.colorado.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40794583\">Colorado<\/span><span data-term-id=\"40794583\"> Department of Labor and Employment<\/span> (CDLE)<\/a> treats missed or interrupted meal and <span data-term-id=\"40794586\">rest breaks<\/span> as wage violations under the <span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\"> Wage<\/span> Act. You may file an administrative claim or civil action to recover lost wages if your employer fails to provide compliant <span data-term-id=\"40794599\">meal periods<\/span> and <span data-term-id=\"40794580\">rest periods<\/span>.<\/p>\n<h2>Paycheck Requirements in <span data-term-id=\"40794547\">Colorado<\/span><\/h2>\n<p>From job ads to <span data-term-id=\"40794617\">final paycheck<\/span>, employers\u2019 pay practices must meet several requirements. Some key requirements are:<\/p>\n<ul>\n<li><strong>Job ads: <\/strong>Under the <span data-term-id=\"40794574\">Equal Pay for Equal Work Act<\/span>, employers must include the hourly pay rate or salary range and a general description of benefits in all job postings<\/li>\n<li><strong><span data-term-id=\"40794572\">Pay period<\/span>:<\/strong> <span data-term-id=\"40794572\">Pay periods<\/span> cannot be longer than one month or 30 days, and employees must be paid within 10 days of the end of each <span data-term-id=\"40794572\">pay period<\/span><\/li>\n<li><strong>Pay stub:<\/strong> With each paycheck, <a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-4-103\/\" target=\"_blank\" rel=\"noopener\">employers must provide a written statement<\/a> showing the <span data-term-id=\"40794600\">gross wages<\/span> earned, all <span data-term-id=\"40794609\">withholdings<\/span> and deductions, net wages earned, the <span data-term-id=\"40794572\">pay period<\/span> dates, the employee\u2019s name or <span data-term-id=\"40794608\">Social Security<\/span> number, and the employer\u2019s name and address<\/li>\n<li><strong><span data-term-id=\"40794617\">Final paycheck<\/span>: <\/strong>Your <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/final-paycheck-laws-by-state.html\"><span data-term-id=\"40794617\">final paycheck<\/span><\/a> must include all earned, unused vacation pay and be paid immediately if you\u2019re fired<\/li>\n<\/ul>\n<p>If you feel like your employer is wronging you over paychecks, consider speaking with an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/colorado\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a>.<\/p>\n<h2>Vacation and PTO<\/h2>\n<p><span data-term-id=\"40794547\">Colorado<\/span> law doesn\u2019t require employers to provide vacation time or paid time off (PTO). If an employer chooses to include this employee benefit, several rules come into play:<\/p>\n<ul>\n<li>Once accrued, earned vacation is treated the same as earned wages under the CWA<\/li>\n<li>\u201cUse it or lose it\u201d policies are not allowed<\/li>\n<li>Employers may set a cap on vacation or PTO accrual, but may not take away already earned vacation or PTO time<\/li>\n<li>Earned vacation time is considered wages and must be included in your <span data-term-id=\"40794617\">final paycheck<\/span><\/li>\n<\/ul>\n<p>Make sure you\u2019re aware of your job\u2019s vacation\/PTO policies.<\/p>\n<h2><span data-term-id=\"40794611\">Paid Sick Leave<\/span><\/h2>\n<p>All <span data-term-id=\"40794567\">Colorado<\/span><span data-term-id=\"40794567\"> employers<\/span>, regardless of their size, must provide <span data-term-id=\"40794611\">paid sick leave<\/span> to most employees. The <span data-term-id=\"40794547\">Colorado<\/span> <span data-term-id=\"40794584\">Healthy Families and Workplaces Act<\/span> (<span data-term-id=\"40794612\">HFWA<\/span>) requires <span data-term-id=\"40794567\">Colorado<\/span><span data-term-id=\"40794567\"> employers<\/span> to provide two types of <span data-term-id=\"40794611\">paid sick leave<\/span>:<\/p>\n<ul>\n<li><strong>Accrued leave: <\/strong>Employers must provide at least one hour of accrued, paid leave per 30 <span data-term-id=\"40794564\">hours of work<\/span>, up to 48 hours per year<\/li>\n<li><strong><span data-term-id=\"40794620\">Public health emergency<\/span> (PHE) leave: <\/strong>(not currently in effect). Employees become entitled to PHE leave only if a qualifying <span data-term-id=\"40794620\">public health emergency<\/span> is declared<\/li>\n<\/ul>\n<p>Under the <span data-term-id=\"40794612\">HFWA<\/span>, employees may use <span data-term-id=\"40794611\">paid sick leave<\/span> for:<\/p>\n<ul>\n<li>The employee\u2019s or <span data-term-id=\"40794605\">family member<\/span>\u2019s illness, injury, or health condition<\/li>\n<li>Domestic violence, sexual assault, or stalking<\/li>\n<li><span data-term-id=\"40794620\">Public health emergency<\/span><\/li>\n<li>Bereavement and related matters<\/li>\n<li>Evacuation orders<\/li>\n<\/ul>\n<p><span data-term-id=\"40794612\">HFWA<\/span> <span data-term-id=\"40794611\">paid sick leave<\/span> and <a href=\"https:\/\/codes.findlaw.com\/co\/title-8-labor-and-industry\/co-rev-st-sect-8-13-3-501\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40794547\">Colorado<\/span> Family and <span data-term-id=\"40794615\">Medical Leave<\/span> Insurance Act<\/a> (FAMLI) benefits are separate programs. You may not receive both benefits for the same hours of leave, but you may supplement FAMLI benefits with <span data-term-id=\"40794612\">HFWA<\/span> leave by agreement with your employer.<\/p>\n<h2>Enforcement and Remedies<\/h2>\n<p>If you think your employer owes you wages, you can send a demand. The <span data-term-id=\"40794577\">state of <\/span><span data-term-id=\"40794547\">Colorado<\/span> provides an optional <a href=\"https:\/\/cdle.colorado.gov\/sites\/cdle\/files\/demand_for_payment_of_wages_2025_fillable_8-6-2025.pdf\" target=\"_blank\" rel=\"noopener\">Demand for Payment of Wages<\/a> form. To seek certain penalties under the <span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\"> Wage<\/span> Act, a written demand for payment to your employer is often a requirement.<\/p>\n<p>If this does not resolve the issue, the next step is to either file a complaint with the CDLE, which investigates violations, or to file a private lawsuit in district court. The <span data-term-id=\"40794583\">Colorado<\/span><span data-term-id=\"40794583\"> Department of Labor and Employment<\/span> <span data-term-id=\"40794589\">Division<\/span> of Labor Standards and Statistics (DLSS) enforces many of <span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\">\u2019s wage<\/span> and hour and other types of labor statutes and labor rules, including the <span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\"> Wage<\/span> Act, the <span data-term-id=\"40794603\">COMPS<\/span> Order, and the <span data-term-id=\"40794612\">HFWA<\/span>.<\/p>\n<p>Administrative claims for <span data-term-id=\"40794594\">unpaid wages<\/span> are currently capped at $13,000. For a larger claim, you need to file a lawsuit in district court.<\/p>\n<p>You can potentially recover:<\/p>\n<ul>\n<li><span data-term-id=\"40794594\">Unpaid wages<\/span> plus 200% of the wages owed or $1,000.00 (if not a willful violation) or 300% of the wages owed or $3,000.00, whichever is greater (for willful violations)<\/li>\n<li>Interest on <span data-term-id=\"40794594\">unpaid wages<\/span><\/li>\n<li>Attorney fees and costs (if you win)<\/li>\n<li>Reinstatement and back pay for retaliation claims<\/li>\n<\/ul>\n<p>You have two years to file a claim under the <span data-term-id=\"40794555\">Colorado<\/span><span data-term-id=\"40794555\"> Wage<\/span> Act, which expands to three years for an employer\u2019s willful violation. This deadline applies to both administrative claims filed with the DLSS and private civil lawsuits. The clock starts when wages first become due, not at the termination date.<\/p>\n<p>Depending on the type of complaint, <span data-term-id=\"40794574\">Equal Pay for Equal Work Act<\/span> claims must be filed within six years from the date of the violation (which resets with each paycheck) for unequal pay claims. For pay transparency claims, file within 2 years of the violation date, or within 3 years for a willful violation.
