Instead, the Connecticut criminal code categorizes murder based on the specific facts of the case. For example, if a defendant kills a police officer or a child, they will likely face the most serious charges. Someone who causes the death of another person in a car accident would most likely face lesser charges.<\/p>\r\n<p>Here, we\u2019ll explain how Connecticut\u2019s murder laws work, including the penalties and defenses to this crime. Specifically, the state recognizes three types of murder, including:<\/p>\r\n<ul>\r\n<li><b>Standard murder<\/b><span> &#8211; The intentional killing of another human being<\/span><\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/felony-murder.html\" style=\"background-color: rgb(255,255,255);\"><b>Felony murder<\/b><\/a><span> &#8211; Killing a third party while committing a violent crime<\/span><\/li>\r\n<li><b>Murder with special circumstances<\/b><span> &#8211; These crimes used to qualify as capital felonies; however, when the state repealed the <\/span><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty.html\" style=\"background-color: rgb(255,255,255);\">death penalty<\/a><span> in 2012, it reclassified these crimes as murder involving special circumstances.<\/span><\/li>\r\n<\/ul>\r\n<h3><b>Standard Murder in Connecticut<\/b><\/h3>\r\n<p>Any type of murder is a serious crime. One of the most severe cases of murder involves someone who intentionally takes the life of another human being. Specifically, Connecticut law defines murder as deliberately causing the death of another person or using <a href=\"https:\/\/dictionary.findlaw.com\/definition\/duress.html\" target=\"_blank\" rel=\"noopener\">duress<\/a>, deception, or force to cause another person to commit suicide.<\/p>\r\n<p>The punishment for standard murder in Connecticut is a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/selected-state-sentencing-laws.html\">minimum sentence<\/a> of 25 years in prison and a maximum sentence of 60 years.<\/p>\r\n<h3><b>Felony Murder<\/b><\/h3>\r\n<p>In Connecticut, felony murder involves the death of a victim during the intentional commission of a felony. Unlike general murder, the defendant did not need to intend the death of the other person to be convicted of felony murder.<\/p>\r\n<p>For example, a person may face felony murder charges if someone dies while they commit or flee from a burglary.<\/p>\r\n<p>The crimes eligible for felony murder in Connecticut include the following Class B felonies and Class C felonies:<\/p>\r\n<ul>\r\n<li>Kidnapping<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/sexual-assault-overview.html\" style=\"background-color: rgb(255,255,255);\">Sexual assault<\/a><\/li>\r\n<li>Robbery<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/burglary-overview.html\" style=\"background-color: rgb(255,255,255);\">Burglary<\/a><\/li>\r\n<li>Home invasion<\/li>\r\n<li>Prison escape<\/li>\r\n<\/ul>\r\n<p>While some states will charge a person with felony murder if a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/co-conspirator.html\" target=\"_blank\" rel=\"noopener\">co-conspirator<\/a> dies during the commission of a felony, this isn\u2019t the case in Connecticut. To secure a conviction of felony murder, the prosecutor must prove that the victim was not a participant in the underlying crime.<\/p>\r\n<p>In Connecticut, murder is punishable by life in prison without the possibility of parole.<\/p>\r\n<h3><b>Murder with Special Circumstances<\/b><\/h3>\r\n<p>Connecticut law calls for more severe penalties for murder cases that involve <a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-54b\/\" target=\"_blank\" rel=\"noopener\">special circumstances<\/a>. These are crimes that were once punishable by death.
