Even if you only suffer <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/can-i-sue-for-emotional-distress.html\"><span data-term-id=\"40442321\">emotional distress<\/span><\/a>, you still need to protect yourself and your family. Once you learn that someone is stalking you, it&#8217;s important that you contact <span data-term-id=\"40442428\">law enforcement<\/span> immediately.<\/p>\n<\/li>\n<\/ul>\n<p>The bottom line is that if someone is following you or showing up at your work or home without a <span data-term-id=\"40442383\">legitimate purpose<\/span>, you need to get someone involved. These laws are designed to punish stalkers and protect stalking victims. <span data-term-id=\"40442298\">Connecticut<\/span> lawmakers first enacted <span data-term-id=\"40442325\">stalking laws<\/span> in 1992 and have updated them over the years to accommodate\u00a0<a href=\"https:\/\/sts.wisc.edu\/wp-content\/uploads\/sites\/328\/2023\/08\/Adamson-et-al.-2023-Cyberstalking-A-growing-challenge-for-the-US-legal-system.pdf\" target=\"_blank\" rel=\"noopener\">technological changes<\/a>.<\/p>\n<p><span data-term-id=\"40442327\">Connecticut<\/span><span data-term-id=\"40442327\"> law<\/span> breaks the <span data-term-id=\"40442451\">crime of stalking<\/span> down into three degrees: <span data-term-id=\"40442407\">First-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span>, <span data-term-id=\"40442431\">Second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span>, and <span data-term-id=\"40442323\">Third-degree<\/span> stalking. You can find the text of these statutes in <span data-term-id=\"40442298\">Connecticut<\/span> General Statutes 53a-181c to 181e.<\/p>\n<p>Below, we discuss each of these crimes in more detail.<\/p>\n<h3><span data-term-id=\"40442431\">Second-Degree<\/span><span data-term-id=\"40442431\"> Stalking<\/span> in <span data-term-id=\"40442298\">Connecticut<\/span><\/h3>\n<p>Normally, we would discuss a <span data-term-id=\"40442313\">first-degree<\/span> crime before we examined a <span data-term-id=\"40442310\">second-degree<\/span> crime. However, the <a href=\"https:\/\/www.findlaw.com\/criminal.html\"><span data-term-id=\"40442410\">criminal laws<\/span><\/a> in <span data-term-id=\"40442298\">Connecticut<\/span> are unique in that <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> serves as the basis for felony stalking. <span data-term-id=\"40442407\">First-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span> is the same as <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span>, but with aggravating factors present.<\/p>\n<p>According to <a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-181d\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40442376\">CGS<\/span> 53a-181d<\/a>, a person is guilty of <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> when they engage in:<\/p>\n<ul>\n<li>\n<p>A <span data-term-id=\"40442319\">course of conduct<\/span><\/p>\n<\/li>\n<li>\n<p>Against a <span data-term-id=\"40442367\">specific person<\/span><\/p>\n<\/li>\n<li>\n<p>Meant to cause a <span data-term-id=\"40442347\">reasonable person<\/span> to fear for their <span data-term-id=\"40442308\">physical safety<\/span> or the safety of others, or suffer significant <span data-term-id=\"40442321\">emotional distress<\/span><\/p>\n<\/li>\n<\/ul>\n<p>A person also commits <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> if they engage in a <span data-term-id=\"40442319\">course of conduct<\/span> against a <span data-term-id=\"40442367\">specific person<\/span> with the goal of scaring the victim into thinking the perpetrator will cause injury or death to their animal.<\/p>\n<p>The following behavior qualifies as a <span data-term-id=\"40442319\">course of conduct<\/span> associated with stalking:<\/p>\n<ul>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/what-really-constitutes-harassment-and-what-can-i-do.html\">Harassing<\/a> the victim<\/p>\n<\/li>\n<li>\n<p>Following the victim<\/p>\n<\/li>\n<li>\n<p>Monitoring the victim&#8217;s comings and goings<\/p>\n<\/li>\n<\/ul>\n<p>Here are a few example scenarios:<\/p>\n<ul>\n<li>\n<p>Leaving harassing letters on someone&#8217;s car every day for a week, along with pictures of the person taken through their bedroom window.<\/p>\n<\/li>\n<li>\n<p>An individual who calls their ex-partner on their cell phone 50 times a day for a month, leaving scary voicemails about what they&#8217;ll do to their ex if they don&#8217;t agree to get back together.<\/p>\n<\/li>\n<\/ul>\n<p>To convict someone of first or <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span>, the state must prove that the defendant intended to harass, terrorize, or alarm the <span data-term-id=\"40442443\">alleged victim<\/span> without a <span data-term-id=\"40442383\">legitimate purpose<\/span>. The defendant can do this through repeated phone calls, <span data-term-id=\"40442359\">social media<\/span> posts, or <span data-term-id=\"40442389\">text messages<\/span>.<\/p>\n<p><span data-term-id=\"40442431\">Second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> is a <span data-term-id=\"40442353\">Class A<\/span> <span data-term-id=\"40442304\">misdemeanor<\/span> in <span data-term-id=\"40442298\">Connecticut<\/span> and carries a penalty of up to one year in prison, fines of up to $2,000, and a conviction on your permanent <a href=\"https:\/\/www.findlaw.com\/criminal\/expungement.html\">criminal record<\/a>.<\/p>\n<h3><span data-term-id=\"40442407\">First-Degree<\/span> <span data-term-id=\"40442445\">Stalking<\/span><span data-term-id=\"40442445\"> Charges<\/span><\/h3>\n<p><span data-term-id=\"40442419\">Connecticut<\/span> <span data-term-id=\"40442325\">stalking<\/span><span data-term-id=\"40442325\"> laws<\/span> define <span data-term-id=\"40442407\">first-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span> as <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> with specific <a href=\"http:\/\/aggravating%20factors\/\" target=\"_blank\" rel=\"noopener\">aggravating factors<\/a>. In other words, <span data-term-id=\"40442407\">first-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span> is an enhanced version of <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span>.<\/p>\n<p>The state will increase <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span> (a <span data-term-id=\"40442353\">Class A<\/span> <span data-term-id=\"40442304\">misdemeanor<\/span>) to <a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-181c\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40442407\">first-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span><\/a> (a <span data-term-id=\"40442306\">Class D felony<\/span>) in the following circumstances:<\/p>\n<ul>\n<li>\n<p>The perpetrator is 22 years old (or older), and the victim is under 16 years of age<\/p>\n<\/li>\n<li>\n<p>The defendant has prior convictions for stalking<\/p>\n<\/li>\n<li>\n<p>The defendant&#8217;s behavior violates an active <span data-term-id=\"40442318\">court order<\/span>\/<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-orders-of-protection-and-restraining-orders.html\"><span data-term-id=\"40442370\">protective order<\/span><\/a><\/p>\n<\/li>\n<li>\n<p>The offender targeted their victim based on race, religion, sex, sexual orientation, or another identifiable characteristic<\/p>\n<\/li>\n<\/ul>\n<p>Examples of <span data-term-id=\"40442407\">first-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span> include:<\/p>\n<ul>\n<li>\n<p>A 30-year-old man repeatedly shows up at a retail store where a 17-year-old girl works, even after she asks him to stop.<\/p>\n<\/li>\n<li>\n<p>Someone with a prior conviction for stalking, sending dozens of Facebook messages to another person daily, demanding that the person go on a date with them &#8220;or else.&#8221;<\/p>\n<\/li>\n<\/ul>\n<p>As stated in <span data-term-id=\"40442376\">CGS<\/span> <a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-181c\/\" target=\"_blank\" rel=\"noopener\">Section 53a-181c<\/a>, the penalties for <span data-term-id=\"40442407\">first-degree<\/span><span data-term-id=\"40442407\"> stalking<\/span> include up to five years in prison and fines of up to $5,000. In addition, the judge may restrict the defendant&#8217;s ability to own firearms.<\/p>\n<h3><span data-term-id=\"40442323\">Third-Degree<\/span> Stalking<\/h3>\n<p>In <span data-term-id=\"40442298\">Connecticut<\/span>, <span data-term-id=\"40442323\">third-degree<\/span> stalking is a much less serious offense than first or <span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span>. To convict someone of this crime, the prosecutor doesn&#8217;t have to <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-intent-to-kill-how-do-you-prove-it\/\">prove intent<\/a>. Instead, all they have to demonstrate is that the defendant acted recklessly.<\/p>\n<p><span data-term-id=\"40442298\">Connecticut<\/span> defines <span data-term-id=\"40442323\">third-degree<\/span> as:<\/p>\n<ul>\n<li>\n<p>Recklessly<\/p>\n<\/li>\n<li>\n<p>Causing a person to have a <span data-term-id=\"40442386\">reasonable fear<\/span> for their safety or <a href=\"https:\/\/www.findlaw.com\/legalblogs\/personal-injury\/how-to-prove-emotional-distress\/\"><span data-term-id=\"40442321\">emotional distress<\/span><\/a><\/p>\n<\/li>\n<li>\n<p>By willfully or repeatedly following the victim or by lying in wait<\/p>\n<\/li>\n<\/ul>\n<p>Unlike first and <a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-181d\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40442431\">second-degree<\/span><span data-term-id=\"40442431\"> stalking<\/span><\/a>, the state doesn&#8217;t have to prove intent in a <span data-term-id=\"40442323\">third-degree<\/span> <span data-term-id=\"40442392\">stalking case<\/span>. It&#8217;s enough that the defendant&#8217;s behavior caused the victim to feel afraid or emotionally distressed. For example:<\/p>\n<ul>\n<li>\n<p>A person who waits in the break room for a coworker to take lunch every day after being told by the coworker that it makes them uncomfortable.<\/p>\n<\/li>\n<li>\n<p>Posting pictures of another person online and insinuating that they are a couple despite the fact that the other party repeatedly told them they weren&#8217;t interested.<\/p>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/codes.findlaw.com\/ct\/title-53a-penal-code\/ct-gen-st-sect-53a-181e\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40442323\">Third-degree<\/span> stalking<\/a> is a <span data-term-id=\"40442315\">Class B <\/span><span data-term-id=\"40442304\">misdemeanor<\/span>, with a potential penalty of up to six months in jail and fines of up to $1,000. Some defendants receive probation in lieu of a jail sentence.<\/p>\n<h2>Stalking and <span data-term-id=\"40442317\">Domestic Violence<\/span><\/h2>\n<p>Many <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/stalking-and-domestic-violence.html\"><span data-term-id=\"40442392\">stalking cases<\/span><\/a> involve ex-romantic partners or incidents of unrequited affection. For example, your ex-girlfriend\/ex-boyfriend may continue to show up at your house in the middle of the night despite the fact that you broke things off.<\/p>\n<p>There are also cases where the alleged stalker is in a current relationship with the victim. For instance, a jealous person may follow their partner (both in real life and online), making them afraid and extremely uncomfortable.<\/p>\n<p>Some people don&#8217;t understand that a person doesn&#8217;t have to physically assault them to be guilty of <a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/domestic-violence-laws.html\"><span data-term-id=\"40442317\">domestic violence<\/span><\/a>. It is enough that a person makes the other party fearful or emotionally distressed.<\/p>\n<h3>How To Recognize Stalking Behavior<\/h3>\n<p>The sooner you can recognize that <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/victim-of-stalking-know-your-legal-options\/\">someone is stalking you<\/a>, the better your chances of avoiding harm.
