Federal and state laws were created to protect <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/whistleblowers.html\">whistleblowers<\/a> for being fired or disciplined at work for \u201cdoing the right thing.\u201d<\/p>\n<p>One reason whistleblowers feel torn is that by discovering their employer has violated a law, they may be held accountable as participating in the crime or exposed to personal liability for the crime if they do nothing. Employees may also feel a sense of loyalty to their employers.<\/p>\n<p>Sometimes, an employee is retaliated against for making a report to OSHA (Occupational Safety and Health Administration) about <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety.html\">unsafe working conditions<\/a>. To encourage workers to make complaints to OSHA despite this risk, <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/employment\/workplace-safety\/osha-whistleblower-protection.html\">legal protection against retaliation<\/a> was provided for whistleblowers in several acts.<\/p>\n<p>The following chart details the main whistleblower laws in Connecticut.<\/p>\n<table width=\"724\" cellspacing=\"0\" cellpadding=\"2\" border=\"1\">\n<tbody><tr><td width=\"190\" valign=\"top\"><b>Code Section<\/b><\/td>\n<td width=\"532\" valign=\"top\">Connecticut General Statutes Sections<br>\n<ul>\n<li>4-61dd: <a target=\"_blank\" href=\"http:\/\/www.cga.ct.gov\/current\/pub\/chap_048.htm#sec_4-61dd\" rel=\"noopener\">Whistleblowing<\/a><\/li>\n<li>33-1336: <a target=\"_blank\" href=\"http:\/\/www.cga.ct.gov\/current\/pub\/chap_603.htm#sec_33-1336\" rel=\"noopener\">Whistleblowing Protections for Employees of Certain Corporations<\/a><\/li>\n<li>31-51: <a target=\"_blank\" href=\"http:\/\/www.cga.ct.gov\/current\/pub\/chap_557.htm#sec_31-51\" rel=\"noopener\">Blacklisting<\/a><\/li>\n<li>4-37j: <a target=\"_blank\" href=\"http:\/\/www.cga.ct.gov\/current\/pub\/chap_047.htm#sec_4-37j\" rel=\"noopener\">Whistleblower Protection for Foundation Employees<\/a><\/li>\n<\/ul>\n<\/td>\n<\/tr><tr><td width=\"190\" valign=\"top\"><b>Prohibited Employer Activity<\/b><\/td>\n<td width=\"532\" valign=\"top\">Employers can\u2019t fire, discipline, or otherwise penalize an employee because he or she or his or her representative reports a violation or suspected violation or requested an investigation, hearing, or inquiry.<br>\n<br>\nAlso, if a government employee reports to a public body concerning unethical practices, mismanagement, or abuse of authority, he or she can\u2019t be fired, disciplined, or otherwise penalized, unless the employee knows the report is false.<br>\n<br>\nCompanies that work in <a target=\"_blank\" href=\"https:\/\/corporate.findlaw.com\/finance\/securities\/\" rel=\"noopener\">securities<\/a>, covered by the <a target=\"_blank\" href=\"https:\/\/dictionary.findlaw.com\/definition\/securities-and-exchange-commission-sec-.html\" rel=\"noopener\">SEC<\/a> (Securities and Exchange Commission), can\u2019t fire, suspend, or discriminate against an employee who lawfully provides information or testifying about a securities violation or fraud on the shareholders, whether brought by the federal or state government or Congress.<br>\n<br>\nTax-exempt charitable, scientific, cultural, or educational organizations or <a target=\"_blank\" href=\"http:\/\/www.cga.ct.gov\/current\/pub\/chap_047.htm#sec_4-37e\" rel=\"noopener\">foundations<\/a> are also prohibited from threatening or taking action against an employee who reports corruption or violation of state laws, gross waste of funds, abuse of authority, or danger to the public.<br>\n<br>\nBlacklisting, or causing a worker to not get work or be hired because of something they did or are perceived as, is prohibited in Connecticut. This was famous in the <a target=\"_blank\" href=\"http:\/\/www.ushistory.org\/us\/53a.asp\" rel=\"noopener\">1950s McCarthyism era<\/a> of Hollywood and government workers accused of being communist.<\/td>\n<\/tr><tr><td width=\"190\" valign=\"top\"><b>What Employees are Protected?<\/b><\/td>\n<td width=\"532\" valign=\"top\">The various whistleblower laws in Connecticut cover government, securities, other private sector, and non-profit employees.<\/td>\n<\/tr><tr><td width=\"190\" valign=\"top\"><b>Remedies<\/b><\/td>\n<td width=\"532\" valign=\"top\">If the employer violates these laws, an employee can, after exhausting all available administrative remedies, bring a civil lawsuit against the employer within 90 days of the final administrative decision or the violation for reinstatement, back pay, to reestablish <a target=\"_blank\" href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employee-benefits-basics.html\">benefits<\/a> (health, retirement, etc.), court costs, and attorney&#8217;s fees.<br>\n<br>\nIf a government job, the civil servant transmits the facts and information to the auditors of public accounts. If discriminating against, the employee can file claim within 30 days of incident with the employee review board or in accordance with collective bargaining contract. A human rights referee, who acts as an independent hearing officer, will be assigned to the case and come to a decision. That decision can be appealed.<br>\n<br>\nA whistleblower at a securities company can sue in <a target=\"_blank\" href=\"http:\/\/www.jud.ct.gov\/EXTERNAL\/super\/default.htm\" rel=\"noopener\">Superior Court<\/a> for damages and injunctive relief not more than one year after the knowing about the specific incident that gave rise to the claim.<\/td>\n<\/tr><tr><td width=\"190\" valign=\"top\"><b>Penalties<\/b><\/td>\n<td width=\"532\" valign=\"top\">Typically, the penalty to the employee is paying money for <a target=\"_blank\" href=\"https:\/\/dictionary.findlaw.com\/definition\/back-pay.html\" rel=\"noopener\">back pay<\/a> and other damages to the wronged employee, as well as any other costs assessed to them.<br>\n<br>\nA person or company who blacklists a worker can be fined $50 to $200. This fine may be low because the statute hasn\u2019t been modernized to account for inflation.<\/td>\n<\/tr><\/tbody><\/table>\n<p>If you \u201cblew the whistle\u201d on your boss or company and were retaliated against, you should <a target=\"_blank\" href=\"https:\/\/lawyers.findlaw.com\/whistleblower-qui-tam\/connecticut\/\" rel=\"noopener\">consult with a lawyer<\/a> who has experience representing whistleblowers, to figure out what your options are.
