Not much in life stays the same. Unexpected events can upset routines and make meeting obligations difficult or even impossible.<\/p>\r\n<p>Parents making <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-basics.html\">child support payments<\/a> may struggle due to changes in their lives. While the primary concern is acting in the <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/focusing-on-the-best-interests-of-the-child.html\">child&#8217;s best interests<\/a>, the District also strives to keep payments manageable.<\/p>\r\n<p>This article will examine when child support agreements are open to modification, explain what information you&#8217;ll need to gather, and walk you through the District&#8217;s child support modification process.<\/p>\r\n<h2>District of Columbia Child Support Basics<\/h2>\r\n<p>Before modifying a child support agreement, learn what child support is and how it functions in the District of Columbia. The requirement for states and the District to administer child support payments became federal law as <a href=\"https:\/\/www.ssa.gov\/OP_Home\/ssact\/title04\/0451.htm\" target=\"_blank\" rel=\"noopener\">Title IV-D of 1975&#8217;s Social Security Act<\/a>.<\/p>\r\n<p>Child support ensures that children of parents who aren&#8217;t married or in a relationship get adequate financial support. The District uses an <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/child-support-determining-parents-income.html\">income shares model<\/a> with <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-child-support-guidelines.html\">the D.C. child support guidelines<\/a> to determine child support obligations for each parent. The noncustodial parent is usually the one making child support payments.<\/p>\r\n<p>The child&#8217;s needs include necessities like food, clothing, shelter, educational expenses, childcare expenses, and more. Parents also must pay health care premiums and cover extraordinary medical expenses for their children. The premiums shouldn&#8217;t exceed <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-916-01\/#:~:text=does%20not%20exceed%205%20%25%20of%20the%20parent%27%20s%20gross%20income.\" target=\"_blank\" rel=\"noopener\">5% of the parent&#8217;s gross income<\/a>.<\/p>\r\n<p>Determining exact child support payments is a detailed and complicated process. FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/child-support-calculations-in-d-c-.html\">District of Columbia Child Support Calculation article<\/a> breaks down the procedure. The Child Support Services Division of the Office of the Attorney General (CSSD) handles all aspects of child support in the District and can answer your questions.<\/p>\r\n<p>All child support payments in the District get collected and distributed by the CSSD. CSSD also enforces <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/child-support-enforcement-in-d-c-.html\">child support<\/a>. In most child support cases, the parent&#8217;s employer takes the payment directly from a parent&#8217;s paycheck. This is wage withholding. All payments get sent to Child Support Clearinghouse.<\/p>\r\n<h2>Accepted Reasons for Modification<\/h2>\r\n<p>Feeling like your child support obligation is too much money often isn&#8217;t enough to merit a modification. Given that the cost of living usually rises and rarely falls, the District of Columbia allows <a href=\"https:\/\/oag.dc.gov\/child-support-services\/services\/modifying-child-support-order\" target=\"_blank\" rel=\"noopener\">a child support review and adjustment conference with the CSSD<\/a>.<\/p>\r\n<p>Both parents can show financial information, including changes in income and expenses. The CSSD plugs these numbers into the guidelines to determine a new possible amount of support. If there&#8217;s a difference of at least 15% from the amount in the order, the child support order is eligible for <a href=\"https:\/\/www.dccourts.gov\/superior-court\/family-court-operations\/forms-childsupport\" target=\"_blank\" rel=\"noopener\">a motion to modify<\/a>.<\/p>\r\n<p>If the original child support order didn&#8217;t include medical support or the child&#8217;s medical needs have changed, a parent can request a review and adjustment conference. This is not subject to the three-year timeline. Parents can also file in court for medical modifications. Speak with a District of Columbia <a href=\"https:\/\/lawyers.findlaw.com\/child-support\/district-of-columbia\/washington?fli=dcta\" target=\"_blank\" rel=\"noopener\">family law attorney<\/a> for help with this.<\/p>\r\n<p>A parent can request a review and adjustment conference with the CSSD if there has been a substantial and material change in circumstances. The three-year timeline doesn&#8217;t apply to this. The parent must provide evidence of the significant change for the CSSD to proceed with a review. <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-916-01\/#:~:text=shall%20be%20subject%20to%20modification%20by%20application%20of%20the%20guideline\" target=\"_blank\" rel=\"noopener\">Changes can include<\/a>:<\/p>\r\n<ul>\r\n<li>Addition of children not under the child support order to either household<\/li>\r\n<li>Child support payments to another birth parent<\/li>\r\n<li>Change or start of alimony payments<\/li>\r\n<li>Custody arrangement change (from sole to shared or shared to sole)<\/li>\r\n<li>Extraordinary medical expenses for the child<\/li>\r\n<li>Increased health insurance premiums for the child<\/li>\r\n<li>Nonvoluntary loss of employment for either parent (quitting a job without good cause or not making an active effort to search for new employment will not get a modification for lower income)<\/li>\r\n<li>Payments take the parent below <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-916-01\/#:~:text=A%20parent%20with%20a%20legal%20duty%20to%20pay%20support%2C%20but%20with%20adjusted%20gross%20income%20below%20the%20self%2Dsupport%20reserve%2C\" target=\"_blank\" rel=\"noopener\">the self-support reserve<\/a><\/li>\r\n<li>Serious illness of either parent<\/li>\r\n<\/ul>\r\n<p>Incarceration of a parent can cause automatic modification of child support payments. <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/code\/sections\/23-112a\" target=\"_blank\" rel=\"noopener\">Under D.C. law<\/a>, any parent with a child support payment obligation sentenced to more than 30 days in jail can petition to modify or suspend their payments while incarcerated.<\/p>\r\n<h2>How To Apply for Modification of Your Order<\/h2>\r\n<p>The custodial and the noncustodial parent can petition to modify an existing child support order. The CSSD recommends following these steps:<\/p>\r\n<h3>1. Schedule a Review and Adjustment Conference With the CSSD<\/h3>\r\n<p>Whether for a three-year review or a substantial and material change in circumstances, scheduling a meeting with <a href=\"https:\/\/oag.dc.gov\/child-support-services\" target=\"_blank\" rel=\"noopener\">the CSSD<\/a> is the first step. Conference scheduling is available at the following numbers Monday to Friday between 8:15 a.m. and 4:45 p.m.:<\/p>\r\n<ul>\r\n<li>CSSD Enforcement Unit \u2014 (202) 442-9900, #4<\/li>\r\n<li>CSSD \u2014 (202) 724-2316<\/li>\r\n<\/ul>\r\n<p>Availability will vary due to demand.<\/p>\r\n<h3>2. Preparation<\/h3>\r\n<p>If you&#8217;re requesting a change in your child support order, the burden of proof falls on you. Prepare for your conference by gathering and <a href=\"https:\/\/oag.dc.gov\/child-support-services\/services\/modifying-child-support-order\" target=\"_blank\" rel=\"noopener\">reviewing all the paperwork<\/a> you&#8217;ll need ahead of time. This should include the following:<\/p>\r\n<ul>\r\n<li>The child support order<\/li>\r\n<li>Two current pay statements, if employed<\/li>\r\n<li>Your most recent federal income tax forms or W-2 statements<\/li>\r\n<li>Proof of medical insurance coverage and cost for the child in the support order<\/li>\r\n<li>Proof of childcare expenses for the child in the support order<\/li>\r\n<li>Proof of any other child support orders and proof of payment&nbsp;on the orders<\/li>\r\n<li>Proof of any other biological or adopted children in the home of the person ordered to pay support<\/li>\r\n<li>Any other information that shows there has been a substantial and material change in the needs of the children or in the payment ability of the parent ordered to pay support<\/li>\r\n<\/ul>\r\n<p>Include any other expenses, income, or changes in circumstance that might be important. If youre injured, bring copies of your medical expenses. If the payments have caused your income to fall below the <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-916-01\/#:~:text=A%20parent%20with%20a%20legal%20duty%20to%20pay%20support%2C%20but%20with%20adjusted%20gross%20income%20below%20the%20self%2Dsupport%20reserve%2C\" target=\"_blank\" rel=\"noopener\">self-support reserve<\/a>, bring proof for the CSSD. You can get a rough estimate using the <a href=\"https:\/\/csgc.oag.dc.gov\/application\/main\/intro.aspx\" target=\"_blank\" rel=\"noopener\">District of Columbia Child Support Guidelines Calculator<\/a>. But this isn&#8217;t an official amount.<\/p>\r\n<h3>3. Attending the CSSD Review and Adjustment Conference<\/h3>\r\n<p><a href=\"https:\/\/oag.dc.gov\/child-support-services\/services\/modifying-child-support-order#:~:text=to%20pay%20support-,The%20Review%20and%20Adjustment%20Conference,-During%20the%20review\" target=\"_blank\" rel=\"noopener\">At the conference<\/a>, the CSSD agent will examine the new information. They&#8217;ll plug it into the guidelines to determine new child support payment amounts. If both parents agree with the new totals, they can sign a consent agreement accepting them as the new payments. A judge will still need to approve it.<\/p>\r\n<p>If the parents don&#8217;t agree, they must <a href=\"https:\/\/www.dccourts.gov\/sites\/default\/files\/2022-01\/Motion_to_Modify_Child_Support_Order_09-2020.pdf\" target=\"_blank\" rel=\"noopener\">file a motion<\/a>. If the new amounts are at least 15% different from the originals or there was a substantial and material change, the CSSD will file the motion. A parent can also independently file a motion to modify a child support order even if the 15% threshold wasn&#8217;t hit.<\/p>\r\n<h3>4. Going To Court<\/h3>\r\n<p>Parents filing an order can do it themselves or hire a <a href=\"https:\/\/lawyers.findlaw.com\/child-support\/district-of-columbia\/washington?fli=dcta\" target=\"_blank\" rel=\"noopener\">District family law attorney<\/a>. Forms are <a href=\"https:\/\/www.dccourts.gov\/superior-court\/family-court-operations\/forms-childsupport\" target=\"_blank\" rel=\"noopener\">available online<\/a>. It helps to speak with one of the following:<\/p>\r\n<ul>\r\n<li>CSSD Enforcement Unit \u2014 (202) 442-9700, #4<\/li>\r\n<li>CSSD Case Management Specialist assigned to the case \u2014 (202) 724-2316<\/li>\r\n<li>D.C. Superior Court Self-Help Center \u2014 (202) 879-0096<\/li>\r\n<\/ul>\r\n<p>You should expect a court hearing within 45 days of filing. The judge will <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-916-01\/\" target=\"_blank\" rel=\"noopener\">use the guidelines<\/a> at the hearing to approve or deny the modification request. The modification is not official until the judge signs the order.<\/p>\r\n<h2>District of Columbia Child Support Modification \u2014 Summary<\/h2>\r\n<p>Life changes come fast and hard, and they can affect your ability to pay child support or make do with what the other parent provides.
