These local laws provide more extensive protections than <span data-term-id=\"52843784\">federal laws<\/span>, making it illegal to treat people unfairly in employment, housing, and <span data-term-id=\"52843765\">public accommodations<\/span>. <span data-term-id=\"52843755\">Washington<\/span>, D.C.&#8217;s list of <span data-term-id=\"52843794\">protected characteristics<\/span> is one of the most comprehensive in the nation, covering traits like <span data-term-id=\"52843777\">source of income<\/span>, <span data-term-id=\"52843786\">personal appearance<\/span>, and <span data-term-id=\"52843767\">gender identity<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p><span data-term-id=\"52843784\">Federal law<\/span>, and some state laws, grant all U.S. citizens the right to be free from discrimination, regardless of race, religion, or any other arbitrary classification. We call these protections <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-are-civil-rights.html\">civil right<em>s<\/em><\/a>.<\/p>\n<p>Lawmakers implemented <span data-term-id=\"52843790\">civil rights laws<\/span> primarily to protect minorities, <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/accessibility-disability-rights-law.html\">people with disabilities<\/a>, women, and other marginalized groups from unfair treatment. These laws often pertain to employment, public access, and housing.<\/p>\n<p>In this article, we&#8217;ll discuss the <span data-term-id=\"52843790\">civil rights laws<\/span> in <span data-term-id=\"52843755\">Washington<\/span>, D.C., and what they protect, in comparison to federal <span data-term-id=\"52843790\">civil rights laws<\/span>. They can help you understand the type of claim you may have and your options.<\/p>\n<h2>Federal <span data-term-id=\"52843790\">Civil Rights Laws<\/span><\/h2>\n<p>Many civil rights protections, including those granted by state governments, stem from the <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-the-civil-rights-act-of-1964\/\"><span data-term-id=\"52843775\">Civil Rights Act of 1964<\/span><\/a>. Congress passed this law to prohibit discrimination in public places and <span data-term-id=\"52843765\">public accommodations<\/span>. It was signed by President Lyndon Johnson.<\/p>\n<p>The Civil Rights Act also accomplished the following:<\/p>\n<ul>\n<li>Prohibited employment discrimination<\/li>\n<li>Mandated the integration of <span data-term-id=\"52843772\">educational institutions<\/span><\/li>\n<li>Established the <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/filing-discrimination-charges-with-the-eeoc.html#:~:text=Employees%20or%20job%20applicants%20who%20wish%20to%20file,civil%20rights%20violations%20and%20possible%20job%20discrimination%20claims.\"><span data-term-id=\"52843766\">Equal Employment Opportunity<\/span> Commission <\/a>(EEOC)<\/li>\n<\/ul>\n<p>While the <span data-term-id=\"52843775\">Civil Rights Act of 1964<\/span> was instrumental in ending systemic discrimination, other anti-<span data-term-id=\"52843787\">discrimination laws<\/span>\u00a0also played a significant\u00a0role.<\/p>\n<p>Some of these include:<\/p>\n<ul>\n<li><span data-term-id=\"52843763\">Americans with Disabilities Act<\/span> (<span data-term-id=\"52843792\">ADA<\/span>)<\/li>\n<li><a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Age Discrimination in <span data-term-id=\"52843791\">Employment Act<\/span><\/a> (ADEA)<\/li>\n<\/ul>\n<p>Once the federal government passed civil rights and anti-<span data-term-id=\"52843787\">discrimination laws<\/span>, most states (and the <span data-term-id=\"52843754\">District of Columbia<\/span>) followed suit.<\/p>\n<h2>The <span data-term-id=\"52843755\">Washington<\/span>, <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span><\/h2>\n<p>States can pass their own <span data-term-id=\"52843790\">civil rights laws<\/span> as long as these laws offer as much or more protection than the <span data-term-id=\"52843784\">federal laws<\/span>. Many jurisdictions, including <span data-term-id=\"52843755\">Washington<\/span>, D.C., have passed laws that expand citizens&#8217; <a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/civilrights.html\">civil rights protections<\/a>.<\/p>\n<p>Lawmakers in the <span data-term-id=\"52843754\">District of Columbia<\/span> have passed laws that expand the protection offered by the federal <span data-term-id=\"52843775\">Civil Rights Act of 1964<\/span>. The <a href=\"https:\/\/ohr.dc.gov\/page\/protected-traits\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843757\">D.C. Human Rights Act<\/span> (<span data-term-id=\"52843773\">DCHRA<\/span>)<\/a> is the most important of these laws. This <span data-term-id=\"52843771\">human rights law<\/span> prohibits unfair and unequal treatment based on specific <span data-term-id=\"52843794\">protected characteristics<\/span>.<\/p>\n<h3>Protected Traits in <span data-term-id=\"52843755\">Washington<\/span>, D.C.<\/h3>\n<p>The <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span> and <a href=\"https:\/\/codes.findlaw.com\/dc\/division-i-government-of-district\/dc-code-sect-2-1401-01\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843754\">District of Columbia<\/span> Code Division<\/a> prohibit discrimination based on:<\/p>\n<ul>\n<li>Age<\/li>\n<li>Color<\/li>\n<li>Credit information<\/li>\n<li>Disability<\/li>\n<li><span data-term-id=\"52843783\">Familial status<\/span><\/li>\n<li><span data-term-id=\"52843768\">Family responsibilities<\/span> (supporting someone who is a blood relative or legal dependent)<\/li>\n<li><a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/gay-and-lesbian-rights-sexual-orientation-discrimination.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843767\">Gender identity<\/span><\/a> and expression<\/li>\n<li><a class=\"editor-rtfLink\" href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-genetic-information-discrimination\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843778\">Genetic information<\/span><\/a><\/li>\n<li>Homelessness<\/li>\n<li><span data-term-id=\"52843788\">Marital status<\/span><\/li>\n<li><span data-term-id=\"52843779\">Matriculation<\/span> (being enrolled in college, university, or another secondary education program)<\/li>\n<li><span data-term-id=\"52843764\">National origin<\/span><\/li>\n<li><span data-term-id=\"52843786\">Personal appearance<\/span><\/li>\n<li>Place of residence or business<\/li>\n<li><span data-term-id=\"52843760\">Political affiliation<\/span><\/li>\n<li>Race<\/li>\n<li>Religion<\/li>\n<li>Sealed eviction record<\/li>\n<li>Sex<\/li>\n<li><span data-term-id=\"52843759\">Sexual orientation<\/span> (<span data-term-id=\"52843774\">LGBTQ<\/span>, etc.)<\/li>\n<li><span data-term-id=\"52843777\">Source of income<\/span><\/li>\n<li>Being the victim of <span data-term-id=\"52843780\">domestic violence<\/span> (or other sexual offense)<\/li>\n<\/ul>\n<h3>Areas of Enforcement<\/h3>\n<p>Many of these <span data-term-id=\"52843794\">protected characteristics<\/span> apply to several important aspects of life, including:<\/p>\n<ul>\n<li>Education<\/li>\n<li>Employment<\/li>\n<li>Housing<\/li>\n<li><span data-term-id=\"52843765\">Public accommodations<\/span><\/li>\n<li>Government services<\/li>\n<\/ul>\n<p>Some only apply to certain settings. For example, the protection against discrimination based on credit information only applies to employment, and the protection of sealed eviction records only applies to housing. Survivors of\u00a0<span data-term-id=\"52843780\">domestic violence<\/span>\u00a0are only protected from discrimination in housing and employment.<\/p>\n<h2>Employment Discrimination in D.C.<\/h2>\n<p>The law prohibits employers from encouraging or tolerating <span data-term-id=\"52843770\">sexual harassment<\/span> or <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination.html\">discrimination<\/a> based on most of the above-<span data-term-id=\"52843794\">protected characteristics<\/span>. This protection extends to both <span data-term-id=\"52843795\">independent contractors<\/span> and full-time employees.<\/p>\n<p>In addition to <span data-term-id=\"52843770\">sexual harassment<\/span>, federal and <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/dc-employment-laws.html\">local laws<\/a> also protect workers from other types of discrimination. For example, companies cannot refuse to hire or promote someone based on a <span data-term-id=\"52843794\">protected characteristic<\/span>. Nor can they discriminate against employees regarding pay, working conditions, or other employment matters.<\/p>\n<h3>What Employers Are Covered by the <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span>?<\/h3>\n<p>The <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span> applies to all employers in <span data-term-id=\"52843755\">Washington<\/span>, D.C., regardless of their size. All employers, including those companies whose <a href=\"https:\/\/natlawreview.com\/article\/us-supreme-court-clarifies-principal-place-business-new-ruling-helps-defendants-avoid-forum-\" target=\"_blank\" rel=\"noopener\">principal place of business<\/a> is outside the <span data-term-id=\"52843754\">District of Columbia<\/span>, must abide by this law as long as they have a physical presence within the District.<\/p>\n<p>The <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span> also covers all workers, even <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/independent-contractors-overview.html\"><span data-term-id=\"52843795\">independent contractors<\/span><\/a> and unpaid interns. Many <span data-term-id=\"52843785\">employment laws<\/span> only apply to full-time and part-time workers. However, the lawmakers in D.C. chose to offer protection to all workers, regardless of their status.<\/p>\n<h2>Housing Discrimination in D.C.<\/h2>\n<p>Like other jurisdictions, the <span data-term-id=\"52843754\">District of Columbia<\/span> maintains laws against <a href=\"https:\/\/ohr.dc.gov\/fairhousing\" target=\"_blank\" rel=\"noopener\">housing discrimination<\/a>. In fact, <span data-term-id=\"52843755\">Washington<\/span>, D.C.\u2019s anti-<span data-term-id=\"52843787\">discrimination laws<\/span> prohibit discrimination based on 21 traits, which go beyond the protections offered under <span data-term-id=\"52843784\">federal law<\/span>.<\/p>\n<p>Some of these <a href=\"https:\/\/ohr.dc.gov\/sites\/default\/files\/dc\/sites\/ohr\/publication\/attachments\/protectedcategories_111319.pdf#:~:text=The%20DC%20Office%20of%20Human%20Rights%20enforces%20the,visit%20or%20work%20in%20the%20District%20of%20Columbia.\" target=\"_blank\" rel=\"noopener\">traits include<\/a>:<\/p>\n<ul>\n<li>Race<\/li>\n<li><span data-term-id=\"52843768\">Family responsibilities<\/span><\/li>\n<li><span data-term-id=\"52843786\">Personal appearance<\/span><\/li>\n<li><span data-term-id=\"52843759\">Sexual orientation<\/span><\/li>\n<li><span data-term-id=\"52843783\">Familial status<\/span><\/li>\n<li><span data-term-id=\"52843777\">Source of income<\/span><\/li>\n<\/ul>\n<p>Property owners <a href=\"https:\/\/codes.findlaw.com\/dc\/division-i-government-of-district\/dc-code-sect-2-1402-21\/\" target=\"_blank\" rel=\"noopener\">cannot deny residence<\/a> to someone based on their receiving housing vouchers or other income assistance. In addition, under <span data-term-id=\"52843755\">Washington<\/span>, <span data-term-id=\"52843758\">D.C. law<\/span>, eviction records are sealed, so prospective landlords cannot deny someone residence based on prior evictions.<\/p>\n<h3>Expanded Protections for People Without Housing<\/h3>\n<p>Homelessness is a problem across the United States, including the <span data-term-id=\"52843754\">District of Columbia<\/span>. It can be challenging for people to secure housing when they lack a permanent address.<\/p>\n<p>In 2022, lawmakers in D.C. passed the <a href=\"https:\/\/code.dccouncil.gov\/us\/dc\/council\/laws\/24-172\" target=\"_blank\" rel=\"noopener\">Human Rights Enhancement <span data-term-id=\"52843761\">Amendment Act<\/span> of 2022<\/a> (DCHREAA), a law that added homeless status to the list of <span data-term-id=\"52843794\">protected characteristics<\/span>. This amendment also requires <span data-term-id=\"52843798\">law enforcement<\/span> to undergo special training on how to positively interact with and assist members of the homeless community.<\/p>\n<h2>How Do I File a Discrimination Complaint in D.C.?<\/h2>\n<p>If you believe you\u2019ve been discriminated against at your job, while looking for a place to live, or while accessing important services, you can file a claim with the <a class=\"editor-rtfLink\" href=\"https:\/\/ohr.dc.gov\/service\/file-discrimination-complaint\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"52843754\">District of Columbia<\/span> <span data-term-id=\"52843756\">Office of Human Rights<\/span><\/a> (<span data-term-id=\"52843776\">OHR<\/span>). There is no cost to file a complaint with this agency.<\/p>\n<p>Since D.C.\u2019s <span data-term-id=\"52843790\">civil rights laws<\/span> cover more <span data-term-id=\"52843794\">protected characteristics<\/span>, the <span data-term-id=\"52843776\">OHR<\/span> is usually the best place to start. However, you can also report discrimination to federal agencies:<\/p>\n<ul>\n<li><strong>For employment discrimination<\/strong>, you can also <a href=\"https:\/\/www.eeoc.gov\/filing-charge-discrimination\" target=\"_blank\" rel=\"noopener\">file a claim with the EEOC<\/a> called a \u201ccharge.\u201d<\/li>\n<li><strong>For housing discrimination<\/strong>, you can <a href=\"https:\/\/portalapps.hud.gov\/FHEO903\/Form903\/Form903Start.action\" target=\"_blank\" rel=\"noopener\">make a report<\/a> with the U.S. Department of Housing and Urban Development (HUD).<\/li>\n<li><strong>For discrimination in educational settings<\/strong>, you can contact the <a href=\"https:\/\/www.ed.gov\/laws-and-policy\/civil-rights-laws\/file-complaint\/ocr-discrimination-complaint-form\" target=\"_blank\" rel=\"noopener\">Department of Education\u2019s Office for Civil Rights<\/a>.<\/li>\n<\/ul>\n<p>Reporting to a government agency is different from pursuing a private legal action against the other party. In some cases, filing a <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/filing-civil-rights-claims.html\" target=\"_blank\" rel=\"noopener\">discrimination lawsuit<\/a> may be the best way to resolve the situation. Depending on what type of claim you wish to pursue, you may need to report to a government agency first.<\/p>\n<p>For example, you must <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/filing-an-eeoc-complaint-or-charge.html\">make a complaint with the EEOC<\/a> <em>before<\/em> filing a private claim for employment discrimination under <span data-term-id=\"52843784\">federal law<\/span>. For claims under the <span data-term-id=\"52843757\">D.C. Human Rights Act<\/span>, you have the option of either filing a complaint with the <span data-term-id=\"52843776\">OHR<\/span> or filing a lawsuit in D.C. Superior Court.<\/p>\n<p>The <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-civil-statute-of-limitations-laws.html\">statute of limitations<\/a> (the deadline for filing a claim) in these types of cases is very strict. For most discrimination claims in D.C., you have <strong>one year<\/strong> from the date of the incident to file a complaint with the <span data-term-id=\"52843776\">OHR<\/span> or file a private lawsuit.
