For example, there are separate statutes for arson committed in buildings where there are people present versus those committed in <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-303.html\" target=\"_blank\" rel=\"noopener\">structures that are unoccupied<\/a>.<\/p>\n<p>According to the <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-301\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"42074611\">D.C. Let\u2019s take a closer look at each one.<\/p>\n<h3>Arson<\/h3>\n<p>According to the <span data-term-id=\"42074611\">D.C. Code<\/span>, a person commits arson when they <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-301.html\" target=\"_blank\" rel=\"noopener\">maliciously <span data-term-id=\"42074621\">set fire<\/span><\/a> to another person\u2019s <span data-term-id=\"42074617\">private property<\/span>, dwelling, building, boat, or <span data-term-id=\"42074615\">steamboat<\/span>. It also applies if they torch a church, school, or <span data-term-id=\"42074616\">public building<\/span>.<\/p>\n<p>Under <span data-term-id=\"42074606\">D.C. law<\/span>, a person acts maliciously (in regard to arson) when they intentionally or wrongfully burn property to cause harm or injury to another person or to threaten the security of the other <span data-term-id=\"42074605\">person\u2019s property<\/span>. It\u2019s also considered a malicious act if a person is charged with <span data-term-id=\"42074621\">setting fire<\/span> to someone\u2019s property with the intent to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/fraud.html\">defraud the other party<\/a> of their property or injure the property owner.<\/p>\n<h3><span data-term-id=\"42074598\">Burning One<\/span>&#8216;s <span data-term-id=\"42074596\">Own <\/span><span data-term-id=\"42074604\">Property<\/span><span data-term-id=\"42074604\"> with Intent<\/span> To Defraud or <span data-term-id=\"42074595\">Injure Another<\/span><\/h3>\n<p>Most people have heard about someone burning their <span data-term-id=\"42074596\">own property<\/span> to either <a href=\"https:\/\/www.ojp.gov\/pdffiles1\/Digitization\/54514NCJRS.pdf\" target=\"_blank\" rel=\"noopener\">collect insurance proceeds<\/a> or harm another person. In the <span data-term-id=\"42074592\">District of Columbia<\/span>, doing this qualifies as arson. The primary difference between this <span data-term-id=\"42074593\">criminal offense<\/span> and general arson is that the defendant intentionally sets fire to their <span data-term-id=\"42074596\">own property<\/span> rather than the property of another.<\/p>\n<p>According to <span data-term-id=\"42074611\">D.C. Code<\/span>, a person is guilty of this crime when <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-302.html\" target=\"_blank\" rel=\"noopener\">they intentionally <span data-term-id=\"42074621\">set fire<\/span><\/a> to any of the following types of property:<\/p>\n<ul>\n<li>Dwelling<\/li>\n<li>Barn<\/li>\n<li>Store<\/li>\n<li>Warehouse<\/li>\n<li>Boat<\/li>\n<li>Any other structure or <a href=\"https:\/\/www.findlaw.com\/realestate\/owning-a-home\/types-of-property-for-tax-purposes.html\"><span data-term-id=\"42074605\">personal property<\/span><\/a><\/li>\n<\/ul>\n<p>A person who commits this crime faces up to 15 years in prison and fines of up to $37,500. If the defendant\u2019s actions cause the death of another person, the fine can increase to $250,000.<\/p>\n<h3><span data-term-id=\"42074594\">Malicious Burning<\/span>, Destruction, or <span data-term-id=\"42074602\">Injury of Another<\/span>&#8216;s Property<\/h3>\n<p>In addition to punishing people for maliciously burning their <span data-term-id=\"42074596\">own property<\/span>, the laws in <span data-term-id=\"42074600\">Washington, D.C<\/span>. also penalize individuals for doing so to another <span data-term-id=\"42074605\">person\u2019s property<\/span>.<\/p>\n<p>The <span data-term-id=\"42074611\">D.C. Code<\/span> states that a person commits this crime when they <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-303.html\" target=\"_blank\" rel=\"noopener\">break, injure, or destroy public or <span data-term-id=\"42074617\">private property<\/span><\/a>. The specific penalty for this offense depends on the <span data-term-id=\"42074601\">value of the property<\/span>.<\/p>\n<p>If a person burns another&#8217;s property worth more than $1,000, the courts can sentence them to up to 10 years in prison and fines of up to $5,000. Burning property valued at less than $1,000 is a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\"><span data-term-id=\"42074597\">misdemeanor<\/span><\/a>, and the defendant faces up to 180 days in jail and fines of up to $1,000.<\/p>\n<h2>Federal Arson Charges<\/h2>\n<p>In addition to <span data-term-id=\"42074592\">District of Columbia<\/span> criminal charges, you may also face federal arson charges depending on the type of property involved. If you damage or destroy certain property by fire or explosives, you could face prosecution in federal court with severe mandatory minimum sentences.<\/p>\n<p>According to <span data-term-id=\"42074619\">federal law<\/span>, a person <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-844\/\" target=\"_blank\" rel=\"noopener\">commits federal arson<\/a> when they maliciously damage or destroy (or attempt to damage or destroy) by means of fire or explosives any building, vehicle, or other real or <span data-term-id=\"42074605\">personal property<\/span> that is used in interstate or foreign commerce or in any activity affecting interstate or foreign commerce. Federal charges often impose heavier penalties.<\/p>\n<p>The &#8220;interstate commerce&#8221; requirement is broadly interpreted by federal courts. It can include commercial buildings, business-use vehicles, rental real estate, and many other types of property. The property does not need to be owned by the federal government. <span data-term-id=\"42074617\">Private property<\/span> qualifies if it&#8217;s used in or affects interstate commerce.<\/p>\n<p>To secure a federal conviction, prosecutors must prove the defendant acted with malice. This means they set the fire with the intent to damage property. For individuals, fines can reach up to $250,000, though courts may impose even higher fines in certain circumstances.<\/p>\n<p>The mandatory minimum sentences mean that if you&#8217;re convicted of federal arson, you will serve significant prison time. There is no probation option.
