DC divides burglary into <span data-term-id=\"42088346\">first-degree<\/span> (entering an occupied dwelling) and <span data-term-id=\"42088352\">second-degree<\/span> (entering an unoccupied building), both <span data-term-id=\"42088383\">felony offenses<\/span>. <span data-term-id=\"42088372\">First-degree<\/span><span data-term-id=\"42088372\"> burglary<\/span> carries between five and 30 <span data-term-id=\"42088399\">years imprisonment<\/span> and up to $75,000 in fines, while <span data-term-id=\"42088352\">second-degree<\/span> carries between two and 15 years and up to $37,500 in fines.<\/p>\n\n    <\/div>\n\n\n\n<div><p>While burglary conjures images of someone breaking into a stranger\u2019s house in the middle of the night to steal their cash, jewelry, and other valuables, the laws cover more than that example. Long ago, under <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-common-law\/\">common law<\/a>, burglary involved someone <span data-term-id=\"42088377\">breaking and entering<\/span> into a dwelling at night with the purpose of committing a crime.<\/p>\n<p>Today, most <span data-term-id=\"42088395\">jurisdictions<\/span> have broadened the definition of this <span data-term-id=\"42088358\">criminal offense<\/span> by removing the requirement that it be committed at night. It\u2019s also been expanded to include any building, not just a dwelling.<\/p>\n<p>This article examines and explains the <span data-term-id=\"42088389\">burglary laws<\/span> in the <span data-term-id=\"42088356\">District of Columbia<\/span>, including the penalties and possible defenses. They go a step further by dividing the crime into <span data-term-id=\"42088346\">first-degree<\/span> and <span data-term-id=\"42088366\">second-degree<\/span><span data-term-id=\"42088366\"> burglary<\/span>.<\/p>\n<p>Under\u00a0<span data-term-id=\"42088360\">DC Code<\/span>, a person is guilty of burglary in the\u00a0<span data-term-id=\"42088346\">first degree<\/span>\u00a0when they <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-801.html\" target=\"_blank\" rel=\"noopener\">unlawfully enter an occupied dwelling with the intent to commit any crime inside<\/a>. For a <span data-term-id=\"42088366\">second-degree<\/span> <span data-term-id=\"42088381\">burglary<\/span><span data-term-id=\"42088381\"> charge<\/span>, a person must have the same intent while entering an unoccupied building or structure.<\/p>\n<p>It doesn\u2019t matter if the secondary crime is completed or not. A person can be convicted of burglary even if they don&#8217;t successfully commit the intended crime. The <span data-term-id=\"42088362\">unlawful entry<\/span> with criminal intent is sufficient for a <span data-term-id=\"42088381\">burglary charge<\/span>.<\/p>\n<h2>Difference Between First- and <span data-term-id=\"42088366\">Second-Degree<\/span><span data-term-id=\"42088366\"> Burglary<\/span><\/h2>\n<p>The primary difference between <span data-term-id=\"42088372\">first-degree<\/span><span data-term-id=\"42088372\"> burglary<\/span> and <span data-term-id=\"42088366\">second-degree<\/span><span data-term-id=\"42088366\"> burglary<\/span> is whether the building is occupied at the <span data-term-id=\"42088424\">time of entry<\/span>. If there are people present, the offender will face <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/burglary-penalties-and-sentencing.html\"><span data-term-id=\"42088372\">first-degree<\/span> <span data-term-id=\"42088381\">burglary<\/span><span data-term-id=\"42088381\"> charges<\/span><\/a>. If there are no people in the building, the individual will face <span data-term-id=\"42088366\">second-degree<\/span> <span data-term-id=\"42088381\">burglary<\/span><span data-term-id=\"42088381\"> charges<\/span>.<\/p>\n<p>Whether or not someone is inside the building at the time of a burglary, the crime is a\u00a0felony. There are no <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\"><span data-term-id=\"42088370\">misdemeanor burglary cases<\/span><\/a>\u00a0in the <span data-term-id=\"42088356\">District of Columbia<\/span>. While both degrees are <span data-term-id=\"42088426\">serious offenses<\/span>, penalties for <span data-term-id=\"42088372\">first-degree<\/span><span data-term-id=\"42088372\"> burglary<\/span> are much more severe than those for\u00a0<span data-term-id=\"42088366\">second-degree<\/span><span data-term-id=\"42088366\"> burglary<\/span>.<\/p>\n<h2>What Are the Penalties for Committing a Burglary in D.C.?<\/h2>\n<p>As in most states, the penalties for burglary in the <span data-term-id=\"42088356\">District of Columbia<\/span> are stiff. Not only will a conviction result in a lengthy\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/sentencing.html\" target=\"_blank\" rel=\"noopener\">prison sentence<\/a>, but it will also require the payment of significant fines.<\/p>\n<p>The <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-3571-01\/\" target=\"_blank\" rel=\"noopener\">penalties for first- and <span data-term-id=\"42088366\">second-degree<\/span><span data-term-id=\"42088366\"> burglary<\/span><\/a> in <span data-term-id=\"42088354\">Washington, D.C<\/span>. are as follows:<\/p>\n<ul>\n<li><strong>Burglary in the <span data-term-id=\"42088346\">first degree<\/span><\/strong>: Imprisonment of at least five (5) years with a potential sentence of 30 years and fines of up to $75,000<\/li>\n<li><strong>Burglary in the <span data-term-id=\"42088352\">second degree<\/span><\/strong>: Imprisonment of between two (2) and fifteen years, and a fine of up to $37,500<\/li>\n<\/ul>\n<p>If the burglary results in the death of another person, the fine increases to $250,000.<\/p>\n<h2>Possible Defenses to Burglary<\/h2>\n<p>Those accused of burglary require a strong defense to avoid a criminal conviction. This can be tricky, because it doesn\u2019t matter if you actually commit the other crime, only that you intended to.<\/li>\n<li><strong>The building was unoccupied<\/strong>: This defense is only available in a <span data-term-id=\"42088372\">first-degree<\/span> <span data-term-id=\"42088422\">burglary<\/span><span data-term-id=\"42088422\"> case<\/span>.
