Regardless of whether the victim suffers a physical injury, the defendant will face up to 30 years in prison. The judge will also impose a fine of up to $75,000.<\/p>\n<p>The penalty will be less severe if the defendant releases the victim to a safe place without injury.<\/p>\n<h2>Possible Changes To D.C. Kidnapping Laws<\/h2>\n<p><a href=\"https:\/\/lims.dccouncil.gov\/Legislation\/B26-0203\" target=\"_blank\" rel=\"noopener\">A bill introduced in 2025<\/a> could create two degrees of kidnapping: first degree and second degree. Under this proposed law, first-degree kidnapping would carry a penalty of up to 30 years, while second-degree kidnapping would result in a maximum prison sentence of 15 years.<\/p>\n<p>The key differences between first- and second-degree kidnapping would revolve around the kidnapper&#8217;s intent. If the prosecution can prove the defendant intended to substantially confine or move the victim for ransom or as part of a hostage situation or other felony, it will be first-degree kidnapping. Second-degree kidnapping involves the same behavior as above, with a less severe intent and purpose.<\/p>\n<h2>Possible Defenses To Kidnapping<\/h2>\n<p>Kidnapping charges are serious, and facing them without legal assistance is not the best option. If anyone dies either during the commission or as a result of a felony, the perpetrator will face murder charges. Since kidnapping is a felony in D.C., a person will face murder charges if their victim (or anyone else) dies during the <span data-term-id=\"40985928\">abduction<\/span>.<\/p>\n<p>This applies even if the death is unintentional or the result of someone else&#8217;s actions. For example, imagine that you kidnap someone and demand a ransom in exchange for their safe return. During the handoff of the money, the victim&#8217;s father is hit by a car and dies. Even though this may not seem like a foreseeable result of the kidnapping, the defendant may still face charges for <a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-2101.html\" target=\"_blank\" rel=\"noopener\">first-degree murder<\/a>. The penalties for murder are the same, regardless of whether it\u2019s a result of felony murder or not.<\/p>\n<h2><span data-term-id=\"40985929\">Parental Kidnapping<\/span>\/Custodial Interference<\/h2>\n<p>While the D.C. <span data-term-id=\"40985965\">criminal statutes<\/span> don&#8217;t reference <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-considered-parental-kidnapping\/\"><span data-term-id=\"40985929\">parental kidnapping<\/span><\/a>, it\u2019s still a crime. According to <a href=\"https:\/\/codes.findlaw.com\/dc\/division-ii-judiciary-and-judicial-procedure\/dc-code-sect-16-1022\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"40985936\">D.C. Code<\/span><\/a>, it is illegal for one parent to intentionally conceal their child from the other parent. It is also against the law for someone to do this on behalf of a child&#8217;s lawful parent or guardian.<\/p>\n<p>Under D.C. <span data-term-id=\"40985933\">criminal law<\/span>, it is illegal for a parent or guardian to do either of the following:<\/p>\n<ul>\n<li><span data-term-id=\"40985928\">Abduct<\/span>, take, or carry away a child with the intent to prevent the other <a href=\"https:\/\/www.findlaw.com\/family\/child-custody.html\">custodial parent<\/a> from exercising their <span data-term-id=\"40985953\">custody rights<\/span><\/li>\n<li><span data-term-id=\"40985928\">Abduct<\/span>, take, or carry away a child from a person with whom the relative has <a href=\"https:\/\/www.findlaw.com\/family\/child-custody\/joint-custody.html\">joint custody<\/a> pursuant to a <span data-term-id=\"40985939\">custody order<\/span> with the intent of preventing the <span data-term-id=\"40985962\">child&#8217;s other parent<\/span> from exercising their <span data-term-id=\"40985953\">custody rights<\/span><\/li>\n<li>Keep a child for more than 48 hours after the other parent demands that they return the child<\/li>\n<\/ul>\n<p>Unlike regular kidnapping, a person who commits <span data-term-id=\"40985929\">parental kidnapping<\/span> often faces <span data-term-id=\"40985945\">misdemeanor<\/span> charges rather than <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/felonies.html\">felony charges<\/a>. If they keep the child from their other parent for more than 30 days or take the child out of the jurisdiction, they will face felony charges instead.<\/p>\n<p>The penalties for <span data-term-id=\"40985929\">parental kidnapping<\/span> are as follows:<\/p>\n<ul>\n<li><strong><span data-term-id=\"40985945\">Misdemeanor<\/span> <span data-term-id=\"40985929\">parental kidnapping<\/span><\/strong>: A fine of up to $250 and up to 240 hours of community service<\/li>\n<li><strong>Felony <span data-term-id=\"40985929\">parental kidnapping<\/span> for less than 30 days<\/strong>: Up to six months in jail and fines<\/li>\n<li><strong>Felony <span data-term-id=\"40985929\">parental kidnapping<\/span> for more than 30 days<\/strong>: Up to one year in jail and fines<\/li>\n<\/ul>\n<p>If the defendant releases the child to a safe place without injury before being arrested, the judge may impose a fine and order them to complete <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/court-ordered-community-service.html\">community service<\/a>.<\/p>\n<h2>Defenses To <span data-term-id=\"40985929\">Parental Kidnapping<\/span> in D.C.<\/h2>\n<p>The <span data-term-id=\"40985933\">criminal laws<\/span> in <span data-term-id=\"40985931\">Washington, D.C<\/span>. treat <span data-term-id=\"40985929\">parental kidnapping<\/span> differently than they do regular kidnapping. It should come as no surprise, then, that the defenses to <span data-term-id=\"40985929\">parental kidnapping<\/span> are different as well.<\/p>\n<p>The <span data-term-id=\"40985927\">District of Columbia<\/span> recognizes the following <a href=\"https:\/\/archive.findlaw.com\/blog\/legal-defenses-to-parental-child-abduction-kidnapping\/\" target=\"_blank\" rel=\"noopener\">defenses to <span data-term-id=\"40985929\">parental kidnapping<\/span><\/a>:<\/p>\n<ul>\n<li>You took your child to protect them from imminent physical harm<\/li>\n<li>You were attempting to prevent imminent physical harm to yourself<\/li>\n<li>Consent of the <span data-term-id=\"40985962\">child&#8217;s other parent<\/span><\/li>\n<li>You had the lawful authority to take the child at the time of the <span data-term-id=\"40985928\">abduction<\/span><\/li>\n<\/ul>\n<p>An example of the above would be a parent removing their child from a home due to <a href=\"https:\/\/www.findlaw.com\/state\/family-laws\/domestic-violence.html\"><span data-term-id=\"40985937\">domestic violence<\/span><\/a>. In this scenario, the defendant would be protecting both themselves and their child from imminent physical harm.<\/p>\n<p>It will be difficult to challenge the prosecution&#8217;s case without a <span data-term-id=\"40985946\">court order<\/span> authorizing you to take or conceal your child from their other parent or legal guardian.
